extinguisher and/or smoke d'etector(s).

called the meeting to order at 7:00 p.m. Present: Councilmembers Dougherty,

Councilmember Swenson, seconded by Councilmember Liljegren, moved to
approve the Agenda. Carried 5-0.
IL Summary of Closed Session from January 12, 2016 Ci ly Council Meetin
City Attorney Vier] ing reported that the City Council held a closed session under
attorney-client privilege regarding matters of potential litigation related to the St.
Croix River Crossing PrQject and the Minnesota Department of Transportation.
He reported no motions were made in the closed session,

A. Mayor McCornber: She reported that she attended the Minnesota Mayor's
Board of Director's meeting as well as the Experienced Elected Officials
Conference the previous week. She also reported that the next Parks
Commission meeting was set for February 22, 2016, and there was a
vacancy on the Parks Commission.
B. Councilmember Dougherty: No report.
C. Councilinernber Lire Oren: No report.
D. Councilmember Runk: No report.
E. Councilmember Swenson: He reported that the Cable Commission held a
meeting and discussed the replacement for Kathy Cinnamon. lie stated
they began advertising and were posting it as a full-time position. He also
reported that the franchise agreement had not been signed.
F. Staff. Deputy Clerk Pinski reported that 'Tim and Michelle St. Sauver of
14295 57"' Street North were chosen as the recycling award winners.

A. Ordering the Razing of a Hazardous Building.—, 15105 63 d Street N. City
Administrator Johnson reported that the City had two options for the
property at 15105 63`1 Street North. He stated option I was to continue
through the court process whereby the City would perform the demolition
under the District Court's order, and option 2 was to approve an
agreement with the property owners whereby the City had their direct
permission to perform the work and assess costs back at zero percent
interest over five years and which would suspend the legal proceedings.
Property owner Wayne Hellerman was present at the meeting and
requested more time to remove belongings from the property,
Councilinember Swenson, seconded by Councilmember Runk, moved to
approve the contract authorized by the City to continue the demolition
process with demolition to occur on February 16, 2016, Roll call vote
taken. Carried 5-0.
Councilmember Swenson, seconded by Councilmember Liljegren, moved
to authorize staff to obtain bids and make an award to the lowest qualified
bidder. Carried 5-0.

VIII. New Business. -
A. Approve Purchase of 2 Replacement Squad Cars and Equipment,.
Councilmember Swenson, seconded by Councilmember Ljl�jegren, moved
to authorize the purchase of two replacement squad cars and equipment at
the price presented. Carried 5-0.
B. Palmer Station — Second Extension Request: City Administrator Johnson
reported that the City received a written request from Creative Home
Construction Investments LL,C representative Mick Lynskey to extend the
approvals through June 2017. He stated that the City Council had
previously granted an extension giving certain timelines for the execution
of the Developer's Agreement and the supply of all securities and platting
to be completed by June 2016. Mr. Lynskey was present at the meeting
and requested the extension be granted.
Councilmember Runk, seconded by Councilmember Dougherty, moved to
grant an extension requiring that the Development Agreement be in place
by December 31, 2016 and the other approvals through June 30, 2017.
Carried 5-0.

RESOLUTION GRANTING THE APPLICATION OF
WHITETAILS UNLIMITED METRO AREA
TO CONDUCT A ONE -DAY RAFFLE AT
HIEGHTS HALL & CLUB ON MARCH 19,2016
WHEREAS, Lindell Blanchette, on behalf of Whitetails Unlimited Metro Area
has applied with the State of Minnesota Gambling Control Board for a permit to conduct
a one -day raffle on March 19, 2016 at the site of Heights Hall & Club, 5880 Omaha
Avenue North; and
WHEREAS, the City of Oak Park Heights has reviewed the application and finds
that its purposes meet the necessary community standards; and
WHEREAS, the City of Oak Park Heights has solicited the input of the public
and there have been no objections to the granting of the application for the raffle permit
as applied for by Whitetails Unlimited Metro Area with the State of Minnesota Gambling
Control Board.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR
THE CITY OF OAK PARK HEIGHTS AS FOLLOWS:

