A yard maintenance enforcement letter was sent to the property owner at 14269 57th street N—This letter only comes after numerous contacts with the property owner to address non-compliant yard maintenance. 2. Staff has determined the Xcel Energy application for the Nova Scotia substation is complete.Please note the City Staff will be seeking a condition on their permit,if approved,that they also address the peeling paint and non-compliant light at the Bayport Substation. 3. The City has signed and executed all elements of the agreements, CUP, plats and easements for the Holiday I CSAH 26 project,My understanding is the road construction is forthcoming very soon with Holiday seeking a building permit in late July. 4. Staff has supplied Bob Brackey a letter with the approving resolution for the retail development in front of Menards. This communication—done via email in most cases—is performed to dose a MN STAT. 15.99 deadline requirement(s)the City must comply with.This message is purely for background information as to our required processing of applications. ST.Croix Rarer Crossing July 7m Project Update from MNDOT. Other Items • Staff has met with the MTN Biking group and have developed a draft permit that is getting closer to being issued — but not immediately pending.I have again attached a draft of that permit so you understand what their requirements shall be.No action is necessary on this. • Both Mayor McComber and Council Member Runk provided me an article from the STAR TRIBUNE regarding the recent Temp Health Care worker law.—See Enclosed. I have also outreached to other cities and have hear back from a number of them that they plan to also"opt-out"—I have enumerated those responses in a spreadsheet and is also enclosed. Most are opting out or are planning to do so. • Washington County—Summary of Meeting Minutes—June 21,28 and July 5y, • Due to complaints,the City inquired to MNDOT when the speed limit signs will be put back into the frontage roads.Apparently the re-installation has been delayed due to a speed study being done.Apparently the speed in being INCREASED.We will await to see what the final report includes from the MNDOT Traffic office. • The City Police Department received a'Thank You to Police'—See enclosed. As of today,the yard maintenance remains largely incomplete and in violation of City Nuisance Ordinance 1109. Please attend to the following in full no later than Friday,July 22,2016: 1. Unless expressly separated, the Perm#and Conditions are applicable Jointly and severally to both SASCA and MORC PERMIT CONDITIONS The City hereby authorizes APPLICANT to route and construct a 2.5 +/- mile mountain biking trail upon City property located within Valley View Park and Oak Park Crossing Park as shown in Exhibit A- further referred here in as the"Trail". Pursuant to such approvals the following conditions are required and applied to this Permit: 1. The APPLICANT shall install and complete the Trails as shown not later than December 31s,2017.All Trails shall be installed following the established sustainability and other best practices as defined by the International Mountain Biking Association and any additional provisions outlined in this Permit. The APPLICANT shall certify and warrant in writing to the City that the Trail is completed to such standard prior to any official opening or use. 2. The APPLICANT shall ensure that such trails constructed hereunder shall be open to the general public and acknowledges that such Trail shall be multi-purpose and not intended as sole or single purpose facility and shall accommodate reasonably compatible uses. 3. The APPLICANT shall mark the Trail route and layout for inspection by the City and Xcel Energy (in applicable areas) prior to any construction taking place. Once the City and Xcel Energy approves the layout, construction may commence. Construction may take place during those hours the Park is open and may not unreasonably interfere with other park users.The APPLICANT shall provide a construction staging plan. Construction must be staged in a methodology so as to ensure that any Trail segments are initiated and fully completed prior to the advancement of other construction.Construction volunteers shall park in the designated Mountain Biking Parking lot. 4. All workers for any installations shall be deemed volunteers and under the direct authority and control of the APPLICANT. All workers shall be required to execute a waiver of liability to the City on forms provided by the City prior to engaging in any construction activities. Persons under the age of 18 must have such forms signed by their parents/legal guardian. The APPLICANT does indemnify and holds- harmless the City from any and all liabilities associated with the installation of the Trails permitted under this Permit including personal injury, equipment damages, etc. The City does not make nor provides any warranty or certification that this area is best suited for the planned uses by the APPLICANT and the APPLICANT accepts all associated risks to construct and operate the Trail. 18 of 35 5. The APPLICANT shall regularly monitor the Trail for the establishment or incidence of persons leaving the established Trail. The Applicant shall be responsible to discourage such actions and shall take necessary steps to discourage such actions. 6. The APPLICANT's construction of the Trails may only be accomplished with hand tools or other small hand-operated equipment so as to minimally impact the surrounding area of the Trail route. No trees or vegetation may be removed that exceeds 4"in diameter. 7. The APPLICANT shall install appropriate signage to ensure all trail users informed as to the operations, rules, risks and access points. A signage plan shall be supplied to the City for review prior to any installations. Signage Plan shall be affixed here to as Exhibit B. 8. The APPLICANT shall, prior to June 30th, 2017 provide and install a "bicycle repair station", similar to as shown in Exhibit C and in the location as shown in Exhibit A 9. The APPLICANT shall in any formal promotional materials and on-site signage direct that parking for the Trail shall be at Valley View Park in the lot so designated in Exhibit A. 10. The Trail shall close to all non-foot traffic one-half hour prior to the regular park closings. Signage to be Installed shall indicate such closing times. The APPLICANT shall ensure adequate signage and install at conspicuous locations along the trails advising of such trail closing times. 11. The APPLICANT shall be solely responsible for regular trail way maintenance including but not limited to:track maintenance,erosion control,garbage removal,sign maintenance.The APPLICANT shall also be responsible to close trail ways to activities that may cause tire-rutting or other trail damages when conditions warrant.At no time may the trail be closed to hikers or other foot traffic. 12. The APPLICANT shall provide regular in-person updates to the City Park Commission regarding the operations, issues and status of the trail systems. The Applicant shall provide a 12-month comprehensive written report to the City outlining the following from the previous 12 months: volume and type of uses, successes,failures,problems,needs,future plans,etc. 13. The APPLICANT may not hold any formal staged race events without the prior expressed written permission by City. 14. MORC shall provide a supplemental indemnification and hold harmless policy to the City with regard to any claims, causes of action or demands that might be brought against the City arising out of the uses authorized by this Agreement; and further, APPLICANT agrees to provide to the City evidence of insurance coverage of at least $1,500,000 of combined single limits covering claims that might be brought against them and/or the City that arise out of the uses authorized by this Agreement and to name the City as an additional insured on their policy. This proof of insurance shall be provided to the City Administrator not later than April 1 sc of each year. 15. Failure on the part of APPLICANT to comply with any specific or general provisions of this Agreement may result in the revocation of this permit. The City will provide written notice to APPLICANT of any defects or known deficiencies for which the APPLICANT shall promptly address to the satisfaction of the City. 2 19 of 35 16. This APPLICANT is obligated to use extreme caution while participating and executing this project including its construction and continued operation.Unless explicitly stated herein,no authority is granted to APPLICANT to manage City properties or facilities. 17. The APPLICANT shall have a written Emergency Operations Plan, that additionally shows extraction points and shall be affixed hereto as Exhibit D. 18. The City makes no warranty that the route selected by APPLICANT are In a condition that best suits this use.APPLICANT is obligated to address any conditions that it may deem unsafe for its riders and correct such deficiencies promptly. This permit shall expire at such time any of the following occur: 1. The APPLICANTS fail to maintain and/or operate such Trails as outlined in the Permit. 2. The City may revoke or suspend this Permit at any time it deems necessary. This PERMIT does not create any expressed or inherent property rights to the APPLICANT. Prior to any such revocation the City shall endeavor to provide reasonable notice of such closure. 3. This Permit shall automatically expire on December 31,2027.
