WHEREAS, the City of Oak Park Heights has determined the need to designate

residents and local businesses; and,
WHEREAS, Heritage Printing has done the printing for the last four years; and,
WHEREAS, the City has been pleased with the quality of this company in
printing the City newsletter.
NOW THEREFORE, BE IT RESOLVED, that the City Council for the City of

A RESOLUTION RECOGNIZING THE CONTRIBUTIONS
OF MICHAEL DAHLQUIST
AS COMMISSIONER TO THE OAK PARK HEIGHTS
PARKS COMMISSION FROM 1991 -1998
AND PLANNING COMMISSION FROM 1998 -2001
WHEREAS, Michael Dahlquist has served as a Parks Commissioner for the City of
Oak Park Heights from 1991 to 1998; and
WHEREAS, he served as the Parks Commission Chair for the City of Oak Parr
Heights from 1995 to 1998; and
WHEREAS, he has served as a Planning Commissioner for the City of Oak Park
Heights from 1998 to 2001; and
• WHEREAS, he has served as the Planning Commission Vice Chair for the City of
Oak Parr Heights from 1998 to 2001; and
WHEREAS, he has worked to assist the City of Oak Park Heights in shaping the
vision of the City's development and growth through his many hours of participation as a
Commissioner and as a participant in several Committee groups including participation in the
Strategic Planning Commission.
NOW, THEREFORE, BE IT RESOLVED, that the City Council for the City
of Oak Parr Heights commends Michael Dahlquist for his dedication and commitment to the
interests of the citizens of the City of Oak Parr Heights.

and use of existing parr lands throughout the City; and
• WHEREAS, Margie Schwartzbauer's contribution of time, effort and dedication to
the Parks Commission for the City of Oak Park Heights have been sincerely appreciated.

RESOLUTION GRANTING THE APPLICATION OF
WHITETAILS UNLIMITED CHAPER METRO AREA TO CONDUCT
A ONE -DAY RAFFLE AT THE VFW CLUB #323 ON MARCH 31, 2001
WHEREAS, Lindell Blanchette, on behalf of Whitetails Unlimited Chapter
Metro Area has applied with the State of Minnesota Gambling Control Board for a permit
to conduct a one -day raffle on March 31, 2001 at the site of VFW Post #323, 5880
Omaha Avenue North; and
WHEREAS, The City of Oak Park Heights has reviewed the application and
finds that its purposes meet the necessary community standards; and
WHEREAS, the City of Oak Park Heights has solicited the input of the public
and there have been no objections to the granting of the application for the raffle permit
as applied for by Whitetails Unlimited Chapter Metro Area with the State of Minnesota
Gambling Control Board.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR
• THE CITY OF OAK PARK HEIGHTS AS FOLLOWS:
That the application of Whitetails Unlimited Chapter Metro Area with the State of
Minnesota Gambling Control Board to conduct a one -day raffle on March 31, 2001 at the
site of the VFW Post #323, 5880 Omaha Avenue North within the City of Oak Park
Heights and the same are hereby approved.

CITY OF OAK PARK HEIGHTS

RESOLUTION OF THE CITY COUNCIL APPROVING
ADVISORY GUIDELINES FOR ESTABLISHMENT OF CIVIL
PENALTIES FOR THE VIOLATION OF STATE LAW
REGARDING THE SALE OR FURNJSHII\NG.OF
TOBACCO TO MINORS
WHEREAS, Minnesota Statute §609.685 provides that it is a misdemeanor to sell,
barter, furnish or give tobacco to a person under 18 years of age; and a gross misdemeanor for a
second violation within five years; and
WHEREAS, the City conducts regular compliance checks to ensure that those
establishments holding municipal tobacco licenses in the City of flak Park Heights are in
compliance with the state statute. In the event that a tobacco license establishment is proved to have
violated state law, then. the Council is called upon. to determine how to proceed properly; and -
WHEREAS, the City Council, upon proof of violation of state law, may revoke the
• license or permit, suspend the license or permit for a period of time and/or impose a civil penalty for
each violation, or impose any combination of these sanctions.
NOW, THEREFORE, in order to guide the City Council and in order to create a
uniform system for dealing with these violations, the City Council for the City of flak Park Heights
does hereby approve the following:
1. BE IT RESOLVED that the following designated civil penalties shall
constitute advisory guidelines for City Council action in cases of violation of .City issued tobacco
licenses. It is understood that the Council may deviate from these advisory guidelines based upon
compelling circumstances presented in individual cases.
SALE OF TOBACCO TO MINORS
(OR PERMIT A PERSON UNDER THE AGE OF 18 YEARS TO
USE TOBACCO PRODUCTS ON THE LICENSED PREMISES):
First Offense: Five Hundred Dollars ($500) civil fine.
Second Offense: One Thousand Dollars ($1,000) civil fine and one five -day license
suspension (Monday through Friday) .
Third Offense: One Thousand Five Hundred Dollars ($1,500) civil fine and a ten-
day license suspension [to include at least one weekend day (Friday or Saturday)] .
• Fourth or Subseauent Offense: At City Council discretion.
2. BE IT FURTHER RESOLVED that it is the policy of the City Council
that the above sanctions shall be issued and calculated as against all offenses occurring within a 24=
consecutive month period from the date of the most recent violation. Any violations having
occurred beyond. 24 consecutive months prior to the most recent violation shall not be counted in
terms of imposing the sanctions noted above.
3. BE IT FURTHER RESOLVED that if the City Council imposes a civil
fine, the Council shall also allow the license holder a reasonable time to pay the fine. A reasonable
time to pay means that all fines shall be paid within 60 days unless the Council determines that a
longer period of time is justified under the circumstances of the case. Failure of a license holder to
pay a fine within the time prescribed by the City Council shall cause that license to be immediately
suspended until full payment is received. by the City.
4. BE IT FURTHER RESOLVED that any license holder who has had their
license or permits suspended or revoked pursuant to City action shall not be allowed to operate the
activity which required the license until the license is reinstated. Any operation during a period of
suspension or revocation shall be deemed to be an. additional violation of the City's Tobacco
License Ordinance and of state law.