A RESOLUTION RECOGNIZING THE CONTRIBUTIONS
OF SERGEANT KEN ANDERSON
WHEREAS; Ken Anderson has served the City of Oak Park Heights for
26 years from 1990 to 2016; and
WHEREAS; Ken Anderson was a consistently friendly voice in patrolling
the City answering a wide variety of calls from residents and businesses; and
WHEREAS; during this period, Ken Anderson respectfully served all the
citizens of Oak Park Heights in an outstanding and professional manner while
assigned to the positions of Patrol Officer, Investigator, School Resource Officer,
and Sergeant.
WHEREAS; Ken Anderson's professionalism and dedication to the
responsibilities to the position of police officer have brought credit upon himself
and the City of Oak Park Heights; and

2. CITY understands that if there is any root blockage in lines requiring a reverse set-up during
televising that the set up will be considered "incidental". We will notify CFIA' of the problems as they

4. CONTRAC-FOR understands that 12il2e is to be cleaned to 95% per NASSCCO specifications. Any

201.6 Request for Quotes — Sanitary Sewer Cleaning/CCTV
Summary: The City of Oak Park Heights is seeking quotes from qualified contractors to
perform sewer cleaning and certified PACP CCTV work over a five year contract period on the
sanitary sewer system. Oak Park Heights owns roughly 135,000 linear feet of sewer pipe
ranging in diameter from four inches to thirty-six inches, most of which are between six inches
and eight inches in diameter.

CLEANING SPECIFICATIONS
Intent of Jet Cleaning: The intent of line cleaning is to remove foreign materials from the lines
and restore the pipe segment to a minimum of 95% of the original carrying capacity. It is
recognized that there are some conditions such as a broken pipe section and/ or other major
blockage that prevents cleaning from being accomplished or where additional damage would
result if cleaning were attempted. Such instances will be reviewed on a case by case basis.
Cleaning Equipment: High -Velocity Jet Equipment shall be used as the primary cleaning
method on this project. All high -velocity pipe cleaning equipment shall be constructed for ease
and safety of operation. The equipment shall have a multiple selection of two or more
high -velocity nozzles. The nozzles shall be capable of producing a scouring action from 15 to 45
degrees in all pipe sizes to be cleaned. Jet washing equipment will not exceed a maximum
pressure of 1800 psi. The equipment shall carry its own water tank. Water for re -filling the tank
will be made accessible through existing City owned fire hydrants,

Cleaning Operation: The equipment shall be capable of removing dirt, grease, rocks, sand, and
other materials and obstructions from the sanitary sewer lines and manholes. If cleaning of an
entire section cannot be successfully performed from one manhole, the equipment shall be set up
on the other manhole and cleaning again attempted. If, again, successful cleaning can -not be
performed or the equipment fails to traverse the entire manhole section, it will be assumed that a
major blockage exists and the cleaning effort shall be abandoned.
Root Removal: Roots shall be removed in the designated sections where root intrusion is a
problem at the discretion of the public works director. Any work done to remove roots in a
section shall be documented in the report. Discing and rodding equipment may be used for root
removal. Documentation shall include the locations in the pipe segment where roots were
removed and the procedure that was used.
Material Removal: All sludge, dirt, sand, rock, grease, and other solid or semisolid material
resulting from the cleaning operation shall be removed at the downstream manhole of the section
being cleaned. Passing material from manhole section to manhole section, which could cause
line stoppages, accumulations of sand in wet wells, or damage pumping equipment, shall not be
permitted.

