General Conditions
Application Review
The undersigned acknowledges that before this request can be considered and/or approved, all
required information and fees, including(any deposits, must be paid to the City. An incomplete
application will be returned to the applicant. The application approval process commences and
an application is considered complete when all required information and fees are submitted
appropriately to the City..
Professional Fee Responsibility
It is the understanding of the undersigned that all City Incurred professional fees and expenses
associated with the processing of this request(s)will be promptly paid upon receipt. If payment
is not received from the applicant, the property owner acknowledges and agrees to be
responsible for the unpaid fee balance eityier by direct payment or a special assessment
against the property.
Applicants will be billed,on a monthly basis for Planning, Engineering, Legal and Community
Development fees as they are accrued. It is understood that interest will be charged on the
account at the Maximum rate allowed by the Fair Credit Act if it becomes thirty (30) days past
due. Failure to pay administrative and processing fees in a timely manner may result in denial
of the application. All fees must be paid at the time of application and shall be paid prior to the
issuance of a building permit.
The undersigned applicant further acknowledges and consents that all unpaid fees owing the
City of Oak Park Heights shall-be treated as unpaid utility fees and may be certified for
collection as with delinquent utility billings and may be assessed against the subject real
property if unpaid by October 31st of each year.

• TEMPORARY CONSTRUCTION AND
ACCESS EASEMENT AGREEMENT
THIS. TEMPORARY AGREEMENT made "/". 2-y . , 2016, by and
between NOVA SCOTIA PARTNERS LLC, "GRANTO and Northern States Power
Company,a Minnesota Corporation,("NSP"),
RECITALS
A. GRANTOR is the record fee owner of certain Real Estate within the County of
Washington, State of Minnesota with a Property ID Number of 05.029.20.11.0119
• and a street address of 5899 NOVA SCOTIA AVE STILLWATER MN 55082
described as:
GOODWILL ADDITION Lot 1 Block 1 ("Premises")and,
B. NSP is in the process of obtaining the necessary permits to expand the Baytown
Substation adjacent to the Premises. To operate and maintain the expanded
substation, NSP wishes to grade that portion of the Premises that lies south of the
Baytown Substation and north of the access drive for the Goodwill Property. NSP
desires temporary construction access over the Premises using excavators, cranes,
bucket trucks, pick up trucks and other related equipment in order to grade the
property.

C. GRANTOR AND NSP has reviewed NSP's proposed grading plan and agrees to
the following terms and conditions:
TEMPORARY CONSTRUCTION AND ACCESS EASEMENT
NOW,THEREFORE:
1. GRANTOR, in consideration of the sum ofniMPANIV00140.04.to GRANTOR
from NSP, receipt of which is hereby acknowledged, grants to NSP, its successors and assigns, a
Temporary Construction Access Easement over and across lands situated in the County of
Washington, State of Minnesota, described on the attached Exhibit "A (the "Premises") The
Temporary Construction and Access Easement shall be limited to that certain part of the Premises
described as the TEMPORARY CONSTRUCTION AND ACCESS EASEMENT AREA on the
Attached Exhibit A.
2. The term of this Temporary Construction and Access Easement Agreement shall be one
year from the date that NSP receives approval of the Conditional Use Permit application with the
City of Oak Park Heights.and may be extended by NSP for an additional 60 periods by NSP giving
GRANTOR notice and additional payment of, per 60 day period. As consideration for
entering into this agreement, NSP shall pay GRANTOR anonrefundable deposit, which •
shall be applied towards the initial one year term.
3. GRANTOR promises and warrants that it has legal and fee title to the above-described
premises and has the right,without title restriction,to execute and deliver this instrument.
4. NSP shall at all times exercise due care and diligence to minimize damages to the property
of the GRANTOR, and NSP agrees to pay all of the costs and expenses associated with its
activities,and to repair and restore any damage to the Property caused by NSP's,at NSP's expense.
NSP shall,prior to the termination date of this document,restore the Premises to its condition prior
to the start of NSP activities, or reimburse the Grantor to restore the property. Restoration work
shall include finish grading of the property and seeding with a native wildflower seed mix.
5. The terms and provisions of this instrument shall be binding upon GRANTOR,
GRANTOR'S heirs,legal representatives,successors,and assigns
