Seggelke, seconded by Kern, moved to adopt Resolution #91-09-49 granting the request of Independent School District No . 834 to commence grading operations on the site of the proposed new senior high school facility, contingent on comments and coordination with City Engineer and Planner. No final conditional use permit is issued at this time. School District to proceed at their own risk and expense- and to enter into a development agreement with the City as soon as possible. Roll call vote taken with aye votes cast by Seggelke, Kern and O'Neal. Nay vote cast by Doerr. Resolution adopted. Dove, attorney for O.L. Kern Irrevocable Trust, has submitted an application for a subdivision, Kern' s Education Addition, to divide two parcels from one larger parcel owned by the applicant. The purpose of the subdivision is to sell the two parcels to Independent School District No. 834 . The property will be utilized by the School District as part of the high school development. The subdivision also provides the 80 feet of right-of-way dedication necessary for 58th Street North and dedicates Stillwater Boulevard North (Trunk Highway 5) for public purposes. Attached for reference: Exhibit A - Site Survey Exhibit B - Preliminary/Final Plat Recommendation: Based upon the following review, our office recommends approval of the subdivision request subject to the following conditions: 1. Designation of the two parcels, Block 1-Lot 1 and Block 2- Lot 1, shall be revised on the plat to Outlot 1 and 2, subject to review by the City Attorney. 2 . Compliance with all provisions of the Subdivision Ordinance as determined by City Staff. 3 . Review and approval of the subdivision by the Minnesota Department of Transportation. 5 . Final plat approval shall be subject to sale of property to School District No. 834 . ISSUES/ANALYSIS Zoning/Comprehensive Plan. The land is currently zoned 0, Open Space. The high school property to the south will retain the 0 District zoning classification, as will the property proposed for subdivision. The Comprehensive Plan amendment for this area, recently adopted by the City Council, indicates the subject property as an institutional land use. The two parcels will be used as a part of the high school site in conformance with the Comprehensive Plan. The plat dedicates the 80 feet of right-of- way necessary for construction of 58th Street North. The dedication, as indicated, is in compliance with the design of 58th Street, as found in the Comprehensive Plan. Easements/Right-of-Way. The easements and right-of-way, as proposed in the plat, are in compliance with the subdivision regulations and Comprehensive Plan. Stillwater Boulevard North (Trunk Highway 5) right-of-way dedication is subject to MnDOT for their review and approval . Subdivision Design. One parcel, Block 1 - Lot 1, satisfies the requirements for a buildable lot in the 0, Open Space District. The other lot, Block 2 - Lot 1, does not meet the requirements. The intent of the subdivision is not to create buildable lots for the School District, but rather to incorporate the property into the site plan for the high school . Our office recommends the two parcels be designated as Outlot 1 and 2, which would allow the School District to make site improvements including parking, drainage, or other facilities, but not construct structures that would require a building permit. The City Attorney should comment on any issues related to the designation of the two parcels as outlots. Park Dedication. Park land dedication would not be required for this subdivision in that the property, upon sale to the School District, will be used for public purposes. If the property is sold for any purposes that require park dedication, under the subdivision regulations, a cash payment would be required by the City. 2 CONCLUSION As stated earlier in this report, our office recommends approval of the preliminary/final plat contingent upon the conditions listed in the Executive Summary. cc: LaVonne Wilson Mark Vierling Joe Anderlik Paul D.