Disposal of Materials: All solids or semi-solids, debris resulting from the cleaning operations
shall be removed from the work area and disposed of properly and is the sole responsibility of
the contractor. All materials shall be removed from the work area no less often than at the end of
each workday. Under No circumstances will the Contractor be allowed to accumulate debris,
etc., on the site of work beyond the stated time, except in totally enclosed containers and as
approved by the Owner.
Water Use: If the Contractor requires water for cleaning operations from hydrants, the
Contractor shall make arrangements with the City of Oak Park Heights Public Works
Department and shall use only fire hydrants designated by the City. The City shall provide a
reasonable amount of water free of charge to the contractor.
Final Acceptance: Acceptance of sanitary sewer cleaning shall be made upon the successful
completion of the television inspection and shall be to the satisfaction of the Owner. If TV
inspection shows the cleaning to be unsatisfactory, the Contractor shall be required to re -clean
and re -inspect the sanitary sewer line until the cleaning is shown to be satisfactory.

TELEVISING SPECIFICATIONS
Intent: All designated pipe sections shall be visually inspected by means of closed-circuit color
television (CCTV). All CCTV work shall. be conducted in accordance with NASSCO Pipeline
Assessment. All inspections shall be done in certified PACP format.
Equipment: The television camera used for the inspection shall be one specifically designed and
constructed for such inspection. The camera shall be capable of radial view for inspection of the
top, bottom, and sides of pipe and for looking up lateral connections. The camera shall be
mounted on adjustable skids, or self-propelled, to keep it in the center of the pie. Lighting of the
camera shall be supplied by a lamp on the camera, capable of being dimmed or brightened
remotely from the control panel. The lighting system shall be capable of lighting the entire
periphery of the pipe. The camera, television monitor, and other components of the video system
shall be capable of producing a picture quality satisfactory to the City; and if unsatisfactory, the
equipment shall be removed and no payment will be made for an unsatisfactory inspection.
Televising: The television camera shall be moved through the line in either direction at a
uniform rate, stopping when necessary to insure proper documentation of the sanitary sewer pipe
condition but in no case will the television camera be pulled at a speed greater than 30 feet per
minute. Manual winches, power winches, TV cable, and powered rewinds (or other devices that
do not obstruct the camera view or interfere with proper documentation of the sanitary sewer
conditions) shall be used to move the camera through the sanitary sewer. If, during the
inspection operation the television camera will not pass through the entire sanitary sewer section,

the Contractor shall re -setup his equipment in a mariner so that the inspection can be performed
from the opposite manhole. If, again, the camera fails to pass through the entire sanitary sewer
section, the inspection shall be considered complete and no additional inspection work will be
required. All costs for re -setup due to an obstruction in the sanitary sewer that will not allow the
camera to pass shall be considered incidental. If the camera becomes submerged due to a sag in
the pipe, a high velocity jet will be utilized to pull water away from the camera lens.
Measuring: The location meter, for accurately recording the location of the television camera
with respect to the reference manhole, shall be a direct reading, above ground, friction clamp
device or other suitable equipment. Mai -king on the cable, or the like, which would require
interpolation for depth of manhole, will not be allowed. The meter shall be capable of reducing
readings for reverse movement of the camera and shall be capable of being manually re -zeroed
for each new setup. Footage shall be shown on the video data.
Television Inspection Logs: The logs shall be typed or Computer printed and acceptable to the
Owner. Printed location records shall be kept by the contractor and will clearly show the
location, in relation to adjacent manholes, of each infiltration point discovered by the television
camera. An estimate of the flow rate of observed infiltration points shall be made and recorded.
In addition, other points of significance such as locations of building sanitary sewer laterals,
joints, unusual conditions, roots, sanitary sewer connections, collapsed sections, presence of
scale and Corrosion, and other discernible features will be recorded and no less than two (2)
copies of such records shall be supplied to the Owner. A summary report of all significant
findings shall be attached to the typed or computer printed log report.

