CITY COUNCIL MEETING MINUTES
I. Call to Order/Pledge of Allegiance/Approval of Agenda: Mayor McComber
called the meeting to order at 6:00 p.m. Present: Councilmembers Dougherty,
Runk, and Swenson. Staff present: City Administrator Johnson and City Attorney
Vierling. Absent: Councilmember Liljegren, City Planner Richards, and City
Engineer Mann.
Councilmember Swenson, seconded by Councilmember Dougherty,moved to
approve the Agenda. Carried 4-0.
II. Council/Staff Reports:
A. Mayor McComber: She reported the Parks Commission scheduled a
worksession for April 18 at 6:00 p.m. followed by the regular meeting at
7:00 p.m. She stated the Parks Commission conducted a walkthrough of
the mountain bike trail proposed area on April 2, she would be attending
the Minnesota Association of Small Cities Legislation Day at the Capitol
on April 19, the Bayport Fire Department Ribbon Cutting event was held
on April 7, there was a Safety and Loss Control seminar scheduled for
April 20,the St. Croix Valley Prayer Breakfast at The Grand was set for
May 6, and the Spring Clean-up event was set for May 7 from 7:30 a.m. —
1:00 p.m. at the Andersen Corporation parking lot.
B. Councilmember Dougherty: He reported he would be attending the CVB
meeting on April 13, and the Middle St. Croix Watershed Management
Organization meeting for April 14 was cancelled.
C. Councilmember Liljegren: Absent.
D. Councilmember Runk: He reported he would be attending the CVB
meeting on April 13, and the Planning Commission meeting for April 14
was cancelled.
E. Councilmember Swenson: He reported that the new Valley Access
Channels Administrator started the previous week.

AN ORDINANCE AMENDING CHAPTER 1118 OF THE
CODE OF ORDINANCES OF THE CITY OF OAK PARK HEIGHTS
RELATING TO PROVIDING FOR EMERGENCY MANAGEMENT FOR
PROTECTION AND PROMOTION OF PUBLIC SAFETY,HEALTH AND WELFARE
IN THE CITY OF OAK PARK HEIGHTS DURING EMERGENCIES
THE CITY COUNCIL OF THE CITY OF OAK PARK HEIGHTS, WASHINGTON COUNTY,
MINNESOTA,DOES ORDAIN:
Section 1. That the Ordinance title of Chapter 1118 of the Code of Ordinances of the City of Oak
Park Heights is hereby deleted in its entirety and replaced with the following: An Ordinance
Providing for Emergency Management for Protection and Promotion of Public Safety, Health and
Welfare in the City of Oak Park Heights During Emergencies.
Section 2. That Sections 1118.01 through 1118.10 of the Code of Ordinances of the City of Oak
Park Heights are hereby amended to read as follows:
1118.01 Policy and Purpose.
A. Because of the existing and increasing possibility of the occurrence of
disasters of unprecedented size and destructiveness resulting from enemy
attack, sabotage, or other hostile action, or from fire, flood, earthquake, or
other natural causes, and in order to insure that preparations of this City
will be adequate to deal with such disasters, and generally, to protect the
public peace, health, and safety, and to preserve the lives and property of
the people of this City, it is hereby found and declared to be necessary:
1. To establish an Emergency Manager to oversee and coordinate;
2. To provide for the exercise of necessary powers during
emergencies and during the time of natural disaster;
3. To provide for the rendering of mutual aid between this City and
other political subdivisions of this State and of other States with
respect to the carrying out of Emergency Management functions;
4. To provide for the formulation of necessary plans and training to
meet the requirements of the City missions.
B. It is further declared to be the purpose of this Ordinance and the policy of
the City that all Emergency Management functions of this City be
coordinated to the extent practicable with the comparable functions of the
Federal government, of this State, the County, and of other States and
localities, and of private agencies of every type, to the end that the most

