Call to Order/Pledge of Allegiance/Approval of Agenda: Mayor McComber called the meeting to order at 7:08 p.m. Present: Councilmembers Dougherty, Liljegren, Runk, and Swenson. Staff present: City Administrator Johnson, City Attorney Vierling, Public Works Director Kegley, City Planner Richards, and City Engineer Mann. Absent: None. Councilmember Swenson, seconded by Councilmember Liljegren, moved to approve the Agenda as amended. Carried 5-0. City Attorney Vierling reported that the City Council met in a closed worksession prior to that evening's council meeting. He stated the meeting was closed pursuant to Minnesota Statute 13d to review possible interest in purchase of City property. He stated the meeting was tape recorded, the City Council provided input on possible uses of the site, and no motions were made. II. Council/Staff Reports: A. Mayor McComber: She reported the next Parks Commission meeting was set for November 21 at 7:00 p.m. B. Councilmember Dougherty: No report. C. Councilmember Liljegren: No report. D. Councilmember Runk: He reported he attended the CVB meeting and there was one item on the City Council Agenda resulting from that meeting. E. Councilmember Swenson: He reported there was a franchise agreement reached with Comcast and the Cable Commission. F. Staff City Clerk Pinski reported that Matt and Stephany Wieland of 5649 Ozark Avenue North and Rachel Torres of 14864 56th Street North were chosen as the recycling award winners for the month of October. III. Visitors/Public Comment: Joe Nichols of 15115 64th Street North reported that the mountain bike team received its first 1 st place trophy. IV. Consent Agenda: A. Approve Bills &Investments B. Mayor McComber added a clarification to page 2 of the October 11, 2016 City Council Meeting Minutes. Councilmember Runk, seconded by Councilmember Dougherty, moved to approve the Minutes with that clarification. Carried 5-0. IV. Public Hearings: None V. Old Business: None VII. New Business: A. Design Guidelines/Plan Amendment—Simonet's Furniture: City Planner Richards reported that the applicant requested minor building changes to the plans. Councilmember Runk, seconded by Councilmember Liljegren, moved to approve the changes as presented. Carried 5-0. B. SCRCP—Opening Events—Consider a Worksession: Councilmember Runk suggested a worksession be set to discuss the process and involvement in a bridge opening ceremony with Robin Anthony from the Greater Stillwater Chamber of Commerce and possibly invite the Town of St. Joseph to participate. Councilmember Swenson state it should be up to the Chamber of Commerce to involve the Town of St. Joseph. McComber suggested starting with the Chamber and moving on from there. Councilmember Dougherty, seconded by Councilmember Swenson, moved to set a worksession before the first meeting in December at either 5:30 p.m. or 6:00 p.m. depending on the worksession agenda. Present: Mayor McComber, Councilmembers Dougherty, Liljegren, Runk, and Swenson; City Administrator Johnson; Public Works Director Kegley;City Attorney Vierling; City Engineer Mann; and City Clerk Pinski. Also present for Agenda Item 3: Bruce Paulson, architect from Stantec. Absent: None. 1. Call to Order: Mayor McComber called the meeting to order at 6:00 p.m. 2. Inquiry on City Owned Land (closed pursuant to MN Stat 13D.05,Subd.3(c)(3)): This portion of the meeting was recorded as required by Statute, and said recording will be kept on record for a period of two years. No action was taken. 3. Cover Park Shelter Design Discussion: City Administrator Johnson provided the group with a packet of photos of various shelter examples. City Engineer Mann provided a packet of information including two design options. Mayor McComber suggested parking spaces be added where the existing shelter was to be taken out next to the playground. She thought five spaces could fit there and twenty spaces could be put in on the north side of the rink. Councilmember Liljegren suggested shifting the rink to the south and placing the shelter at the northeast corner of the rink. Councilmember Swenson stated a retaining wall would need to be added for the parking area next to the playground. Stantec architect Bruce Paulson explained the two design options. The City Council preferred option 1 for back-to-back plumbing. McComber suggested an overhang be added to the side of the building. Paulson stated he could move the double doors to the other side,move bathroom doors to the sides, and put glass on the front of the building to open it up. McComber suggested the warming house space be eighteen feet wide instead of fifteen feet. Councilmember Swenson suggested reducing the bathrooms to a single stall,and McComber suggested the bathrooms and mechanical room be moved to the back wall. Councilmember Dougherty suggested a sink and counter in the warming area. Councilmember Swenson suggested windows all along the front wall. Paulson noted the building could be block built or stick built with high-impact sheetrock,and the City Council could consider in-floor heat. Councilmember Runk thought in-floor heat was not worth the cost, and McComber suggested the floor would be a mess of melted snow. City Administrator Johnson questioned if the City wanted to consider solar panels. McComber stated solar panels could be added to the south side. City Engineer Mann stated he would put together everything from that meeting and would bring it back to the City Council before they put specs together. No action was taken. 