Dear Mr. Moszer:
The City has noted that there has been tow truck and other vehicles driving over the curb at
the alley of the above-referenced property and parking upon the yard area. Within City limits,
no vehicle shall be parked upon any yard, without being placed upon a designated driveway
or approved parking pad. This can be found in City Ordinance 401.15.F. Off-Street Parking
and Loading. The applicable ordinance sections, along with information regarding parking
pads is enclosed for your reference.
Note that section 6 (f) does not allow any vehicle exceeding a gross capacity of 12,000 GVW
to be parked off-street in a residentially zoned district.
To comply with city ordinance regulations, the City requires that the tow truck shall be
removed from the residential property and all other vehicles shall be placed fully upon a
driveway, upon an approved parking pad or to the interior of the r garage. No vehicles shall
be parked upon the yard, unless upon a driveway or approved parking pad.
This letter serves as the City's request that all driving over the curb at the alley cease
immediately and that the tow truck.be removed from the property and all other vehicles be.
parked to a compliant area as described above no later than Tuesday. July 5. 2016. A site
visit will be made after that date and time to ensure compliance has been met.-

Dear Ms. Barkley:
Thank you for meeting with me and Arborist, Lisa Danielson today to discuss the condition of
your rear yard and trees. As you are aware, per our conversation this morning, Arborist Danielson
has found numerous trees either in poor/unsafe or dead condition that require removal by City
Ordinances 1109 & 1302. You were provided with these ordinances during our visit and advised
of the need to address certain trees as outlined.
As of today, your rear yard is overgrown with buckthorn, contains numerous trees in need of
trimming and/or removal, various piles of wood and vegetation and several areas of stockpiled
containers, and such. You stated that you have arranged for someone to remove the buckthorn.
Such removal will go a long way in making it easier for you to clear away the piles of wood,
vegetation, containers and other items in the yard area and to allow access to a tree service to trim
and remove the necessary trees.
This letter directs that you to attend to the removal of the buckthorn,piles of wood,vegetation and
other accumulations, and to maintain the trees via trimming and remove hazard trees so that they
do not pose a nuisance or safety hazard as described in City Ordinances 1109 and 1302. I have
enclosed a list of tree services that are currently licensed to work within the City of Oak Park
Heights.
The above work is to be done no later than August 12, 2016. At that time, we will make an
additional site visit. Failure to comply with this request may result in the City pursuing legal
remedies to abate the situation per City Ordinance.

Dear Mr. Sullivan:
The City is in receipt of your application materials submitted on June 14, 2016 for the
amended Conditional Use Permit to allow expansion of the Xcel Energy Substation on
Nova Scotia Avenue. The City will deem it complete with receipt of the following items
by June 29, 2016:
1. Please provide mailing labels for properties within 500 feet of the exterior
boundaries of the property.
2. Provide drainage calculations for the site.

Subject: New Loading Dock Constructed Over Existing Water-Supply Well at Dahl-Tech, Inc.,
5805 St. Croix Trail North, Oak Park Heights, Washington County,Minnesota
The purpose of this letter is to notify you that Rosa Architectural Group,Inc. has designed a
loading dock that was constructed over an existing water-supply well,and George Siegfried
Construction Co.has constructed a loading dock over an existing water-supply well at Dahl-
Tech, Inc. in Oak Park Heights,Minnesota, in violation of Minnesota Rules, chapter 4725.
The Minnesota Department of Health(MDH)must require you to take action to bring the well
into compliance.
Mr. Patrick Sarafolean, metro district hydrologist, inspected the subject loading dock addition
and water-supply well on June 1,2016, with Mr.Mark Dahlke with Dahl-Tech,Inc. and
Ms. Julie Hultman, city of Oak Park Heights building official. Mr. Sarafolean has reported that
the loading dock designed by Rosa Architectural Group,Inc., and recently constructed by
George Siegfried Construction Co., was constructed over the existing water-supply well at Dahl-
Tech,Inc.The well is now enclosed in a pit or vault underneath the floor of the loading dock
addition.The vault is covered with a steel lid. The work that has been done violates several
provisions of Minnesota Rules, chapter 4725. Specifically,Minnesota Rules,part 4725.2175
prohibits the construction of a building or building addition that is not an approved well house,
over awell. Minnesota Rules,part 4725.2185 requires that a horizontal isolation distance of at
least 3 feet be maintained between a well and the farthest exterior projection of a building,
including the walls, roofs, decks, overhangs and other permanent structures.Minnesota Rules,
part 4725.2250, Subpart 11 requires that the well casing must terminate at least 12-inches above
the established ground surface and specifically prohibits termination of the well in a well pit.