effective preparations and use may be made of the Nation's manpower,
resources, and facilities, for dealing with any disaster that may occur.
1118.02 Definitions.
A. "Emergency Management" means the preparations for and the carrying
out of all emergency functions, other than functions for which military
forces are primarily responsible, to prevent, minimize, and repair injury
and damage resulting from disasters caused by enemy attack, sabotage, or
natural causes. These functions include, without limitation, fire-fighting
services, police services, public works, medical health services, rescue,
engineering, warning services, communications, radiological, chemical
and other special weapons defense, evacuation of persons from stricken
areas, emergency welfare services, emergency transportation, existing or
properly assigned functions of plant protection, temporary restoration of
public utility services, utilization of best available shelters, and other
functions related to civilian protection, together with reasonable activities
for preparation for and carrying out of the foregoing functions.
B. "Emergency" means an emergency declared by the Governor under
Minnesota Statutes, Section 12.31, or an emergency proclaimed by the
Mayor under Section 1118.06 of this Ordinance.
1118.03 Establishment of Emergency Manager.
A. There is hereby created within the City government an Emergency
Manager. The Emergency Manager shall be appointed by the City
Council for an indefinite term and may be removed by it at any time.
They shall receive such compensation as the City Council shall determine
from time to time and they shall be paid necessary expenses. The
Emergency Manager shall have direct responsibility for the organization,
administration, and operation of emergency management, subject to
direction and control of the City Council. Emergency management shall
be organized into such divisions and bureaus, consistent with State and
local emergency management plans, as the Emergency Manager deems
necessary to provide for the efficient performance of local emergency
management functions during an emergency. The Emergency Manager
shall perform emergency management functions within the City and, in
addition, shall conduct such functions outside the City as may be required
pursuant to the provisions of Minnesota State Statute Chapter 12 as
amended, or this Ordinance. The City Council may appoint a Deputy
Emergency Manager to act in the absence of the Emergency Manager.
1118.04 Powers and Duties of the Emergencyger.
A. The Emergency Manager, with the consent of the Council, shall represent
the City on any regional or State organization for emergency management.
They shall propose Mutual Aid Agreements with other political
subdivisions within or outside the State for reciprocal Emergency

Management aid and assistance in an emergency too great to be dealt with
unassisted, and they shall present such agreements to the Council for its
action. Such arrangements shall be consistent with the State Emergency
Management Plan and the Oak Park Heights Emergency Operation Plan
and during an emergency, it shall be the duty of the Emergency Manager
to coordinate and oversee such assistance in accordance with the
provisions of mutual aid arrangements. Any mutual aid arrangement with
a political subdivision of another State shall be subject to the approval of
the Governor.
B. The Emergency Manager shall make such studies and surveys of the
manpower, industries resources, and facilities of the City as they deem
necessary to determine the adequacy for Emergency Management, and to
plan for the most efficient use in time in an emergency.
C. The Emergency Manager shall prepare a comprehensive general plan for
the emergency management of the City—also known as Emergency
Operation Plan/EOP. When the Council has approved the plan by
resolution, it shall be the duty of all municipal employees and
departments, along with all contracted services of the City to perform the
duties and functions assigned by the plan as approved. The plan may be
modified in like manner from time to time. The Emergency Manager shall
coordinate the emergency management activities of the City to the end
that they shall be consistent integrated with the emergency management
plans of other political subdivision within the State.
D. In accordance with the State and City emergency management plans, the
Emergency Manager shall institute such training programs and public
information programs and shall take preparatory steps, including the
partial or full mobilization of emergency management forces in advance of
actual disaster, as may be necessary to the prompt and effective operation
of the City Emergency Management Plan in time of an emergency. They
may, from time to time, conduct such practice or other emergency
management exercises as they may deem necessary and practical given the
time and resources available within the city.
E. The Emergency Manager shall utilize the personnel, services, equipment,
supplies, and facilities of existing departments and agencies of the City to
the maximum extent practicable. The department heads and personnel of
all such departments and agencies shall, to the maximum extent
practicable, cooperate with and extend such services and facilities to the
Emergency Manager and to the Governor upon request.
1. The head of each city department and agency or contracted service,
in cooperation with and under the direction of the Emergency
Manager, shall be individually responsible for the planning of such
emergency management activities as assigned in the city

emergency operations plan involving the utilization of the facilities
of their department or agency.
F. The Emergency Manager shall make reasonable effort to carry out all
orders, rules and regulations issued by the Governor pertaining to
Emergency Management given the scope, resources, and abilities of the
manager and the city.
G. The Emergency Manager shall direct and control the general operations of
all local emergency management resources during an emergency in
conformity with controlling regulations and instructions of State
Emergency Management authorities and the City Emergency Operation
Plan. The heads of departments and agencies shall be governed by their
orders in respect thereto.
H. Consistent with the Emergency Management Plan, the Emergency
Manager shall designate at some suitable place in the City an emergency
Operations Center and, if required by the local Emergency Management
Plan, auxiliary centers to be used during an emergency as headquarters for
direction and control. They shall arrange for representation at the center
by municipal departments and agencies, public utilities and other agencies
authorized by Federal or State authority to carry on emergency
management activities during an emergency. They shall arrange for the
installation at the Emergency Operations Center of necessary facilities as
available for communication with and between heads of emergency
management divisions, the stations and operating units of municipal
services and other agencies concerned with emergency management and
for communication with other communities and Emergency Operating
Centers, within the surrounding area and with the Federal and State
agencies concerned.
I. During the first thirty (30) days of an emergency, if the Legislature is in
session or the Governor has coupled his declaration of the emergency with
a call for a special session of the Legislature, the Emergency Manager
may, when necessary to save life or property, require any person except
members of the Federal or State Military forces and officers of the State or
any other political subdivision to perform service for emergency
management purposes as they direct; and they may commandeer, for the
time being, any motor vehicle, tools, appliances, or any other property,
subject to the owner's right to just compensation as provided by law.
1118.05 Emergency Volunteers:
A. No emergency volunteer shall carry any firearm while on duty except on
written order of the Chief of the Police Department.

