MINUTES OF MEETING HELD MONDAY, FEBRUARY 13, 1989
Call to order by Mayor Sommerfeldt at 7:00 p.m. Present: O'Neal,
Kern, Seggelke, Doerr, Eckberg and Wilson.
Clerk read public hearing notice and presented affidavit of
publication on amendment to Ordinance #401 primarily relating to
administration and processing of building permits. Mayor called
for comments. Seggelke, seconded by O'Neal, moved to_ close
hearing. 5 aye votes. Hearing closed.

Seggelke, seconded by O'Neal, moved to adopt the above Ordinance.
Roll call vote taken with 5 aye votes cast. Ordinance amended.
ParkingOrdinance hearing was continued. Mayor called for
comments and discussion ensued. Seggelke, seconded by Doerr,
moved to close hearing. 5 aye vote. Hearing closed.
O'Neal, seconded by Doerr, moved to adopt amendment to above
Ordinance with the following exceptions: Delete Section 2.6.c.
Section 2.6.d to read as follows; The boulevard portion of the
street right-of-way shall not be used for parking except on
designated driveways. Section 2 . 6.h to read as follows.; Truck
Parking in Residential Areas. No more than one stake-bed truck
under 7,000 GVW or other truck under 12,000 GVW shall be parked
off-street in a residential zoned district, except when loading,
unloading or rendering a service. Roll call vote taken with 5
aye votes cast. Ordinance amended.
Seggelke, seconded by O'Neal, moved to schedule a public hearing
Monday, February 27th at 7:00 p.m. on request from Andersen
Corporation for a Conditional Use Permit to temporarily park
vehicles for a three month period on property owned by Trinity
Lutheran Church. 5 aye votes. Carried.
Doerr, seconded by Kern, moved to schedule a public hearing,
Monday, February 27th at 7:00 p.m. on request from Peter Miller
for rezoning of his property. 5 aye votes. Carried.
Doerr, seconded by Kern, moved to schedule a public hearing
Monday, March 13, at 7:00 p.m. to rezone existing commercial
properties in newly annexed area alopg Highway #36. 5 aye votes.
Carried.
Seggelke, seconded by O'Neal, moved to delete pistol range from
City Hall Expansion project. Aye votes cast by Seggelke, O'Neal,
Kern and Sommerfeldt. Nay vote cast by Doerr. Carried.
O'Neal, seconded by Doerr, moved to transfer $500,000.00 from
Closed Bond Fund to Capital Outlay Fund for Hall Expansion
project. 5 aye votes. Carried.

Attached please find a draft of the proposed changes to the Oak
Park Height' s Parking Ordinance as discussed at the 4 January
workshop. These changes are, however, presented in an
informational format rather than as an Ordinance amendment due
to the need for explanation to be given for the various changes
being proposed.
Although the Ordinance may appear different than originally
envisioned at the workshop, it still achieves the basic intent of
establishing stricter regulations for R-1 Districts and new
developments while maintaining existing regulations for the older
R-2 Districts . The recommended changes also expand the exterior
storage requirements of the Ordinance to cover a more
comprehensive list of items while limiting the number of
recreational vehicles and equipment that may be stored outside.
Please review these recommended changes and associated comments .
If they are found acceptable or only in need of minor revision,
they may be put into Ordinance format for your next meeting
(February 13, 1989 ) . If you have any questions regarding these
changes, please do not hesitiate to call .