The MDH must require Rosa Architectural Group,Inc. and George Siegfried Construction Co. to
make corrections to bring the well into compliance.You must either:
1. Have the water-supply well in the loading dock addition permanently sealed by a licensed
well contractor and replace it with a new, comparable, complying water-supply well;or
provide a comparable water supply acceptable to Dahl-Tech,Inc.; or
2. Relocate the loading dock in a complying location and have the well casing brought into
compliance.
All well work must be done by a Minnesota licensed well contractor. The work must be
completed by July 27,2016. Failure to make corrections to achieve compliance by this date may
result in additional enforcement actions.
Please notify Mr. Sarafolean of your plan to achieve compliance so that arrangements for
inspection may be made.Failure to notify Mr. Sarafolean or myself will be considered a
violation of this notice and may result in additional enforcement actions.

VACATION RENTALS:
To Regulate or Not to Regulate, That Is the Question
It seems to me we must begin our analysis of whether and how to regulate "vacation
rentals" by asking ourselves why we wish to regulate them. There are, I think, a
relatively small number of possible answers to that question. They include, in no
particular order:
1. Because we can.
2. To generate tax revenue.
3. To protect other businesses who are or may be in a similar market niche.
4. To assure that vacation rentals are of high quality and provide what they
say they will provide.
5. "[T]o maintain the character and integrity of residential areas and to
provide a means through the establishment of specific standards and
procedures by which home occupations can be conducted in residential
neighborhoods without jeopardizing the health, safety and general welfare
of the surrounding neighborhood. In addition, this Section is intended to
provide a mechanism enabling the distinction between permitted home
occupations and special or customarily 'more sensitive' home
occupations, so that permitted home occupations may be allowed through
an administrative process rather than a legislative hearing process."
6. To be ready with answers and solutions if and when neighbors of vacation
rentals begin to complain
Let us evaluate each of these issues separately.
Because We Can. Though I am sure there are governmental officials and
administrators at various levels who enjoy wielding power just because they enjoy
power or because they think they know better than the rest of us what is good for
society. I am not yet so cynical to believe those people inhabit our city hall.
Tax Revenue. Oak Park Heights apparently has a "Lodging Tax". That is, the city adds
some percentage to the cost of renting a room. Apparently that tax is only added on
what the city considers short term rentals not long term leases.
Such a tax may be a reason to identify'Vacation Rentals" but It does not seem that
actually regulating or licensing them would change or enhance the city's ability to collect
a lodging tax.
To Protect Other Businesses. It seems to me the city, or any level of government for
that matter, ought not be in the business of picking which businesses should succeed

and which should fail. Indeed, the city should, I think, always work to break down
barriers to make it easier for small businesses to thrive.
To Assure High Quality. Though many of us believe the internet and social media
reveals too much about too many, one of the great benefits of the internet and social
media is that it does reveal all. If a "vacation rental" is not what it is presented as on the
internet it will be out of business after the first rental. There is no better way of self-
policing than social media and the internet.
I suspect there may be those that say there is another side to this: it is necessary to
make sure that"vacation rentals" have enough space, or enough bathrooms or enough
of this or that. Once again, everything about the "vacation" rental is on the internet,
Why does the city care if one wishes to rent a room that has no bathroom attached to it?
Would we object to camping sites that have no bathrooms at all? In this instance, like
campers, they know what they are getting into and who are we to stop them?