B. Personnel procedures of the City applicable to regular employees shall not
apply to volunteer workers.
1118.06 Emergency Regulations.
A. When used in this section, the term "Emergency" includes, in addition to
the meaning given in Section 1118.02, B, disasters caused by fire, flood,
windstorm, or other natural causes.
B. Whenever necessary to meet an emergency or to prepare for such an
emergency for which adequate regulations have not been adopted by the
Governor or the City Council, the Mayor may, by proclamation,
promulgate regulations, consistent with applicable Federal or State law or
regulation, respecting: the sounding or dissemination of warnings; the
conduct of persons and the use of property during emergencies; the repair,
maintenance, and safeguarding of essential public services; emergency
health, fire and safety regulation, and all other matters which are required
to protect public safety, health and welfare in emergencies.
C. Every proclamation of emergency regulations shall be in writing and
signed by the Mayor; shall be dated; shall refer to the particular
emergency to which it pertains, if so limited; and shall be filed in the
office of the City Clerk, where a copy shall be kept posted and available
for public inspection during business hours. Notice of the existence of
such regulation and its availability for inspection at the Clerk's office shall
be conspicuously posted at the front of the City Hall or other headquarters
of the City and at such other places in the affected area as the Mayor shall
designate in the proclamation. Thereupon the regulation shall take effect
immediately, or at such later time as may be specified in the proclamation.
By like proclamation the Mayor may modify or rescind any such
regulation.
D. The City Council may rescind any such regulation by resolution at any
time. If not sooner rescinded, every regulation shall expire at the end of
three (3) days / 72hrs. after its effective date or at the end of the
emergency to which it relates, whichever occurs first. Any Ordinance,
rule or regulation inconsistent with an emergency regulation promulgated
by the Mayor shall be suspended during the period of time and to the
extent that such conflict exists.
1. During an emergency, the City is, notwithstanding any statutory or
charter provision to the contrary, empowered, through its
governing body acting within or without the corporate limits of the
City, to enter into contracts and incur obligations necessary to
combat such disaster by protecting the health and safety of persons
and property and providing emergency assistance to the victims of
such disaster. The City may exercise such powers in the light of
the exigencies of the disaster without compliance with time-

consuming procedures and formalities prescribed by law pertaining
to the performance of public work, entering into contracts,
incurring of obligations, employment of temporary workers, rental
of equipment, purchase of supplies and materials, limitations upon
tax levies, and the appropriation and expenditure of public funds
including, but not limited to, publication of ordinances and
resolutions, publication of calls for bids, provisions of civil service
laws and rules, provisions relating to low bids and requirements for
budgets.
E. During an emergency the Mayor is authorized to contract on behalf of the
City for services or for the purchase of merchandise or materials where the
amount of the contract or purchase does not exceed $10,000.00. The
Mayor may take such action without prior approval of the Council and
without compliance with regular purchasing and bidding procedures, but
all claims resulting therefrom shall be audited and approved by the
Council as in the case of other purchases and contracts.
1118.07 Emergencygement Procedure.
A. There is hereby established in the City treasury a special fund to be known
as the Emergency Management fund. Into this fund shall be placed the
proceeds of taxes levied for emergency management, money transferred
from other funds, gifts, and other revenues. . From it shall be made
expenditures for the operation and maintenance for emergency
management. Regular accounting, disbursement, purchasing, budgeting,
and other financial procedures of the City shall apply to the Emergency
Management Fund insofar as practicable; but budgeting requirements and
other financial procedures shall not apply to expenditures from the fund in
any case when their application will prevent compliance with terms and
conditions of a Federal or State Grant of money or property for emergency
management purposes.
B. The Emergency Manager shall, after the end of each year, prepare and
present to the City Council for the information of the Council and the
public, a report of the activities of emergency management during the
year.
1118.08 Shelter in Public Structures.
A. It is the policy of the City that shelters or areas of refuge be incorporated
in all public buildings of the City to the fullest extent practicable in order
to provide protection in an emergency.
B. The City Council shall require that all contracts for the design or
construction of public buildings, including additions to or alterations of
existing structures, incorporate protection for at least the normal
anticipated daily population of the building. The shelter protection