SECTION 401. 04 .B. 14 - EXTERIOR STORAGE
Exterior Storage. All materials and equipment except as provided
below and in Sections 401 .05 through 401 . 14 of this Ordinance
shall be stored within a building or fully screened so as not to
be visible from adjoining properties, except for the following:
a. Clothes line poles and wires .
b. Not more than a total of two (2) recreational vehicles
and/or pieces of equipment (not including racing cars) .
c . Construction and landscaping materials currently being used
on the premises .
d. On and off-street parking of currently registered and
operable passenger vehicles and trucks not to exceed a gross
weight of twelve thousand ( 12 ,000) pounds .
e. Lawn furniture or furniture used and constructed explicitly
for outdoor use.
f . Rear or side yard exterior storage of firewood for the ,
purpose of consumption only by the person or persons on
whose property it is stored.
Comment: The number of recreational vehicles and equipment that
may be stored outside has been limited while the type of items
that are acceptable in exterior storage has been expanded. The
latter items (e and f) have most likely been previously allowed,
however, the Ordinance would now recognize their acceptability.
SECTION 401. 04 .E - OFF-STREET PARKING REQUIREMENTS
6 . Location. All accessory off-street parking facilities
required by this Ordinance shall be located and restricted
as follows :
a. Required accessory off-street parking shall be on the
same lot under the same ownership as the principal use
being served, except under the provisions of Section
401 . 03 .E . 9 .
b. Except for single, two family, townhouse and
quadraminium dwellings, head-in parking, directly off
of and adjacent to a public street, with each stall
having its own direct access to the public street,
shall be prohibited.

c . There shall be no off-street parking within fifteen
( 15) feet of any street surface.
d. The boulevard portion of the street right-of-way shall
not be used for parking.
e. Setback Area - Required Accessory Off-Street Parking.
Required accessory off-street parking shall not be
provided in required front yards or in required side
yards abutting a public street for all uses within R-1
and R-2 Districts and for quadraminium and townhouse
dwellings within R-3 and R-B Districts . Said parking
must be provided within a garage, car port, or on a
defined driveway constructed of concrete or bituminous
materials . Said driveway may be constructed of crushed
rock for properties developed] prior to March 10, 1980
and within existing R-2 Districts .
Comment: This is basically the same provision as in the
existing Ordinance only with greater clarification. Required
accessory parking specifically refers to the two (2 ) parking
spaces required by Ordinance for single family, two-family,
quadraminium and townhouse dwellings . They are the parking
spaces that are typically provided within a garage or on a
driveway alongside the dwelling unit. The reason these spaces
are not prohibited from required side (except when abutting a
street) or rear yards is due to the case when such spaces are
provided in a detached garage. A detached garage may be located
within a property' s required side and rear yards subject to the
City's accessory building setback requirements . A change that
was made, however, is an exception for the construction of
driveways within older developments of R-2 Districts . This
change was made to accommodate those properties within "lower Oak
Park" that do not contain paved driveways .
Townhouse and quadraminium dwellings are singled out within R-3
and R-B Districts (single and two-family dwellings are not
allowed) to maintain similar requirements as in the R-1 and R-2
Districts . Multiple family structures and uses within the B-1,
Neighborhood Business District intentionally are excluded from
this requirement as it may be desirable to provide parking within
the front yard of such uses and districts .
f . Setback Area - Accessory Off-Street Parking (General) .
Accessory off-street parking provided above and beyond
the requirements of this Ordinance for all uses within
R-1 and R-2 Districts and quadraminium and townhouse
dwellings within R-3 and R-B Districts shall be subject
to the provisions below:

(1) For all uses and districts listed above except R-2
Districts developed prior to March 10, 1980:
Accessory off-street parking shall be provided on
a designated driveway leading directly into a
garage and/or on one ( 1) designated parking pad
contiguous to the driveway and located away from
the principal use. Said driveway may be located
within front or rear yard setback and must be
constructed of concrete or bituminous materials .
Said parking pad may be located within same
setback as contiguous driveway and also within the
adjacent side yard setback provided subject side
yard does not abut a public street. Said parking
pad must be constructed of concrete, bituminous
materials or crushed rock.
( ii) For all uses within R-2 Districts developed prior
to March 10, 1980 : Accessory off-street parking
shall be provided in the rear yard or on a
designated driveway leading into a garage and/or
one ( 1) designated parking pad contiguous to the
driveway and located away from the principal use.
Said driveway and parking pad must conform to the
provisions of Section 401 . 04 .E. 6 . f. (i) regarding
placement and materials of construction.
Comment: The above provisions would replace the Ordinance' s
existing provision ( f) and separate the accessory parking
requirements according to when the property was developed. This
approach was chosen over the separation of existing and new R-2
Districts (as discussed at the workshop) on the basis that
redevelopment within the older R-2 Districts should occur at
maximum City standards . The proposed Ordinance would require
this of potential redevelopments, however, it would also allow
existing properties within the R-2 District to be regulated by
the more lenient provisions .
Item ( i) requires that all general accessory parking be provided
on a driveway or parking pad that may be within front, side and
rear yard setbacks while Item ( ii) requires that all general
accessory parking be provided on driveway or parking pad (with
the same provisions) or within the rear yard. The current
Ordinance' s applicable provision is similar to Item (ii) .

