SASCA has proposed that walkers, hikers,mountain bicyclists,and runners would all likely be able to use these trails but would be mainly for mountain bikers and trail runners in the summer and possibly fat tire snow biking and snowshoeing in the winter. Lastly SASCA would be the party responsible for initial construction and continued maintenance of all facilities, The Stillwater Area Scholastic Cycling Advocates (SASCA), a 2014 formed non-profit limited liability corporation and currently recognized 501c(3)non-taxable charity and is the support and funding provider for the Stillwater Area High School Mountain Bike Team. Staff has attempted to summarize the issues that would appear immediately apparent; but please note - this document is not a "EIS" Environmental Impact Statement, a deep scientific nor a tool that is universally comprehensive. 1 of 137 Staff Memo-MT Biking Trails Use of the Trails: As indicated in the submitted document and summary the SASCA group would like to install approximately 2.5 miles of single track mountain biking trails within Valley View Park—lying east of the park Shelter. The proposal would be staged in a two-year timeline and would also include a trail-head and informational signage and bicycle repair station. SASCA and MORC proposed that their entities would fully fund the construction of all elements consistent with the IMBA(International Mountain Biking Association)protocol and best management practices as outlined in the Proposal and generally includes:limiting trail grades to 10%,protecting from erosion,no living tree removals of any size greater than 4"in diameter. Exhibit 2 contains such deed secured by the Office of the City Attorney and does not contain any use restrictions or directives. The City's recent(2008)Comprehensive Park Plan generally,as well as the specific Valley View Elements outlines the following: Generally: Provide opportunities for all ages to participate'in lifetime fitness through the use of trails,tennis courts,cross- county skiing,and other activities. Develop recreational and environmental education programs to familiarize people with the parks. Decide if and how coordination with the recreational needs of the County,athletic associations,civic groups, etc.can be accomplished. Define the means by which park development can minimize impacts on adjacent properties, i.e., off-street parking,screening, landscaping,setbacks,etc. Valley View Park: • Identify park boundaries and aid visitors in locating picnic and trail facilities with improved signage. Allow safe access to the lower area of the park with an improved trail system. Develop recreation and environmental education programs that would familiarize people with the park. PARKS PLANS from 2008 Master Plan "Valley View Park is valued for its dense vegetation, variation in topography, and wevanas. The master plan proposes to maintain and enhance the natural aesthetics of the park. Improvements to the park focus on making the park more visible in the community and St. Croix Valley, more accessible, and as a continued resource for environmental education. The proposed improvements to the park,as listed below,will maintain and update the facilities that are already present Creating a more inviting entry with landscaping will more clearly identify the park at its entrance on Osgood Avenue. Once people enter the park,signage identifying park boundaries and facilities could aid visitors in locating picnic areas and trails. Currently,many people are unaware of the lowerportlon of the park due to lack of signage and the physical separation from the upper portion of the park. The amount of recreational area will increase substantially in this area when Xcel closes and caps the A.S. King Plant Ash Landfill in 2011..." Relative to the Oak Park Crossing Park, The City's agreement with Xcel Energy as executed in 2012(Enclosed here as Exhibit 3)provides a license across such lands for park purposes that"do not penetrate of disturb the surface"and exists through December 2061. This is interpreted to mean that the City may utilize any portion of the property for reasonable recreational purposes that correlate to a City park use. However, the City cannot make ground elevation changes to the Property or construct any trails without confirmation by Xcel/ MPCA with confirmation that"fly-ash" geomembrane cap functionality will not be impacted. Based on the submitted concept plan,the areas proposed to be utilized are not within the CAP area and should in no way impact cap functionality directly. In addition, the proposal outlines and intends to generally utilize the already established gravel roadways. Appropriate signage requiring that riders remain on the trails, as well as keeping the 4 of 137 Staff Memo-MT Biking Trails established trail-ways clean, debris fee is an ongoing requirement of both the Agreement and what the City would expect from the applicant. Coordination with Xcel Energy will always remain a requirement. Impacts on Wetlands: This report cannot begin to engage the deep regulatory circumstances that regulate activities in wetlands. Local,State and Federal rules are applicable.What we do know is that there cannot be general construction activities in a wetland. Or, that may cause a detrimental impact(s)to wetlands. Communication with Bureau WSR, The U.S. Army Corps or Minnesota DNR may be needed if there is any planned construction in a wetland.City Ordinance 406.060 similarly has restrictions on lands Within a BUFFER AREA adjacent to a wetland. However, the City may permit the development of (impervious) trails within 15' upslope of the wetland 406.090. City Ordinance 406.020. B. further outlines that wetlands should be protected but seeks to allow a reasonable use. A cursory comparison with the DNR Wetland Inventory Maps-as above—which is the best data available remotely- the proposed routes appear—and based on the mapping scales available at this time-to show that there is some very limited activity within wetlands. As a final layout is determined a wetland delineation may be required if there is any apparent encroachment into the wetlands and/or the 15'upslope setback. The fact that there is a wetland impact does not mean that a facility of this type cannot be constructed within it but should any construction be proposed —appropriate permits would first need to be secured. Many Minnesota State parks—for example- have trails and much larger projects adjacent, through and across wetlands—See Exhibit 4 or http://www.dnr.state.mn.us/weUandsivisit.html. One of three gmeral options would need to be pursued prior to final develo meat: 1. Adjust the layout in areas so as to avoid wetlands. 2. Wetlands could be utilized, but there could be no"development"of a trail other than mowing or very minimal stabilization. 3. Secure required permits for more advanced or more impactful development in such areas. 5 of 137 Staff Memo-MT Biking Trails Impacts on Watersheds: The area in question is within the jurisdiction of the Middle St.Croix Watershed Management Organization. Similar to the above State agencies a construction permit may be required by the MSCWMO.Two points to note: 1. The MSCWMO rules are also triggered by a change in use of the lands.The land is already designated park and hosts hikers, geocachers,walkers, dog walkers,etc. The addition of mountain biking_ is a park amenity and does not constitute a change in use at the macro scale. 