provided for shall meet or exceed the minimum space and protection
criteria recommended, unless exempted from such shelter requirement as
provided in Section C.
C. The Council may exempt buildings or structures from the requirements of
this section where it finds that such incorporation of shelters will create an
additional cost in the construction of such structure in excess of eight
percent (8%) of the estimated cost thereof without shelters so
incorporated, or if it finds that other factors make unnecessary or
impracticable the incorporation of fallout shelters in such structures.
1118.09 Conformity and Cooperation with Federal and State Authority.
A. Every employee of the City shall cooperate with Federal and State
authorities and with authorized agencies engaged in emergency
management and emergency measures to the fullest possible extent
consistent with the performance of their other duties. The provisions of
this Ordinance and of all regulations made thereunder shall be subject to
all applicable and controlling provisions of Federal and State laws and of
regulations and orders issued thereunder and shall be deemed to be
suspended and inoperative so far as there is any conflict therewith.
1118.10 Penal .
Any person who violates any provision of this Ordinance or of any regulation
adopted thereunder relating to acts, omissions, or conduct other than official acts
of City officers or employees, is guilty of a misdemeanor and upon conviction
may be punished by a fine of not more than Seven Hundred Dollars ($700.00) or
by imprisonment for not more than ninety(90) days, or both.
Section 3. Effective Date. This ordinance shall be in full force and effect from and after its passage
and publication according to law.

Recommendation: Appoint Ms.Judith Chirhart to the City Parks Commission subject to the
completion of a standard background investigation by the City Police Department.

The City has received a communication from Washington County Dept for Property Records and
Taxpayer Services requesting that the City enter into an open-ended agreement with Washington
County for property valuation/assessment services.
The County has provided a copy of that Standard Agreement that they would like to execute with
all cities; enclosed—Rates are annually based on the County's standard rate schedule and
number/type of parcels. The fees were as follows in recent years: 2014-$22,608;In 2015 22,715
The Agreement outlines several services to be required by the County and to the best of my
knowledge this document carries on with past practices. There is a however a straightforward
process to terminate the Agreement with 120-day written notice,but options thereafter would be
limited.
Recommendation: Approve Agreement for Assessment Services.

Thank you for partnering with Washington County for local assessment services. This is a great partnership
that serves our citizens well. In the past,assessment service agreements have included expiration dates and
that date is coming soon.
Attached is our standard agreement for assessment services. The agreement reflects our current arrangement,
and ensures a seamless continuance of the existing services and procedures. Functionally,there are to be no
changes. Administratively,the new agreement is an ongoing agreement that directs the County Assessor to
perform assessment services until otherwise directed or terminated by either party. Minnesota statutes 273.072
allow us to enter into a rolling agreement with a termination clause rather than continually renewing fixed term
agreements to reduce administrative burden. Under this statute either party may terminate the agreement with
a six-month notice.
Please have your city council or township board review and execute the enclosed agreement. Signed
agreements may be returned to me by June I'in the enclosed envelope. If your organization requires a fully
executed copy of the final agreement please mail two copies and we will return one for your records.

AGREEMENT FOR ASSESSMENT SERVICES
THIS AGREEMENT, made and entered into this day of , 2016 by and between
the City of Oak Park Heights, a Minnesota municipal corporation,herein referred to as the City, and
Washington County, a body politic and corporate, herein referred to as "Washington County"pursuant
to the authority contained in Minnesota Statutes 471.59,which authorizes the joint and cooperative
exercise of powers common to contracting parties and Minnesota Statute 273.072 Subd. 1, which
provides that a county and city or town may, by agreement entered into under 471.59 provide for the
assessment of property in the municipality or town by the county assessor.
WITNESS:
WHEREAS, the City desires to retain Washington County and the Washington County Assessor
to perform assessment services for the City; and
WHEREAS, Washington County desires to perform assessment services required by the City;
and
WHEREAS,the City and Washington County deem it mutually advantageous to set forth the
terms and conditions of their relationship in writing;
NOW, THEREFORE, the parties hereto agree that the following shall constitute joint agreement
for assessment services:
SECTION ONE-PARTIES
The City hereby contracts with Washington County to perform, and Washington County hereby
agrees to perform,the assessment services hereinafter described.
SECTION TWO-SERVICES
Washington County Assessor shall perform all assessment services required by State statute and
the City. Such services shall include,but are not limited to the following:
a. Appraisal of all real and personal property located within the City.
b. Interprets regulations,rules and legislative changes to the City Council, Realtors,
bankers, citizens and civic groups as necessary or upon request.
C. Answers questions/concerns regarding property values and classifications.