g. Recreational vehicles and equipment may be parked in
front, side or rear yards provided they are parked on
designated driveways or parking pads and do not hinder
day to day use of required off-street parking.
h. Truck Parking in Residential Areas . No more than one
stake-bed truck over 7,000 GVW or other truck over
12,000 GVW shall be parked on or off-street in a
residential zoned district, except when loading,
unloading or rendering a service.
Comment: The provisions (g) and (h) are the same as in the City
Attorney' s draft Ordinance ( 17 August 1988) with the
exception that recreational vehicles and equipment may be parked
in the side yard provided they are on a designated driveway or
parking pad.

River Hills project. 4 aye votes. Carried.
O'Neal, seconded by Kern, moved to purchase computer equipment as
outlined and buy outright at a cost of $21,438.50. 4 aye votes.

MINUTES OF PARKING ORDINANCE WORKSHOP HELD WEDNESDAY, JANUARY 4, 1989
7:00 P. M.
Present: Sommerfeldt, Doerr, O'Neal, Seggelke, Kern, Holst and Gutoske.
Ordinance currently allows parking in driveway and one accessory space in
front yard on driveway, away from principal use. Can park anywhere in side
or rear yard. Driveway must be concrete, asphalt or crushed rock.

until meeting of January 23, 1989 . 5 aye votes. Carried.
O'Neal, seconded by Doerr, moved to grant preliminary approval of
snowplowing contract with additions to be made by City Attorney
and presented at council meeting January 9 , 1989. 5 aye votes.

Perry Furgala as warming house supervisors. 5 aye votes.

O'Neal, seconded by Doerr, moved to make a donation of an
unspecified amount at this time, to the Minnesota Peace & Police
Officers Association for the children and drugs project. 5 aye
votes. Carried.

rate increase for 1989 . 5 aye votes. Carried.

Snowplowing Fund ($3468 .50) to General Fund Capital Outlay for

O'Neal, seconded by Seggelke, moved to transfer $9, 000.00 from
1988 Tree Removal Fund to 1989 Tree Removal Fund. 4 aye votes.

Seggelke, seconded by O'Neal, moved to direct City Staff to
advertise for sealed bids for used squad cars. Bids to be opened
Tuesday, December 27th at 2:00 p.m. Stipulation to be noted that
squads are not available until new squads have been delivered. 4
aye votes. Carried.
Torgerson, seconded by O'Neal, moved to approve 1989 liquor,
bingo, amusement and cigarette licenses as presented. 4 aye
votes. Carried.

Occupation licenses as presented. 4 aye votes. Carried.

suggestions and recommendations.

401.03 GENERAL PROVISIONS

required by this ordinance shall be located and restricted
as follows:

prohibited.
c. There shall be no off-street parking within fifteen
( 15) feet of any street surface.
d. The boulevard portion of the street right-of-way shall
not be used for parking.

COMMENT: The phrasing of the wording ( in the case of t
a corner lot) leaves it somewhat ambiguous
as to what it is being applied to, i.e. are we
talking side yard setbacks only on corner
lots or on all lots?
At the present time, the Council should be
aware that we do have a significant amount
of exterior storage and parking of trailers
on side yards on existing corners.
f. In the case of single family, two-family, townhouse and
quadraminium dwellings, parking shall be prohibited inYt-

driveways leading directly into a garage or one ( 1) ?

