Oak Park Heights,MN 55082 Re: Fence and Property Line Related Issues Dear Mr. &Mrs. Krabbenhoft: As a result of the ongoing issues in relation to the location of the common property line between your residence and 5690 Newgate Circle and the fence location at 5680 Newgate Circle N., I made a site visit to the properties November 15, 2004 to investigate these issues. I was able to locate the North property pins and followed the lines in accordance with the Certificate of Survey for your property and the adjoining properties of 5690 Newgate Circle N. and 5790 Newgate Ave.N. Wooden stakes were installed at the pins and a line strung between the two pins from the front to the rear of the common property line of 5680 and 5690 Newgate Circle N. Relative to the locations of the pins, the fence as constructed has been misplaced and encroaches upon the eastern 3-foot side yard setback. With this letter, you are hereby directed to correct the fence location so that is complies with the required setback and are further directed to do so within 30 days of the date of this letter. At your request, the City will forward a copy of this communication to the fence installer noted upon the permit for the fence installation. Please contact me when the fence has been relocated for final inspection. I would appreciate it if the string would be left in place until the inspection process is completed following the relocation of the fence. The survey monuments may not be moved under Minnesota Statute 505.33. If you have any questions regarding this letter,please contact me immediately.