RESOLUTION NO. 01 -02 -15
A RESOLUTION APPROVING AND AUTHORIZING THE
EXECUTION OF A REDEVELOPMENT AGREEMENT
WITH ANDERSEN CORPORATION
It is hereby resolved by the Board of Commissioners (the
"Board ") of the Oak Park Heights Economic Development Authority
(the "Authority ") as follows:
1. Recitals.
(a) The Authority has the powers provided in
Minnesota Statutes, Sections 469.090 to 469.108
(collectively, the "Act ").
(b) Pursuant to and in furtherance of the objectives
of the Act, the Authority has undertaken a program to
promote development and redevelopment of certain land
within the City of Oak Park Heights and in this connection
• is engaged in carrying out its Redevelopment Project within
the City.
(c) There has been approved pursuant to the Act a
Redevelopment Plan for the Redevelopment Project.
(d) The redevelopment and development of property
within the Redevelopment Project by private developers are
stated objectives of the Redevelopment Plan.
(e) Andersen Corporation (the "Developer ") has
presented the Authority with a proposal for the completion
of certain redevelopment undertakings within the
Redevelopment Project, and a certain Redevelopment
Agreement between the Authority and the Developer (the
"Development Agreement ") stating the terms and conditions
thereof and the Authority's responsibilities respecting the
assistance thereof has been presented to the Board for its
consideration.
2. The Board hereby determines that the Authority's
execution and performance of the Development Agreement would be
• in furtherance of the Redevelopment Plan and hereby approves the

Development Agreement substantially in the form presented to the
Board and hereby authorizes the officers of the Authority in
their discretion and at such time, if any, as they may deem
appropriate to execute the same on behalf of the Authority, with
such additions and modifications as those officers may deem
desirable or necessary, as evidenced by their execution thereof.
3. Upon execution and delivery of the Development
Agreement, the officers and employees of the Authority are
hereby authorized and directed to take or cause to be taken such
actions as may be appropriate or necessary on behalf of the
Authority to implement the Development Agreement.
4. The Board hereby determines that the execution and
performance of the Development Agreement will help realize the
public purposes of the Act and are in furtherance of the
Redevelopment Plan and the tax increment plan for the Saint
Croix Mall Tax Increment District.

RESOLUTION 01 -03 -16
A RESOLUTION OF THE CITY OF OAK PARK HEIGHTS REGARDING
SUPPORT FOR FOREST HEALTH BILL (S.F. #862, H.F. #1031) INTRODUCED
IN THE 82 LEGISLATIVE SESSION
WHEREAS, a bill to support community forest ecosystem health programs,
assessments and tree plantin, has been introduced to the House and Senate of the State
of Minnesota during the 82" legislative session, and
WHEREAS, the City of Oak Park Heights has been a recipient of similar grants
in past years which have provided matching funds for oak wilt control, community
forestry education programs and staff training, and
WHEREAS, the City of Oak Park heights recognizes the importance of trees
within our communities and that these trees must be healthy and properly cared for in
order to provide the many benefits associated with trees, and
WHEREAS, the City of Oak Park Heights has long had a commitment to the
• trees within its community, both natural and planted, and
WHEREAS, the City of Oak Park Heights has had a forestry program in place
and been a Tree City, USA community for the past 20 years,
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Oak
Park Heights supports appropriations for forest health issues and grants to communities
for insect and disease control (especially for oak wilt disease), forest health educational
programs, community forestry assessments (such as inventories) and tree planting;
BE IT FURTHER RESOLVED that the City of Oak Park Heights supports the Forest
Health bill (S.F. 9862, H.F. #1031) and asks that the Minnesota Legislature support it
also.

