Despite such date passing,Staff have taken only limited steps to begin material re-enforcing such ordinances as construction elements have been continuing to wrap up and so there was no confusion. That stated,construction is now complete and unless there is an alternative thought and desire to change or further suspend the City ordinances by the City Council,the City Staff will be seeking compliance on temp.signage,banners,balloons,etc.that was generally in place prior to construction. I5-04-18 CITYCOUNCIL CITY OF OAK PARK HEIGHTS WASHINGTGR COUNTY, MINNESOTA A RESOLUTION ESTABLISHING FINDINGS OF FACT AND RESOLUTION OF THE CITY COUNCIL THAT THE CITYWILL TENIPOk-AMLY SUSPEND ENFORCMENT OF CERTAIN PROVISIONS OF THE SPECIAL EVENT/TEMPORARV SIGN REGULATIONS (SECTION 401.15.G.8)WITHIN THE HIGHWAY36COO IIDOR WHEREAS, the City Council of the City of Oak Park Heights, at its February 26, 2013 meeting,discussed providing special events/temporary sign allowances for business in the Highway 36 corridor impacted the St Croix Rivet' Crossing project: and WHEREAS, the City Council recognizes that with the anticipated construction activities, businesses ad;acent to the north end south frontage roads will suffer from lack of visibility and should be given special provisions for signage, at least on a temporary hasis;.anel 't'4'HEREAS, the City Council shall consider by resolution that the City will temporarily suspend enforcement of certain provisions of the special e-vents/temporary sign regulations (Section 40 .15.07.8). and NOW,THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FORTHE CITY OF OAK PARK HEIGHTS THAT THE CITY COUNCILAPPROVES THE FOLLOWLNG: The City Council of the City of Oak Park Heights suspends enforcement of the special events.itemporary sign regulations in accordance with the following conditions: 1. The area is limited to those businesses in the B-2 General Business District, the B-3 Highway Business and Warehousing District, the B-4 Limited Business District. and the R-B Residential Business Transitional District from the westerly City limits to Beach Road. 2. Only those businesses directly abutting(making contact with)Highway 36 and the North and South Frontage Roads of Highway 36 are subject to this allowance. 3. The suspension in enforcement applies only to Section 401.15.G.8.b related to number of events and time limitations and to Section 401.15.G.8.d.4)related to Page 4 of 20 banners. As a result. the businesses impacted by this suspension will be allowed banners continually during the time limits as specified. 4. The suspension in enforcement will apply from May 1,2014 tc-P October 31.2014, unless an extension is granted by the City Council. The signs and displays described below are permitted for special events in addition to the maximum allowable sign area,provided they are professionally done and the fallowing standards are met and complied with: 1, Balloons. Tents al } Sar�nsrettes and Pennants- 4j Banners- 51 Search lights. a) Search tights as regulated in Section 401.15.B.7.g.1) of this Ordinance. 38 6) Ribbons, Streamers and Air Inflatable Devices—limited to three (3) special event days per calendar year, each no longer than ten (10) days per event. e Prohibited Sims and Displays for Special Events. The signs or displays described below are prohibited for special events: 31,33 1; Animated signs, dynamic display signs, electronic graphic display signs, Multivision signs, video display signs, light bulb strings, and portable signs. 2) zai_�1Ia-'Ys or spzeci:al features on any landscaped areas or on mcdfs.. Aerial rides. 4) Additional lighting that does not meet this Ordinance. 5) Any sign or display in the public right-of-way. f. Sign Permit Rec;Wrements for Special Event Lot Decorations. Before any special event signs or decorations shall be permitted to be used for an event, the responsible property owner or organization small submit a completed application for a sign permit with the City. NSIO R;GT RSGULA—IONS. a. R-1, R-1A, R-113, R-1G, Single Family Residential and R-2, Low to Medium Density Residential Districts. Except as otherwise provided in this Ordinance, signs in these districts shall be limited to: 1) Any multiple dwelling structure with three (3)or more units shall be allowed one(1)monument sign,not to exceed six(6)feet in height or one (1)wall sign, the aggregate square footage of sign space shall not exceed thirty-two(32)square feet_ 2;) Other non-residential uses permitted or conditionally permitted in the R-1, R-1A, R-113, R-1C, and R-2 Districts shall be allowed one monument sign,not to exceed eight(8)feet in height and one(1)wall sign, the aggregate square footage of