This is the purpose of our city's ordinance 401.15.M, under which "vacation rentals" are
to be regulated.
It is difficult to see the nexus between the above "purpose" and any of the regulations
that have been proposed for"vacation rentals". Indeed, here is no evidence that
vacation rentals have an impact, one way or another, on the "character and integrity" of
a residential area. If that were the case the city would have heard about them long
before they came up at the convention and visitor's bureau meeting. Indeed, one of the
reasons "vacation rentals" are popular is because they provide an "in the neighborhood"
experience.
To be Ready with Answers. . . A gentleman by the name of Adam Thierer has written
extensively about what he calls "permissionless innovation". His theory, and I think it is
a wise one, is that there is really an inverse relationship between regulation and
Innovation; the more regulation the less Innovation. This does not mean that all
regulation is bad or unnecessary but it does mean that pre-emptive or worst case
scenario, which is what we are trying to do in this instance, causes economic
opportunities to become less likely resulting in fewer services, lower quality, higher

prices, diminished economic growth and eventually a lower standard of living.
Regulating by guessing what might happen in the future is a bad idea on every level.
Looked at another way, we can ask ourselves what are the possible complaints that
might come to the city concerning "vacation rentals"?
• Noise is already covered by ordinance.
• Rowdiness and disturbing the peace is already covered by ordinance.
• Parking is already covered by ordinance.
• Trash bins in annoying places is already covered by ordinance.
But, it might be said, that neighbors may complain just about the fact that someone is
renting out his/her home. If that is a big deal to a neighbor s/he can always use a civil
remedy. (See the StarTribune article, "Battles brew over room rentals", June 10, 2016.
That is contract dispute be handled, not by a city but in a civil action.) If the city begins
to get involved in these kinds of disputes it is "Katy bar the door". I don't like my
neighbor's flowers, or trees, or car, or on and on. And it could be argued that the city's
refusal to allow a person to use his/her home for a "vacation rental" is a "taking" by the
city without just compensation.
One can also ask how the city would enforce such an ordinance and whether it would
be worth the city's time, money, energy and resources to do so.
In conclusion, it seems like the wisest and most prudent course for the city to take is to
apply the lodging tax to "vacation rentals" and deal with issues as they come up.
Adopting an, "oh, something could go wrong approach so we must prepare for
Armageddon"would be short sighted, counterproductive and go against the whole idea
of encouraging people to come to our city.

St. Croix River navigation channel scheduled to move June 23
STILLWATER, Minn.—Crews will be moving the river navigation channel buoys to between Piers 9 and 10 Thursday,June
23.
Currently,the river navigation channel through the St.Croix Crossing bridge construction zone is between Piers 10 and
11.
The river navigation channel will move one more time in mid-July to between Piers 8 and 9 after all the bridge deck
construction is complete at Pier 8.Once this happens the river navigation channel will be in this location for the
remainder of the boating season.

Stay cable installation begins at Pier 11
Paving underway in Wisconsin
STILLWATER, Minn.—Crews installed the first set of stay cables at Pier 11 near the Wisconsin shoreline on June 29.Stay
cable installation is anticipated to begin at Pier 10 after the holiday.
The segment lifters that were erecting segments at Pier 9 have been moved and are now operational at Pier 11.When
bridge deck construction is complete at Pier 8 in early July,those segment lifters will move to Pier 10.
Other St.Croix Crossing bridge construction highlights are:
• Crews have installed the third set of stay cables at Pier 12,closest to the Wisconsin shoreline
• Crews will have placed up to the 10th eastbound and westbound segments in the bridge deck construction
sequence at Pier 10,by the end of the week of June 27
• Crews continue to glue segments at Span 14.All segments will be glued by mid-July.Span 14 bridge deck
construction is ongoing through the fall.
Wisconsin highway construction update
Crews completed paving the new Hwy 35/64 eastbound lanes. Paving will continue on the westbound lanes as well as
the CR E interchange ramps.

Stay cable installation and bridge deck segment placement continues out on the river, and
crews have reached a few notable milestones.

Dear Senator Housley and Representative Lohmer:
I am contacting you as your constituent and as a city official in the City of Oak Park Heights to
request your support for a 2016 special session to complete work left unfinished when the
Legislature adjourned sine die in May.
It is extremely important to the City of Oak Park Heights that the Legislature reconvene to pass
the omnibus tax, bonding, and transportation bills. These bills were identified as high priorities
for both bodies of the Legislature and the governor, and action on them should not wait until
2017.
Our common constituents deserve a transportation system that works. I respectfully ask you to
keep the interests of all Minnesotans in mind by working to pass a comprehensive, sustainable
transportation funding bill as part of a special session.
I urge you to work with the leaders of your caucus to reach an agreement with Gov.Mark Dayton
so that a special session can be called to deal with these important issues.