• RESOLUTION NO. 01-03-
CITY OF OAK PARK HEIGHTS
WASHINGTON COUNTY, MINNESOTA
A RESOLUTION VACATING
DRAINAGE AND UTILITY EASEMENTS
LOCATED WITHIN LOT 2 BLOCK 2, JACOB ADDITION
WHEREAS, an application was filed with the City of Oak Park Heights
requesting the City vacate the drainage and utility easements contained within Lot 2,
Block 2, Jacob Addition; and
WHEREAS, the applicant is warranting and representing that it is the
owner of land contained within said property; and
WHEREAS, the public hearings as required by law have been properly
noticed, with hearings conducted before the Planning Commission of the City of Oak
Park Heights as directed by the City Council; and
• WHEREAS, the applicant is proposing a replat of the area contained
within Lot 2, Block 2, Jacob Addition with a reconveyance to the City of Oak Park
Heights of corrected and new drainage and utility easements to replace those that have
been vacated as a result of this proceeding; and
WHEREAS, the applicant's payment of the costs incurred by the City
with respect to these proceedings is sufficient consideration for the vacation thereof.
WHEREAS, the City Council voted to approve the vacation of the same
drainage and utility easements at its meeting of February 13, 2001 meeting.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
FOR THE CITY OF OAK PARK HEIGHTS AS FOLLOWS:
1. That the City of Oak Park Heights does hereby vacate all drainage
and utility easements now contained within existing Lot 2, Block
2, Jacob Addition.
2. The action of the City of Oak Park Heights is contingent upon the
replat of the area known as Lot 2, Block 2 of Jacob Addition and
the rededication therein to the City of Oak Park Heights of new
drainage and utility easements in the manner and form prescribed
• and directed by the Office of the City Engineer and City Planner.
• 3. Be it further resolved that the City Clerk shall prepare a Notice of
Completion of these proceedings which shall contain the name of
the City, the identification of the vacation, the statement of the
time of completion thereof, and a description of the real estate and
land affected thereby. Such Notice shall be presented to the
County Auditor /Treasurer, who shall enter the same in its transfer
records and note upon the instrument over his official signature the
words "Entered Into The Transfer Records." The Notice shall
then be filed with the County Recorder of Washington County, all
as required by Minnesota Statute §412.851.

PROCLAMATION
WHEREAS: Minnesota is home to many of our nation's natural resources, foremost
among them are our beautiful and abundant forests; and
WHEREAS: Trees are an increasingly vital resource in Minnesota today, enriching our
lives by purifying the air, conserving soil, water and energy, creating jobs
through a large forest products industry, serving as recreational settings,
providing habitat for wildlife of all kinds, and creating beautiful landscapes
to make our communities more livable; and
WHEREAS: Human activities such as construction damage, pollution and neglect, as
well as climatic extremes, disease and insects threaten our trees, creating
the need for concerted action to ensure the future of community and rural
forests in our state and throughout the country; and
WHEREAS: Each individual can act locally to improve the environment by planting
trees and ensuring that these trees are protected and receive proper
• maintenance in the years ahead; and
WHEREAS: Each year on the last Friday in the month of April and throughout the
month of May, the people of Minnesota pay special tribute to the vital
natural resource that our trees represent and dedicate themselves to the
continued vitality of our state's community and rural forests;

