CITY OF OAK PARK HEIGHTS
WASHINGTON COUNTY, MINNESOTA
A RESOLUTION ESTABLISHING FINDINGS OF FACT AND
RECOMMENDING TO THE CITY COUNCIL THAT THE
REQUEST BY STILLWATER MOTORS FOR AN AMENDED
CONDITIONAL USE PERMIT FOR A VEHICLE SALES PARKING LOT
EXPANSION FOR THE PROPERTY LOCATED ON THE CORNER OF
MEMORIAL AVENUE AND 58 STREET NORTH SHOULD BE
APPROVED WITH CONDITIONS
WHEREAS, the City of Oak Park Heights has received a request from Stillwater
Motors for an amended Conditional Use Permit to allow for the construction of additional
vehicle sales parking at the dealership located on the corner of Memorial Avenue and 58 North;
and after having conducted a public hearing relative thereto, the Planning Commission of oak
Park Heights makes the following findings of fact:
1. The real property affected by said application is legally described as
follows, to wit:

2. The applicant has submitted an application and supporting
documentation to the Community Development Department consisting of the followin g items:
and

3. The subject property is zoned B -3, Highway Business and warehousing
District in which vehicle sales is a permitted use; and
4. An amended Conditional Use Permit is required to allow for the
construction of additional vehicle sales parking; and
5. The City staff prepared a memorandum dated July 2, 2002 reviewing the
request; and
6. The memorandum dated July 2, 2002 recommended the request be
approved with conditions; and
7. The Plannin Commission held a public hearin at their Jul 11, 2002
meetin took comments from the applicants and public, closed the public hearin and made the
followin recommendation:
NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING
COMMISSION FOR THE CITY OF OAK PARK HEIGHTS THAT THE PLANNING
COMMISSION RECOMMENDS THE FOLLOWING:
A. The application submitted b Stillwater Motors for an amended Conditional Use Permit
to allow for the construction of additional vehicle sales parkin at the dealership located on the
comer of Memorial Avenue and 58 1h Street North and affectin the real propert as follows:

approval subject to the followin conditions:
1. The applicant shall provide at least four disabilit accessible stalls for the customer,
emplo and vehicle sales lots.
2. The applicant shall provide a snow removal plan subject to the approval of Cit Staff.
3. The li plan shall be revised to compl with all Zonin Ordinance standards subject to
the approval of Cit Staff.
4. The g radin g and draina plan are subject to the review and approval of the Cit En
and the applicable Watershed District.
5. The Plannin Commission recommends to the Cit Council no chan to Conditions 7 and
11 of the conditional use permit, si on November 8. 2000, for the emplo parkin lot.
6. The landscape plan is subject to review and approval of the Cit Arborist.
