GALLER November 23, 1988 The Honorable Mayor and City Council City of Oak Park Heights In Re : Kieper Assessment Appeal Dear Mayor Sommerfeldt and Members of the Oak Park Heights City Council : Regarding the above-entitled matter as I have previously advised you, I have requested Bill Schwab to review John Dahl ' s appraisal of the Kieper property and to provide me with his analysis. Mr . Schwab has confirmed that Mr . Dahl ' s appraisal is unacceptable . It is Mr . Schwab' s preliminary opinion that he would be able to prepare an appraisal which would sustain the assessment in the amount of $24, 105. 12. He is , however , concerned regarding the fact that there are two accessory buildings located on the property, a single car garage and a larger building/garage which must be removed in the event the balance of the property were to be subdivided and developed . After deducting the costs of removing these buildings, Mr . Schwab has indicated he would be much more comfortable with an assessment of approximately $20, 000. 00. At the pretrial conference held on November 23, I suggested this figure to John Rheinberger , the Kieper ' s attorney, and assuming we receive authorization from the City Council to reduce the assessment to the sum of $20, 000. 00, Mr . Rheinberger indicated that he would recommend that his clients accept this figure . Based upon all the factors involved , including the cost of obtaining a formal appraisal from Mr . Schwab and the cost involved in the trial of the assessment appeal , we recommend that the City Council authorize our office to formally offer a settlement figure of $20, 000. 00 to Mr . BRIGGS PAUL A.WOLFF MARK J.VIERLING November 11 , 1988 VICKI L.GIFFORD GREGORY G.GALLER The Honorable Mayor and City Council City of Oak Park Heights In re : Kieper assessment appeal Dear Mayor Sommerfeldt and members of the Oak Park Heights City Council : Asou are aware , Gene and Sharon Kieper have appealed YP PP their assessment for street , sewer and water improvements in the amount of $24, 105. 12. As you are further aware , the City Council has previously authorized Mr . Gary Vizenor to do an appraisal of the Kieper property for the purpose of determining whether or not the benefits , as a result of the public improvements , exceed the amount of the assessment. Mr . Vizenor arranged for Mr . John Dahl from his office to do the actual appraisal and Mr . Dahl found that the benefit to the property as a result of the improvements was $16, 689. 00 . It is our opinion that Mr . Dahl did a totally unacceptable job in appraising this property and we , therefore , have requested Mr . William Schwab, an appraiser who has now purchased Mr . Vizenor ' s appraisal business , to review Mr . Dahl ' s appraisal and , if necessary, to re-appraise the Kieper property. As the Council is aware , unless we have an appraisal which shows the benefits exceed the amount of the assessment, there is no way to sustain the assessment in the Court proceedings . Based on the above , we request that the Council authorize Mr . Schwab to re-appraise the property and to further authorize our office to advise Mr . John Rheinberger , the Kieper ' s attorney, that the property will be re-appraised . This matter has been set for Pre-trial before Judge Maas on November 23, 1988 , and we hope to have the results of Mr . Schwab' s appraisal prior to that time.