d. Draws and calculates"splits" of real estate sales reflective of joint ownership of land
parcels.
e. Maintains a listing of the assessment of each and every parcel of property within the City.
f. Each parcel of property within the City shall be reviewed at least once every five years.
It is the intention of the parties that the Washington County Assessor shall make every
effort to view and revalue approximately one-fifth of the parcels during each year that
this Agreement remains in force.
g. Holds and staffs an annual Board of Appeal or Open Book Meeting. The format of this
appeals meeting will be at the discretion of the City and guided by Minn. Stat. § 274.01,
subd. 1.
h. Interprets and applies regulations,rules and legislative changes to other appraisers, real
estate professionals, citizens and civic groups, other governmental bodies and personnel
as necessary and upon request.
i. Answers property owner questions/concerns regarding appraisal practices,property
values and classifications. Draws and interprets maps, charts and other descriptions to
assist property owners in understanding the process.
j. Develops land and building valuation schedules; conducts statistical analysis to support
appraisal decisions, and oversees Computer Aided Mass Appraisal system(CAMA)table
adjustments; and draws and calculates "splits"of real estate and new plats of property,
including land areas, classes and valuations. Conducts statistical surveys to support
appraisal decision e.g., current sales study using the CAMA system.
k. Coordinates research of complex appraisal issues,reviews, investigates and makes
recommendations on applications for abatement or other reduction of assessed value.
1. Coordinates collection of sales information and annual assessment activities in apartment,
commercial, industrial, residential and personal property markets.
m. Coordinates the valuation and classification of exempt properties, including interpreting
laws applying to exempt organizations and processing exemption requests.
n. Manages state tax court petitions and coordinates TIF assessment functions with the city.
Provides values to city for various projects in which there may be an assessment
agreement.
o. Investigates and handles all applications for abatement or reduction of assessed value.
P. Provides a report of assessment activities (Assessment Report) each year prior to the
appeals period.

SECTION THREE-AGREEMENT PRICE
The City shall pay a fee to the County each year for assessment services based on the parcel mix
located within each community. The assessment fee schedule is approved by the County Board each
year and establishes the fee associated with each property use. The County will utilize the same fee
schedule for all of its contract communities. The City will be billed for assessing services upon the
completion of the assessment cycle. The County will provide an invoice to the City no later than June 1
of each year payable on or around July 1.
SECTION FOUR-INDEPENDENT CONTRACTOR
It is understood and agreed between the parties that the Assessor is an independent contractor
and not an employee of the City. The Assessor shall be responsible for furnishing its own
transportation,books and any other documents or items of personal property required to perform the
services. The City shall not be required to maintain any insurance coverage needed in connection with
the performance of the Assessor's services, including but not limited to automobile liability insurance,
workers compensation insurance and public liability insurance.
SECTION FIVE-DURATION AND TERMINATION
This Agreement shall commence on July 1, 2016 and remain in force until terminated by either
party giving the other party a six-month written notice of its intent to terminate the Agreement per
Minnesota Statute 273.072 Subd. 4.

(this is actually a permitted increase without need of Council approval. This Fee is based
on County Tipping Fee Rates)
2. An inflationary Adjustment to their Collection and Recycling Fees of 2.8%
(they have stated increase personnel and other inflationary costs)
3. An Increase to the Yard Waste fee of$.90 per month.
(they have stated that their compost site options have seen rate increases)
4. Appliance Fee(Large Items) increase from$.26 to $.41 per month
(they have stated that their costs to manage MATTRESSES has doubled from $15 to $30
per unit.)
The current contract does allow Tennis to seek rate adjustments from time-to-time subject to the
final approval of the City Council.The City however is not obligated to approve any rate increase
other than the adjustments to the Disposal Fee as this is a simple pass through from Washington/
Dakota County Res. Energy Center. If these requests were approved, the total price increase
to the City would be approximately $17,705 per year above 2015 rates and is over 10%
increase.
In reviewing this request the following is known.
• The adjustment for the Disposal fee of$.06 per month is required to be paid by the City;
this can vary annually based on County rates.
• The City is not obligated to pay a CPI adjustment under the current Agreement, but the
City has provided small adjustments in the past. That said the CPI for Private
Transportation Minneapolis/St. Paul is<0%and does not justify any rate increase. (See
enclosures from the Fed. Reserve bank of St. Louis).

