Dear Sir/Madam:
In June of 1997, the City Council authorized a review of site lighting for locations within the
community that were perceived to create glare beyond the allowances of the lighting
regulations found in the Oak Park Heights Zoning Ordinance. The Council was concerned
about the amount of glare and how it affects surrounding residential properties and public
roadways.
The lighting regulations require that all site lighting be arranged to deflect light away from
any adjoining residential zone or from public streets. Any light or combination of lights
which cast glare on a public street shall not exceed one (1) foot candle (meter reading) as
measured from the center of an abutting street. The Council employed Engineering
Development Network, Inc. to measure the light levels and found that the lighting at your
site exceeds the allowances of the ordinance (see attached).

Three Existing Retail Sites

Dear Mr.Robertson:
We completed our survey of the exterior site lighting last week at the designated following
three retail sites:
Stillwater Amoco Station-60th Street&Osgood Avenue
St. Croix Car Wash-59th Street& Osgood Avenue
Stillwater Ford-Lincoln-Mercury-60th Street& Stillwater Boulevard

Owners and/or managers were contacted at all sites,and they were most cooperative in
having their site exterior lighting fully illuminated including signage during hours of
complete darkness as we requested.
Light levels were measured in "footcandles" using a Gossen Panlux Electronic 2 light meter
whereby light levels as low as 0.1 FC may be measured on a 2 FC full scale. All
measurements were made at ground level.
Direct glare/brightness observations are strictly qualitative based upon Illuminating
Engineering Society standards and criteria.
Study results were compared with criteria stated in the City Ordinance on Page 15-7 Article
7 titled Glare as they were applicable.

We are submitting our report of the study findings enclosed with this letter. The report
describes each site lighting system and presents site perimeter light levels and surrounding
area direct glare/brightness observations and comments.
We believe the study and report results, in general, satisfactorily cover the subject matter as
we discussed.

Site Perimeter Lighting Intesity Study

Introduction
A study was conducted during June 1997 to measure site perimeter light levels,observe
exterior lighting direct glare/brightness and compare their compliance with City Ordinance
Glare criteria at the following sites:

St. Croix Car Wash -59th Street& Osgood Avenue
Stillwater Ford-Lincoln-Mercury -60th Street& Stillwater Boulevard

Direct glare and brightness from exterior lighting as observed at the site perimeters,
roadways and adjacent.properties were noted as follows:
Stillwater Amoco -Canopy dropped lens lights were very bright with intense direct
glare in all directions.
- Canopy individual light fixture brightness and direct glare was quite
intense from the adjacent property and maintained a relatively high
brightness at longer distances from 0.1 to 0.25 mile.
-Canopy lighting appeared that it could present an potential
objectionable glare to oncoming vehicles on Osgood Avenue.
-Pole"shoebox"light fixtures have a 45 degree forward tilt toward
the front of the site,but glare/brightness was absorbed by the
canopy lights.
St. Croix Car Wash - Canopy dropped lens lights were extremely bright with very intense
glare in all directions.
-Canopy individual light fixture brightness and direct glare was very
intense from the adjacent property and maintained a relatively high
brightness at longer distances from 0.1 to 0.5 mile including the SE
nearby housing complex.
- Canopy lighting appeared that it could present an intense glare to
oncoming vehicles on Osgood Avenue.
-Canopy lighting did extend beyond the property lines and illuminated
adjacent buildings to the SE including a church and housing.
- North building mounted floodlight is directed at 60 degrees above
horizontal and may present direct glare to north drive vehicles.
-South pole light fixtures lighting and glare is fairly well contained on
the site.
Stillwater Ford, -25'poles with multiple"shoebox"lights have flat horizontal lens
Lincoln,Mercury with low brightness and moderate glare at the site perimeter/street and
minimal glare from adjacent properties.
-Pole mounted 14' height floodlights are directed away from the
street with negligible direct glare to roadways and adjacent property.
-Building mounted N/W/S floodlights serve areas close to the
building and are a substantial distance from the property lines and
roadways, thereby present negligible glare.
-A more prevalent level of entire site brightness resulted from pole"
mounted flag illumination reflected glare.
-Overall total site surface light levels make it a large area source of
indirect reflected glare/brightness from distant SE housing.

Conclusions:
1. Stillwater Amoco and St. Croix Car Wash light levels of,respectively, l.5FC and
4.OFC at the street center-line exceed City Ordinance 1FC maximum.
2. Stillwater Amoco and St. Croix Car Wash canopy dropped lens and high intensity metal
halide lamped light fixtures provide an extremely high level of brightness and direct glare to
surrounding areas and roadway vehicular traffic.
3. Stillwater Ford Lincoln Mercury glare controlled pole top shoebox flat lens area light
fixtures, on-site directed floodlight and set-back building mounted floodlights maintain an
acceptable glare/brightness level as viewed by surrounding property and roadways.
4. Lamp shielding from property line may not be realistic for all light functions,but light
fixture alternative lamp shielding and low brightness lenses/diffusers can control offsite
glare within more desireable City established parameters.
This study and accompanying report was prepared at the request of the City Of Oak Park
Heights.

