Dear Mr. &Mrs.Peterson:
As a result of the ongoing issues at your property and in relation to the location of the common
property line between your residence and 5690 Newgate Circle and the fence location at 5680
Newgate Circle N.,I made a site visit to the properties November 15,2004 to investigate these
issues.
I was able to locate the North property pins and followed the lines in accordance with the
Certificate of Survey for your property and the adjoining properties of 5690 Newgate Circle N.
and 5790 Newgate Ave.N. Wooden stakes were installed at the pins and a line strung between
the two pins from the front to the rear of the common property line of 5680 and 5690 Newgate
Circle N.
Please be advised that while City Zoning Ordinance 401.15.E —Fencing, Screening and
Landscaping,Section(2)as noted in my August 5,2004 letter to you, discusses hedges and
planting,the pertinent issue is that any planting to your property should not that extend beyond
your property,at the time of planting or during the lifetime of the plantings growth,into an
adjoining property. Any limbs or plantings that extend into an adjoining property are subject to
that property owner's trimming,removal, etc.up to the adjoining property line.
With this in mind,I encourage you to relocate your plantings along the adjoining property line as
such that their growth does not encroach upon the adjoining property line.
