REGULATION OF PEDDLERS AND SOLICITORS
AN ORDINANCE PROHIBITING PEDDLERS OR SOLICITORS FROM ENTERING
UPON CERTAIN PREMISES WITHIN THE CITY OF OAK PARK HEIGHTS,
WASHINGTON COUNTY, MINNESOTA, AND PROVIDING PENALTIES THEREFOR.
THE CITY COUNCIL OF THE CITY OF OAK APRK HEIGHTS, WASHINGTON
COUNTY, MINNESOTA, DOES ORDAIN:
1403. 01 Definitions.
For the purpose of this ordinance, the words defined in
this section have the meanings ascribed to them:
A. "Peddler" means any person with no fixed place of
business who goes from house to house carrying or
transporting goods, wares or merchandise and
offering or exposing the same for sale, or making
sales and deliveries to purchasers of the same.
B. "Solicitor" means any person who goes from house
to house soliciting or taking or attempting to
take orders for the purchase of goods, wares or
merchandise , including magazines , books ,
periodicals or personal property of any nature
whatsoever for delivery in the future.
1403 .02 Peddlers and Solicitors.
A. Any resident of the City of Oak Park Heights who
wishes to exclude peddlers or solicitors from
premises occupied by him may place upon, or near,
the usual entrance to such premises a printed
placard or sign bearing the following notice:
"Peddlers and Solicitors Prohibited" . Such
placard shall be a least 3 3/4" long and not
smaller than forty-eight point type.
B. No peddler or solicitor shall enter in or upon any
premises, where such placard or sign is placed and
maintained.
1403.03 Exemptions.
The terms of this ordinance do not include the acts of
persons selling personal property at wholesale to
dealers in such articles, nor to newsboys, nor to the
acts of merchants or their employees in delivering
goods in the regular course of business. Nothing
contained in this ordinance prohibits any sale required
by statute or by order of any court, or to prevent any
person conducting a bona fide auction sale pursuant to
law.
'� 1403.04 Religious and Charitable Organizations, Exempt.
�.� Any organization, society, association or corporation
desiring to solicit, or to have solicited in its name

( money, donations of money or property or financial
assistance of any kind, or desiring to sell or
distribute any item of literature or merchandise for
which a fee is charged or solicited from persons other
than members of such organizations upon the streets, in
office or business buildings, by house to house
canvass, or in public places for charitable, religious,
patriotic or philanthropic purposes shall be exempt
from the provisions of 1403. 02B of this ordinance,
provided there is filed an application in writing on a
form to be furnished by the City Clerk, which
application shall set forth the name and purpose of the
cause for which permit is sought, the period during
which the solicitation is to be carried on and whether
or not any commission fee or wages are to be expended
in connection with the solicitation and the amount
thereof. Upon being satisfied that such organization,
association or corporation is a religious, charitable,
patriotic or philanthropic organization, the Clerk
shall issue a permit without charge to such
organization, association or corporation to solicit in
the City of Oak Park Heights.
1403.05 Penalties.
Any person who violates any provision of this
ordinance, upon conviction thereof, shall be punished
) by a fine not exceeding $500.00 and/or by imprisonment
for a period not exceeding ninety (90) days, or both.
1403.06 Effective Date.
This ordinance shall be in full force and effect from
and after its passage and publication according to law.
