Grading and erosion control
The following apparent violations have been observed by BCWD staff:

NOTICE ISSUED FOR PROBABLE VIOLATION TO BCWD RULE
You hereby are requested to take the following actions to come into compliance with the above BCWD Rule:
Action Required and Requested Date of Compliance
1. Repair/reinstall silt fence such that it is effective in preventing erosion into the ditch. This action is required in
all areas where the silt fence is failing on site.
2. Install rock construction entrance as specified on grading plan and stabilize side slopes and ditch slopes with seed
and mulch appropriate for early fall as per MnDOT Standards and Specifications Section 2575. Measures to
ensure stability of the ditch slopes include erosion control blankets, fiber logs, bio-logs, and check dams.
3. In the event that sediment leaves the site to the downstream water body excavation of excess material in the
downstream and will be required. Cleaning out of sediment from ditch bottom and pipe under entranceway will
help ensure that sediment does not leave site. Use of erosion control blankets as specified on the grading plan is
required.
4. It appears that construction has halted for this project. If construction is not going to proceed as planned leveling
of the piles of dirt on site is required as well as seeding and mulch entire site. Measures to ensure stability of the
ditch slopes may include erosion control blankets, fiber logs, bio-logs, and check dams.
5. There exists an erosion problem making this area not stable. Measures need to be taken to stabilize this area.

The timeliness and completeness of your actions with respect to the above items will be considered by the Board of
Managers in deciding on further enforcement. On notice and an opportunity to be heard, the Board may issue a Cease
and Desist Order requiring compliance with any violations found. The listing of violations above does not prevent the
Board from finding additional or other violations on the basis of the evidence presented. Failure to comply with BCWD
Rules, the conditions of your permit or an Order of the Board of Managers will subject you to civil and criminal
penalties. Minnesota Statutes §103D.545.
Pursuant to BCWD Rule 8.0, you will be liable for all costs incurred by the BCWD in obtaining and monitoring your
compliance with applicable BCWD Rules, permit conditions and Orders of the Board of Managers, including consultants'
costs and attorneys' fees. If you do not complete the actions requested above by the indicated deadlines, the BCWD itself
may act to remedy apparent noncompliance and recover the costs of its action, including attorneys' fees, from you or your
surety.
This Notice does not affect the ability of any other federal, state or local body of government to take enforcement action
against you pursuant to its own laws and regulations.