RESOLUTION 01 -04 -18
A RESOLUTION IN SUPPORT OF HOUSE FILE 2339 (MCELROY) AND
SENATE FILE 2191 (METZEN)
(Providing a partial exemption from the utility personal property tax, and replacement of
lost revenues to host communities)
WHEREAS, the City of Oak Park Heights has hosted an electric utility
generation facility since 1968; and
WHEREAS, the City of Oak Park Height depends upon revenues from the
personal property tax on electric utility attached machinery to compensate the community
for hosting this generation facility; and
WHEREAS, the investor -owned utilities have sought to exempt electric utility
attached machinery at their generation facilities from the personal property tax; and
WHEREAS, the City of Oak Park Heights joined with other generation facility
host communities to express our belief that the personal property tax provides a critical
source of revenue for host communities; and
• WHEREAS, the City of Oak Park Heights, as a member of the Coalition of
Utility Cities, joined with the Coalition of Utility Counties, and Xcel Energy to negotiate
these issues and resolve their concerns; and
WHEREAS, Allete, formerly known as Minnesota Power, was invited to join the
Coalition of Utility Cities, the Coalition of Utility Counties, and Xcel Energy in these
negotiations, but Allete chose not to participate; and
WHEREAS, the Coalition of Utility Cities, the Coalition of Utility Counties and
Xcel Energy have reached an agreement by which the State of Minnesota would partially
exempt electric utility attached machinery from the personal property tax; and the State
of Minnesota would issue revenue bonds to create trust funds for each host community,
so that these trust funds might be invested and the earnings from them would replace the
personal property tax revenues; and
WHEREAS, the above mentioned allocation will be used to remediate the
electric generation facility site in a manner consistent with the requirements of the wild
and scenic river designation upon retirement of the generation facility: and
WHEREAS, the Coalition of Utility Cities, the Coalition of Utility Counties and
Xcel Energy have each agreed to support this proposal and introduce it as legislation
during the 2001 session of the Minnesota Legislature; and
•
WHEREAS, the proposal has been introduced as House File 2339 (McElroy) and
• Senate File 2191 (Metzen) during the 2001 session of the Minnesota Legislature; and
WHEREAS, the Coalition of Utility Cities has requested that each city member
review the proposal and enacts a resolution to support the proposal;
BE IT RESOLVED, by the City Council of the City of Oak Park Heights,
County of Washington, Minnesota that the City of Oak Park Heights hereby approves the
agreement to exempt the personal property tax and establish a trust fund to compensate
host communities, as contained in House File 2339 (McElroy) and Senate File 2191
(Metzen), and requests that the Minnesota Legislature support and pass this legislation
during the 2001 legislative session.

A RESOLUTION ESTABLISHING A NO PARKING
AREA ON STREETS WITHIN THE CORPORATE LIMITS OF
THE CITY OF OAK PARK HEIGHTS LOCATED WEST
OF TRUNK HIGHWAY NO.5
WHEREAS, the City Council has received the report of the Chief of Police of the City of
Oak Park Heights as it affects issues concerning traffic circulation, pedestrian safety and parking issues on
Memorial Avenue, 58`' Street and 55"' Street, all located west of Trunk Highway No. 5 in the City of Oak
Park Heights; and,
WHEREAS, the City Council finds that it is in the interest of the public to establish 55'
Street, Memorial Avenue and 58 Street, all located to the west of Trunk Highway No. 5 within the City of
Oak Park Heights as a "no parking area anytime "; and,
WHEREAS, for convenience of the Stillwater Area High School, it is appropriate to delay
the implementation of the no parking regulations until July 1, 2001.
NOW, THEREFORE, BE IT RESOLVED, by the City Council for the City of Oak Park
Heights as follows:
1. That the City Council does hereby establish 58"' Street, 55`'' Street and Memorial
Avenue, all located to the west of Trunk Highway No. 5 as a "no parking anytime" zone.
2. That the Director of Public Works is instructed to implement and place on or after
July 1, 2001 appropriate "no parking" signage on Memorial Avenue, 55"' Street, and 58"' Street, all located to
the west of Trunk Highway No. 5.
3. That the Chief of Police of the Police Department of the City of Oak Park Heights is
authorized and directed to enforce the no parking anytime restrictions on 55 Street, 58 Street and
Memorial Avenue located west of Trunk Highway No. 5 in the City of Oak Park Heights from and after July
1, 2001.

REGARDING SUPPORT FOR FOREST HEALTH BILL
(S.F. #862, H.F. #1031) INTRODUCED TO THE 82
LEGISLATIVE SESSION
WHEREAS, a bill to support community forest ecosystem health pro assessments
and tree planting, has been introduced to the House and Senate of the State of Minnesota
during the 82 legi session, and
WHEREAS, the City of Oak Park Heights has been a recipient of similar grants in past
years which have provided matching funds for oak wilt control, community forestry
education programs and staff training, and
WHEREAS, the City of Oak Park Heights recognizes the importance of trees within our
communities and that these trees must be healthy and properly cared for in order to provide
the many benefits associated with trees, and
WHEREAS, the City of Oak Park Heights has long had a commitment to the trees within
its community, both natural and planted, and
WHEREAS, the City of Oak Park Heights has had a forestry program in place and been a
Tree City, USA community for the past 20 years,
NOW, THEREFORE, BE IT RESOLVED, that the City of Oak Park Heights
supports appropriations for forest health issues and grants to communities for insect and
disease control (especially for oak wilt disease), forest health educational programs,
community forestry assessments (such as inventories) and tree planting;
BE IT FURTHER RESOLVED that the City of Oak Park Heights supports the Forest
Health bill (S.F. #862, H.F. #1031) and asks that the Minnesota Legislature support it
also.

