PLANNING COMMISSION MEETING MINUTES
Thursday, September 15,2016—Oak Park Heights City Hall
Call to Order: Chair Kremer called the meeting to order. Present: Commissioners Kremer,
Nelson& Quale; City Administrator Johnson, City Planner Richards, and Commission
Liaison Runk. Absent: Commissioner Anthony&Thurmes.

approve the Agenda as presented. Carried 3 —0.

VI. Public Hearings:
A. Oak Ridge Place Memory Care Expansion—6060 Oxboro Ave. N.: Consider
requests of HAF Architects on behalf of TIC Properties 1 LLC for Conditional Use
Permits to allow memory care and assisted living and for parking, and a Variance to
building height and setback requirements.
City Planner Richards reviewed and discussed the September 7, 2016 Planning to the
request, noting that the City Council did approve the same request on April 28, 2015
and that this approval lapsed, necessitating re-approval by City Ordinance.
Richards noted further that the plans presented have not changed from those remitted
and approved in 2015, adding that prior to the 2015 approval issues within an
existing City drainage easement and ponding area were realized by the Applicant and
the City and discussed the activity taken by the Applicant as to this and the current
status of the matter.
Chair Kremer opened the hearing and invited public comment.
There being no public comment to the public hearing, Chair Kremer closed the
public hearing. Brief discussion ensued as to the conditions recommended in the
planning report and how the application process requirements.
Commissioner Nelson, seconded by Commissioner Quale,moved to recommend
that the City Council approve the request, subject to the conditions of the September
7, 2016 Planning Memorandum; specifically, as follows:

1. The Oakridge Memory and Assisted Living shall remain as senior rental and
shall not be converted to non-restricted rental housing.
2. The Applicant shall obtain an access permit from Washington County for the
new driveway.
3. All tree removal and landscape plans shall be subject to review and approval
of the City Arborist.
4. The grading and drainage plans shall be subject to review and approval of the
City Engineer and the Middle St. Croix Watershed Management
Organization.
5. All utility plans shall be subject to review and approval of the City Engineer.
6. All lighting shall be full cut off and be compliant with the lighting standards
of the Zoning Ordinance.
7. The signage shall be compliant with the Zoning Ordinance and shall be set
back at least five feet from the property line.
8. The Fire Marshal and Police Chief should review the plans and determine the
accessibility of emergency vehicles throughout the development.
9. A snow storage plan shall be provided and shall be subject to review and
approval of the City Engineer.
10. Any mechanical equipment that is ground mounted or visible from adjacent
streets shall be screened as required by the Zoning Ordinance.
11. The Planning Commission was favorable to the proposed building
appearance, colors and materials.
12. To the extent that the Developer's project contains tax exempt facilities, lands
or buildings,the Developer will execute an agreement with the City to make a
payment in lieu of taxes to the City for the life of the project. A payment in
lieu of taxes agreement shall be in a form prepared and approved by the City
Attorney.
13. The Applicant knowingly is installing its infrastructure upon lands that are
encumbered by a City drainage easement, located at the southeast corner of
the property. At this time the City and Applicant concur that the
modifications as proposed will not materially disrupt the City's ability to use
such easement and water that drains and will continue to drain to such
easement area from areas not under the control of the Applicant. Should the
Applicants activities or actions materially impair the City's ability to utilize

its drainage easement, the Applicant shall make any corrections as directed by
the City at is sole expense.
14. The City reserves the right to require the Applicant, at their expense, to
remove any and all of the improvements located within the existing drainage
easement if ordered by the City Council. Should the Applicant fail to make
such changes as directed by the City, the City may make all necessary
changes as required and assess all such costs back to the applicant. The City
shall not be responsible for any costs related to the Applicant's improvements
in the City's drainage area.
15. The Applicant shall provide a revised description for the drainage easement at
the southeast corner of the property that removes the existing building from
said easement. The revised agreement shall be subject to review and
approval of the City Attorney and City Engineer.
16. The terms and conditions listed above for the drainage easement shall be set
forth in a Permissive Use Agreement between the City and the Applicant as
drafted by the City Attorney to be executed prior to issuance of any building
permits.
17. The Applicant shall be required to enter into a Development Agreement if
required by the City Attorney. The Development Agreement shall be subject
to the review and the approval of the City Attorney and the City Council.

BACKGROUND
Lorene Clark has made application to construct a building on Memorial Avenue North
that will be used for a retail store and gun range. The City Council approved the same
application on August 25, 2015. The Planning Commission had recommended the
project at their August 13, 2015 meeting. The Applicants did not ask the City Council
for an extension of approval in time, requiring the Applicant to come back through the
entire process. The plans have not significantly changed from what was approved by
the City Council in 2015.
The site is zoned B-3, Highway Business and Warehouse in which retail stores and
commercial recreation such as the indoor firearms range is a permitted use.
The report as follows is an update from the 2015 Planning Report that went to the
Planning Commission and City Council.

