CITY OF OAK PARK HEIGHTS
WASHINGTON COUNTY, MINNESOTA
A RESOLUTION ESTABLISHING FINDINGS OF FACT AND
RESOLUTION OF THE CITY COUNCIL THAT THE
REQUEST BY VALLEY SENIOR SERVICES ALLIANCE (VSSA)
FOR PRELIMINARY AND FINAL PLAT APPROVAL TO
ALLOW THE CONSTRUCTION OF EIGHT
HOUSING UNITS ON NOLAN AVENUE WITHIN
MCKEAN WEST BE APPROVED WITH CONDITIONS
WHEREAS, the City of Oak Park Heights has received a request from VSSA for
preliminary and final plat approval to allow eight housing units on Nolan Avenue in McKean
West of Boutwells Landing; and after having conducted a public hearing relative thereto, the
Planning Commission of Oak Park Heights recommended that the application be approved with
conditions. The City Council of the City of Oak Park Heights makes the following findings of
fact:
• 1. The real property affected by said application is legally described as
follows, to wit:

and
2. The applicant has submitted an application and supporting
documentation to the Community Development Department consisting of the following items:

and
3. On September 24, 2002, the City Council approved an amendment of the
Boutwells Landing concept/general plan of development and rezoned the area to PUD District;
and
4. Approval of the concept/general plan was conditioned upon submission of
a preliminary and final plat; and
5. Valley Senior Services Alliance has submitted a preliminary and final plat
in compliance with Chapter 402, the Subdivision Ordinance of the City of Oak Park Heights; and
6. City staff prepared a memorandum dated October 3, 2002 reviewing the
• request; and
7. The memorandum dated October 3, 2002 recommended that the request be
approved with conditions; and
8. The Planning Commission held a public hearing at their October 10, 2002
meeting, took comments from the applicants and public, closed the public hearing, and
recommended that the application be approved subject to conditions.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR THE
CITY OF OAK PARK HEIGHTS THAT THE CITY COUNCIL APPROVES THE
FOLLOWING:
A. The applications submitted by VSSA for preliminary and final plat approval to allow
eight housing units on Nolan Avenue in McKean West of the Boutwells Landing
development and affecting the real property as follows:

Be and the same as hereby approved by the City Council of the City of Oak Park Heights subject
to the following conditions:
• 1. The applicant shall fully comply with the conditions of the amended concept plan/general
plan approval by the City Council on September 24, 2002.
2. The preliminary /final plat is revised to provide the necessary right -of -way for the future
road to the Environmental Learning Center. Provision for the timing of construction of
this roadway and cost responsibility shall be included within an amended development
contract.
3. The City Attorney, Parks Commission, and City Council should comment on the park
dedication requirements for this development.
4. All grading and drainage plans and all easements are subject to review and approval of
the City Engineer.
5. An amended development contract shall be entered into between the City and the
applicant.
Approved by the Planning Commission of the City of Oak Park Heights this 22 day of
October 2002.
