A RECOMMENDING RESOLUTION OF THE PLANNING COMMISSION CITY OF OAK PARK HEIGHTS WASHINGTON COUNTY,MINNESOTA A RESOLUTION ESTABLISHING FINDINGS OF FACT AND RECOMMENDING TO THE CITY COUNCIL THAT THE REQUEST BY DAVID PHILLIPS, REPRESENTING LEONARD INVESTMENTS FOR AN CONDITIONAL USE PERMIT TO ALLOW FOR AUTOMOTIVE SALES AND SERVICE AND VARIANCES FOR SIGNAGE AT 12969 60th STREET NORTH SHOULD BE APPROVED WITH CONDITIONS WHEREAS, the City of Oak Park Heights has received a request from David Phillips, representing Leonard Investments for a Conditional Use Permit to allow for automotive sales and service, Conditional Use Permit for freestanding light fixture height, and Variances related to the numbers, size, height and total amount of signage for Fury Chrysler Jeep Dodge and Ram at 12969 60th Street North, and after having conducted a public hearing relative thereto, the Planning Commission of Oak Park Heights makes the following findings of fact: 1. The real property affected by said application is legally described as follows, to wit: SEE ATTACHMENT A and 2. The applicant has submitted an application and supporting documentation to the Community Development Department consisting of the following items: SEE ATTACHMENT B and 3. The property is zoned B-2, General Business District in which automotive sales and service use is a conditional use; and 4. Fury has requested a Conditional Use Permit to allow Fury Chrysler Jeep Dodge and Ram to operate an automotive sales and service operation out of this location; and 5. Fury has requested a Conditional Use Permit to allow for 28 foot freestanding light fixtures instead of the 25 feet allowed by the Zoning Ordinance; and 6. Fury has requested Variances to allow for a freestanding sign at 40 feet (30 feet allowed) in height and 160 square feet in size (150 square feet allowed) and a Variance to allow a second freestanding sign; and 7. Fury has requested a Variance for a total of 11 wall signs (2 wall signs allowed); and 8. Fury has requested a Variance for a total sign area of 648 square feet (500 square feet allowed); and 9. City staff prepared a planning report dated October 8, 2014 reviewing the request; and 10. Said report recommended approval of the Conditional Use Permits and Variances subject to the fulfillment of conditions; and 11. The Planning Commission held a public hearing at their October 16, 2014 meeting, took comments from the applicants and public, closed the public hearing, and made the following recommendation: NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION FOR THE CITY OF OAK PARK HEIGHTS THAT THE PLANNING COMMISSION RECOMMENDS THE FOLLOWING: A. The application submitted by David Phillips, representing Leonard Investments for a Conditional Use Permit to allow for automotive sales and service, Conditional Use Permit for freestanding light fixture height, and Variances related to the numbers, size, height and total amount of signage for Fury Chrysler Jeep Dodge and Ram at 12969 60th Street North, and affecting the real property as follows: SEE ATTACHMENT A Be and the same as hereby recommended to the City Council of the City of Oak Park Heights for approval with the following conditions: 1. All grading, drainage, erosion control, and utility plans are subject to review and approval of the City Engineer. 2. All new lighting fixtures shall be full cut off and installed in compliance with the lighting standards of the Zoning Ordinance. All visible interior lighting shall also be full cut off. 3. The outdoor lighting shall be turned off one hour after closing, except for approved security lighting. 2 4. Changes to the landscape or new plantings are subject to review and approval of the City Arborist. 5. Any new mechanical equipment that is located on the roof or ground level and visible from street level or from neighborhood properties shall be screened with materials that blend harmoniously with the building façade materials. 6. The sign specifications and methods of illumination shall be subject to review and approval of the City Planner at the time of permitting. 7. The Planning Commission was favorable to the building design and building materials. 8. Plans shall be provided for the trash enclosure gates subject to review and approval of City staff. 9. The Applicant shall provide a snow removal plan or indicate if the snow will be hauled off site. 10. The Planning Commission was favorable to the Variances required for the size, height and number of freestanding signs, for the number of wall signs, and for the total square footage of requested signage. 11. Building entrance plantings shall be required. The Applicant shall revise the landscape plan or provide seasonal planters at the main entrance to the building. 12. A bike rack should be identified on the site plan and placed on site. 13. Sound levels generated from the site shall be in compliance with Section 401.15.B.11 of the City Zoning Ordinance. 14. The use of an exterior announcement system shall not be allowed. 15. All storage of materials, parts and supplies shall be interior to the building. 16. All auto repair activities shall be conducted indoors and the overhead doors to service bays shall be kept closed at all times except when moving vehicles in and out. 17. Automotive sales and service shall not be conducted between the hours of 10:00 PM and 6:00 AM unless otherwise allowed by formal action of the City Council. 18. The applicant shall receive and retain, if required, a Hazardous Waste Generators License for batteries, oil and tires from Washington County. 3 Recommended by the Planning Commission of the City of Oak Park Heights this 16th day of October, 2014. Application Materials • Application Form • Fees • Plan Sets • Written Narrative and Graphic Materials Explaining Proposal • Proof of Ownership or Authorization to Proceed Development Request Review with City Staff/Consultants: October 1, 2014 Planning Commission Review & Recommendation: October 16, 2014 Conditional Use Permit - Lapse of Approval: Unless the City Council specifically approves a different time when action is officially taken on the request, the conditional use permit shall become null and void twelve (12) months after the date of approval, unless the property owner or applicant has substantially started the construction of any building, structure, addition or alteration, or use requested as part of the conditional use. An application to extend the approval of a conditional use permit shall be submitted to the Zoning Administrator not less than thirty (30) days before the expiration of said approval. (401.03.C.4.a and b) Variance — Lapse of Approval: Unless the City Council specifically approves a different time when action is officially taken on the request, the variance shall become null and void twelve (12) months after the date of approval, unless the property owner or applicant has substantially started the construction of any building structure, addition or alteration, or use requested as part of this variance. The property owner shall have the right to submit an application to extend the approval of a variance to the Zoning Administrator not less than thirty (30) days before the expiration of said approval.