RE:Omnibus Transportation Funding
Dear Senator Housley and Representative Lohmer:
There is an urgent need to do something about our transportation system. Minnesota's road and
bridge infrastructure is aging, and its transit systems—both urban and rural need to expand to
accommodate the state's demographics, workforce, and economy. I am contacting you as your
constituent and as a city official in the City of Oak Park Heights to request your support for
including an omnibus transportation funding package as part of a 2016 special session. This
package must be comprehensive and sustainable.
Without a transportation funding bill this year,Minnesota's road construction budget will shrink
by 45 percent.This is unacceptable at a time when needs are at an all-time high.
Any transportation bili passed by the Legislature must include dollars dedicated to city streets.
According to a report released in 2012 by the Transportation Finance Advisory Committee, cities
collectively need an additional $400 million per year to bring city streets up to an economically
competitive standard.
Existing funding mechanisms for city street maintenance and reconstruction are inadequate, and
the shortfall is resulting in increasing property tax burdens for our residents and businesses.
Municipal state aid (MSA) is limited to cities over 5,000 in population —147 of 853 cities in
Minnesota—and cannot be applied to more than 20%of an MSA city's lane miles.
Please work to pass an omnibus transportation funding bill that provides additional dedicated
state funding for city streets, including funding that can be used for non-MSA city street
maintenance, construction,and reconstruction. Specifically, I support(s)passage of a provision in
the Senate's omnibus transportation bill (IHF 4)that imposes a $10 surcharge on license to fees

to k dedicated to city streets in large and small cities. Half of these funds would be directed to
the Small Cities Assistance Account established by the 2015 Legislature. The dedicated funding
provision for city streets, which raises approximately $57 million, does not exist in the Douse
transportation bill.
In our City's situation, these funds could directly help fund the reconstruction of the frontage
roadways that serve a large commercial corridor nearest to Menards, Kohl's and several other
national retailers.
Our common constituents deserve a transportation system that works. I respectfully ask you to
keep the interests of all Minnesotans in mind by working to pass a comprehensive, sustainable
transportation funding bill.

- Commissioner Kriesel—reported that he attended the Stillwater Veterans Memorial Day Event

Lower Valley mayors and the St. Croix Foundation regarding trail improvements along County
State Aid Highway 18. He attended an open house regarding County State Aid Highway 12.
He attended the Solid Waste Management Coordinating Board meeting on May 25h. He
attended the Metropolitan Mosquito Control District Executive Committee meeting on May

- Commissioner Weik—reported that she attended the Woodbury Veterans Memorial Day
Event,and commended Staff Sergeant Marcus Kuboy on his presentation. She attended the
Yellow Ribbon Network Picnic at the Big Marine Veterans Rest Camp. She reported that the
Madison's Place playground and splash pad opened on Saturday,June 4t',at Bielenberg Sports
Center in Woodbury, She reported that TRIA Orthopedic had its groundbreaking ceremony at
City Place in Woodbury. She reported that she met with several lobbyists regarding updates on
a potential special session. She attended the Prairie Restoration Event at Crossroads Church in
Woodbury, and thanked staff and volunteers. She reported that she has been working on a
letter for East Metro Strong regarding a comprehensive transportation bill in the event that
there may be a special session. She summarized several highlights from the Metropolitan
Energy Policy Coalition Meeting on June 2nd, including a restructuring proposal,updated
operating procedures, and a name change to the Metropolitan Energy Coalition. She reported
that she applied for National Association of Counties(NACo)presidential reappointments for
the Rural Action Caucus, and the International Economic Development Task Force Ad Hoc
Committee. She attended the Association of Minnesota Counties District X meeting, and the
presentation on mental health in jails.
- Commissioner Bi lg z —reported that she attended the Association of Minnesota Counties
District X meeting, and highlighted the mental health in jails presentation. She summarized
legislative updates from the Association of Minnesota Counties District X meeting, including
the lack of transportation bills,bonding bills, and county program aid. She attended the Red
Rock Corridor Meeting, and reported that they agreed to send a letter to the legislative leaders,
that if there is a special session to request that Red Rock Corridor be considered in the
proposal. She offered congratulations to the Park High School Girls' Softball team,who have
made it to state finals.

