Call to Order/Pledge of Alleziance/Approval of Agenda: Mayor McComber called the meeting to order at 7:08 p.m. Present: CounciImembers Dougherty, Liljegren, Runk, and Swenson. Staff present: City Administrator Johnson, Public Works Director Kegley, Police Chief DeRosier, City Engineer Mann, and City Attorney Vierling. Absent: City Planner Richards. Mayor McComber added one item to the Consent Agenda as Item I.: "Consider Letter of Support—World's Fair—Minnesota 2023." Councilmember Liljegren, seconded by Councilmember Runk. moved to approve the Agenda as amended. Carried 5-0. II. Council/Staff Reports: A. Mayor McComber: She reported the Parks Commission held a Public Hearing on May 16; the next Parks Commission meeting was set for June 20 at 7:00 p.m. at City Hall; the LMC Conference was scheduled for June 14 through June 17; Natalie Warren from the St. Croix River Association would provide a presentation at the June 27 City Council meeting; and the summer park program's first event was set for June 7. She also welcomed Judith Chirhart to the Parks Commission. B. Councilmember Dou hert r: He reported he attended the CVB annual meeting on May 19. C. Councilmember Lil_iegren: He reported he attended the Parks Commission Public Hearing on May 16, and he received several calls with comments. D. Councilmember Runk: He reported he attended the CVB annual meeting, and the next Planning Commission meeting was set for June 9. E. Councilmember Swenson: He reported the Cable Commission was holding monthly meetings focusing on the franchise proposal. F. Staff: City Attorney Vierling reported that the City Council held a closed worksession prior to that evening's meeting regarding matters of potential litigation with MNDOT. He stated an update was provided and direction was given. No action was taken in the closed session. City Clerk Pinski reported that Mark Bonse of 5817 Olinda Avenue North and Christina Oberembt of 5704 Stagecoach Trail North were chosen as the recycling award winners for the month of May. City Council Meeting Minutes May 24, 2016 Page 2 of 4 City Clerk Pinski reported that there were 375 loads brought in at the clean-up event resulting in 55.26 tons. City Clerk Pinski reported that the City of Oak Park Heights was selected as the City of Excellence Award winner through the League of Minnesota Cities. Councilmember Dougherty and Mayor McComber stated they would be present at the awards ceremony to accept the award. Mayor McComber reported that the City was designated as a Playful City USA for 2016. III. Visitors/Public Comment: A. Approve Resolution Recognizing the Contributions of Guy Sederski to the City of Oak Park Heights: Mayor McComber read the Resolution, and Councilmember Swenson presented a plaque to Guy Sederski. Councilmember Runk, seconded by Councilmember Dougherty, moved to approve the Resolution. Roll call vote taken. Carried 5-0. Mayor McComber announced that there was a vacancy for the Cable Commission citizen representative position. IV. Consent Agenda: A. Approve Bills & Investments B. Approve City Council Worksession Notes—April 26, 2016 C. Approve City Council Minutes—April 12, 2016 D. Authorize Letter to Delegates Attending 2016 Minnesota Elks Association State Convention. E. Approve the Listing Agreement with Greystone Real Estate Group for the "Bell Property" located at 5416 Stagecoach Trail F. Approve Reappointments to the Planning Commission G. Authorize the 2016 Ragnar Relay Event H. Approve Street Traffic Line Painting by Stripe Right 1. Consider Letter of Support—World's Fair—Minnesota 2023 Councilmember Liljegren, seconded by Councilmember Dougherty, moved to approve the Consent Agenda. Roll call vote taken. Carried 5-0. V. Tobacco Compliance Violation—Liquor Time: Councilmember Swenson, seconded by Councilmember Liljegren, moved to set an Order to Show Cause Hearing for June 27 and imposed a$500 sanction according to the City Resolution. Carried 5-0. B. Consider the Allowance of a Mountain Biking Trail in Valley View Park: Mayor McComber reported that a Public Hearing was held at the Parks Commission meeting on May 16, and the Parks Commission recommended approval with eleven conditions. She reported she spoke with the mayors of Inver Grove Heights and Woodbury after the Public Hearing regarding their experiences. She suggested a portable toilet be placed at the trail to dissuade trail users from using the park shelter restroom during reservations. Councilmember Swenson noted that parking in the park lots instead of streets would need to be enforced. Councilmember Dougherty suggested that the City may want to consider a fine for people who create offshoots to the trail and add a condition that the trail builders must contact the City for inspections to ensure it was being built as planned. McComber stated she thought the City should be in charge of building the trails due to liability, and the City should receive letters from Xcel Energy, MPCA, and the watershed. She also suggested not allowing snowshoeing or cross-country skiing. Councilmember Liljegren suggested not putting stipulations on use of the trail if someone wanted to snowshoe in the winter. He said parks were there to be used, and he was impressed with the passion of the mountain biking community. Councilmember Runk reported he visited Carver Lake and Salem Hills parks and spoke with many trail users. He said he received many positive comments.. Councilmember Swenson, seconded by Councilmember Liljegren, moved to approve the mountain bike trail at Valley View Park. Carried 4-1, McComber opposed. McComber stated she did not think it was the right location due to environmental concerns. Councilmember Runk asked who would determine when the trail was closed due to weather or other reasons. City Administrator reported he would seek an agreement with MARC and/or SASCA to monitor for trail closures. C. 2016 Street Reconstruction Project 64th, Ozark and 641h Street: Councilmember Swenson, seconded by Councilmember Dougherty, moved to authorize the project to move forward allowing the City City Council Meeting Minutes May 24, 2016 Page 4 of 4 Administrator and Mayor to sign an agreement, and directing staff to come back to council if numbers come back largely different than estimates. Carried 5-0. D. CSAH 26— Southeast Frontage Road Re-ali lment Project—Consider Agreements with Washington County: Councilmember Runk, seconded by Councilmember Dougherty, moved to approve the County Construction Agreement. Carried 5-0. Councilmember Dougherty, seconded by Councilmember Swenson, moved to approve the County City Maintenance Agreements. Carried 5-0. Councilmember Runk, seconded by Councilmember Dougherty, moved to approve the City Utility Cost Connection Agreement. Carried 5-0. Councilmember Runk, seconded by Councilmember Dougherty, moved to approve the Resolution for Municipal Consent. Roll call vote. Carried 5- 0. Councilmember Runk, seconded by Councilmember Swenson, moved to approve the Resolution for No Parking. Roll call vote. Carried 5-0. E. Oak Park Crossing Trail Project—Consider Change OrdersW 1 and 2: Councilmember Runk, seconded by Councilmember Dougherty, moved to approve Change Order 1. Carried 5-0. The City Council decided to wait to take action on Change Order 2. VIII. Other Council Items or Announcements: None IX.
