Ine nutshell, VBVVD will not allow further development to occur in the Kern Center unless on-site ponding is provided for water quality and water quantity -or- all the appropriate permits from each agency has been obtained bo install the outlet hothe wetland proposed in the Stillwater AUAR. (Lake Brno. Brown's Creek, Washington County GVVCO. Minnesota DNR. etc...) This includes the Post Office proposal without anonmitepond. With the current development, weare just exceeding the pre-development peak discharge rates for the site (as of the original permit for the Kern Center) and are not providing any water quality storage. Memorandum To: Valley Branch Watershed District Board of Managers From: John Hanson Subject: LISPS Stillwater, oak Park Heights — Permit 2000 -16 REVISION Date: August 4, 2000 P roject: 23/82016 VOO 007 The District permitted this project last month. The applicant has now requested to eliminate the stormwater pond located north of 55"' Street and use the Kern Center pond to meet the rules and regulations of the District. By e liminating the storinwater pond, several trees could be saved. __ � 0, The project is located near 55 th Street North and Highway 5, within the Kern Center. Specifically, the project is located in the southwest quarter of Section 6, Township 29 North, Range 20 west. A site location map is attached. A reduced revised site plan is attached. A figure showing the general drainage patterns and jurisdictional boundaries is also included. CONCERN The new proposal would increase the stormwvater discharge rates leaving the Kern Center site. The VBWD has allowed increases in discharge rates only if the discharge rates are controlled at community boundaries. The city of Oak Park Heights has indicated to the VBWD that they wish to modify the outlet of the wetland west of the Kern Center Pond to meet the rate control requirements. This wetland is outside of VBWD and within the Browns Creek Watershed District (BCWD). In addition, this wetland is partly in Lake Elmo and partly in Oak Park Heights. Wetland Conservation Act issues within BCWD.) Modification of the wetland may require permits from the Minnesota Pollution Control Agency, the Department of Natural Resources, and the U.S. Army Corps of Engineers, in addition to BCWD and Lake Elmo. The City of Oak Park Heights has not submitted proof of these approvals to the VBWD. CONCLUSIONS To conform to the VBWD rules and regulations, the peak discharge rates leaving the post office site need to remain the same or be lowered from the undeveloped condition. water quality pond ing requirements also need to be met. The VBWD-approved site design conformed to these rules. The current revised design does not. If the LISPS wishes to use the Kern Center pond for the stormwater needs, modifications need to be made to provide the necessary water quality treatment (deed storage) and conform to the VBWD stormwater rate control rule. Permits from the Minnesota Department of Transportation may be necessary for any work within the pond. If all the agencies having j Lirisd iction have permitted the modifications to the wetland to conform to the rate control i•Lile, water quality treatment still needs to be addressed. Since there are several oLItstanding issues at the Kern Center, VBWD approval of the revised site design is not recommended.