25th regarding well sealing and septic program,and water efficiency grants. He attended the

Outdoor Heritage Fund for Conservation Easement Funding on Wilder and Warner Nature
Center parcels. He reported that May Town passed a resolution in support of the county
leaving land-use decisions to the townships. He attended a Transit Meeting in Forest Lake
yesterday,June 6th,regarding transportation service needs for seniors.

The Ramsey/Washington Recycling& Energy Board (R&€Board) is a joint powers board composed of Ramsey and
Washington counties. Following an extensive evaluation and public engagement process that began in 2013,the R&E
Board purchased the Recycling& Energy Center(R&E Center) in Newport in late 2015. Previously called the Resource

Recovery Facility,the R&E Center shreds trash collected from homes and businesses which is converted to electricity at
off-site Xcel Energy plants,powering 20,000 homes annually.The R&E Center is a key element to reach aggressive state
waste management and recycling goals.
Waste designation is the term used in Minnesota law that provides an implementation tool to direct all trash generated
in both Ramsey and Washington counties to the R&E Center for processing instead of landfilling. Currently only 80%of
trash from the two counties and available for processing is delivered to the R&E Center.The R&E Board started
discussing waste designation as a tool to accomplish environmental and economic objectives beginning in 2013. The
two counties then began to evaluate the future of waste processing in the East Metro and possible purchase of the
facility in Newport,including public engagement and discussion about designation in 2015.
The Solid Waste Master Plan guides county waste management activities and includes strategies to increase recycling
and organics recovery,along with continued support and preference for waste processing over landfilling.The county is
amending the Processing chapter in the Solid Waste Master Plan,to clarify policies and include implementation of a
Ramsey/Washington County Joint Waste Designation Pian.The amendment recognizes the recent purchase of the
processing facility in Newport,and.is designed to ensure that waste generated in the County is managed higher than
landfilling on the Minnesota Waste Management Hierarchy.
The R&E Board is preparing loth the Amendment#1 to the Solid Waste Master Plan for each county,and the
Rarnsey/Washington County Joint Waste Designation Plan.

Subject:Police Activity Report—June 2016
This overview report is the activity of the Oak Park Heights Police Department during the month of June
2016. Officers responded to and generated 506 calls for service in the City of Oak Park Heights.
The department responded to many incidents during the month. This is a summary/sampling of some of
the cases we responded to and investigated:
1. Responded and investigated male at retail store pulling a knife on other customers.
2. Arrested 3 juvenile males in a city park starting a fire and were in possession of 3 other
homemade"Molotov Cocktails".
3. Responded to theft from retail business while it was open,male entered all dressed in black and
face covered. Had a crow bar in hand. Used crow bar to pry open cash register.
4. Investigating burglary to business and theft of the company car.Vehicle recovered a week later
after a pursuit starting in WI and ending in Cottage Grove. 2 persons arrested.
5. Investigating residential burglary reporting theft of multiple firearms. Homeowners on vacation
and had relatives watching house who apparently had a party in the house....
6. Arrested a male for disorderly conduct and obstructing police. Male was intoxicated and causing
disturbance on docks at marina trying to enter a boat of someone else.
7. Arrested a male in the lobby of an apartment building who was touching females and claiming he
was the"Emperor of Rome".
8. Arrested male for driving scooter on city trails that also had felony warrants and found in
possession of meth.
9. Arrested male for domestic assault that started at local restaurant. Left in vehicle and male broke
nose of female during assault. Female broke window of car and jumped out onto highway to get
away.
10. Responded to noise complaint and arrested male on warrant for failure to appear on a previous
noise complaint citation we issued to him.
We had an audit of our BCA/FBI security measures and access. We passed without issue.
A local resident brought us chocolate chip cookies thanking us for work.
Investigator Paradise filled in patrol shifts due to the suspension of David Kisch.
Officer Tennessen has completed his FTO training and will be out on his own starting this weekend of the
4'h of July. He will be filling the shift from left open by the recent resignation of Kisch after internal

investigation and until a new shift bid is conducted at the end of the year. This will give him needed
exposure to admin staff and call loads while settling in with the department.
Investigator Vierling did community outreach and spoke to business*employees about safety issues.
We had 5 days during the month where we were at full staff due to vacations,sick leave and training.
We have been seeing significant repairs to our 2 oldest squad cars that are due to be replaced while
waiting for them to have emergency equipment installed.Unfortunately the company doing the
conversion of the equipment to the new squads has not scheduled us yet indicating they take installs in the
order they are received. I notified them the day we received the squads in May.
Officers attended training courses during the month:
1. All officers received training on Sexual Harassment
2. Officer Tennessen attended 3 day long training on Crime Scene Processing
3. All officers received training on legal survival for police officers
4. All officer received refresher training on defensive tactics
5. Officers Vierling,Tennessen,and Hicks attended training on auto theft.
6. Officer Croft completed his Taser instructor refresher

