CITY OF OAK PARK HEIGHTS
WASHINGTON COUNTY, MINNESOTA
A RESOLUTION ESTABLISHING FINDINGS OF FACT AND
RECOMMENDING TO THE CITY COUNCIL THAT THE
REQUEST BY STILLWATER MOTOR COMPANY FOR AN INTERIM
USE PERMIT TO ALLOW FOR INSTALLATION OF FIVE FLAGS ON
POLES AT 5900 STILLWATER BOULEVARD NORTH
SHOULD BE APPROVED WITH CONDITIONS
WHEREAS, the City of oak Park Heights has received a request from Stillwater
Motors Company for an interim use permit to allow for installation of five flags on poles at 5 900
Stillwater Boulevard North; and after having conducted a public hearing relative thereto, the
Planning Commission of Oak Park Heights makes the following findings of fact:

1. The real property affected by said application is legally described as

2. The applicant has submitted an application and supporting
documentation to the Community Development Department consisting of the following items:

3. The subject property is zoned B -3, Highway Business and Warehousing
District. The vehicle dealership and outdoor sales lot is a conditional use permit within the B -3
District; and
4. Section 401.15.G.5.n of the Zoning ordinance allows the display of more
than three flags outside of a building only by interim use permit; and
5. The applicant has requested the display of five fags on poles at the front
of the dealership building; and
6. City staff reviewed the request in a planning report dated December 7,
2006 and recommended the interim use permit be approved with conditions; and
7. The Planning Commission held a public hearing at their December 14,
2006 meeting, took comments from the applicants and public, closed the public hearing, and
made the following recommendation:
NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING
COMMISSION FOR THE CITY OF OAK PARIS HEIGHTS THAT THE PLANNING
COMMISSION RECOMMENDS THE FOLLOWING:
A. The application submitted by Stillwater Motors Company for an interim use permit to
allow for installation of five flags on poles at 5 900 Stillwater Boulevard North and affecting the
real property as follows:

Be and the same as hereby recommended to the City Council of the City of oak Park Heights for
approval with the following conditions:
1. The Planning Commission recommends the placement of the flag poles more than 20 feet
apart.
2. The flags should be displayed in accordance with the U.S. Flag Code, Minnesota
Statutes, or Executive order.
3. The interim use shall be in effect for 10 years from the date of approval by the City
Council. An extension may be requested from the City Council.
4. All temporary /special event signage on site shall be displayed in accordance with Section
401.15.6.8 of the oak Park Heights Zoning ordinance.

Conditional Use Permit m Lapse of Approval:
Unless the City Council specifically approves a different time when action is officially
taken on the request, the conditional use permit shall become null and void twelve (12)
months after the date of approval, unless the property owner or applicant has
substantially started the construction of any building, structure, addition or alteration, or
use requested as part of the conditional use. An application to extend the approval of a
conditional use permit shall be submitted to the Zoning Administrator not less than thirty
(30) days before the expiration of said approval. (401.03.C.4.a and b)