• The City does not specify nor require that Tennis take the yard waste to any given location
and is a risk Tennis accepted when it submitted its bids for the current 5-year contract.
Tennis is also obligated to ensure that there is not solid waste mixed in with its materials
as delivered.
• The fee increase for the Appliance Fee stems from the change in rates from the Washington
/ Dakota County Rec. Energy Center where they have increased their disposal and
processing of mattresses from $15 per unit to $30 per unit. Like yard wash the City(nor
the County) does not require that mattresses are delivered to this site and Tennis simply
should find another location. However, unlike yard waste or recyclables the recovery
and/or disposal of mattresses is complex and not easily performed making the County
facility likely the sole option. So, perhaps this is fee is unavoidable as there are few (or
perhaps no other options) and Tennis would not profit from this rate adjustment
In discussing these facts with Tennis Sanitation,they have since amended their request to simply
focus on the Disposal and Appliance Fee adjustments. If these were approved the City's annual
cost would be 1.97%+/- over 2015.The City did plan for a 3%increase in the 2016 General Fund
Budget/levy.
Recommendation: Authorize the approval of two rate increases effective 1/1/16 an
Appliance Fee adjustment of$.15 per month and affirm the Disposal Fee Adjustment of$.06
per month.All other rates will remain as is.

Effective January 19; 2016 our yard waste rate will increase from $5.00 per yard to $9.00 per
yard which is an 80%increase.As a result,we are proposing to increase our rate for yardwaste
to$ .90 per month.

Tennis Sanitation is requesting a CPI rate adjustment of 3%which equates to$.19 per home
per month. We have incurred increased costs in health care, insurance and labor costs.

ITEM 5: Recycling Rebate
Over the past three months, we have been experiencing 10 year lows in commodity values.
The City of Oak Park Heights averages 25 tons per month and the net value per ton after
processing has been averaging ($4.00) per ton. This results in a monthly cost of$100.00 per
month, The City has not received any invoices for commodity adjustments because Tennis
Sanitation has decided to absorb these costs.
Tennis Sanitation takes pride in providing great service to our customers. As part of providing
great service — it is important that we pass-on justified disposal increases to maintain the
quality of service that you come to expect.

1. What is the Ramsey/Washington Recycling and Energy Board(R&E Board)?
Tsar is the new name for the Ramsey/Washington County Resource Recovery Project Board.

2. Who will own the facility in Newport?
The counties have decided that the Newport facility will be owned by the Ramsey/Washington
Recycling and Energy Board (R&€ Board).
3. What needs to be done to complete the sale?
RRT and the R&E Board have entered into a Purchase Agreement.There are several conditions
that have to be met for the deal to be completed.The target date for deciding that the
o:)nditions have been met is December 3,2015.After that, and before the end of the year,the
sale would be closed.
One of the conditions to be met is for the R&E Board to be assured that it has enough waste
under contract to operate the Newport facility and meet its obligations.That is why we art?
working hard now to secure commitments for waste delivery agreements.
4. Who will haulers contract with for waste delivery to Newport?
Waste delivery agreements will be between the R&E Board and waste haulers for delivery of
waste from Ramsey and Washington Counties.
S. Will there still be hauler rebates?
Yes,for 2016—2017,the R&E Board will continue to provide rebates.A decision has not been
made for 2018+.
6. What will be the tipping fee and rebate amount?
The tipping fee for 2016—2017 for all waste coming into the Newport facility will be$70.00
per ton.The tipping fee for 2018+has not been established.
The R&E Board will provide rebates to haulers that deliver waste from Ramsey and Washington
Counties to the Newport facility at the rate of$12.00 per ton for 2016 and 2017.That means
that the net cost to haulers under a waste delivery agreement will be$58.00 per ton for 2016-
2017.The rebate application process will remain the same as previous years.
There will be certain special charges,such as for mattresses,tires, and appliances that are

Re: Trail Crack Route and Seal -2016
The City contracted with Fahrner Asphalt to route and seal trail cracks on the trail system in
2015. The estimated quantity necessary to complete the whole trail system fell about 8,000 LF
short—so the work was not fully completed in 2016. Fahrner quoted the same cost of$1.60 per
LF to complete the remaining 8,000 LF,an estimated expense of$12,800.
This work is funded with the budgeted projects Trail Maintenance budget which has a balance
of$97, 694. Crack sealing is typically the first undertaking to extend the life of the trail
segment and there are substantial cracks along the trail. I recommend Council authorize
staff to accept the quote and contract with Fahrner Asphalt for an estimated total of
$12,800 to complete crack routing and sealing on the remainder of the trail system.

