Dear Mr. Hellerman:
I am writing to you in response to the fire that occurred to your garage/barn on January 14,
2005 at 15105 63"St. N. Since the fire at your residence,we have had several conversations
and the site has been visited by both Fire Chief,Matt Bell and myself
There are four matters of issue to your property, the first of which is the fire damaged,non-
conforming, structure itself. After conducting site visits,wherein the structure has been
found unsafe per the 2003 Minnesota State Building Code. Additionally, City Ordinance
401.15.A.7 directs that non-conforming structures destroyed beyond 50% of their fair
market value as determined by the City,be removed. This structure is considered non-
conforming due to its height,which exceeds the maximum height allowance of 17-feet and
setback from property lines as it encroaches upon the minimum setbacks of 5-feet from the
side-yard and 8-feet from the rear-yard property lines. Based on estimated fair market value
of the structure,damage to the same has been found in excess of 50%of its estimated fair
market value. Accordingly,this damaged structure is to be removed from the property no
later than May 20,2005 in accordance with City Ordinance and Minnesota Statutes Sections
463.15—463.26. Prior to its demolition,a licensed contractor must secure a demolition
permit from the City for demolition of the structure.
Secondly, City ordinance requires that all vehicles stored upon property within the city limits
be operable and licensed. In conversation with you,you stated that you might have one
vehicle that is not. This vehicle will was to be removed from your residence or made
operable and licensed by April 11,2005 as per my letter of March 11,2005 to you.As of
today,I have not received communication from you as to compliance with City Ordinance
that all the vehicles at your property are operable and licensed. I ask that you contact me
immediately and communicate the status of the vehicles at your property and the status of
their operability and licensure. Any vehicles not operable and licensed shall be removed by
May 11, 2005.
Third, there is a large amount of storage items/debris on the property,which was directed to
be removed by April 11, 2005, as per my letter of March 11,2005 to you.As of today,the
debris remains. The City requests that all items be relocated off the premises or stored
within your home no later than May11, 2005 and that you contact the Building Official when
such removal/relocation has been finalized.

Fourth and finally, City Ordinance requires that the exterior of homes be kept in good
maintenance as a matter of public safety. The paint on your home is peeling and is in a state
of disrepair,subjecting the siding to moisture,which ultimately leads to a variety of building
structure and code repair needs. Accordingly you are requested to attend to the home
exterior and return it to a properly maintained state (painted, stained or resided)no later than
June 30,2005.
Please recall that on March 11, 2005,per your conversation with City Administrator,Eric
Johnson and myself,you agreed that the issues of the yard debris,vehicle storage and home
exterior would be addressed. Should you not comply with the terms stated above, the City
will be required to seek alternative remedies to correct the above conditions. Now that
Spring has come,making outdoor work possible,I am thanking you in advance for your
following through and ask that if you have any questions at all,that you contact me
immediately so that all of the above noted issues can be resolved in a timely manner.