A RESOLUTION RESCINDING THE APPROVAL OF THE REQUEST FOR
PROPOSAL FOR A COMMUNICATIONS TOWER FROM MAGNUM BUSINESS
SYSTEMS FOR NON PERFORMANCE WITH THE REQUIREMENTS OF THE
PROPOSAL
WHEREAS, the City of Oak Park Heights advertised for Request for Proposals for a
Communications Tower to be built on the north side of the water tower located at 58 Street and
Norell Avenue; and
WHEREAS, the City of Oak Park Heights City Council approved a Request for Proposal
from Magnum Business Systems on June 27, 2000, subject to entering into a final agreement
with the City; and
WHEREAS, the City of Oak Park Heights has worked with Magnum Business Systems
on negotiating a site lease agreement and explained the planning process procedures involved in
establishing a tower and provided them with a draft site lease agreement in November of 2000;
and
WHEREAS, The City of Oak Park Heights City Council directed staff to contact
Magnum Business Systems giving them until April 1, 2001 to contact the City regarding their
current proposal; and
WHEREAS, The City of Oak Park Heights sent a letter on March 19, 2001 to Magnum
Business Systems requesting that they contact the City in regard to their interest in completing
the site lease agreement and establishing a communications tower as outlined in their Request for
Proposal; and
WHEREAS, The City of Oak Park Heights was never contacted by Magnum Business
Systems in regard to their interest in completing the site lease agreement and establishing a
communications tower as outlined in their Request for Proposal; and
BE IT RESOLVED, by the City Council of the City of Oak Park Heights, County of
Washington, Minnesota that the City of Oak Park Heights hereby rescinds approval of the
Request for Proposal for a Communications Tower from Magnum Business Systems for non
performance with the requirements of the proposal.

WHEREAS, the City of Oak Park Heights is within the Metropolitan Service
Area serviced by Metro Transit.
WHEREAS, the City of Oak Park Heights residents depend upon the Metro
Transit service Routes 246 (Stillwater -Oak Park Heights- Bayport) and 294 (Stillwater -
Lake Elmo- Oakdale- St. Paul Express) provided through the Metropolitan Council.
WHEREAS, Route 294 (Stillwater- Lake Elmo — Oakdale — St. Paul Express)
had a Ridership of 98,490 in the year 2000.
WHEREAS, Route 246 (Stillwater — Oak Park Heights- Bayport) had a Ridership
of 9,413 in the year 2000.
. WHEREAS, proposed legislation would significantly reduce necessary funding
to Metro Transit services.
WHEREAS, the Minnesota State Legislature action would force eliminating
entire routes to include Route 246 and 294.
BE IT RESOLVED, by the City Council of the City of Oak Park Heights,
County of Washington, Minnesota that the City of Oak Park Heights hereby disapproves
of legislative action eliminating or cutting transportation funding for Metro Transit
thereby eliminating entire service routes

RESOLUTION OF THE CITY COUNCIL ACCEPTING THE GIFT OF 14 WREN
HOUSES FOR PLACEMENT THROUGHOUT THE CITY OF OAK PARK
HEIGHTS FROM MR AKEY
WHEREAS, Mr. Clifford Akey has presented to the City a gift of 14
Wren Houses for placement throughout the City's Parks; and
WHEREAS, these Wren Houses would improve conditions in the city
for such birds, increasing bird watching opportunities and other natural
environment; and
WHEREAS, at a meeting on May 21 st, the Parks Commission moved
to recommend that the City Council accept the gift of Wren Houses from Mr.
• Akey; and
WHEREAS, State Statues §465.03 (Gifts to Municipalities) requires
that a City may accept a grant or devise of real or personal property, which would
benefit the citizens. Every such acceptance shall be by resolution of the
governing body adopted by a two - thirds majority of its members, expressing such
terms in full.
NOW, THEREFORE, BE IT RESOLVED, that the City Council for
the City of Oak Park Heights acknowledges Mr. Akey's donation with gratitude,
and appropriates the donation of the Wren Houses to the City for placement
throughout the City park system.

