Administrator WEEKLY.NOTES Nov 16th,2007 Zonina / Development Items. 1. The City has received a MINOR SUBDIVISION request from VSSA as related to their pending refinancing and bond issuance.The current Boutwells Landing site is divided into two parcels; they are seeking to redivide into 3 parcels.The new division is again part of the refinancing requirement and that the upcoming expansion must sit on a separate land parcel.Staff has reviewed the request and has no objections as VSSA has met the MINOR SUBDIVISION requirements as list in Cc Ordinance 402.There is no action required by the Planning Commission or City Council. 2. I have enclosed a map from Washington County that shows the numerous real estate foreclosures over the past 18 months. 3. The MPCA has issued a FILE CLOSURE letter on the former AMOCO gas ►i I7 3 8 station site as now owned by ERICKSON POST ACQ. While the MPCA has (004-h St not given the site a clean bill of health, per se, it does mean that no addition work or monitoring needs to be done.This is good news in terms of a possible redevelopment of the site as part of the required D. Hecker demolition. 4. Ted Schoenecker from Washington County did provide a STATUS REPORT to the City on the Gov. Center Project-please see his email. Franchise Agreements I have enclosed drafts of GAS AND ELECTRIC franchise documents that would be ultimately adopted via ordinance;the City's franchise agreements with Xcel Energy expire will be expiring.The DRAFT form is essentially a hybrid of the City's current documents and the MODEL AGREEMENTS as offered by the LMC. While there several differences between current and these drafts, from the City's perspective, the material changes can be found in the sections that relate to tree trimming/clearance (Sec 5) and pole maintenance (Sec 8). I have forwarded these drafts to John Wertish of Xcel Energy so that we can commence that discussion and hopefully ascertain their comments early. In discussion with John W., we hope to have these completed prior to the end of 2007. Other Items: • I have enclosed the memo from Flaherty & Hood who represents the Coalition of Utility Cities, where they summarize the meeting held by the Dept. of Revenue on the new valuation rules for utility properties. As you know, the City will continue to pursue a class-rate increase utility property to make up for the tax losses that resulted from these Page 1 valuation rules amendments. r. . Based on the information provided, the MPCA staff has closed the release site,file. Closure of the file means that the MPCA staff does not require any additional investigation and/or cleanup work at this time or in the foreseeable future. Please be aware that file closure does not necessarily mean that all petroleum contamination has been removed from this site. However, the MPCA staff has concluded that any remaining contamination, if present,.does not appear to pose a threat to public health or the environment under current conditions. The MPCA reserves the right to reopen this file and to require additional investigation and/or cleanup work if new information, changing regulatory requirements or changed land use make additional work necessary. If you or other parties discover additional contamination(either petroleum or nonpetroleum) that was not previously reported to the MPCA, Minnesota law requires that the MPCA be immediately notified. You should understand that this letter does not release any party from liability for the petroleum contamination under Minn. Stat. ch. it SC (2002)or any other applicable state or federal law. In addition, this letter does not release any party from liability for nonpetroleum contamination, if present, under Minn. Stat. ch. 115B (2002), the Minnesota Superfund Law. The monitoring wells for this site should be abandoned in accordance with the Minnesota Department of Health Well Code, Chapter 4725. The Petrofund is administered by the Petroleum Tank Release Compensation Board (Petro Board) and the Minnesota Department of Commerce. To learn more about who is eligible for reimbursement, the type of work that is eligible for reimbursement, and the amount of reimbursement available, please contact Petrofund staff at 651-297-1119 or 1-800-638-0418, If future development of this property or the surrounding area is planned, it should be assumed that petroleum contamination may still be present. If petroleum contamination is encountered during future development work, the MPCA staff should be notified immediately. For specific information regarding petroleum contamination that may remain at this leak site, please call the Petroleum Remediation Program File Request Program at 651/297-8499. The MPCA fact sheet Request to Bill for Services Performed must be completed prior to arranging a time for file review.