4. Animal Humane Society (AHS) agrees to provide the following services: a. Housing for stray or abandoned animals that are retrieved or legally seized by your municipality's community service officer(CSO) or animal control officer (ACO), or for stray animals that are brought into the shelter by a citizen and verbal permission is given by your agency via phone for intake. Housing includes kennel space, daily cleaning, food and water. b. Herd management vaccination following our standard vaccination protocols, as well as medically necessary and/or emergency care for sick or injured animals impounded during regular business hours. c. Euthanasia services as deemed necessary by an AHS veterinarian. These services may be provided at the end of the legally required holding period or in the case of a medical situation that requires immediate euthanasia. d. Adoption services as deemed appropriate by AHS veterinary staff. The animals will be evaluated for these services at the end of the legally required holding period. e. Euthanasia services and body disposal as deemed appropriate by AHS veterinary staff. The animals will be evaluated for these services at the end of the legally required holding period. f. Provide animal rabies quarantine or diagnostic service for stray felines or canines that have bitten a person. g. Hold animal for the legally required stray holding period: 5 days in MN, 4 Days in WI if a live release, 7 days in WI if euthanized or until reclaimed by owner within this holding period. h. AHS is not responsible for sick or injured animals that are left after hours. Outside treatment must be sought for these animals by the animal control officer or community service officer prior to leaving the animals at the AHS facility when veterinary staff members are not on duty. b. AHS has the sole authority to disposition all animals that have not been reclaimed upon the expiration of the legally designated holding period. 1 Page 25 of 74 c. AHS will not accept feral cats seized under municipal authority by your municipality's CSO or ACO. 3. The City of Oak Park Heights agrees to: a. Adhere to the drop off procedure set forth by AHS including animal housing at the shelter and paperwork. Drop off procedures and paperwork training for community service or animal control officers will be provided. b. Adhere to state laws and local ordinances that apply to the handling of stray or abandoned animals and the seizure and return of animals to their owners. c. Direct citizens where to take stray animals when not receiving permission for impoundment at AHS. d. Seek care for injured or sick animals prior to drop off in the event that it is after hours and/or AHS veterinary staff is not on duty. e. Pay the designated fees for each animal cared for from your municipality. AHS will charge a standard stray holding fee of$142 per canine or feline and a $43 fee per "other" domestic animals (rabbits, guinea pigs, birds etc.) not reclaimed by its owner. AHS will charge a$10 administrative/processing fee to the municipality for each animal reclaimed by its owner in place of the stray holding fee. In these instances AHS will charge the owner reclaim fees. Fees for animals seized by the municipality(such as rabies quarantine)may vary due to the differing nature of their holding periods and services required. f. Adhere to AHS policy and best practice for unclaimed animals. The City of Oak Park Heights may request and view AHS policies at any time. g. Adhere to building access rules and ensure that the service access door is closed and locked after use in an after hours drop off. h. Ensure that the municipality's CSO/ACO uses his/her discretion in the field as to whether or not to impound an animal. AHS is not responsible for those decisions. i. Be available to members of your community to resolve their concerns related to the actions of your ACO/CSO officers and your municipality's procedures, policies and requirements. j. Release AHS from all liability of claims resulting from or related to providing impound housing services. The scope of the project is detailed within the attached memo from City Engineer Lee Mann, but concisely, Stantec would begin design work as soon as authorized by the City. Bids would be collected in January or February of 2017 and the project should commence in the springlearly summer of 2017. Recall during 2016 budget sessions,the City developed a fluid ten year Street Maintenance plan which set aside funding for mill and overlay projects for the next ten years. The planned 2017 work which includes the mill and overlay of Neal Ave, 60th Street N and Krueger Lane N is an estimated expense of$313,283 plus the not to exceed expenditure for engineering services of$34,000 brings the 2017 project estimated total to $347,283, an amount within the funding plan. The 2017 mill and overlay project will be funded by the budgeted projects mill and overlay fund which at that time will have adequate fund balance. Enclosed in the packet is a ten year mill and overlay plan that staff intends to follow.