WHEREAS, there exist portions of land located within the City of Oak Park
Heights and specifically within the Kern Center 2 °d Addition lying west of Trunk Highway No. 5
and north of 55" Street and south of Trunk Highway 36 within the City of Oak Park Heights which
are currently part of the former Valley Branch Watershed District, now Lower St. Croix Valley
Watershed District; and,
• WHEREAS, hydrologically there are portions of Kern Center 2" d Addition which
practically and effectively flow into Brown's Creek Watershed District; and,
WHEREAS, it has been the express desire of the City of Oak Park Heights through
its City Council that this area be included into and joined with the Stillwater AUAR area and
exempted from storm water run off controls and that this area be transferred from the former Valley
Branch Watershed District, now Lower St. Croix Valley Watershed District and transferred to the
Brown's Creek Watershed District for purposes of implementing this agreement; and,
WHEREAS, these areas to be transferred to the Brown's Creek Watershed District
should also be set up within the AUAR properties already identified within the Brown's Creek
Watershed District as their own sub - watershed taxing district within the Brown's Creek Watershed
District for management of storm waters within the area, with project costs taxed to the affected
areas under the Brown's Creek Watershed District jurisdictional authority; and,
WHEREAS, Brown's Creek Watershed District has indicated to the City of Oak
Park Heights that they concur with the inclusion of these properties into the AUAR program so that
these properties can be established as their own sub - watershed taxing districts with other properties
within the established AUAR project which also benefits and directly addresses the construction
and funding of the trout stream mitigation project (TSMP); and,
WHEREAS, in conjunction therewith, the City of Oak Park Heights recognizes that
there are properties now within the Brown's Creek Watershed Management District as located
within the jurisdictional authority of the City of Oak Park Heights now occupied by Stillwater Ford
• which hydrologically flow into the former Valley Branch Watershed District, now Lower St. Croix
Valley Watershed District and those properties should be transferred from Brown's Creek
Watershed District to the Lower St. Croix Valley Watershed District (formerly Valley Branch
Watershed District) for all watershed regulatory purposes; and,
WHEREAS, Brown's Creek Watershed District concurs with the transference of
that property from their jurisdiction to the Lower St. Croix Valley Water Management District
(former Valley Branch Watershed District).
NOW, THEREFORE, BE IT RESOLVED, by the City Council for the City of
Oak Park Heights as follows:
1. That the City of Oak Park Heights agrees and concurs with the transference
of those lands within the Kern Center 2 "d Addition Project provided that the lands so transferred are
joined into the AUAR program area and are exempted from volume runoff controls to be regulated
under the same principals of other lands regulated within the AUAR area relative to stormwater rate
regulations
2. That the area of the City of Oak Park Heights now occupied by Stillwater
Ford hydrologically flows into the Valley Branch Watershed District, although it has been
jurisdictionally located in the Brown's Creek Watershed District. That the City specifically concurs
and agrees that this property be transferred from the Brown's Creek Watershed District to the
Lower St. Croix Valley Water Management District (former Valley Branch Watershed District) for
purposes of water management and regulatory control.
3. That subject to the foregoing, the City of Oak Park Heights concurs with the
request of the Lower St. Croix Valley Watershed District and the Brown's Creek Watershed
District as contained within their petition dated May 18, 2001 to the Board of Water and Soil
Resources of the State of Minnesota transferring these properties as identified within the City of
Oak Park Heights between those two jurisdictional units.

uninhabitable and in hazardous condition; and,
WHEREAS, both the Building Inspector and the Chief of the Fire Department
providing for building inspection and health and safety services for the City of Oak Park Heights
have determined that the residential structure damage by fire located upon the property at 5887
Beach Road North within the City of Oak Park Heights is uninhabitable and hazardous; and,
WHEREAS, the property owner has been provided time to remove or raze the
property so as to remove the condition of the hazardous building upon the property and has not
completed same as of this time; and,
WHEREAS, the City Council for the City of Oak Park Heights determines it is in
the public interest to proceed at this date to secure the removal of the hazardous building located on
the property at 5887 Beach Road North so as to protect the public; and,
WHEREAS, it appears to the City Council that corrective action under Chapter 463
of the Minnesota Statutes needs to be taken in order to affect the removal of the hazardous building
at this time.

WHEREAS, The City of Oak Park Heights has made and entered into a developer's
agreement with Valley Senior Services Alliance.
WHEREAS, Valley Senior Services Alliance is developing an area known as Boutwell's
Landing.
WHEREAS, The City Council of the City of Oak Park Heights has identified "funding
and completion of city park in Boutwell's Landing project area" as one of its seven goals
for 2001 -2002.
WHEREAS, In accordance with the development agreement, Valley Senior Services
Alliance will be dedicating a reasonable portion of its development to the City for public
uses as parks, playgrounds, public open space, trails, or other amenities in satisfaction of
the City's park dedication requirements.
WHEREAS, City staff has provided the City Council with correspondence explaining
® the park land dedication figures related to the park land located in Boutwell's Landing.
WHEREAS, The City Council of the City of Oak Park Heights will have the opportunity
to accept the park dedication of the park land located in Boutwell's Landing once the area
has been completed and developed to meet the requirements of the development
agreement and other laws.

district at this time in that the single family use may not be the appropriate long term land use for