Ree DNR Water Supply Plan Update
The DNR is the regulatory agency that permits the use of the City wells for the public water
supply. Every ten years,all public water suppliers in Minnesota that serve more than 1,000 people
must have an updated water supply plan approved by the Department of Natural Resources. Oak
Park Heights updated water supply plan is due on December 31,2016. Like past years,the water
supply plan update is a cooperative between City staff and Stantec engineers. Stantec has offered
services on an hourly basis not to exceed$8,550 to assist staff with updating the plan. The project
will be funded from the Water Utility fund—contracted services.
I am recommending authorization to accept Stantec's proposal to assist the City in updating
the plan for an amount not to exceed$8,550.

Dear Andy,
Thank you for the opportunity to serve the City of Oak Park Heights by assisting with your DNR
Water Supply Plan.This letter presents Stantec's proposal for engineering services based on the
task list as detailed below.Stantec will provide a completed Water Supply Plan Template based
on data and guidance provided by the City of Oak Park Heights.
Completion of the Water Supply Plan (Plan) will be a collaborative effort between the City of Oak
Park Heights and Stantec.Stantec will update the Plan template with the available information. A
large number of the required tables in the Plan are strictly data entry that will completed by City
staff_ Once those tables are complete,Stantec will complete evaluations, projections,and
recommend(.',ions as detailed in the tasks below.A meeting with City staff to finalize emergency
response, conservation projects, and other Plan elements is recommended and include in this
scope of services.
A key component of the new DNR Water Supply Plan template is the sustainability of the aquifer(s)
serving the City's wells. As water use conflicts have arisen in the region in recent years, the plan
requires that aquifer sustainability (along with impacts to natural resources) be addressed. Even
cities with no known current water use conflicts will be required to develop a monitoring plan to
ensure that sustainability goals are being met over the next decade
PROJECT TASKS
To assist the City in completing the Water Supply Plan,Stantec will perform the follow tasks:
1. Update the Plan template for the City and provide to the City for data entry.
2. Answer questions from the City regarding data entry as needed.Then review the Plan as
completed by the City,facilitate additional data entry as needed, and compile the required
Appendices.
3. Complete water demand trends and projections,per capita water demand graphs, demand
triggers and priorities,and general capital improvement planning.
4. Stantec will assess the available data on the sustainability of the resources supplying the City,
including reviewing water levels from monitoring wells and any observation points.Summaries
of observed trends in aquifer levels and any monitored natural resources will be provided.
5. Meet with City staff to review draft Plan including suggestions for future water sources,water
use priorities and demand reductions, and conservation measures.
6. Finalize Plan based on City input and provide to the City for submission to DNR.

Tasks not included in this proposal:
1. If the City's water level monitoring plan for Appendix 2 is not sufficient to meet DNR
requirements, developing a new groundwater monitoring plan would be additional services.
2. This scope does not include developing a detailed water system Capital Improvements Plan
through 2040 but Stantec will assist the City with general water system planning required to
complete Table 12.
Stantec can provide a scope and fee for additional tasks if requested.
DATA NEEDS
To complete the Water Supply Plan, a large number of the required tables in the Plan are strictly
data entry that will be completed by City staff. City staff will need to complete the data in the
template word document.The attached Water Supply Plan template is highlighted to identify the
following City responsibilities:
1. Tables highlighted in yellow identify data entry to be completed by the City. (For example,
Table 2-Historic Water Demand)
2. Tables highlighted in green are tables which Stantec will start and provide input for the City to
review, update, and complete. (e.g.Table 6-Water Sources)
3. Tables highlighted in magenta are tables were Stantec can provide suggestions or examples
for City to consider, but the City will need to review and determine City's decision in regards
to these items. (e.g.Table 18-Water Use Priorities)
COMPENSATION AND SCHEDULE
Stantec proposes to provide the City of Oak Park Heights with professional engineering services
required to provide the tasks described.Stantec will provide these services on an hourly basis not
to exceed$8,550. Reimbursable expenses are included in this proposed figure.Stantec will bill our
time in accordance with the current rates under the master agreement with the City of Oak Park
Heights.Stantec will not exceed the hourly amount without prior authorization from the City.
The DNR requires the City of Oak Park Heights Water Supply Plan be submitted through the MN
DNR Permitting and Reporting System (MPARS) by December 31,2016.Stantec can begin work
once initial data entry by the City is complete and will provide a complete Plan within 3 months
thereafter.