2. The MSCWMO rules are also triggered by the addition of new impervious surfaces which will require pre- treatment such as upon a new parking lot. As there are not any planned impervious surfaces proposed nor is there a change in land-use type (such as from undeveloped to a commercial use)the MSCWMO generally would not have any permitting requirements with a plan of this type. That said, a copy of the plan has been supplied to the MSCWMO for review and their initial commentary is enclosed(See Exhibit 5).Generally,no additional review is needed if the pian remains out of wetlands and if only hand tools are utilized. Impact on other Park Users: Much of the area proposed for the mountain biking trails is currently not utilized from an activity-use and there should not be any conflicts with other park users. The off-paved trail development will limit the interaction between walkers, bikers and traditional trail users. SASCA has outlined that they will install signage to ensure that such riders provide right-of-way to walkers. Impact on Adjacent Properties: Other than one residential property at 15336 576)Street,much of the trail will likely not be close to neighbors nor readily visible from adjacent properties. Staff cannot comment on the character or content of each individual trail users, however in communicating with the City of Woodbury and Inver Grove Heights—their experience at Carver Lake and Harmon Park (respectively) has been positive for the greater community, see Exhibit 6. The one property owner mentioned has submitted a letter of support for this proposal and is enclosed in the above Exhibit 6. Visual impacts to the west of Valley View Park near the parking area should be limited as there is a 6'high fence and a wooded area between such homes and the parking area. Staff would not anticipate people visiting the park with mountain bikes in tow to create noise or other disturbances that would be impactful. It is possible that with additional visitors to the Park,based on this type of use,a perception of isolation may be reduced and security will be enhanced. Impact on Parking and Vehicular Traffic: The SASCA group has proposed that those utilizing the trails,and reaching the area by car to park in Valley View Park as shown on the Plan Revision. Valley View Park has adequate parking at the overtlow lot and which is largely unutilized.There may be an occasion when Valley View Park is rented-out for a large event and parking at the site will be challenging, however based on several years of rental data this may occur once or twice per year. Parking will be encouraged within Valley View Park and access to the trails will only be from designated trail areas. As this trail system is 2.5 miles in length,use likely will be limited compared to much larger trail systems in Woodbury or other regional park systems. Lighting: There is no planned lighting of the trails,trail head or any other aspect of this proposal- nor is use after dark permitted. Access&Hours of Operation: City Park and Trail Hours are:From October 1st through April 30th the park hours shall be from 6:00 am of until 10:00 P.M. of each day. Between May 1st and September 30th the park hours shall be between 5:00 am 6 of 137 Staff Memo-MT Biking Trails and 10:00 pm. These rules would be applicable to all areas of the proposed mountain biking trails. The City may want to offer a prior window of closure- see conditions. Signage: Many trails of this nature are to be marked showing curves,or sloped areas as well as rules of the trail-ways and rider etiquette. In addition, many trail-ways systems have an established trail-head with a similar posting of rules and direcWn travel,SASCA has prop such a trail head similar to items shown in Exhibit 7.Signage mast only be for informational purposes only and not generally meant for un-related advertising. Liability—Assumption of Risk: In communicating with the City insurance carrier—the League of Minnesota Cities Insurance Trust.Unlike a skateboard park, the City would have no material liability premiums to incur as a result of this proposal and would be a covered activity. See Exhibit 8. It is important that there is appropriate signage outlining that there are inherent risks in such activity,but no additional or supplemental coverages are required to be secured. Recommendation. With these known conditions, there appears to be limited dsk to the City for allowing the proposal to proceed from a cost; management and/or liability standpoint; and that theme are not environmental conditions that would be impacted and the development of such facility would appear to mesh well with gaining more access to the lower areas of the Park as outlined in the Park Master Plan while maintaining It landscape and natural elements. The concept would offer another low-cost amenity In the City`s Parks. In addition, at only 2.0 miles it wouldseem logical that the trails will not be a major regional draw,but will be a viable localized amenity for those ingested in the sport of mountain biking including the local high school team. H the Park Commission would prefer to provide a recommendation supporting the proposal the following conditions should be considered as prerequisite,however if the Commission does not desire to take an action of support for advancement to the City Council and does not support such proposal similar motions can of course be made. Goal To have at least 2+ miles of sustainable single track trail open for use by September of 2016 in Valley View Park and a full build out of 5 miles by September 2017. In late 2014,Eric Johnson, City Administrator of OPH, contacted SASCA about the possibility of land for trail building in and around Valley View Park. SASCA was in the middle of getting approval for a trail build in Brown's Creek Park Reserve in Stillwater. By May of 2015, it was made clear that approval would include new restrictions brought to the City's attention very late in the process.Negotiations halted immediately and work stopped on approval. SASCA turned to the offer made by OPH. The past several months have been spent evaluating the park, dividing it into build sections and confirming areas that can be used and areas that cannot. This proposal has been developed to offer a summary overview of how the trail would look in the park and how it would mesh with the current trails and other amenities in the park. With approval to build, SASCA, already organized as a 501c(3)non-profit organization,proposes to work in consultation with the P &R Commission, OPH City Staff and MORC(Minnesota Off-Road Cyclists)to finalize the building process and work to raise money for expenses incurred to complete the work. Soil erosion concerns at Valley View will be addressed by trail design. The proposed trail will adhere to state-of-the-art design standards developed by the International Mountain Bicycling Association(IMBA)to promote long-term sustainability of trails by minimizing soil erosion potential, reducing future maintenance needs, and eliminating trail users' desire to create shortcuts or social trails. This proposal details anticipated use of many resource- compatible techniques in construction of the new trail miles. The current and future SASCA members have limited but increasing trail building experience and plan to use the first phase of building trail to learn from MORC representatives about the process. Many volunteers are already registered for official IMBA trail building classes to be held once every month in the summer in close proximity to the Midwest. The area selected and level of difficulty of the trail planned means simple and faster building. It will allow the group to amass quality volunteers and teach them on the job about proper building techniques and utilizing the tools safely and properly. February 17,2016 Page 14 12 of 137 Staff Memo-MT Biking Trails SASCA—ValIey View Single Track Natural Trail Proposal Rev. 1 Qualifications Training Some of the current members have limited trail building experience. Training may consist of working with other volunteer groups in other towns to get experience with maintenance and new trail extension building. Most trail building experience will be born out of training support from MORC. The intent would be to set up a few"training sessions" where the process of building the trail would be learned by working slowly, deliberately and under the close direction of the leader from MORC. Most if not all of the first mile of Section E trail is in an area deemed "easy" for building trail. In some cases,the enact location of the trail will be more difficult than the simple clearing of surface cover"duff' exposing the hard- packed dirt underneath. Only later in the trail, weeks after starting, will a few small bench cuts need to be executed. At these points, experience will be called upon from MORC for advice and guidance. IMBA and MORC do host training seminars and building seminars in the field. Some cost money and some are free. The timing of the building is such that these types of educational opportunity will have to happen as the first phase is being built. Again, the simplicity of the trail will allow for"on the job training"to be both successful and realistic. Experience SAS CA will utilize the experience MORC (Minnesota Off-Road Cyclists). This is ;, non-profit full of volunteers, experienced dirt crews and trail designers. Kinnikinnic Off-Road Cyclists(KORO) also have a home trail called Whitetail Ridge in River