Video Recordings: The purpose of recording shall be to supply a visual and audio record of the
condition of the lines that may be replayed both daily and at future presentations. DVI)
recording playback shall be at the same speed that it was recorded. Upon completion of the
work, all DVDs recorded during the television inspection shall become the property of the
owner. Cost of DVDs shall be included in the unit price bid. A complete recording shall be
made of each line televised. A voice recording on DVD, shall make brief and inforinative
comments on the sanitary sewer conditions.
DVDs shall include the following information:
A. Visual (on screen in comer):
1. Report number.
2. Date of television inspection.
3. Sanitary sewer section and number.
4. Current distance along reach (tape counter footage).
5, Printed labels on DVD and case with location information, date, format infort-nation, and
other descriptive information.

adjacent street, and manhole numbers.

Television inspection logs shall include, but are not limited to, the following:

operator, inspector, and weather conditions.

corresponding DVD identification.

Traffic Control: Contractor is responsible for all traffic control devices, signage and warning
lights. In all cases the work shall be conduct so as to minimize, as best as practical, all types of
traffic disruption..

Bidder Qualifleations: No bids will be accepted other than those submitted by experienced
Sewer Televising, Inspection and Cleaning Contractors. Contractors must demonstrate that they,
and/ or their employees, have been in the business of televising, inspecting and cleaning of
sanitary sewers for at least 5 years. Bidder qualifications must accompany bid submittal and will
be used to evaluate the bidder's ability to perform the work as required.
Laws and Regulations: The contractor shall comply with all Federal, State, County and City
laws, ordinances, and regulations affecting the work under this specification. Unless otherwise
instructed it shall be the responsibility of the contractor to obtain and preserve all the necessary
permits, licenses, or outside agency approvals throughout the duration of the job.
Indemnification: The contractor shall defend, indemnify and hold harmless the City of Oak
Park Heights, its officers and employees from all suits, actions and claims of any character
brought because of injuries or damages received or sustained by any person, persons or property
as a result of the operations of the contractor; or on account of or in consequence of any neglect
in performing the work- or through the use of unacceptable materials in constructing the work; or
because of any act or omission, neglect, or misconduct of the contractor or its subcontractor; or
because of any claims arising or amounts recovered from infringements of patents, trademarks,
copyrights, or because of any claims arising or amounts recovered under the Workers'
Compensation Act, or under any other law, ordinance, order or decree.

Plans and Specifications: Before submitting its bid, the bidder shall carefully examine the entire
contents of the specifications so as to be thoroughly familiar with all the requirements. Bidders
are instructed to acquaint themselves with all the conditions affecting the work-, such as
obstacles, right-of-way encroachments and of surface and subsurface geological formations. The
successful bidder shall not be allowed any extra compensation by reason of any unforeseen
difficulties, of which the bidder could have discovered, by reasonable anticipation prior to the
bidding. Before submitting a bid, all bidders must examine existing field conditions, and/or
specifications to judge for themselves the difficulties with which may arise in the execution of
the work,
Inspections: All workmanship and materials are subject to the inspection and approval of the
City of Oak Park Heights. If, in the opinion of the City, it is not expedient to correct inadequate
workmanship not in compliance with the specifications, the City shall have the right to deduct
the difference in value between the workmanship or materials supplied and that called for under
the specifications. The value shall be determined in accordance with competent cost estimates.
Any deductions shall not be construed as a waiver, release or compromise of any other losses,
costs, damages or causes of action of the City arising out of such non -complying workmanship.

Payment: Payment for the work is dependent upon the approval of the Public Works Director.
Payments shall be based on the bid unit price per linear foot for the corresponding linear foot of
work performed. Measurement of the actual number of feet cleaned and/ or televised shall be
made from the center of the manhole. Payrnent will be made upon final, completion of yearly
work,
Quantity: The estin-lated quantities are given below; however bidders are to note that this may
vary to meet actual department demands throughout the contract. For bidding purposes the
following estimates are given for a five (5) year period.

specified above to be obtained by the contractor or its subcontractors shall be paid for by the
contractor or its subcontractors. Except for intentional or willful acts by the City, the contractor
does hereby release the City from any loss or liability incurred by the contractor related to the