12,000 GVW shall be parked on or off street in a
residential zoned district, except when loading,
unloading or rendering a service.

1117.03 No vehicle shall be parked on any street in the City
of Oak Park Heights for more than twenty-four ( 24)
consecutive hours.
PROPOSED:
1117.03 (a) No vehicle shall be parked on any street in the
City of Oak Park Heights for more than twenty-four
(24) consecutive hours.
(b) No motor vehicle over one-ton and 12,000 G.V.W.
capacity bearing a commercial license and no
commercially licensed trailer shall be parked on
any street or roadway in any area in the City of
Oak Park Heights which is zoned residential
except when such vehicle is engaged in loading
or unloading or rendering a service in the area
involved.

Based upon conversation with City staff, .our office has attempted to respond
to issues and concerns which have been identified relative to parking in residential
areas.
Our review of the Zoning Ordinance and City code suggests many of regulations.
needed are in fact already enacted and part of established standards. This would
indicate enforcement needs to be pursued. We have, however, drafted several re-
visions which attempt to clarify present regulations or expand coverage as a means
to further respond to problems which exist. Our suggestions in this regard are
attached.
Please note that our approach has been to have the Zoning Ordinance govern all off-
street parking matters dealing with parking and storage on private property. The
general City code is being relied upon for on street parking.
Our office is expecting to be represented at your workshop meeting on 26 July
where this matter will be more fully discussed.

I spoke with Oak Park Heights Chief of Police, Gene Ostendorf and
he outlined the specific issues prompting this study. Basically,
the City would like to clear up two problem areas : 1) . Get
commercial vehicles out of residential areas, and 2 ) . Regulate
the placement of vehicles in residential yards . Al and I
discussed the issues and I went from there.
I reviewed the existing ordinance and found that the following
areas of concern are addressed. (Pleease see attachments) :
* Commercial vehicle parking in required residential off-
street parking.
* Storage of unlicensed/inoperable vehicles .
* Other outside storage in residential areas .
* Home occupation requirements for parking and exterior
storage.
* Parking in residential front yards .
Problems in th:e City that are related to the above list of items
may be controlled with stricter enforcement .
Consequntly, I focused on items of concern that are either, not
addressed or not stringent enough.
By adding the following entries to the Ordinance, the problems
the City is experiencing may be alleviated.

10. Dust and Other Particulated Matter. The emission of
dust, fly ash or other particulated matter by any use
shall be in compliance with and regulated by the State
of Minnesota Pollution Control Standards , Minnesota
Regulation APC 1-15, as may be amended.
11 . Odors. The emission of odor by any use shall be in
compliance with and regulated by the State of Minnesota
Pollution Control Standards , Minnesota Regulation APC
1-15, as may be amended.
12 . Noise. The emission of noise by any use shall be in
compliance with and regulated by the State of Minnesota
Pollution Control Standards , Minnesota Regulation NPC
1 , as may be amended.
13 . Refuse. Passenger automobiles., station wagons and
trucks not currently licensed by the State, or which
are, because of mechanical deficiency, incapable of
movement under their own power , parked or stored
outside for a period in excess of thirty (30) days , and
all materials stored outside in violation of the City
Ordinance are considered refuse or junk and shall be
disposed of. The piling of junk in yards in all
residential districts shall be considered to be a non-
conforming use and shall be removed within a period of
three ( 3) months after the effective data of this
Ordinance.
14 . Exterior Storage. All materials and equipment except
as' provided for in Sections 401 . 05 through 401 . 13 of
this Ordinance shall be stored within a building or
fully screened so as not to be visible from adjoining
properties , except for the following:
a. Clothes line pole and wires.
OS Recreational equipment and vehicles.
c. Construction and landscaping material currently

C. Yard Requirements.
1 . Purpose. This Section identifies minimum yard spaces
and areas to be provided for in each zoning district.