Falls, WI. There are personal connections through the Stillwater High School Mountain Biking Team and the Chilkoot Cycle Club which can and will be called upon for advice and support. Equipment The proposed trail will be constructed with specialized hand tools owned by the organization,private volunteers or possibly a trailer of tools lent out to SASCA by MORC. Various rakes, shovels, and machetes, hand saws: clearing leaves, twigs, and briars Gas powered plate compactor: tamping loosened trail to stabilize trail surface and "season"trail much faster and more completely than riders Chain ,Saw: gas powered,minimum 14", for cutting large brush and clearing larger fallen trees February 17,2016 Page 18 16 of 137 Staff Memo-MT Biking Trails SASCA—Valley View Single Track Natural Trail Proposal Rev. 1 General Trail Construction Guidelines SASCA understands and acknowledges the concerns about potential soil erosion at Valley View. With this in mind, the trail should be designed and constructed with those concerns taken into account using suggested resource compatible guidelines. Grade half-rule: The trail tread linear slope on a hillside should not exceed half of the average grade of the slope. In other words, on a 10% grade hillside the trail would not be steeper than a 5% grade. This practice results in water flowing down the hillside rather than being channeled down the trail. No trail section Valley View should be constructed to exceed the half-rule. Ten percent average maximum grade: This is a rule of thumb that may have to be lowered to reflect soil types,watershed areas, and vegetation in order to stay within erosion control limits. Allowing for short lengths of trail that may exceed 10%,the overall average grade should be less. This will probably not be an issue at Valley View, specifically at the Phase One location and probably within the boundaries of the entire part due to the flatter and rolling terrain. Maximum sustainable trail grade: When a section of trail becomes unsustainable even if less than 10% grade,due to drainage or erosion concerns, the trail should be re-routed or other controls instituted to eliminate the problem. Experience gained from the Carver Lake Park trails indicates that when the half-rule is followed,trail erosion is very minimal. February 17,2016 Page 19 17 of 137 Staff Memo-MT Biking Trails SASCA—Valley View Single Track Natural Trail Proposal Rev. 1 Grade reversals: A frequent change from climbing to descending to climbing again prevents a long section of trail from accumulating water runoff that would degrade the trail or encourage erosion. Out-slope: The trail tread, of approximately 18 inches in surface width and used by feet and tires, when appropriate, should have 5% out-slope to slow water flow without cutting rills. This grade is level enough for hikers to use without turning their ankles and along with a full bench-cut, will prevent trail creep. Armoring: Using stone, wood,or synthetic materials,trails in wet or highly erosion prone areas can be made more durable. It is highly unlikely armoring will be needed in this location at Valley View. Restrictions The proposed trail takes great care to give a wide berth from the private property, wet areas and steep ravines and drainage areas in the park. No official restrictions are known of after initial questions to City staff. IMBA guidelines suggest not cutting any living trees larger than 3"to 4" at the base. It will require no maintenance by the OPH city maintenance departments. Volunteers provided by the organization will conduct all necessary maintenance. MORC renrecentativec and SASCA tnemherc have made a nreliminary exnminntinn of tnnnsrmnhical maps, aerial photographs, and have hiked the area being considered in this proposal. While general references can be made to the terrain found in the proposed trail area, specifics relating to the exact trail location and needed or desired features will require on-site measurements and examinations and will likely be altered during various stages of the design process. SASCA intends to work with the city and the Parks Commission during every step of this process. Preliminary trail routes have been determined based on proper elevation lines and with respect to potential erosion Markers have been placed and trail has been hiked several times to determine "best line" scenarios and route re-alignments to enhance the riders' experience within the park, i.e. large trees, rock formations, historic locations. Step One: Obtaining permission. The hope is that this written proposal, followed by a physical inspection of the proposed trail location by City/Commission staff, will result in approval for SASCA to finalize trail design and later construction activities. An open house for the public,to see the proposed trail, learn about single track trails, see how they are planned and built and how the trail would be used, would be on display. No trail construction will begin until the proposed trail corridor is clearly identified and approved by city staff;the commission and city council, if necessary. Step Two: Defining boundaries. Valley View Park is very well defined with very specific sections. The park can be divided into 4 to 5 distinctive sections(see addendum map). They are naturally and logically divided by water, current asphalt trails and large ravines. Step Three: Definition of Users. Beginner to intermediate mountain bicyclists and middle school/high school racers are expected to be the primary users of the proposed new trail. Secondary users will be trail runners in the summer months and possibly winter fat tire bicyclists and snowshoers in the winter months. Winter mountain biking is growing sport. In any and all cases, alternate sports will have to be considered but never to the detriment or damage of the trail itself. Step Four: Define control points. Control points include the beginning and end of the trail, interesting terrain features, or areas that should be avoided. A positive control point is one created by placing the trail so it takes users to a desirable place such as a scenic overview or optional trail feature that adds challenge or requires greater than normal skills or efff-oort to traverse. A negative control point is one that should be avoided such as a boggy area, site boundary, or in this case large ravines and the water drainage feature in the middle of the park. Buffers can be used to disguise or discourage access to protected areas. Buffers can be existing tree fall created by moving limbs or vegetation to block access. There is no need for barricade-type buffers on a trail that is designed and constructed such that it is more enjoyable for the user to stay on the trail than it might be to leave it. Control points will be defined in greater detail once the location of the trail corridor is determined. Every effort will be made to avoid negative control points. The proposed section trails would travel and transition through each section, one by one, with options to repeat sections or skip and move to other sections. The trail has long runs with small turns and shifts to enhance the ride with natural formations like trees,rocks and elevation changes. The turns are generally wide and sweeping to keep erosion to a minimum. The whole trail returns the rider to the original start. Along the trail, there will be short connectors to shorten the loop. There are more open sections which may allow for extension loops, alternate trail and bypassing. Step Six: Plan contour route. The topographical map indicates at least 110 feet of elevation change from just above the water level to the highest point in the proposed trail area. In order to minimize or eliminate soil erosion, a primarily contour route will be used; however, a contour route does not preclude elevation change. Climbing and descending are accomplished by traversing slopes rather than following the fall line. Elevation changes should be designed to not exceed 50% of the existing slope grade so as to not channel water from its natural flow, which is straight downhill. Numerous grade reversals will also prevent water from accumulating or flowing along the trail. A grade reversal is a change from downhill to uphill over a short section of trail tread and will force water to flow off the downhill edge of the trail. All trail tread should be bench-cut into the side of the existing hill for the full width of the tread. This practice prevents trail creep and