KERN Center Pond Pagel of 29 TO: City Council Members FROM: Eric Johns On Wed, Dennis Postler and I had met with Karen Kill from the BCWD to discuss a possible impact to the City's capacity to develop the Memorial Ave area to a full 80 percent impervious as was contemplated by our joint agreement in 2004. Essentially, BCWD is suggesting that if the recent WILL ZINTL Project is allowed to drain ALL of their water to the POND, then the City will need to restrict a similar amount of water from a future site as the ENTIRE area being proposed by WILL ZINTL was somehow not included in the agreement. Naturally, we disagree with this analysis by the BCWD and WILL ZINTL project should be unaffected as should the City's future capacity. 1 have authorized BONESTROO to research the situation (up to $2,000) and which should decisively refute the statements by the BCWD. Interestingly, the amount of water that is being discussed here would be roughly 1 to 2 percent of the total volume initially anticipated. The BCWD is not joining realistic water hydrological theory with physical application. Stand by,
