RE: Utilit Installation and Parkin Lot Expansion Project

As y ou are aware, work has started on y our parkin lot expansion and utilit (sanitar sewer and water main
connection projects. The Brown's Creek Watershed District (BCWD) has not permitted an of the construction
activit that is under wa The BCWD did receive a permit application from Dave Dupa on Monda June 17,
2002 for the parkin lot expansion project onl However, the sewer and water connection was not p art of that
application. The work for this utilit connection alone, exceeds the threshold of 5,000 s feet of
disturbance or 50 cubic y ards of earth moved for re a BCWD permit.
We are re that y ou take the followin actions to brin this site into compliance with the District's Rules
and avoid the BCWD from takin further measures:
I ) Repair and/or reinstall properl the silt fence alon the entire northern perimeter of the site.
2 Remove all recentl deposited sediment within the Hi 36 road ditch adjacent to y our propert
We understand that the stormwater dischar permit is pendin review and approval b Mn/DOT.
However, an work performed within the Hw 3 6 ROW must be done in coordination with Mn/DOT.
3 Construct a temporar sediment basin in the same location as the proposed stormwater pond. The
temporar sediment basin should be at least 0.5 acre-feet in size. Construct temporar diversion
channels, as necessar to direct all runoff from the disturbed area into the temporar sediment basin.
4) Work on items 1-3 above must be completed b 5 4 00 PM on Monda June 24, 2002.
The BCWD will seek an action to stop all work if the above correction measures have not been satisfactoril
implemented. Work on the sanitar sewer and water main ma continue provided all provisions in items 1-4
have been addressed satisfactoril We understand that y our contractor ma be continuin with the sanitar
sewer installation concurrentl with the necessar temporar erosion and sediment control measures. However,
under no circumstances can the water service work be without items 1-3 above bein satisfactoril
completed. The BCWD ma also re y ou to take other measures, as necessar to prevent sediment from
leavin the site. All temporar erosion and sediment control must be properl maintained. Also, there shall be
no further work related to the parkin lot until proper permits are issued.
