A RESOLUTION APPROVING THE VACATION OF CITY DRAINAGE AND UTILITY EASEMENTS
Whereas the City of Oak Park Heights did previously approve the CSAH 26 realignment;and,
Whereas the City has also approved a general plan to allow for the construction of a new Holiday Gas Station at the
intersection of CSAH 26 and Osgood Ave(County Road 67), including associated storm water ponds that also accept
public water and related improvements;and,
Whereas the planned improvements by Washington County also include certain alignment alterations to Osgood Ave;
and.
Whereas the current easements will be no longer necessary for City utilities and replaced by new easements within a
new plat with revised legal descriptions and will ensure City ordinances and utilities are provided continuity;and,
Whereas Washington County has requested the City vacate its sanitary easements lying along the eastern side of
Osgood Ave and around the perimeter of Block I, Lot 1 of the Plat of Oak Park Heights Auto Plaza as shown in the
drawing and legal description below.

NOW,THEREFORE,BE IT RESOLVED,that the City Council for the City of Oak Park Heights does find that
the request to vacate these public drainage an utility easements is acceptable to the City and contingent on
rededication of the easements within the new plat and all other commitments and costs associated with the above
two projects being fully completed to the satisfaction of the City Engineer and City Attorney
BE IT FURTHER RESOLVED,That the Mayor and City Administrator are authorized to issue and sign further
certifications as to this vacation as directed by the city Attorney.
