CITY OF OAK PARK HEIGHTS
WASHINGTON COUNTY, MINNESOTA.
A RESOLUTION ESTABLISHING FINDINGS OF FACT AND
RESOLUTION OF THE CITY COUNCIL THAT THE
REQUEST BY STILLWATER MOTORS FOR AN AMENDED
CONDITIONAL USE PERMIT FOR A VEHICLE SALES PARKING LOT
EXPANSION FOR THE PROPERTY LOCATED ON THE CORNER OF
MEMORIAL AVENUE AND 58 STREET NORTH BE APPROVED
WITH CONDITIONS
WHEREAS, the City of oak Park Heights has received a request from Stillwater
Motors for an amended Conditional Use Permit to allow for the construction of additional
vehicle sales parking at the dealership located on the corner of Memorial Avenue and 5 81h North;
and after having conducted a public hearing relative thereto, the Planning Co of oak
Park Heights recommend that the application be approved with conditions. The City Council of
the City of oak Park Heights makes the following findings of fact.
I . The real property affected by said application is legally described as
follows, to wit.

2. The applicant has submitted an application and supporting
documentation to the Community Development Department consisting of the following items:

3. The subj ect property is zoned Bw3, Highway Business and warehousing
District in which vehicle sales is a permitted use; and
4. An amended Conditional Use Permit is need to allow for the construction
of additional vehicle sales parking; and
5. The City staff prepared a memorandum dated July 2, 2002 reviewing the
request; and
6. The memorandum dated July 2, 2002 recommended the request be
approved with Conditions; and
7. The Planning Commission held a public hearing at their July 11, 2002
meeting, took comments from the applicants and public, closed the public hearing and
recommended that the application be approved subject to conditions.
Now, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR
THE CITY OF OAK PARR HEIGHTS THAT THE CITY COUNCIL RECOMMENDS
THE FOLLOWING:
A. The application submitted by Stillwater Motors for an amended Conditional Use Permit to
allow for the construction of additional vehicle sales parking at the dealership located on the
corner of Memorial Avenue and 58 th Street North; and affecting the real property as follows:

Be and the same as hereby approved by the City Council of the City of Oak Park Heights subject
to the following conditions:
1. The applicant shall provide at least four disability accessible stalls for the customer,
employees, and vehicle sales lots.
2. The applicant shall provide a snow removal plan subj ect to the approval of City Staff.
3. The lighting plan shall be revised to comply with all Zoning Ordinance standards sub ect to
the approval of City Staff.
4. The grading and drainage plan are subject to the review and approval of the City Engineer
and the applicable watershed District.
5. The Planning Commission recommends to the City Council no changes to Conditions 7 and
11 of the conditional use permit, signed on November 8, 2000, for the employee parking lot.
6. The landscape plan is subject to review and approval of the City Arborist.
