THIS LETTER REQUIRES A RESPONSE TO AVOID POSSIBLE ADMINISTRATIVE ACTION OR CANCELLATION OF THE RADIO STATION AUTHORIZATION(S) DESCRIBED HEREIN. Dear Licensee: The Federal Communications Commission's (FCC) Wireless Telecommunications Bureau is conducting an audit of the construction and operational status of all of the Private Land Mobile Radio (PLMR)stations licensed on frequencies below 512 MHz that are subject to frequency coordination and rule-based construction and operational requirements' The Commission's Part 90 Rules for the PLMR facilities require construction within a specified time frame and for stations to remain operational in order for the license to remain valid. Specifically, when a licensee fails to construct its authorized PLMR facilities within the requisite construction period or allows its constructed station(s) to discontinue operations for a period of one year, the station license cancels auto- matically and the licensee is required to notify the Commission? We are writing this letter to inquire about the operational status (e.g. , whether a station is constructed and operating) of the PLMR stations for which you are licensed. For your convenience, your licensed call signs are listed in an attachment to this letter. You are required to review the stations authorized under each call sign listed in the attachment and provide a response using the appropriate column(s) on the attachment indicating whether or not each station authorized under a call sign listed is constructed and operating in accordance with its current FCC authorization? If the answer for stations under a particular call sign is yes(e.g. , all stations are constructed and currently operating in accordance with the licensed parameters), then you indicate "Yes" in column 1A and no additional information on that call sign is required (e.g. , you do not have to complete col- umns 1 B, 2 and 3 for that call sign). If the answer to the question is no for a particular call sign (at least one sta- tion under the call sign has not been constructed or has discontinued operation for more than one year), then you leave column 1 A blank and put"No" in column 1B and write the word "Cancel" in column 2. If, however, you do not think that all of the stations authorized under the call sign should be cancelled, then leave column 2 blank for that call sign and provide an explanation as to why the station(s)should not be cancelled. The City of Oak Park Heights would be glad to afford your client and MOM Warehouse an opportunity for a public hearing before the City Council so that your client could certainly explain his view of the occurrences. The civil penalty as provided by the City of Oak Park Heights Resolution is a presumptive fine and sanction if, indeed, the Council determines that the event did occur and that sanction is warranted. We will schedule tentatively this hearing for the Oak Park Heights City Council meeting on February 8 at 7:00 p.m. If you require additional time, please advise. The City will issue a separate notice with regard to the hearing and also provide a copy of the police reports as it affects the alleged infraction. Thank you for your attention and correspondence on this matter. Yours very truly, Mark J. COMMENCEMENT OF CASE.A petition for liquidation under chapter 7 of the Bankruptcy Code has been filed in this court by or against the debtor or debtors, and an order for relief has been entered. You will not receive notice of all documents filed in this case. AU documents filed with the court, including lists of the debtor's property, debts, and property claimed as exempt are available for inspection at the office of the clerk of the bankruptcy court. CREDITORS MAY NOT TAKE CERTAIN ACTIONS.A creditor is anyone to whom the debtor owes money or property.Under the Bankruptcy Code, the debtor is granted certain protection against creditors.Common examples of prohibited actions by creditors are contacting the debtor to demand repayment, taking action against the debtor to collect money awed to creditors or to take property of the debtor, and starting or continuing foreclosure actions, repossessions,or wage deductions. If unauthorized actions are taken by a creditor against a debtor, the court may penalize that creditor. A creditor who is considering taking action against the debtor or the property of the debtor should review§ 362 of the Bankruptcy Code and may wish to seek legal advice. The staff of the clerk of the bankruptcy court is not permitted to give legal advice. MEETING OF CREDITORS.The debtor(both husband and wife in a joint case)is required to appear at the meeting of creditors on the date and at the place set forth above for the purpose of being examined under oath.Attendance by creditors at the meeting is welcomed, but not required. At the meeting, the creditors may elect a trustee other than the one named above, elect a committee of creditors, examine the debtor, and transact such other business as may properly come before the meeting. The meeting may be continued or adjourned from time to time by notice at the meeting, without further written notice to the creditors. LIQUIDATION OF THE DEBTOR'S PROPERTY. The trustee will collect the debtor's property and turn any that is not exempt into money. At this time, however, it appears from the schedules of the debtor that there are no assets from which any distribution can be paid to creditors. If at a later date it appears that there are assets from which a distribution may be paid, the creditors will be notified and given an opportunity to file claims. EXEMPT PROPERTY. Under state and federal law, the debtor is permitted to keep certain money or property as exempt. If a creditor believes that an exemption of money or property is not authorized by law,the creditor may file an objection. An objection must be filed not later than 30 days after the conclusion of the meeting of creditors. DISCHARGE OF DEBTS. The debtor is seeking a discharge of debts.A discharge means that certain debts are made unenforceable against the debtor personally. Creditors whose claims against the debtor are discharged may never take action against the debtor to collect the discharged debts. if a creditor believes that the debtor should not receive any discharge of debts under$ 727 of the Bankruptcy Code or that a debt owed to the creditor is not dischargeable under$ 523(aX2),(4), (6),or(15)of the Bankruptcy Code, timely action must be taken in the bankruptcy court by the deadline set forth above labeled'Discharge of Debts." The various peace officers believed to be involved are: 1. Badge#115, Deputy Debries; 2. Badge#205, Officer Roettger; • • September 24, 1997 Page 2 3. Badge#216, Officer Parker; 4. Badge#472, Officer Hoppe; 5. Badge#479, Officer DeRosier; and 6. Badge, #503, Officer Ferguson. The circumstances surrounding the Mr. Vevang's injuries are as follows: Mr. Vevang was injured when officers used illegal force. Mr. Vevang was leaving the Freight House in Stillwater. There was an altercation on the deck by people who were unknown to Mr. Vevang. Mr. Vevang was not involved in the altercation. One of Mr. Vevang's party was knocked down by the people involved in the altercation. Then another of Mr. Vevang's party was pulled into the altercation. Robin Hetchler,Mr. Vevang's girlfriend, alerted Mr. Vevang of what was transpiring. Mr. Vevang proceeded around the crowd to see if he could find his companion. In the process, a peace officer, without warning or provocation, sprayed a substance known as Freeze+P into Mr. Vevang's face from a very short distance. Mr. Vevang never resisted. He was completely overcome by the spray, pain, difficulty breathing, and surprise of the sudden assault. He fell to his knees and was then knocked to the ground by another officer. He was then cuffed by this officer, lifted by his hair, and then the first officer sprayed Mr. Vevang in both eyes again. Mr. Vevang was subsequently beaten, and choked to unconsciousness. He suffered cuts, abrasions, and permanent vision impairment. It is not currently known the amount of compensation to be claimed. However, the injuries suffered by Mr. Vevang include, but are not necessarily limited to,pain, suffering, disability, emotional distress, disfigurement, and permanent vision impairment. The amount of compensation is believed to exceed $50,000. Further investigation and time is necessary to know the full extent of the harm and damages suffered. Damages may include lost wages, diminution of earning capacity, and medical expenses. Attorneys' fees may be appropriate. If you have any questions, please feel free to call. Thank you. Very'trul yours. i, Shawn M. Perry SCP:lj d ;' 1
