From I Ryan Fleming, PE Regarding I Permit 16-07: Oak Park Heights Pizza Ranch Restaurant Engineers Report The following review of the above mentioned project located within the legal jurisdiction of the Brown's Creek Watershed District (BCWD) was conducted to determine compliance with the BCWD rules pursuant to the Board's permit issuance determination for this project. Bruns Memo response to BCWD preliminary project comments; Dated 5/4/2016 W Stormwater Management Manual Hard Copy;Dated 5/4/2016 to GENERAL COMMENTS This review was conducted for a proposed building and parking lot for Pizza Ranch, located on Morning Dove Avenue in the City of Oak Park Heights. The proposed construction includes clearing and grubbing of the existing site,construction of a new Pizza Ranch restaurant and parking lot as well as installation of site utilities and stormwater management. Overall,the project will disturb 1.8 acres of land. All drainage from the building and parking lot is to be directed to drainage swales that convey water to the Kern Center Pond. The proposed project includes 1.23 acres of impervious area.The Kern Center Cooperative Agreement allows a maximum of 74.4 acres of hard surface within the Kern Center Commercial Area to which the City has allocated Pond capacity. Prior to this permit application, 24.52 acres of impervious surface is allowed for future development within the Kern Center Pond drainage area. (T)651.770. 4 84 8 (F)651.770.2552 www.eorinc.com Rule 2.0—STORMWATER MANAGEMENT o The project maintains drainage to the southbound ditch along Minnesota State Trunk Highway No. 5 and to the drainage swale running down the center of the Kern Center commercial area. Both of these conveyances drain to the Kern Center Pond. • Stormwater management for the site is covered by the Kern Center Pond and Rule 2.0 was satisfied for the site as described in the Kern Center Pond Cooperative Agreement. • The site proposes 1.23 acres of new impervious surface. With completion of this project, the total remaining impervious surface allowed for future development within the Kern Center Pond drainage area is 23.29 acres. Rule 3.0—EROSION CONTROL o N_ According to BCWD rule 3.2, All persons undertaking any grading, filling, or other land disturbing activities which involve movement of more than fifty(50) cubic yards of earth or removal of vegetative C cover on five thousand (5,000) square feet or more of land shall submit an erosion control plan to the O District,and secure a permit from the District approving the erosion control plan. W ❑ Rule Requirements Met With Conditions p W The project proposes a combination of rolled erosion control blankets, sod and seeding to prevent erosion D from disturbed areas. Sediment will be control with the use of bioroll check dams in the swales,curb cut inlet protection of stacked sand bags and a rock construction entrance pad. - Discussion: • The plan indicates the use of Turf Reinforcement Mat(TRM) throughout the site, including what appears to be intended as sod. Revision of the legend for sod restoration areas is suggested. • In response to BCWD preliminary comments made on 3/17/2016, the plan now includes redundancy of Category 3 wood fiber blanket and TRM throughout the swales. The intention of the comment was to suggest the wood fiber variety of Category 3 blanket along the centerline of the ditch in lieu of the straw variety of Category 3 blanket for durability in areas of concentrated flow. In addition, the comment was intended to only protect/armor the flow path from the back of the curb cut down to the center of the swale and at the 90 degree turn in the swale at the west corner of the property with riprap or TRM. The current plan meets the erosion control requirement; however, the District was not suggesting doubling up of the erosion control products in the swales. Conditions: 1. The Stormwater Pollution Prevention Plan will include the contact information for the erosion and sediment control responsible party during construction once a contractor is selected. 2 Emmons&Olivier Resources,Inc. 651 Hale Avenue North Oakdale,Minnesota 55128 memo cont. The project drains to Long Lake, an impaired waterbody for excess nutrients. The fertilizer specified for the project should be revised to meet the criteria of MnDOT Metro District Design guidance to limit phosphate and using slow release Type 3 fertilizer. Rule 4.0—LAKE, STREAM, AND WETLAND BUFFER REQUIREMENTS Buffer zone widths are dictated by the presence of a stream or tributary of Brown's Creek and by the quality of lakes or wetlands on the development site. o Rule Not Applicable to Permit Rule 5.0—SHORELINE AND STREAMBANK ALTERATIONS CD According to BCWD rule 5.0,no person shall construct or install a shoreline or streambank improvement below the ordinary high water mark of a waterbody,without first obtaining a District permit. cV CV o Rule Not Applicable to Permit Rule 6.0—WATERCOURSE AND BASIN CROSSINGS F— According to Rule 6.2, no person shall use the beds of any waterbody within the District for the 0 placement of roads,highways and utilities without first securing a permit from the District. 111 o Rule Not Applicable to Permit Rule 7.0—FLOODPLAIN AND DRAINAGE ALTERATIONS According to BCWD Rule 7.2,no person shall alter or fill land below the 100-year flood elevation of any waterbody, wetland, or stormwater management basin, or place fill in a landlocked basin, without first obtaining a permit from the District. No person shall alter stormwater flows at a property boundary by changing land contours, diverting or obstructing surface or channel flow, or creating a basin outlet, without first obtaining a permit from the District. o Rule Requirements Met The project proposes open stormwater conveyances and a commercial building(Rule 7.3.2). The general drainage directions to the southbound ditch along Minnesota State Trunk Highway No. 5 and to the drainage swale running down the center of the Kern Center commercial area are maintained. The lowest proposed floor elevation is 940.0 feet. This allows greater than 2.0 feet of separation between the floor and 100-year high water elevation of Kern Pond(937.9 feet). Erosion control fee for grading or alteration of 5.0— 19.9 acres $1,250 2. Floodplain and drainage alterations fee $500 TOTAL FEES $1,750 Rule 9.0—SURETIES Sureties for this project are as outlined below: 1. All of the conditions 0 must be fully met prior to issuance of the permit. LLJ 1. STIPULATIONS OF APPROVAL: 1. Note that the permit,when issued,will require that the applicant notify the District in writing at least three business days prior to commencing land disturbance.
