Date/Time Received City Administrator /Date Financial Implications $ Budget Line Item Budgeted: Yes No Funding: Levy Other g vY t zc,r Administrative Recommendation: Approve Den No Recommendation C omments: S :IS I - TARED \Forms \CQUNCIL ACTION REQUEST.Joc and and RESOLUTION NO, PLANNING COMMISSION CITY OF OAK PARK HEIGHTS WASHINGTON COUNTY, MINNESOTA A RESOLUTION ESTABLISHING FINDINGS OF FACT AND RECOMMENDING TO THE CITY COUNCIL THAT THE PROPERTY WITHIN THE VILLAGE AREA, EAST OF STAGECOACH TRAIL AND NORTH OF 56 STREET, SHALL REMAIN THE CURRENT ZONING DISTRICT DESIGNATION OF R -2, LOW AND MEDIUM DENSITY RESIDENTIAL WHEREAS, the City of Oak Park Heights has received a request from om neighborhood residents to consider rezoning the area east of Stagecoach Trail and north to g o rth o f 5 6 Street from R -2, Low and Medium Density Residential to R -I Single Family R • � g y es�dentzal, and after conducting a public hearing relative thereto the Planning Commission of Oak . g Park Heights makes the following findings of fact: follows, to wit: 1. The real property affected by said application is legally described as g y SEE ATTACHMENT A The applicant has submitted an application and supporting documentation to the g e Community Development Department consisting of the followin g items: SEE ATTACHMENT B 2. The City Council of the City of Oak Park Heights, at their March 27, 2001 meeting, directed staff to schedule a public hearing of the Planning Commission to consider a rezoning t� g ng of the area east of Stagecoach Trail and north of 5 Street from the R -2 District to the R-1 District; and 3. A rezoning of this property would also require a change in Comprehensive p Plan land use designation from business /residential transition to low density residential • and � d 4. City staff prepared a memorandum dated May 2, 2001 reviewin g the request for a change in Comprehensive Plan and use designation and zoning; and 5. Said memorandum recommended that the Comprehensive Plan land use designation and zoning classification not be changed from its current designation and zoning district at this time in that the single family use may not be the appropriate lon g term and use for the property in question; and 6. The Planning Commission held a public hearing at their May 10, 2001 meeting, took comments from residents of the area and the public in general, requested additional information of City staff regarding lot size, and continued the ublic hearing to their p g June 14, 2001 meeting; and 7. City staff researched issues regarding zoning history and lot size requirements as provided in a June 7, 2001 memorandum; and 8. The Planning Commission continued the public hearing and made the following recommendation at their June 14, 2001 meeting: NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION FOR THE CITY OF OAK PARK HEIGHTS THAT THE PLANNING COMMISSION RECOMMENDS THE FOLLOWING: 1. That the request for rezoning the property within the Village Area, east of Stagecoach Trail and north of 56th Street from R -2, Low and Medium Density Residential to R -1 Single Family Residential be denied in that the Planning Commission finds no compelling p g reasons to change the Comprehensive Plan land use designation and zoning district classification at this time; and 2.