sign space shall not exceed ferry (40) square feet. The signs shall not be illuminated except by conditional use permit as provided for in Section 401.03 of this Ordinance_ I One(1)freestanding sign,not to exceed six(6)feet in height or one (1) wail sign, the aggregate square footage of sign space shall not exceed four(4)square feet shall be allowed for home occupations as provided for in Section 401.15.M of this Ordinance, and day care nursery facilities as provided for in Section 401.15_N of this Ordinance. HEIGHTS Memo To: Mayor and Council From: Betty Caruso,Finance Director Date: July 22,2016 Y Re: Street Maintenance Work Session Included with this memo is information for OPH's Street Maintenance Plan(Plan). The Plan is based on the amounts listed in the 2016 CIP Budget for the 15 areas defined on the Map. It consists of costs for mill and overlay and future street reconstruction and results in a deficit of$7.7 million over the life span of OPH's roads. v This is reflected on Page 5 and in the chart on Page 6. The Total Street Reconstruction estimate of$26,663,090 is $3.1 million short over the 26 year span with the current funding policy of transferring tax levy dollars to the Street Reconstruction fund and increasing this annually by the Construction Cost Index. The Total Mill and Overlay estimate of$6,148,865 however is $4.6 million short over the 12 year span of maintenance. Current funding consists of$100,000 tax levy transfer to Budgeted Projects. The 2014 and 2015 Street Reconstruction required less funds than anticipated and the remaining balance is approximately$1.2 million. This balance is utilized in the projections therefore reducing the funding defict to $6.5 million. Possible Funding Scenarios for the Plan are on Pages 7-9. • Scenario#1(page 7) -Funds the shortfall with an annual increase in the tax levy of$250,000. • Scenario #2 (page 8)—Adds a change in policy and would assess 25% of the mill and overlay project to all abutting properties. This is approximately$7.00/ft; $14/ft on 581h Street as this road is twice as wide. It also includes an increase of $185,000 in the annual tax levy. • Scenario#3 (page 9)—Looks at the Plan over 10 years. Projections and actuals can vary greatly over the span of 28 years- Cost changes,plans of tax levies can be interrupted due to unforeseen changes, levy limits, and council's actions, and scheduled maintenance can be delayed or accelerated. Plans need to be reviewed every year and re-evaluated every 5 years. Based on this, scenario#3 was developed. It actually utilizes an annual increase in tax levy of$100,000 and the 25% street assessment. Finally,the summary on page 10 shows the impacts of the three scenarios on the residential tax payer. Area Maintenance Chart based on 2015 costs increased by 3%till year of maintenance to arrive at a future value. 3. Maintenance costs do not include utility replacement,engineering or other administrative costs. 4. Present Funding Levels include: Annual Street Reconstruction Tax Levy of$364,200 increased every year by 3%to correspond with Maintenance Chart Expenditure increases. Actual increases per policy are based on Construction Cost Index which has been less than 3%on average. • $100,000 Annual Tax Levy for Mill and Overlay. Started in 2015. Reallocation of Seal Coating Annual Maintenance Levy to Mill and Overlay. • Seal Coating Expenses are not used in calculations for this presentation. This expense is not presently being funded—although this is not a large dollar amount on an annual basis funding should be planned for$50,000 annual levy to fund future amounts. SCENARIO-ASSUMPTIONS 1. Scenario 1- Increase in Tax Levy Only to Fund the full Project as projected. Impact on Residential Property based on 2016 Tax Values. 2. Scenario 2—Increase in Tax Levy to fully Fund the project as projected reduced for an estimate of 25%Assessment for Mill and Overlay. Estimating Assessment at$7.00/linear foot.And $14/linear Foot for 58`h St as it is a wider street. • Assessments for Mill and Overlay assume abutting properties not just those with frontage. For example a corner lot would pay on both sides. 3. Scenario 3—10 year plan. Scenario 1-2 estimate for the 28-30 years of street maintenance. Plans of value need to be re-valued every 5 years and 10 year plans yield better estimates that can be projected. Majority of the next 10 years expenditures will be mill and overlay. Scenario 3 utilizes additional levy and assessments. Both are approximately$1,000,000 each. If either method is preferred,then the "Cost to Taxpayer"can be easily adjusted (by doubling the levy amount to$42 vs$21 or assessment from$560 to$1,120). Page 20 of 20