minimises future maintenance. With a flatter section of land, gradual slopes which follow the natural elevations changes of the land, will be used over longer stretches. The trail, at almost all times, will be an on very slight slope and be slightly pitched perpendicularly to the direction of the trail. Pooling of water will be kept to an absolute minimum. SASCA envisions a narrow corridor with long runs and wide turns. Some sections may be more tight and twisty, especially in the wooded areas. This will change the riding pace through the course from fast on the straights to slow with obstacles and tight turns. The flow essentially will follow the natural flow of the land, making the trail neither especially easier nor more difficult than what the land provides naturally. Step Eight: Establish the corridor. This will entail marking a potential trail with marker flags and ribbon, measuring slopes, evaluating the course, and identifying control points that may call for re-routing the initially conceived route. The trail design should adhere to IMBA's five main points for designing and constructing sustainable trails. These main points are explained in more detail later in this report under the "Erosion Control Measures"heading. The initial marking of the trail is done with marker flags or ribbon placed in or near the presumed center of the trail tread, at close enough intervals so that the general direction of the trail is evident. This might be 30' or more apart. Step Ten: Construction plan. Once the final route is designed and approved by the city/commission, a construction plan will be developed identify areas needing bench cuts, specialized turning features, or erosion control structures and include a time frame for construction. Step Eleven: Flag the final approved alignment and confirm permission to begin construction. February 17,2016 Page 115 23 of 137 Staff Memo-MT Biking Trails SASCA—Valley View Single Track Natural Trail Proposal Rev. 1 Construction Process SEE THE REVISED CONCEPT PLAN (4-20-16) - ONLY 2.5 Miles The construction process will begin with a full thaw of all trail land and a proper drying out period. This can occur as early as April or as late as June. The assumption is the land would be ready for work on or around May 15"'. Section E would be the proposed first trail in the park. The trail length would be approximately 0.75 miles. This would be followed by Sections C, D, B and then Al and A2. The plan would be to finish E, C and D before September 1, 2015. All subsequent trail building of Sections Al and A2 would occur in late 2016 if weather permitted or in Spring/Summer of 2017. Organizing of building teams. Building teams would consist of able-bodied people, generally aged 18 and older,no adult approval needed for the volunteering. A typical group would consist of a trail blazer in the front,marking exact locations for digging with temporary flags as little as a few feet apart. The blazer may work on secondary clearing of small live and dead obstructions before the diggers come through. The diggers would be the people with McLeods and Pulaskis,rakes and tampers, exposing the bare ground by removing any grass,dui leaves, semi composted tree waste and wood, and creating the first actual line of travel. The trailing diggers will work more on leveling the exposed dirt and tamp any loosened soils. The trailer will lag behind,working with a clinometer or the like, filling in low spots and making final considerations for creation of drainage culverts perpendicular to low spots to insure no puddling on the trail. Sometimes the trailer will even follow back and forth with a bike to be sure the trail is riding correctly. Groups should change jobs or positions in the line. Generally, the blazer will be a leader and more knowledgeable of proper final line of a trail and may not move around as much. Special teams. To involve as much of the bicycling community in this volunteer project, youth groups,high school clubs or teams,town organizations and general public will be invited to take part. Youth groups,people under 18, will be divided into groups by age and be given much shorter work times and easier conditions in which to dig. The experience of building trail will be much more important for the youth volunteers than the actual yards completed. The inclusion of different groups will foster a greater public ownership and excitement for the final product. Construction would begin with a general cleaning of the ground 18"on either side of the center line of the trail. The general cleaning would be the removal of downed trees and branches, piles of brush, other natural and dead material. No live branches,brush, saplings nor undergrowth would be removed in this step. This work would prepare a suitable path for work to be done on the exact trail. Building Sequence.The building of the trail, while logically built from the start to the finish may not be the course of action taken. Based on weather,manual labor on site,time and general conditions of the land, sections may be selected for building around the entire loop with sections being connected over a period of time. An example might be selecting a wide February 17,2016 Page 117 25 of 137 Staff Memo-MT Biking Trails SASCA—Valley View Single Track Natural Trail Proposal Rev. 1 open area in a wooded section when less or no digging is needed. This might be a section worked on by a youth group or worked on during a hot spell when heavy digging and minor bench cutting may be too rigorous. Work following wet weather may be better pointed in the direction of open prairie areas where the moist and looser soils will respond better to clearing narrow trail of grass roots. Natural Materials. Sections of trail may need to be enhanced with natural materials to better define the trail in certain sections. This may be apparent in more open wooded areas with little or no underbrush. Natural materials would consist of larger downed logs,branches and even whole trunks of dead trees. Some rock is naturally occurring and other is man-placed. These obstructions may be left in place to add to the technical challenge or removed and replaced in a better location for the same reason. A few manmade walls and other rock formations could be used in place, deconstructed and the rock used of other trail purposes or completely bypassed and ignored if the city deems some historic or other value to the structure. Any once-living natural materials would be used with the understanding that they will naturally decay and at some point be replaced or removed with no replacement. Over years, with riders staying on specific trails, growth will be impeded close or on the trail while underbrush will slowly fill in naturally on either side of the trail. Technical Additions. During the trail building process,natural materials may be used for creating safer traverses through potentially wet areas, more technical challenges for the rider or detours to allow for alternate challenges for the rider. After the original trail is completed, February 17,2016 Page 118 26 of 137 Staff Memo-MT Biking Trails SASCA—Valley View Single Track Natural Trail Proposal Rev. 1 teams may be created to make important low bridges over wetter areas, or exposed rooted areas near important trees. Some technical additions may be placed in areas just for the enhancement for the rider. These additions would be made from natural but not necessarily naturally occurring materials. Consideration would be made to insure no chemical treated wood or concrete would be used over natural stone. These structures would be unassuming, camouflaged with natural color and be fully movable and removable if and when necessary (no concreted footings, etc). Removals. While building trail, care will be taken to remove ANY AND ALL garbage, trash,non-naturally occurring waste or dumped material. The volume of this waste will be recorded by volume for city staff to be made aware of quantity. Local nursery specialists will be called upon to train teams to look for non-native and invasive species of trees, bushes, and vines to be removed as completely and safely as possible. Enhancements. Trail markings and a central trail map will be proposed at some point at or near the main trial head for the park. It is the intention of the group to create a list of potential Eagle Scout project "themes" for boy scouts to consider for enhancement of the park. These projects would include volunteer work and possible private and public donations of material and equipment when necessary. NSP also grants to Grantee a 60 foot temporary construction easement, said temporary easement being 30 feet on each side of the above described easement centerlines, said temporary easement shall expire on the 1st day of July, 1968. The permanent easement granted herein gives .the Grantee, its successors and assigns the right and privilege to enter upon the premises described herein at any time they may see fit, and construct, maintain and repair underground pipelines for the purpose of conveying sewage over, across, through and under the lands hereinbefore described, together with the right to excavate and refill ditches and/or trenches for the location of said pipelines, and the further right to remove trees, bushes, and undergrowth, for the construction and maintenance of said pipelines. 