2 . No lot, yard or other open space shall be reduced in
area or dimension so as to make such lot, yard or open
• space less than the minimum required by this Ordinance,

spectators occupy benches , pews or
other similar seating facilities,
each twenty-two (22) inches of such
seating facilities shall be counted
as one ( 1) seat for the purpose of
determining requirements.
( 3) Should a structure contain two (2)
or more types of use, each use
shall be calculated separately for
determining the total off-street
parking spaces required.
h. Stall , Aisle and Driveway Design.
( 1) Parking Space Size . Each parking
space shall be not less than three
hundred ( 300 ) squarefeet ,

e. Setback Area. Required accessory off-street
parking shall not be provided in front yard

f. In the case of single family, two family,
townhouse and quadraminium dwellings , parking
shall be prohibited . in any portion of the
front yard except designated driveways
leading directly into a garage or one (1)
open, surfaced space located on the side of a
driveway, away from the principal use. Said
extra space shall be surfaced with concrete

7 . Use of Required Area. Required accessory off-
street parking spaces in any district shall not be
utilized for open storage , sale or rental of
goods , storage of inoperable vehicles: as regulated
• by Section 401 .03 .B. 14 of this Ordinance, and/or
storage of snow.

401A. 02 Permitted Uses. All types of Home Occupations are
allowed except those restricted to commercial or
business zoning districts within the City as provided
in Section 401 . 09 , 401 . 10 , 401 . 11 and 401 . 12 of the
Zoning Ordinance of the City of Oak Park Heights.
• Examples of occupation to, be permitted as Home
Occupations within the City of Oak Park Heights are
those of art studio, dressmaking, special offices of
clergymen , architect offices , engineer offices ,
accountant offices, attorney offices , real estate
agent-appraiser offices , day care or group foster home
or other similar uses which have no storage or
merchandise , are service orientated , have no retail
sales of goods on the premises , and do not generate
vehicular traffic in excess of an amount normally
experienced in residential districts.
401A.03 Prohibited Activities. The following restrictions
shall apply to all Home Occupations within the City of
Oak Park Heights.
a. Home Occupation shall be carried on only by the
members of the family residing within the dwelling
unit.
b. There shall be no exterior storage of equipment or
• materials used in the Home Occupation.
c. There shall be no visual evidence of the Home
Occupation outside of the principal or accessory
structure in which it is located.
d. Objectionable noise , vibration, smoke, dust,
electrical disturbances , heat, glare or hazardous
or toxic material shall not be produced, stored or
kept upon the premises. Any waste disposed of in
the sewer system shall not create or cause a
greater volume than that which is normally
generated by a single-family residential dwelling.
e. There shall be no on-site advertising allowed.
f. The Home Occupation shall not cause internal or
external alterations of substance to the dwelling
unit nor shall it involve construction features
not customarily found in single-family residential
dwellings.
g. There shall be no retail sales allowed on the
premises.

401A. 04 Parking . No Home occupation shall be permitted which
generates more than two cars on-street parking. Off-
street parking spaces must be in a garage, garage apron
or driveway. There shall be no more than four off-
street parking spaces.
401A. 05 Conditional Use Permit Required. The fee owner of a
residential dwelling in which a Home Occupation is
proposed to be conducted shall be required to obtain a
Conditional Use Permit from the City of Oak Park
Heights before engaging in any such occupation or
before allowing such occupation to take place upon the
premises. Conditional Use Permit shall be applied for
in the manner set forth within Section 401'. 16 of the
Zoning Ordinance of the City of Oak Park Heights.
Conditional Use Permits for Home Occupations granted by
the City of Oak Park Heights shall be reviewed annually
by the City Council , at which time the applicant' s
compliance shall be reviewed and modifir tions of any •
condition set forth within the Conditional Use Permit
may be made by the City Council.
401A. 06 Enforcement, Suspension/Revocation, Abandonment and/or
Discontinuation of Home Occupation. The Zoning
Administrator and/or the City Council of the City of
Oak Park Heights may from time to time request of any
applicant and/or anyerson conducting a Home
Occupation, verification that the Home Occupation is
being conducted in a manner consistent with this
Ordinance. The City Council may suspend or revoke any
Conditional Use Permit or Certificate of Compliance for
violation of any provision or condition of this
Ordinance. Suspension and/or revocation of the
Certificate of Compliance or Conditional Use Permit for
Home Occupation shall be preceded by written notice to
the applicant/fee owner providing an opportunity to be
heard before the City Council at a special or regular
meeting thereof. Notice shall be given at least eight
(8) days in advance of the time and the place of
hearing which shall also be specified therein and shall
also state the nature of the violation (s) alleged. The
City Council may without any advance notice ,
temporarily suspend any Conditional Use Permit pending
the hearing on revocation or suspension for a period
not to e4ceed thirty (30) days.
401A. 07 Effective Date.
This Ordinance shall take effect and be in full