Site Lighting Ordinance Compliance Study
Three Existing Commercial Sites

Dear Mr. Robertson:
Thank you for this opportunity for Engineering Development
Network, Inc . (EDN) to submit our proposal to provide Electrical
Engineering Services for the referenced project .
PROJECT DESCRIPTION; `
We understand this project to consist of a site lighting
ordinance compliance study at Amoco Service Station, Union 76 .
Service Station/Car Wash and Stillwater Ford located near Highway
36 in Oak Park Heights, Mn
EDN shall provide Electrical Engineering Services for a,
study/report of Site Lighting System consisting of property line
horizontal footcandle light level measurement and qualitative
(visual observation) survey of offsite degree of direct glare and
brightness .
BASIC SERVICES:
Basic Electrical Engineering Design Services shall consist of the
following:
* Survey existing exterior site lighting equipment .
* Light meter measure min/max light level at lot lines (4)
* Visually observe offsite degree of direct glare/brightness .
* Submit letter report of study results

FEE COMPENSATION:
Basic Engineering Services shall be fee compensated at an hourly
cost/plus fee (hourly rates stated below) not to exceed One
Thousand Dollars ($1, 000)
Basic and Additional Electrical services standard hourly charge
rates shall be as follows :
Clerical $38 . 00/hr
Drafter $50 00/hr
Designer $65`. 00/hr
Engineer $75 . 00/hr
Principal $85 . 00/hr
Fee compensation shall be invoiced and paid monthly in proportion
to services completed. Payment is due within 30 days of invoice.
Unpaid balance shall bear interest at 1% per month.
SUPPLEMENTAL
This proposal is based upon the City Of Oak Grove Heights and/or
their representatives providing site configuration and property
lines drawings . Site owners/managers operationg site lighting
after normal businesss hours during periods of total darkness .
ADDITIONAL SERVICES:
Additional Electrical Engineering Services shall be provided upon
request with written authorization on an hourly fee basis and
shall include:
* provide site plans showing light levels at lot lines
* provide site plans showing lighting equipment
* present study report to council
* quantitative direct glare/brightness measurements
* expansion of the project scope

REIMBURSABLE EXPENSES:
Miscellaneous reimbursable service expenses shall include:
* Study report additional copies printing at 1 . 15 times our
cost
* Lightmeter rental cost at 1 . 15 times our cost
* Long distance phone calls, courier service, postage, fax
charges at 1 .15 times our cost .
* Owner meetings & site visit travel at' $0 .315/mile: •
SUSPENSION OR TERMINATION OF SERVICES:
The client or Engineering Development Network, Inc . (EDN) may
suspend or terminate any or all services covered by this
agreement at any time, subject to theclient ' s giving a minimum
of five days written notice to EDN of suspension or termination.
In the event of such suspension or termination by client, EDN
shall be paid for services rendered to ,date of the suspension or
termination, including all unpaid Additional Services rendered
and unpaid Reimbursable Expenses incurred. Such payment shall be
an amount equal to the actual hours of services furnished at the
preceding hourly rates .
DISPUTES
Any controversy or claim arising out of or relating to this
agreement, or the breach thereof, shall be settled by arbitration

in accordance with the Commercial Arbitration Rules of the
American Arbitration Association, and judgement upon award
entered in any court having jurisdiction thereof .

MISCELLANEOUS:
If the above conditions are acceptable, this letter shall serve
as a contractual agreement between Engineering Development
Network, Inc . and City Oak Park Heights (Client)
If the above conditions are acceptable, please sign the two
copies, retain one copy and return the second copy of this
agreement as a record of our contract .

Re : Lighting Measurement at sites in Oak Park Heights
Dear Mr. Wilmer:

of the buildings in question is old enough so that precise lot
sizes are available for only one of them.

Annexation Area Park Design - City Planner Richards reviewed a
report detailing possible park designs and boundaries, as
requested by the Haase family and Tim Nolde. Tim Nolde, Daryl
Haase, and Linda Haase Pilgreen were present . Nolde also
submitted a proposed park and subdivision plan. Council was in
consensus that the east-west park concept, designated as "Plan
A", was preferable . Councilmember Robert stated that the Parks
Commission would review the concept plans and make
recommendations at the next Parks Commission meeting scheduled
Tuesday, April 16th, 1997. Nolde requested the Council set the
southern and eastern boundaries of the park so he can proceed
with development plans . After considerable discussion,
Councilmember Beaudet, seconded by Robert, moved to approve
Concept Plan A for eastern and southern boundaries of the park on
the 40 acres in question, subject to park access changes.
Carried 3-i . Councilmember Turnquist opposing.
New Business:
Staff Report - Cover Park Neighborhood Request for Rezoning -
City Planner Teague reviewed a Staff report prepared in response
to some Cover Park residents ' request that the City rezone a
large portion of land currently zoned R-2, Low and Medium Density
Residential to R-1, Single Family Residential in the area south
of 59th Street, east of Peabody Avenue, and west of Highway 95 .
Council discussed land use issues and structures that would be
defined as non-conforming if the land was rezoned. City Attorney
Vierling stated that the petition was signed by a very small
percentage of residents/property owners who live in the area.
Councilmember Robert, seconded by Turnquist, moved to table
discussion until the next Council meeting. Carried 4-0 .
Lighting Ordinance Discussion - Council reviewed a memo from City
Planner Richards regarding the lighting regulation material
provided by Councilmember Robert . Council directed City Planner
Richards draft a proposed lighting ordinance . Council directed
Administrator Robertson measure the light intensity at Stillwater
Ford, the car wash, and Amoco station to see if they would meet
current lighting regulations .
Council Chamber Remodeling Plans - Council was in consensus to
table discussion of this issue.

Joint Powers Agreement with the City of Bayport to undertake the