2. It is agreed that Grantee shall restore said premises, as nearly as possible, to the same condition as it was prior to the time of said excavation for said sewage pipelines, and in the event of repair or maintenance of said lines, restore said premises to nearly the same con- ditions as practical as it was prior to said excavation. It is further Weed that the Grantee will restore any fencing that is necessary to remove or become damaged during the process of excavating or the subse- quent repair of said lines. 43 of 137 Staff Memo-MT Biking Trails 4 3. It is further agreed that as a part of the consideration of this grant, NSP will not be assessed for the construction, maintenance and repair of the above-described sewer line. 4. NSP, at some future date, shall fill the premises described herein, to an elevation which at this time is unknown, therefore, Grantee agrees that during the period of said filling operation, the Grantee shall raise the sewer manholes in increments of 5 to 6 feet minimum to allow continued filling of the property. The material and labor cost of raising said manholes shall be at the sole cost of the Grantee, and said work shall commence within 5 working days from the date of NSP's written request to perform said work. 5. Grantee, at NSP's request and at the time of ultimate disposal or development of the property by NSP, shall install new sewer lines in locations suitable to the development of the property as determined by NSP. Grantee also agrees to install the new lines at its sole cost and provided, however, that property owners hooking onto said expenses/ lines shall be assessed on the same basis as all other property owners in said village. 6. Grantee hereby waives all claim for loss or damage to said sewer lines which may be caused or occasioned by the filling of said lands by NSP as set forth in paragraph 4 above. 7. Allowed Uses/Restrictions. Use of Property: a) Licensee may use the Property for traditional public park purposes that do not penetrate/disturb the surface. Any park structures shalt be constructed on floating concrete slabs or other non-permanent foundation systems that do not come within one foot above the geomembrane/clay cap. b) Licensee shall make no ground elevation changes to the Property or construct any structure, trails, etc. without confirmation from Xeel Energy and the MPCA that the cap functionality will not be impacted or that an amended closure plan has been approved by the MPCA I 48 of 137 Staff Memo-MT Biking Trails c) The grant to Licensee under Paragraph 1 herein shall extend to Licensee's employees, agents, independent contractors, subcontractors, volunteers, invitees, and suppliers. d) Licensee shall install signage on the Property to notify members of the public and others of access restrictions, access hours, emergency contact information, park identification and other items as set forth in this Agreement.The signage and non- permanent shelter structures that do not come within one foot above the geomembrane clay cap. Licensee shall, ensure all signage and any other items or equipment that are located or installed on the Property by the Licensee for the Permitted Use will be removed prior to the expiration or termination of the Agreement. e) Within the scope of parkland activities of the Licensee identified within its comprehensive plan, the Licensee shall make reasonable efforts, consistent with City Park management practices, to ensure the Property is kept free of rubbish, waste, debris and kept in a neat, safe and orderly condition. Licensee shall also ensure that the Property will be cleaned of any trash or debris and the Property and the surrounding areas will be returned to Licensor in a cleaned and respectable condition prior to the expiration or termination of the Agreement. Upon expiration or termination of the Agreement,Licensee shall reasonably restore the Property to its original condition by removing all aboveground structures,signage and equipment. Licensee may not dispose of any trash, chemicals or other substances on the Property, and may not use any part of the Property for landfill purposes, but may place refuse receptacles upon the property for public use. g) The Property shall not be used in any manner or form inconsistent with the allowed use of the Property stated herein or as may be permitted by subsequent agreements. h) Licensee shall use its best efforts to ensure that all vehicular traffic shall be limited to existing roads on the Property. No motorized vehicles, recreational vehicles,commercial vehicles or trailers shall be parked or stored on the Property by Licensee or anyone else pursuant to this Agreement. No equipment shall be stored on the Property by Licensee. 2 49 of 137 Staff Memo-MT Biking Trails i) Licensee shall bear the entire cost associated with its Permitted Use and securing MPCA approval, if required, for SW-54 Closure Plan modifications; Lieensoes contributions to this effort will be limited to the resources of Licensoes staff. j) Licensor shall bear the cost of closed landfill inspections and maintaining the non- park areas identified in Attachment A. k) Licensor and the Minnesota Pollution.Control Agency (MPGA) reserve the right to approve or deny proposed plan(s)and construction drawing(s)for the Permitted Use. Licensor and the MPCA reserve the right to request modifications to the plan(s)and drawing(s)when it is necessary to protect the Property. 1) Licensee shall use its best efforts to ensure that there shall be no overnight parking or camping on the Property. 4. Insurance. Licensee shall be utilizing this Property for the purposes of a public park. Throughout the term and any extension term hereof, the Licensee shall extend and maintain its insurance coverage for Licensee's operations as to the Property,currently in the amount of One Million and Five Hundred Thousand Dollars ($1,500,000.00 aggregate) and will name Licensor as an additional insured, which coverage shall be evidenced by a Certificate of Insurance provided to Licensor prior to access to and occupation of the Property and annually thereafter. In the event the Minnesota Legislature amends Minnesota Statutes Chapter 466 to increase the statutory limits as set forth therein, the Licensee shall increase the insurance limits accordingly. In addition, Licensee shall maintain workers' compensation coverage at statutory limits. 5. Compliance with Laws, Rules & Regulations. At its sole cost and expense, Licensee shall give all necessary notices and obtain all required permits, licenses, authorizations and approvals and shall comply and ensure that all of its employees, agents, independent contractors, subcontractors, suppliers, invitees and representatives comply with all applicable federal, state and local laws, ordinances, governmental rules and regulations relative to the operations larder this Agreement, including those relating to the preservation of the public health and safety,employment laws,environmental laws, zoning, ordinances, rules and regulations and those within the Occupational Safety and Hazard Act (OSHA). Licensee shall be liable for any fines or assessments levied thereunder against Licensee resulting from its acts or omissions hereunder. 6. Safety. Licensee shall identify hazardous and potentially hazardous area on or about the Property and shall inform its employees, independent contractors, subcontractors, suppliers,invitees and representatives and members of the public so as to safeguard against any and all hazards or other safety risks. 