WHEREAS, Kathy Cinnamon has served as the Administrator for the
Central St. Croix Valley Joint Cable Communications Commission and Valley
Access since May 1995 and will be retiring in March 2016; and
WHEREAS, the City Council of the City of Oak Park Heights relies on
the Cable Commission to ensure the franchise with the cable company is being
followed, and Kathy Cinnamon's role as Administrator has been instrumental in
assisting the Commission in their role; and
WHEREAS, Kathy Cinnamon respectfully served in her position in an

WHEREAS, the voters within the Stillwater Area Public School District voted to pass a Levy in
20,13 and a Bond in 2015 in order to fund the area schools in a variety of ways; and
WHEREAS, many voters understood that the passing of the levy and bond meant that no
schools were to close in the foreseeable future; and
WHEREAS, the Stillwater Superintendent proposed the BOLD initiative which would result in
the closure of three elementary schools in the district- Withrow Elementary, Marine Elementary,
and Oak Park Elementary; and
WHEREAS, the proposal to close schools emerged from inside the district, without prior or
direct input from the general public and without sufficient details provided to the City or the
public; and
WHEREAS, the Oak Park Heights City Council recognizes the value to the community of each
school facility, which serve as venues for social interactions, activities and recreational
opportunities, and
WHEREAS, the City strives to expand and improve partnerships with all school districts within
the City and collaborate for the purposes of providing the community with educational and
recreational activities that result in improvements to the quality of life for the citizens; and
WHEREAS, the proposal to, close schools does not consider the impact on the communities; and
WHEREAS, the process and timeline outlined for deliberation of this important decision, which
may have widespread community impact, is short and scripted without time for legitimate debate
and careful consideration of ideas and alternatives; and
WHEREAS, Oak Park Elementary is an important community asset located within the
community
WHEREAS, Oak. Park Elementary School is located in a suburban setting with municipal
services such as city sewer and water, and further is considered a neighborhood school where
children can actually walk to the school without busing or car travel and which also directly
benefits those families without transportation options; and,
WHEREAS, the existing zoning, lack of public improvements in the area, and surrounding land
use patterns makes the viable re -use or sale of the building unlikely without significant financial
investment; and,

WHEREAS, the City has donated some of its, limited financial resources toward the installation
of recreational playground equipment at Oak Park Elementary School for the enjoyment of all
citizens with the City and. the Stillwater School District.
WHEREAS, the Oak. Park Elementary school grounds include other outdoor recreational
amenities that serve a need for area residents, and it remains unclear whether those amenities will
remain available or will need to be replaced at a new location and at additional expense.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE
CITY OF OAK PARK HEIGHTS, MINNESOTA, that it should and hereby does respectfully
request the Stillwater Area Public School District to do the following:
1. Delay taking any action on February 11, 2016 that involves the closing of schools, and reset
all timelines that depend On this action.
2. Create a process that is inclusive of the impacted communities, and families and includes an
open evaluation of alternatives, vetting of ideas, and proper study of implications.
3. Ensure that any proposal factors the value that the school facilities and associated activities
have on the communities in which they are located and determine the impact of the loss of
those facilities and activities.
4, Review the "Mission" of the Stillwater School District and determine the proper role of the
school district in maintaining a strong community, soliciting feedback and valuing of
community partnerships.
S. In partnership with the City of Oak Park Heights and the City of Stillwater, evaluate the
likelihood of re -use possibilities for property and facilities prior to making a decision.
Determine the impacts that a vacant or repurposed facility will have on the vibrancy of this
part of the City, or share plans to demolish the facility and return to an allowable use.
6. Include within the process a method of community engagement that attempts to identify all
positive benefits and negative consequences of the proposal and provide a meebanisin, for
evaluating, weighing, and balancing any factors identified.
7. Determine whether this action collectively improves the quality of life for residents within
the community and whether the vacated space may be put to a future use that is beneficial.
The City of Oak Park Heights offers its assistance to the school board and its staff in
facilitating or participating ina proper process.
