together with all hereditaments and appurtenances belonging thereto.
The Grantor certifies that the Grantor does not know of any wells on the described real
property
Grantor and Grantee acknowledge that Grantor is the holder of that certain
Mortgage, Assignment of Leases and Rents, Security Agreement and Fixture Financing
Statement dated September 24, 2007 executed by Sydney Holdings of Oak Park
Heights LLC, a Minnesota limited liability company in favor of Grantor in the amount of
$4,500,000.00, filed on September 26, 2007 as Document No. 3663496, as amended
by that certain Amendment No. 1 to Mortgage, Assignment of Leases and Rents,
Security Agreement and Fixture Financing Statement dated July 21, 2008, filed on
November 10, 2008 as Document No. 3714362 ("Mortgage") which is hereby
contemporaneously assigned by Grantor to Grantee and by this conveyance neither
party intends that there be a merger of fee title estate and the interests and estates of
Grantor as mortgagee under the Mortgage and the parties further intend that the