7. Licensee shall provide all reasonable security it deerns necessary to protect the Licensee's permitted uses. Nothing in this Agreement shall be interpreted or construed as a partnership or joint venture between Licensor and Licensee concerning Licensee's operations on the Property. 10. Licensee to Indemnify. (a) (i) As used in this License,the term"Claims"means (1) losses, liabilities, and expenses of any sort, including attorneys' fees; (2)fines and penalties; (3) environmental costs, including, but not limited to, investigation, removal, remedial, and restoration costs, and consultant and other fees and expenses;and(4)any and all other costs or expenses. (ii) As used in this License, the term "Injury" means (1) death, personal injury,or property damage; (2)loss of profits or other economic injury; (3) disease or actual or threatened health effect;and(4)actual damages. Licensee's Sole Risk and Expense. Licensee agrees that use of the Property by the Licensee hereunder, or its employees, licensees, agents, contractors, subcontractors, invitees,suppliers and other persons and members of the public, shall be at the sole risk and expense of Licensee. 13. Services. The Property, including any improvements thereon, is ,as is." Any service to or on the Property shall be at the sole expense of the Licensee,including,but not limited to,permits, licenses, fees and any associated costs of"hook-up",and must be approved by Licensor in advance. 15. Distance and Height Requirements. The Licensee shall construct and use the Property so as to maintain the maximum distance between the Permitted Uses and the Licensor's electric, natural gas, and/or railroad facilities, or other facilities located on the Property,allowable by the height, width and terrain of the Property. If the Pennitted Uses crosses over or under the Licensor's electric, natural gas, and/or railroad facilities the crossing shall be as directed by the Licensor. Notwithstanding the foregoing, minimum vertical and horizontal moons, as directed by the Licensor, shall be maintained on all crossings and parallel encroachments. Licensor shall provide Licensee with a master list of required distances from identified facilities of Licensor and a map identifying same which shall be attached hereto as Exhibit B. 16. Removal and Relocation. The Licensor can remove at its own expense all items from the Property,or any part thereof,installed or otherwise on the Property pursuant to this License, or relocate the same to a different location on the Property if the Permitted Use should interfere, in the Licensor's sole and absolute discretion, with the operation and maintenance of the Licensor's facilities as now or hereafter constructed. in the event that 5 52 of 137 Staff Memo-MT Biking Trails the Licensee's use of the Property should, in the reasonable judgment of the Licensor, constitute a hazard to the Licens&s facilities or the general public,the Licensor may require immediate removal, relocation, or modification of the Permitted Use to eliminate such interference or hazard, and may suspend the Licensee's right to use the Property under this License until such removal, relocation, or modification is completed. If Licensee's items constitute a hazard to the Licensor's facilities or the general public, then any removal, relocation or modification of Liomsee's items installed on the Property shall be at Licensee's expense provided that Licensee was notified by Licensor of the need to remove the items from the property and after being provided reasonable time in which to do so, failed to remove such items.. 17. Licensor's Electric Power Advisory. The Licensee agrees and understands that the Licensor may have conshvcted electric power generation, transmission, distribution, or related facilities on the Property, the Licensee has been fully advised by the Licensor that such electric facilities may now transmit and may continue to transmit electric current at significant voltages, and that the conductors on electric lines may not be insulated. The Licensee shall advise all of its employees, licensees, agents, contractors, subcontractors, invitees, suppliers and other persons,including members of the public,who enter upon the Property, pursuant to the provisions of this License, of the existence and nature of such electric facilities and the potential danger and risk involved. 18. Disclaimer of Warranty. Licensor makes no representation as to the suitability of the Property for the Pernutted Use and no such representation, or any other representations, are made by Licensor or shall be implied by operation of law or otherwise. Additionally, Licensor shall have no responsibility or liability, of any kind, type, nature or description on account of the failure, cessation or termination of electric service to the Property; on account of inadequate or improper functioning of the equipment of Licensee; on account of any interference, regardless of source, with the exception of interference caused by any of Licensor's equipment that is not operating within its own specific license parameters,with signals transmitted from the equipment of Licensee,of any kind,type,nature or description,including by way of illustration but not limitation,loss or damage due to fire, water,windstorm,hail, lightning,earthquake,riot, vandalism, theft, acts of contractors, acts of agents or employees or others utilizing the Property, or for any other cause whether originating fium, within or without the communications sysWm of the Licensee. Further, the Licensor shall have no liability or responsibility of any kind, nature or description for mtaintmance, repair, restoration or renovation of the equipment of the Licensee. 19. Assignment. Licensee shall not assign, sell, delegate, subcontract or otherwise transfer or encumber in any manner whatsoever,all or any portion of the rights, duties or obligations under this Agreement. Any such transfer or encumbrance shall be null and void and shall permit Licensor to terminate this Agreement immediately without written notice. d 53 of 137 Staff Memo-MT Biking Trails 20. Licensor's Reserved Rights. Licensor reserves the right,at any time and from time to time,to make such use of the Property as is necessary to comply with the requirements of SW-54,the facilities closure plan, post closure plan and contingency action plan and for the purpose, including,but not limited to, the construction, operation or maintenance of its, transmission or distribution and appurtenant facilities located or to be located on the Property. In the exercise by Licensor of all of the foregoing rights,Licensor will use its best efforts not to materially interfere with the Permitted Use. Unless Licensor must act immediately due to a threat to human health or a threat to the environment, Licensor will provide at least six (6) months of notice to Licensee if it exercises the foregoing Tights or any other rights of Licensor to enter into or use the Property in a manner that will substantially impair Licensee's use of the property. However, Licensor"I not in any event be liable for mconvemence, annoyance, disturbance or other damage to Licensee, or the Permitted Use, by reason of the exercise of the foregoing rights or any other rights of Licensor to enter.into or use the Property,and the obligations of Licensee under this License shall not be affected in any manner. The City does not release or relinquish any other zoning, land-use,.police or other legal authority over the property or it's Licensor as a result of this License. 21. Encumbrances. Licensee shall keep the Property fi= and clear of any and all liens and encumbrances arising or which might arise, for any reason, out of Licensee's occupancy and use of the Property by anyone in connection with the Permitted Use. 22. Entire Agreement. This Agreement and Exhibit attached hereto and by this reference incorporated herein,constitute the full and complete understanding of the parties regarding the subject matter hereof This Agreement shall supersede and replace all prior or contemporaneous oral or written agreements, correspondence or understandings. Any modification or amendment of this Agreement must be made in writing and executed by both parties hereto. 23. Amendment. This Agreement may be amended only by a written amendment signed by both parties. 24. Licensed Interest Only. This License does not convey an interest in real properly. 