AN ORDINANCE RELATING TO THE PARKING OF VEHICLES
THE CITY COUNCIL OF THE CITY OF OAK PARK HEIGHTS DOES ORDAIN:
1117 . 01 As used herein the term,
(a) "Vehicle" shall mean every device in, upon, or
by which any person or property is or may be
transported or drawn upon a highway, except devices
moved by human power or used exclusively upon
stationary rails or tracks , and
(b) "Street" shall mean any street, avenue, place,
drive or any other public way in the City of
Oak Park Heights.
1117 . 02 There shall be no parking at any time of any vehicle
at the following street locations in the City of Oak
Park Heights :
South side of 64th Street North;
South side of Upper 63rd Street North, West of Paris
Avenue;
South side of 63rd Street North;
East side of Paul Avenue;
North side of 62nd Street North;
Peller Avenue North , 40 feet back from 59th Street
North , East side from 60th Avenue North to Upper
61st Street North ;
West side of Stagecoach Trail;
Both sides of Mill Road now called 59th Street North,
West of 95;
West side of Peabody Avenue North , North of Beach Road
North;
East side of Olinda Avenue North..

of Oak Park Heights for more than twenty-four (24)

1117 . 04 Whenever, in the opinion of the Mayor of the City of
Oak Park Heights , an emergency exists in the City , or
in a section or sections thereof , because of snow,
freezing rain, sleet , ice, snow drifts , or other
natural phenomena , which create or are likely to create
hazardous road conditions impeding , or likely to
impede , the free movement of fire, health, police,

and welfare of the community , the Mayor may declare
an emergency to exist for a period of seventy-two
(72) , hours , but such • emergency maybe sooner terminated
if conditions permit. If the Mayor is absent from the
City, or is unable to act , the said emergency may be
declared by any two ( 2) members of the' City Council.
Notice of such emergency shall be given by radio,'
television or press, which news media shall be, requested
to cooperate with the City ;off icials, and when given
such notice, shall constitutedue, •and proper notice.
Said notice shall specify the hour that said emergency
commences and there ' shall be an 'interval of a't least
six (6) hours between 'the first time that notice is
given ' and t'he' commencement ' of said emergency.
1117. 05 (a) During said period. of emergency , nomvehicle shall
be parked or left standing on';any streets from
1: 00 A.M. to 8: 00 A.M. '
(b) 'the 'parking of vehicles directly in front of all—
night eating establishments on the above-described
streets during said emergency betweef, the hours
of 1: 00 A.M. and 8: 00 A.M. will not be prohibited
under Section 1117 .07 of this ordinance if the owner or
• operator of the vehicle is inside ' 'the eating establish-
ment while it is parked , and is: available'__tove
said vehicle if it is hindering •snow removal operations
If` 'the owner or operator does ; not remove his
vehicle when requested by a,,. police officer or a
,City, employee engaged in removing snow , , 'said
vehicle may be removed as provided in Section
1117 .07 . ,.
(c) Parking may be resumed on individual ' streets , in
this, area as , soon as the snow has been removed
from these streets, except as -may be otherwise
restricted by ordinance.
1117 . 06 ' During the period of said emergency , all' vehicles on
streets , avenues , places and drives of the City of • Oak
Park Heights shall be parked as follows :
• '
(a) All vehicles on streets , avenues , places and
drives of 'the City of Oak Park Heights;' between
the hours of 8: 00 A.M. and 8: 00 A:M. of` the
succeeding day, shall be parked only• on the side
of the streets , avenues , places ' and drives bearing
even-numbered United States Post Office address
on even-numbered days of the month.

