Home My WebLink About15-01-05 RESOLUTION 15-01 -0.5 RESOLUTION TO WASHINGTON COUNTY AND TO THE MINNESOTA DEPARTMENT OF TRANSPORTATION IN SUPPORT OF THE REVOCATION OF PORTIONS OF COUNTY STATE AID HIGHWAYS 21,23,AND 28 AND THE DESIGNATION OF PORTIONS OF COUNTY STATE AID HIGHWAYS 21,23 AND 26 IN THE CITY OF OAK PARK HEIGHTS: WHEREAS,a new highway alignment was constructed in the year 2013 connecting Stagecoach Trail North(County State Aid Highway No. 21),near its intersection with 58`h Street North,to Beach Road, near its intersection with Lipper 61"Street North, in the City of Oak Park Heights,and; WHEREAS,an improved highway is currently being constructed connecting the above described segment to Osgood Ave N(County State Aid Highway No. 24)along the south frontage of Trunk Highway No. 36 in the City of Oak Park Heights, and; WHEREAS, a new highway alignment is currently being constructed between Stagecoach Trail North (County State Aid Highway No. 2l)near its intersection with 56`h Street North(County State Aid Highway No. 28)to St. Croix Trail North(Minnesota:Trunk Highway No.95) in the City of Oak Park Heights and the City of Bayport,and; WHEREAS,the City of Oak Park Heights has been notified that Washington County intends to revoke the County State Aid status of Stagecoach Trail North(County State Aid Highway No. 21)within the north half of Section 3,Township 29N, Range 20W and within the south half of Section 34, Township 3ON, Range 20W,described in Attachment 1 as Segment A,and; WHEREAS, the City of Oak Park Heights has been notified that Washington County intends to revoke the County State Aid status of the 2012 alignment of County State Aid Highway No.23 south of 62nd Street North, described in Attachment 1 as Segment B,and; WHEREAS,the City of Oak Park Heights has been notified that Washington County intends to revoke the County State Aid status of 56ffi Street(County State Aid Highway No.28)between Stagecoach Trail North(County State Aid Highway No. 21)and Pickett Avenue,described in Attachment 1 as Segment C, and; WHEREAS,the City of Oak Park Heights has been notified that Washington County intends to designate the newly constructed highway alignment between Stagecoach Trail North and St. Croix Trail North (Minnesota Trunk Highway 95)as a portion of County State Aid Highway No. 21, described in Attachment 1 as Segment D, and;. CROIX RIVER CROSSING AND ITS APPROACHES, FINDING SAME TO BE SUBSTANTIALLY CONSISTENT WITH THE PLANS AS GRANTED MUNICIPAL CONSENT FORTHE 1995 LAYOUT WHEREAS, in 1995 the City Council for the City of Oak Park Heights (hereafter referred to as the "City") approved a particular layout for the construction of the various roadway and layout approaches for the St. Croix Crossing Project, and; WHEREAS, in 1995 the City and the Minnesota Department of Transportation signed a Memorandum of Understanding that documents actions related to a specific layout, the execution of the project, including costs, timelines and statutory provisions, and; WHEREAS, the Department has continually worked towards the resurrection of the Project ultimately leading to a July 2nd, 2012 submission of construction plans to the City as required by Minnesota Statutes 161.177( 1995), and; WHEREAS, the City has reviewed the MNDOT submitted construction plans from July 2, 2012 relative to the 1995 layout plan approved by the City on August 10, 1995, and has had the input of their City Engineer, and; WHEREAS, the City Council finds that the changes existing between Layout Plans as approved by the City in 1995 and the construction plans are insignificant or otherwise beneficial to the city at large, and; WHEREAS, the City has received and acknowledges the commitment from the Minnesota Department of Transportation as set forth within correspondence signed by the Commissioner of Transportation Thomas Sorel dated August 23, 2012, and this City approves of same, and; WHEREAS, the City of Oak Park Heights and the Minnesota Department of Transportation have benefitted from the input and participation and the resolution of various issues by the intervention of the Honorable Mark Dayton, Governor of the State of Minnesota, and acknowledges and is grateful for his input and commitments as outlined in his correspondence to the City dated August 23, 2012, and the City approves of same, and; WHEREAS, the City of Oak Park Heights has previously been benefitted by the assistance of the Honorable Kathy Lohmer, member of the House of Representatives of the State of Minnesota in securing additional funds for the City in this project to address financial needs as presented, and is grateful for her input; and, WHEREAS, the City has been benefitted also on the federal level by the participation of the Honorable Michele Bachmann member of the United State Congress and her staff in addressing Federal funding issues relative to this project, and is grateful for her input and continuing assistance; WHEREAS, the City has been benefitted also on the federal level by the participation of the Honorable Amy Klobuchar member of the United States Senate and her staff in addressing Federal funding issues relative to this project, and is grateful for her input and continuing assistance; WHEREAS, the City has been benefitted by the diligent work of its City staff, together with MNDOT staff, and Project Director Jon Chiglo in working to find solutions to the various issues that have been presented relative to this project and the various renditions and changes that have occurred. NOW, THEREFORE, BE IT RESOLVED, by the City Council for the City of Oak Park Heights as follows: 1. That the City Council approves the construction plans submitted by the Minnesota Department of Transportation to the City on July 2, 2012 as being in accordance with the 1995 Layout Plans as approved by the City on August 14, 1995 in Resolution 95-08-39. 2 2. The City of Oak Park Heights approves of all work associated with the St. Croix Crossing Project as the City finds the plans as submitted benefit and are in the best interest of the citizens and residents of the City of Oak Park Heights. 3. That the City of Oak Park Heights waves or releases any claim of statutory non-compliance by the Minnesota Department of Transportation with the submission of the construction plans on July 2, 2412. 4. That the City Council authorizes its staff to begin work with the staff of the Minnesota Department of Transportation to negotiate and formalize Cooperative Construction and Utility Agreements consistent with the commitments and financial projections agreed to between State and City staff. This City Council action was solidified as a result of the August 23'a,2012 commitment by Governor Dayton(attached)to seek $1.52 million dollars from Federal or from State of Minnesota sources to cover the$1.52 million in anticipated City utility costs associated with the Project-As the Governor's letter is not a unilateral guaranty of funding,the City Council is at this time seeking comments and input from our area legislators,as well as input from those seeking such ofees,as to their ability to aid the Governor to bring his funding effort to fruition.In effect,the City Council is inquiring if your office would be supportive of legislation that would aid in accomplishing the$1.52 million commitment? The City Council is respectfully requesting that efforts be made to fully support Governor Dayton's commitments to the City which enabled the Project to proceed on a timely basis. Without this funding being ultimately supplied the City will be required to fund the$1.52 million from other sources and which would pose a significant challenge to the City. Likewise,if you believe there is specific action the City can take to additionally help in this cause,please advise us as soon as possible.