25. Non-Transferable Right. I have been the lead on the trail system since day 1 and have gained a ton of experience over the past 6 years with trail construction, maintenance,volunteer management and programming. I would be happy to answer any questions you may have. It might be easiest to have a quick phone conversation, but I'll try to answer your questions below, The off-road cycling trail has been a great addition to the City of Woodbury. It's very popular and has been well received. We do have a couple residents every once in while that express concerns, but overall their concerns have been very minimal.There is an overwhelming majority of residents that thoroughly enjoy the trail system and use it every day.We have a volunteer trail crew that maintains the trail and they have been a huge asset to the city.The parks and recreation department holds a winter bike race every January and the success of that event has been incredible.The race even received national exposure on the CBS Evening News last year,which was great for the City of Woodbury.We have many user groups that utilize the trail—high school cycling league teams (Stillwater trains there on occasion),trail runners, snowshoers,fat bike riders,walkers, hikers,families and kids. It's incredible how many users we have and the diversity of the different user groups. Something to keep in mind... o I highly recommend that you have a professional trail builder help with trail layout,design and construction. It's not as simple as laying down a path in the woods.There a science behind building mountain bike trails and how to do it correctly so they are sustainable and built to last.Allowing anyone to go and develop trail layout and design is not the best idea,unless they have lots of experience building other trails. Even then I would be cautious. I would recommend working with a group such as Trail Source(local MN trail builder)that has the experience and expertise in trail design and construction.Trail layout and design is critical to having a successful off-road cycling trail system. Trail construction is also not as easy as raking the leaves away and making a trail. You need to have proper grading, drainage, soils, armoring, and much more to have a sustainable well- built trail system. I wish it was easier, but with the amount of users these trails get,they have to be built and maintained correctly or they will be prone to failure. Volunteers must help maintain the trail system as it is an on-going process.The volunteers should be trained and know the best practices for mountain bike trail maintenance and construction.We work closely with the Minnesota Off-Road Cyclists (MORC) and partner with them on the volunteer maintenance and trail construction of our off-road cycling trail. The only drawback has been the parking lot. It was originally only sized for the small park and associated users. When the land was donated and developed for mountain biking there was not a way to expand the parking lot because of the location without damaging either the park or the biking trail. It has the the space and the terrain to be one of the best mountain trails in the metro area. 1 was not able to attend the last park board meeting as I and my family were on a spring break vacation. understand that there were some concerned citizens opposing the possibility of the trails. Below is a summation of an article written about the impacts of mtbing on a piece of land: While land managers have long been concemed about the environmental impacts of mountain biking, there are still very few good studies published in peer-reviewed journals. White and others (2006) and Hendricks(1997) note that the majority of mountain biking research has focused on social issues, such as conflicts between trail users.As a consequence, the ecological effects of mountain biking on trails and natural resources remain poorly understood. Still, an emerging body of knowledge on the environmental impact of mountain biking can help guide current management decisions. All c f the existing scientific studies indicate that while mountain biking, like all forms of recreational activity, can result in measurable impact to vegetation, soil, water resources, and wildlife, the environmental effects of well-managed mountain biking are minimal. Furthermore, while the impact mechanics and forces may be different from foot traffic, mountain biking impacts are little different from hiking, the most common and traditional form of trail-based recreational activity. Key observations about the environmental impacts of mountain biking: 1. Environmental degradation can be substantially avoided or minimized when trail users are restricted to designated formal trails. Many studies have shown that the most damage to plants and soils occur with initial traffic and that the per capita increase in further impact diminishes rapidly with increasing subsequent traffic. Many environmental impacts can be avoided and the rest are substantially minimized when traffic is restricted to a well-designed and managed trail. The best trail alignments avoid the habitats c f rare flora and fauna and greatly minimize soil erosion, muddiness, and tread widening by focusing traffic on side-hill trail alignments with limited grades and frequent grade reversals. Even wildlife impacts are greatly minimized when visitors stay on trails;wildlife have a well-documented capacity to habituate to non-threatening recreational uses that occur in consistent places. 2. Trail design and management are much larger factors in environmental degradation than the type or amount of use. Many studies have demonstrated that poorly designed or located trails are the biggest cause of trail impacts. As evidence, consider that use factors (type, amount, and behavior of trail visitors) are generally the same along the length of any given trail, yet there is often substantial variation in tread erosion, width, and muddiness. These impacts are primarily attributable to differences in grade and slope alignment angle, soil type and soil i 34 of 53 86 of 137 Staff Memo-MT Biking Trails moisture, and type of tread construction, surfacing, and drainage. This suggests that a sustainable trail that is properly designed, constructed, and maintained can support lower- impact owerimpact uses such as hiking and mountain biking with minimal maintenance or degradation. 3. The environmental degradation caused by mountain biking is generally equivalent or less than that caused by hiking, and both are substantially less impacting than horse or motorized activities. In the small number of studies that included direct comparisons of the environmental effects of different recreational activities, mountain biking was found to have an impact that is less than or comparable to hiking. For example, Marion and Olive (2006) reported less soil loss on mountain bike trails than on hiking trails, which in tum exhibited substantially less soil kiss than did horse and ATV trails. Similarly, two wildlife studies reported no difference in wildlife disturbance between hikers and mountain bikers (Taylor&Knight 2003, Gander& ingold 1997), while two other studies found that mountain bikers caused less disturbance(Papouchis and others. 2001, Spahr 1990).Wilson and Seney(1994)found that horses made significantly more sediment available for erosion than hikers or mountain bikers, which were statistically similar to the undisturbed control. One final point to consider, however, is that mountain bikers, like horse and vehicle users, travel further than hikers due to their higher speed of travel. This means that their use on a per-unit time basis can affect more miles of trail or wildlife than hikers. However, an evaluation of aggregate impact would need to consider the total number of trail users, and hikers are far more numerous than mountain bikers. The trails would be primarily used by mountain bikers, but would also be available for Diking,skiing and snow shoeing. Other park users would benefit from this proposal and it seems a reasonable idea. More trails are good for everyone and anything that gets young people outdoor exercise should be supported. However, I think it would be prudent-fbr the City to get some additional.information(if it—hasn't done so already) before approving this plan. Also, I have some specific concerns about the trails and their routing. What general benefit is there to the City from this proposal? Most likely the majority of people using the bike trails would not be City residents. Is the SASCA connected with the