OF THE CITY COUNCIL CITY OF OAK PARK HEIGHTS WASHINGTON COUNTY, MINNESOTA A RESOLUTION ESTABLISHING FINDINGS OF FACT AND RESOLUTION OF THE CITY COUNCIL THAT THE REQUEST BY STILLWATER MOTORS FOR AN AMENDED CONDITIONAL USE PERMIT FOR A VEHICLE SALES PARKING LOT EXPANSION FOR THE PROPERTY LOCATED ON THE CORNER OF MEMORIAI, AVENUE AND 58 STREET NORTH BE APPROVED WITH CONDITIONS WHEREAS, the City of Oak Park Heights has received a request from Stillwater Motors for an amended Conditional Use Permit to allow for the construction of additional vehicle sales parking at the dealership located on the corner of Memorial Avenue and 5 8th North; and after having conducted a public hearing relative thereto, the Planning Commission of Oak Park Heights recommend that the application be approved with conditions. The City Council of the City of Oak Park Heights makes the following findings of fact: follows, to wit: and and request; and 1. The real property affected by said application is legally described as SEE ATTACHMENT A 2. The applicant has submitted an application and supporting documentation to the Community Development Department consisting of the following items: SEE ATTACHMENT B 3. The subject property is zoned B -3, Highway Business and Warehousing District in which vehicle sales is a permitted use; and 4. An amended Conditional Use Permit is need to allow for the construction of additional vehicle sales parking; and 5. The City staff prepared a memorandum dated July 2, 2002 reviewing the 6. The memorandum dated July 2, 2002 recommended the request be approved with conditions; and 7. The Planning Commission held a public hearing at their July 11, 2002 meeting, took comments from the applicants and public, closed the public hearing and recommended that the application be approved subject to conditions. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR THE CITY OF OAK PARK HEIGHTS TITAT THE CITY COUNCIL RECOMMENDS THE FOLLOWING: A. The application submitted by Stillwater Motors for an amended Conditional Use Permit to allow for the construction of additional vehicle sales parking at the dealership located on the corner of Memorial Avenue and 58 Street North; and affecting the real ro ert as follows: P P y SEE ATTACHMENT A Be and the same as hereby approved by the City Council of the City of Oak Park Heights subject to the following conditions: 1. The applicant shall provide at least four disability accessible stalls for the customer, employees, and vehicle sales lots. 2. The applicant shall provide a snow removal plan subject to the approval of City Staff. 3. The lighting plan shall be revised to comply with all Zoning Ordinance standards subject to the approval of City Staff. 4. The grading and drainage plan are subject to the review and approval of the City Engineer and the applicable Watershed District. 5. The Planning Commission recommends to the City Council no changes to Conditions 7 and 11 of the conditional use permit, signed on November 8, 2000, for the employee parking lot. 6. The landscape plan is subject to review and approval of the City Arborist.