6. The Planning Commission held a public hearing at their May 10, 2001
meeting, took comments from residents of the area and the public in general, requested
additional information of City staff regarding lot size, and continued the public hearing to their
June 14, 2001 meeting; and
7. City staff researched issues regarding zoning history and lot size
requirements as provided in a June 7, 2001 memorandum; and
8. The Planning Commission continued the public hearing and made the
following recommendation at their June 14, 2001 meeting:
NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING
COMMISSION FOR THE CITY OF OAK PARK HEIGHTS THAT THE PLANNING
COMMISSION RECOMMENDS THE FOLLOWING:
1. That the request for rezoning the property within the Village Area, east of

Single Family Residential be denied in that the Planning Commission finds no compelling
reasons to change the Comprehensive Plan land use designation and zoning district classification

question and determined that no significant land use or zoning district changes would occur in
the area until the St. Croix River Crossing of Highway 36 and roadway changes and
improvements are completed.

findings of fact:

monument sign, and wall signs that exceed the requirements of allowable signs found within
Section 401.15.G.8 of the Zoning Ordinance of the City of Oak Park Heights; and
5. Section 401.15.G.8 of the Zoning Ordinance specifies sign allowances for
• the B -2, General Business District to include one freestanding sign with a maximum of one
hundred fifty (15 0) square feet not to exceed thirty (3 0) feet in height, and two wall signs not to
exceed one hundred fifty (150) square feet total on each facade of the corner lot; and
• 6. City staff prepared a memorandum dated June 7, 2001 reviewing the
request for the variances; and
7. Said memorandum recommended that a partial approval of the requested
variance for sign installation be approved in that the hardship for the variance is the limited
visibility of the dealership from Highways 5 and 36, and the large scale of the building facades.
The signage recommended for the site by City staff included the following:
A. One pylon sign, not to exceed one hundred thirty (130) square feet and
thirty (30) feet in height. The sign would require a base with landscaping
constructed out of materials similar to what is used on the principal
building. Plans for the sign base would need to be submitted by the
applicant for approval by City staff.
B. Two monument signs, at each of the entrances to the site, not to exceed
eighty (80) square feet each and no more than eight (8) feet in height.
C. All proposed wall signage except for the advertising above the windows
on two facades consisting of the wording "alignment, brakes, tires,
shocks /struts and air conditioning."
• D. The applicant may choose the wording/logos on the pylon and monuments
signs based upon the examples provided;
8. The Planning Commission held a public hearing at their June 14, 2001
meeting, took comments from the applicant, closed the public hearing, and made the following
recommendation:

WHEREAS, Safe and Sober is a National Traffic Safety Campaign
designed by the National Highway Traffic Safety Administration seeking to unite
national, state and local efforts to reduce impaired driving crashes and increase
safety belt and child seat use with enhanced and enforcement efforts in public
information and educational activities; and,
WHEREAS, the Chief of Police for the City of Oak Park Heights has
• recommended to the City Council that the City of Oak Park Heights coordinate
and enter into a Grant application with the Stillwater Police Department and the
Bayport Police Department to be submitted to the Minnesota Department of
Public Safety, Office of Traffic Safety for Grant funds, which would enable the
City of Oak Park Heights to enter the Safe and Sober Community's Project for
the period of time of October 1, 2001 through September 30, 2002; and
WHEREAS, the implementation of the Safe and Sober Program within the
Oak Park Heights Community could have a significant effect on public safety by
increasing public awareness of the risks associated with highway travel and
educating the public as to what can be done to manage those risks by use of
seat belts and sober driving and to publicly communicate to the community a
special enforcement efforts that are about to be implemented within the
community effecting the safe and sober program and also providing a report back
to the community with regards to the result achieved through the program; and,
WHEREAS, the City Council for the City of Oak Park Heights feels that
the best interest and public safety of its citizens could be furthered by applying
for the Grant Application in conjunction with the Stillwater Police Department and
the Bayport Police Department.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR
• THE CITY OF OAK PARK HEIGHTS AS FOLLOWS:
That the Oak Park Heights Police Department enter into a Grant
Agreement with the Minnesota Department of Public Safety, Office of Traffic
Safety for the project entitled "Safe and Sober Communities" during the period of
time from October 1, 2001 through September 30, 2002.
BE IT FURTHER RESOLVED, that Chief of Police, Lindy Swanson of the
Oak Park Heights Police Department is hereby authorized and directed to
execute such agreements as may be necessary to implement the project on
behalf of the City of Oak Park Heights Police Department.
BE IT FURTHER RESOLVED, that the Chief of Police, Larry Dauffenbach
of the Stillwater Police Department is hereby authorized to be the fiscal agent
and administer this grant on behalf of the City of Oak Park Heights Police
Department.