I would like the City Council to discuss approving a communication from the City with the Mayor to sign
to MNDOT requesting that they examine the number of accidents that is occurring at the temporary
intersection of STH 95 and STH 36 and offer analysis as to why this may be occurring and any options to
reduce such incidents.
Generally,there appears to be an unusual amount of incidents at this location and may be due to how it is
signaled—such as with the use of a flashing yellow arrow.

Enclosed is a beginning draft of AIR B&B-type ordinance ;amendments. Some highlights include:
1. These operations would be permitted via the issuance of a CUP following a standard process.
2. The rules generally follow similar conditions as a Bed and Breakfast.
3. Would be permitted in all Residential Districts,but only in a single family dwelling.
4. This version also would allow the rental of single bedroom within an owner-occupied home.
Staff is in need of any generalized feedback as well begin to plan for a Public Hearing/adoption timing.

REQUIRED DEFINITIONS:
1. Transient Lodging:A building or facility constructed solely as a single family home not occupied by
the owner and where compensation of any kind is provided to the owner or their designee in
exchange for periodic lodging to transient guests.
2. Transient Guest(s):A person or persons who maintains a permanent residence not in the transient
housing and rents or occupies a room or home far a limited duration of less than thirty-one days.
Transient Lodging would be permissible via a Conditional Use Permit in all Residential Districts providing that
the following criteria are met:
1. Only a detached single family home may be utilized as a transient lodging consistent with the
terms and conditions found herein:
a. The parcel on which the facility is located shall accommodate at least three thousand(3,000)
square feet of lot area per bedroom unit. Not more than two persons may occupy any one code compliant
bedroom and total occupancy capacity may be calculated via the established number of compliant
bedrooms.
b. The facility shall have a State issued license for lodging and/or food service, and/or comply
with and maintain all health, safety, building, and fire codes as may be required or applicable by the
Building Official. The owner is responsible to ensure the facility is code compliant.
C. The owner or other non-transient guests may not occupy the structure while such facility is
being utilized as a transient lodging facility by more than two transient guests at any one time. Only one
bedroom may be allocated to the transient guests while the site is occupied by the owner or other non-
transient guests.
d. All bedroom units shall be established within the principal structure.
e. The principal structure of the facility being used for transient lodging facility housing shall
have a minimum size of one thousand seven hundred fifty (1,750) gross square feet and at least one
bathroom (consisting of a shower, toilet and sink)for every four persons occupying the facility.
f. No transient lodging facility shall be located closer than at least nine hundred(900)feet from
other bed and breakfast facilities and/or transient lodging as measured from property lines.
g. Dining and other facilities shall not be opened to the public but shall be used exclusively by
the registered guests of the facility.
h. Two(2)off-street parking spaces shall be provided for the facility plus one for each bedroom
over two bedrooms. No parking spaces shall be located in the front yard of the property, other than on an
existing driveway. All parking areas shall be improved with asphalt, but shall be exempt from other
commercial parking requirements of the Zoning Ordinance.

i. All signing and informational or visual communication devices shall be in compliance with
Section 401.15.G of this Ordinance and/or as may be restricted by the City Council.
j. Adequate lighting shall be provided between the principal structure and the parking area
for the safety of guests. All external lighting shall be regulated by conditional use permit.
K. Any excessive occupant noise reported to the City and in violation of City Code shall receive
a warning on the first offense and eviction by the owner on the second. Continued violations shall be
grounds for the suspension or revocation of use permits
I. All transient lodging conditional use permits may be reviewed, including site inspections,
by the Community Development Department at any time. If violations of City ordinances, Building
Code, or conditions of approval are found, the Community Development Director shall schedule a
public hearing of the Planning Commission to review the conditional use permit and conditions. Upon
a Planning Commission recommendation, the City Council may revise or cancel the conditional use
permit.
m. All solid wastes, recycling and/or related wastes generated from transient guests shall be
independently disposed of by the property owner and not remitted into the City's systems without
separate written approval of the City.
n. No transient lodging shall be supplied to any one occupant or group of occupants for more
than ten consecutive days or for more than twenty days in a thirty-day period.
0. Any applicable lodging or room tax as established by City Ordinance shall be paid by the
owner of the property to the City.