(b) All vehicles on streets , avenues , places and
drives of the City of Oak Park Heights, between
, the hours of 8: 00 A.M. and 8 : 00 A.M. of the
; succeeding day , shall be parked only on the side
of the streets , avenues , places and drives bearing
odd-numbered United States Post Office address on
odd-numbered days of the month.
(c) Where parking is normally permitted only on one
side of the street , vehicles parked pursuant to
the aforesaid provisions may be parked on that
side of the street only .
(d) The parking of vehicles on streets during the period
of said emergency that are directly in front of
business places during business hours will not be
prohibited unless the vehicle in front of said
business establishment is hindering snow removal.
1117 . 07 Any vehicle which shall be left parked or standing in
violation of this ordinance may be summarily removed
without notice to the owner or operator by officers of
the police' department of the City of Oak Park Heights,
or persons employed or designated by them, and stored
in any appropriate place. All necessary costs and
expenses of towing , removing and storing of such vehicles
shall be first paid to the person or persons designated,
by the person claiming the vehicles before release of
the same.
The City of Oak Park Heights shall not be responsible
for any damage to such vehicles removed in accordance
with the provisions of this ordinance.
1117 . 08 It shall be unlawful for any firm, person, or corporation
to cause, allow, suffer, or permit any vehicle operated
by or registered in the name of such person, firm or
corporation to be parked contrary to the provisions of
this ordinance . The presence of any vehicle on a public
street in the City of Oak Park Heights , parked contrary.
to the provisions of this ordinance, shall be prima
facie evidence that the registered owner of said vehicle
submitted or authorized the commission of the violation.

t MINUTES OF MEETING HELD TUESDAY, OCTOBER 13, 1987
Call to order by Mayor Sommerfeldt at 7:00 P.M. Present: Torgerson, Seggelke,
Doerr, O'Neal, Eckberg and Johnson.
Deputy Clerk read public hearing notice, presented affidavit of publication and
mailing list on request for variances by David Foley. Mayor called for comments
and discussion ensued. O'Neal, seconded by Seggelke, moved to close hearing.

proposed amendment to Ordinance #502 relating to the disposal of garbage and
refuse so as to require separation of grass clippings and leaves. Mayor called
for comments and discussion ensued. O'Neal, seconded by Torgerson, moved to

O'Neal, seconded by Doerr, moved to adopt Resolution #87-10-41 to repeal
Ordinance No. 87-1101-04 relating to regulation of motor vehicles so as to regulate
and control the parking of motor vehicles upon lots occupied by residential
dwellings. Roll call vote taken with 5 aye votes. Ordinance repealed.
Council requested City Auditor to schedule workshop on Tax Increment Financing
with Council, City Auditor and Juran and Moody.
Seggelke, seconded by O'Neal, moved to adopt Resolution #87-10-42 establishing
general fund reserves. Roll call vote taken with 5 aye votes. Resolution adopted.
O'Neal, seconded by Torgerson, moved to adopt Resolution #87-10-43 charging 10%
interest on late unpaid utility accounts that are certified to the County for
1988 taxes collectable in 1989. Roll call vote taken with 5 aye votes. Resolution
adopted.
Seggelke, seconded by Doerr, moved to adopt Resolution #87-10-44 to amend Ordinance
#206 by deleting #206.23 which states - Residential Requirements. All new employees
shall be a resident of Oak Park Heights within six (6) months after the completion
of his probation period, and all present employees shall reside within one-half (i)
mile of the City limits of the City of Oak Park Heights. Roll call vote taken with
5 aye votes. Resolution adopted.