Stillwater Area Schools? if so, perhaps the quid pro quo would be the school district suspend its effort to close the Oak Park Heights Elementary School in return for the use of the park by SASCA. What expenses will there be to the City if this plan is implemented? These might include increase use of the park's bathrooms,auto parking,more trash to collect and perhaps law enforcement costs. If SASCA has no connection to the school district,what assurances will the City have that the commitments included in the proposal will be kept? its easy to make promises,but when there's financial or other unforeseen pressures it's easy put off getting things like routine maintenance done. Organizations tend to come and go,and SASCA might not be around forever. Is this trail system for"casual use only,or does SASCA intended to hold events? Competitive events will most like involve spectators with the associated need for more restrooms,trash collection,parking,etc. Is the 2.5-mile system the final plan? An earlier proposal included a significantly longer system of bike trails. If the SASCA intends to request more trails in the future,it would seem a good idea to address that now. My specific concerns about the trails and routes are: Erosion Control is difficult to implement in any construction project. SASCA has addressed this issue in its proposal. They specifically state that"It is highly unlikely that armoring will be needed at this location in Valley View". That may be true,but it would seem prudent for the City Engineer to review the proposal and make recommendations on erosion control measures. 89 of 137 Staff Memo-MT Biking Trails It appears parts of the SASCA system will be co-located with existing trails. On the drawing included in the proposal it looks like the SASCA will use the exlsdng paved road from the Valley View parking lot to where the road intersects the existing paved trail system. The bike trail also appears to use an existing section of the paved trail between the road the powerline right-of- way to the north: Assuming the cyclists`intention is to cover the course in minimal time,using existing trials or even co-locating the two would not seem to be a good idea. Fast moving cyclists might be a hazard for the slower moving users of the trail. There might be a similar concern at locations were the bike trails intersect the existing system. For eleven years now, I have spent at least once a week exploring and enjoying Valley View Park. In addition, please note that I own and ride a mountain bike myself but even so, I AM AGAINST THE PROPOSAL TO DIG DIRT TRAILS THROUGHOUT VALLEY VIEW PARK FOR THE SOLE BENEFIT OF MOUNTAIN BIKERS. My experience as a habitat developer, a trail biker, and a regular visitor to Valley View and other MN parks, is that such a plan will cause serious erosion problems, significant damage to trees and the entire understory, severe wetlands pollution, destruction of the prairie rehabilitation, and will drive out all the wildlife that makes Valley View Park so special. We need to find a way to Pre—serve this amazing resource--not calve it uv and destroy it. I grew up in this area,and then moved back to the Valley seven years ago aitr undergoing a double lung transplant.I needed a quiet and peaceful place to recover and begin a new life. Unfortunately,the anti-rejection drugs I had to take afterwards destroyed my kidneys and pancreas. I spent two years on dialysis and it helped me so much to do that treatment just a few minutes from my home in Oak Park Heights. I finally got a donor and had that second double organ transplant 2%years W. I spend my days trying to stay healthy and situ; my doctors order me to get daily exercise and so I walk in this beautiful park,but then I require significant rest afterwards which this peaceful neighborhood has always provided- Now I learn that the beautiful parks so close to my home are on point to become race tracks for mountain bikers with all that implies:Dozens of teenagers riding past my home to get to the park to practice 4 days a week,adult treks every week by the Chilkoc t Bike Club,all sorts of rallies and events with the only accessible vehicle parking being on my previously quiet little side street on the northwest corner of the park. What are residents supposed to dol These nearby parks are our neq;hbwhood's greatest asset. Our property values will plummet. The parks and our surrounding streets will become dangerous to walk--especially for disabled people like me and the R aymie Johnson residents--not to mention fuer all the numerous senior citizens in this area. I ask you to think about these people who live here,pay taxes,and hope to stay=who think this Valley View Park its just fine as it is—"a hidden ireasure"is how you describe it on the G,W3 vwbsi#e. Oak Park Heights MN 55082 (651)351-2013 39 of 53 136 of 137 Staff Memo-MT Biking Trails Concerning.Mountain biking trail proposal I am opposed to this proposal.I would not appreciate the noise,congestion and traffic that would be generated by this proposal.This is a dirt trail that will look ugly and be too close to my townhouse.Also,it will be a place where weeds can take root and spread,making care of the grass in the backyard more difficult I do not believe that volunteers will be able to maintain such a trail. All this trail does is give me more reason to worry.That is not fair to me or to any of my neighbors.My back entrance will be more accessible,inviting unwanted attention,perhaps even break ins. This type of project needs to be limited to public lands.It is unfair to place such burdens on residents for the sake of a sports club. Call to Order: Chair Bye called the meeting to order. Present: Vice Chair Weyer, Commissioners Johnson and Norton, City Administrator Johnson, Public Works Director Kegley, Arborist Danielson, and Commission-Liaison McComber. Absent: None. H. Approval of Agenda: Vice Chair Weyer, seconded by Commissioner Johnson, moved to approve the Agenda. Carried 4-0. III. Approve Parks Commission Minutes—March 21, 2016: Commissioner Norton, seconded by Commissioner Johnson, moved to approve the Minutes. Carried 4-0. IV. Department/Commission Liaison Reports: A. Arborist: Arborist Danielson reported that the spring 2016 boulevard tree planting was set to begin at the end of April, and residents were mailed a letter with details about the planting and new tree care tips. She also reported the Minnesota DNR raised the oak wilt risk to high, so it was important not to prune oaks from the beginning of April through the end of July. B. Public Works Director: Public Works Director Kegley reported the City received enough applications to fill the summer park attendant positions. He also reported that the staff was working on getting the park shelters ready for opening, and they may be open before Memorial Day weekend. Kegley also reported he would be meeting with a representative from an asphalt sealing company to discuss the best approach to sealing the rest of the trail system. C. Other/ Commission Liaison Reports: Commission-Liaison McComber reported that the Spring Clean-up event was set for Saturday, May 7 from 7:30 a.m. to 1:00 p.m. V. Visitors/Public Comment: None VI. Public Hearings: None VII. New Business: A. Parks Commission Vacancy: Commissioner Norton, seconded by Chair Bye, moved to approve Judith Chirhart. Carried 3-1, Vice Chair Weyer opposed. B. C. 2016 Arbor Day Ceremonial Tree Planting: Arborist Danielson reported that a requirement for the Tree City USA award was to have a ceremonial tree planting. She requested a date for the planting at Valley View Park. Oak Park Crossing Park Trail Bid Results: City Administrator Johnson reported that the City received five bids. He requested the Parks Commission make a recommendation on the size of the concrete pad. The commissioners discussed that the idea was to have a smaller slab so gatherings there felt more intimate. Vice Chair Weyer, seconded by Commissioner Norton, moved to recommend the base bid and alternative 1 awarded to the low bidder. Carried 4-0. B. Capital Improvements Discussion: Chair Bye stated that City Administrator Johnson was going to compile numbers to get a list of what each commissioner felt were the important items to get a good estimate. Commissioner Norton, seconded by Chair Bye, moved to discuss the prioritization of the capital improvements after the City Administrator had compiled all the lists. Carried 4-0. IX. Informational: A.