Legislative Update
Legislative leaders and the Governor have met sporadically since the legislative session ended a little
over a month ago, and the Capital Investment Conference Committee met once, but there is no
agreement yet among legislative leaders and the Governor on a scope of items for a special session.
Outstanding issues include an omnibus tax bill that was pocket vetoed by the Governor due to a $100
million error in the bill, and a bonding bill (see below) with the key point of contention being funding
for the Southwest Light Rail Line (SWLRT). The Governor's outlined requirements for a special
session include funding for SWLRT, correcting the tax bill and including a sales tax exemption for
High School League events as well as additional spending in various budget areas. House Speaker
Daudt this week listed a provision to prevent local governments from adopting wage laws and tax
credits for private school tuition as items proposed for inclusion in a special session. ...clickforfull

Bonding Bill Debated
Members of the capital investment conference committee convened last week in the State Office
Building to review the bonding bill that failed to pass the last night of the regular legislative session.
That bill included a Metro Cities initiative for$2.5 million for inflow and infiltration mitigation, $45
million for affordable housing and $300 in cash for transportation.

Metropolitan Council Adopts Housing Performance Score Changes
The Met Council has approved changes to the methodology that determines a community's housing
performance score. The methodology was entirely revamped for the 2015 scores and a working
group was convened this spring to review the first round of scoring and discuss additional

Met Council Equity Advisory Committee Holds First Meeting
The first meeting of the Metropolitan Council's new Equity Advisory Committee was held this week.
The committee members were appointed earlier this year. The committee is made up of four Met
Council members, eight geographic district representatives serving four-year terms and nine at-large
members serving two-year terms.

DEED to Hold Info Session on Redevelopment Grant and Demolition Loan Programs
The Minnesota Department of Employment and Economic Development (DEED) will hold an
informational session to provide details about the next grant round for the agency's Redevelopment
Grant and Demolition Loan Programs. The session will highlight what types of projects are eligible
and which will compete well for grant funds.

DEED to Hold Training on GIS-Enhanced Site Database System
DEED has made the Location One Information System (LOIS) tool available to communities and
economic developers. LOIS is free for local officials, based on DEED's state subscription. LOIS
provides a GIS-enhanced site database system which provides ways for community and economic
development organizations to showcase available sites and buildings to site selectors and real estate
consultants through the use of customizable searches, maps and reports. LOIS can plug into a local
website and includes ESRI Demographic Reports and thematic maps.

Broadband Grant Webinars Scheduled for June and July
Starting on June 23, the Minnesota Office of Broadband Development (OBD) staff will host a series of
webinarftoll-free conference calls to launch the 2016 Border-to-Border Broadband Development
Grant Program. The office will introduce this year's changes to the program, walk through the
application, review the scoring criteria, and answer any questions. Information presented at each call
will be the same, so participants only need to choose one date.

Transportation Improvement Plan Released for Public Comment
Last week the Transportation Advisory Board (TAB) approved the 2016 Transportation Improvement
Plan (TIP) for public comment. The TIP addresses transportation projects in the region that are
prioritized by year, and that will use federal dollars or have effects on air quality. Projects include
highways, transit, bikeway and pedestrian improvements. All metropolitan planning organizations
(MPO's) must draft a TIP. Comments will be accept through August 3"d, with the final approval
scheduled for consideration on August 17th.

Environmental Initiative to Host Forum on Drinking Water Infrastructure
The Environmental Initiative will host a forum on drinking water infrastructure on Tuesday, June 28x"
at the University of Minnesota. The forum will explore how we might funding and solutions to
Minnesota's drinking water infrastructure challenges. Several speakers, including local officials, will
present at the forum. The cost is $30 for members, and $60 for non-members. EI is asking for
registrations by this Friday June 24. More information and registration.