A RESOLUTION ESTABLISHING FINDINGS OF FACT AND
RESOLUTION OF THE CITY COUNCIL THAT THE
REQUEST BY DDD LLC TO AMEND ITS CUP /PUD FOR PROPERTY
AT MEMORIAL AVENUE NORTH AND 55 STREET
BE APPROVED WITH CONDITIONS
WHEREAS, the City of Oak Park Heights has received a request from the DDD
LLC to amend its CUP /PUD to allow for access on the northerly side of the west building and to
remove the center island between the two buildings located on property at Memorial Avenue
North and 55` Street; and after having conducted a public hearing relative thereto, the Planning
Commission of Oak Park Heights recommended that the amended CUP/PUD be approved with
conditions. The City Council makes the following findings of fact and resolution:
1.
follows, to wit: The real property affected by said application is legally described as
Lot 2. Block 1 Kern Center 2 n Addition
and
The applicant has submitted an application and supporting documentation to the
Community Development Department consisting of the following items:

2. The subject site is zoned B -3, Highway Business and Warehousing
District in which business and warehousing uses are a permitted use; and
3. DDD LLC proposed a change in the site plan to add a driveway on the
northerly side of the west building to improve access and to remove the landscaped triangle
between the two buildings to allow for better delivery truck access; and
4. City staff prepared a memorandum dated July 31, 2001, reviewing the
request for the CUP /PUD; and
5. Said memorandum recommended approval of the CUP /PUD and site plan
subject to the conditions listed below; and
•
6. The Planning Commission held a public hearing at their August 9, 2001
meeting, took comments from the applicant and the public; closed the public hearing; and
recommended that the amended CUP /PUS and site plan be approved su 'Ject to the fulfillment of
various conditions.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR
THE CITY OF OAK PARK HEIGHTS THAT THE CITY COUNCIL RECOMMENDS
THE FOLLOWING:
A. That the request for an amended CUP/PUD and site plan for the DDD
LLC to allow for access on the northerly side of the westerly building and removal of the center
island between the two buildings located on property at Memorial Avenue North and 55 Street
affecting real property as follows:
Lot 2, Block 1 Kern Center 2 "d Addition
Be and the same as hereby approved by the City Council of the City of Oak Park Heights for
approval with the following conditions:
1. The driveway access at the north side of the westerly building shall be at
least 20 feet wide.
2. The storm water pond shall be constructed compliant with
recommendations of the Valley Branch Watershed District and the City Engineer.
3. The trash enclosure shall be sized to accommodate at least two dumpsters
and shall be constructed of materials similar to the principal buildings on site.
4. All conditions of the CUP /PUD and site plan approval made by the City
Council at their April 24, 2001 meeting shall be complied with by the applicants.

LEVIES
WHEREAS, the City Staff has prepared and submitted to the
City Council it's proposed budget for calendar year 2002; and,
WHEREAS, the City Council for the City of Oak Park Heights
has determined that the proposed budget as submitted by the City
Staff is in the best interests of citizens of the City of Oak
Park Heights.
NOW, THEREFORE, BE IT RESOLVED by the City Council for the
City of Oak Park Heights as follows:
1. That the 2002 proposed budget is hereby approved as
presented by City Administration in the total General
Fund amount of $2,658,520.00.
2. That the City Administrator is hereby authorized and
directed to certify to Washington County the Proposed
General Fund levy for the City of Oak Park Heights for
the calendar year 2002 in the amount of $1,906,179.00.
• 3. The City Administrator is also authorized and directed
to certify to Washington County a special levy to be
added to the Proposed General Fund levy in the amount
of $2,000.00 for the PERA contribution rate increase.
4. The City Administrator is also authorized and
directed to certify to Washington County for
collection the proposed sum of $59,400.00 for General
Obligation Bonds of 1995, to be collected in calendar
year 2002.

THE PROTECTION, SAFETY AND SECURITY OF OUR CITY
WHEREAS, public safety is an essential need of the City of Oak Park Heights; and
WHEREAS, the various services required to protect our city are provided by a combination
of several public and private agencies; and
WHEREAS, these resources include the fire departments of Bayport and Stillwater, the
police departments of Bayport, Stillwater and Oak Park Heights, the Washington County Sheriffs Office
and other paramedical and emergency response personnel; and
WHEREAS, providing these services requires a high degree of commitment and involved
personal risk; and
WHEREAS, all Oak Park Heights residents and businesses and their visitors, customers and
• employees directly benefit from these services; and
WHEREAS, the tragic events of September 11, 2001 vividly demonstrate the critical
importance of qualified public safety personnel and the great courage and dedication often required of them.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Oak Park
Heights hereby expresses its deep appreciation and high esteem to all the firefighters, law enforcement