PROJECT DESCRIPTION
The project narrative provides the following description:
Our proposal is to build a one of a kind indoor shooting range and retail destination in
Oak Park Heights. This facility will provide a community, family friendly, safe and
inviting environment for all levels of shooting sports enthusiasts.
Range 082 Indoor Shooting is a 45,000 square foot entertainment facility incorporating
five shooting bays, educational space and retail area.
The shooting range will consist of 38 lanes (10 rifle, 10 training, 18 pistol). Top quality,
state-of-the art equipment from Action Target will make it a true Five Star Range. The
five shooting bays allow for shooting competitions and competitive shooting
tournaments, as well as individual practice.
The 8,500 square foot retail space will offer a wide variety of merchandise, including
unique and high end items not generally offered at other sporting goods outlets. The
retail space will also include a library/technical center and concession area.
Patrons will experience a safe and welcoming environment when they step in the door.
Highly skilled and knowledgeable staff will assist all patrons, whether they are seasoned
shooters or beginners. Classes will be offered and taught by certified professionals
approved by the Minnesota BCA and NRA. Classes will range from beginner safety and
personal defense to advanced marksmanship and tactical.
Range 082 will be a year round destination which the City of Oak Park Heights can call
a landmark for the community.
ISSUES ANALYSIS
Comprehensive Plan. The property is designated as Highway Business/Warehouse
on the Proposed Land Use Map. The proposed use is consistent with this land use
designation.

Zoning. The property is zoned B-3 Highway Business and Warehouse District. The
use of the site for retail and as commercial recreation is a permitted use in this district.
Subdivision. The property has been split as part of a minor subdivision in compliance
with Section 402.01G. Minor Subdivisions of the Subdivision Ordinance.
Site Plan. The front of the building is orientated to Highway 15 with the parking lot
adjacent to the front entrance. A large front yard on the southeast side and large side
yard on the southwest allows for green area, landscaping and storm water ponding.
The loading area for the building is located on the Memorial Avenue North side of the
building but is screened with a berm and landscaping.
Setbacks. The building and parking areas are compliant with all setback requirements.
Traffic Circulation/Curb Cuts. The site plan indicates that there will be two curb cuts
off of Memorial Avenue North. The curb cut and driveway near the northwest property
lines is set back 10.5 feet and is compliant with setback requirements. There are three
landscape islands within the parking lot. The plan should be subject to review by the
Fire Marshal for emergency vehicle access.
Snow Storage. The plans do not indicate an area for snow storage. The applicant
shall indicate where the snow is to be stored.
Parking. The following table provides an analysis of proposed and required parking
spaces:

Per ordinance, the site would require 106 parking spaces. The proposed site plan
indicates a total of 74 spaces, with 32 proof of parking spaces. The parking
requirements are met with the proof of parking spaces. The plans indicate four disability
stalls adjacent to the front entrance which will be adequate for the site.
Landscaping. The submitted landscape plan is subject to City Arborist review and
approval. City Arborist comments are found as an exhibit to this report.
Lighting. The lighting plan indicates the locations of the parking lot and site fixtures as
well as the building wall fixtures. The lighting specifications indicate that the fixtures to
be used in the parking lot and on the walls, will be full cut off and LED. The light poles

are shown at 25 feet with a 3-foot base. The lighting regulations limit the height from
ground level to the top of the fixture at 25 feet. All light fixtures shall be required to be
full cut off, compliant with the height requirements, and be consistent with Section
401.15.6.7 of the Zoning Ordinance as it relates to lighting requirements. A photometric
plan shall be provided subject to review of City Staff.
Trash Storage. The floor plan indicates that the trash containers will be stored behind
the fenced area on the northwest side of the building. The fence will be a solid concrete
structure.
Mechanical Screening. Any exterior mechanical equipment, either on the roof or
ground mounted will need to be screened in accordance with Section 401.15.E.10.e. of
the Zoning Ordinance. The plans indicate that the roof mounted and ground mounted
mechanical equipment will all be screened.
Noise. Sound levels generated from the site shall be in compliance with Section
401.15.6.11 of the City Zoning Ordinance. All of the gun range activity is to be
conducted indoors. There will be no range activity outside of the building.
Grading, Drainage, Erosion Control and Utilities. Grading, drainage, erosion
control, and utility plans are subject to review and approval by the City Engineer. Storm
water issues are also subject to review and approval by the Browns Creek Watershed
District.
Signage.
Freestanding Sign. The applicant has proposed two freestanding signs, one adjacent
to Highway 15 and the other adjacent to Memorial Avenue. The location of the
Memorial Avenue sign is not shown on the site plan. The bases of both signs will need
to be landscaped.

The Zoning Ordinance would allow for two wall signs on separate building facades and
two freestanding signs. The total allowable sign area is 300 square feet. The applicant
has proposed one wall sign and two freestanding signs with a total of 276 square feet of
signage.
Sign Illumination. The proposed plans indicate that the signs would be lit by sign floods
mounted on the parking lot light poles. Additional detail is required to review how the
signs will be illuminated. The signs will be required to comply with the Zoning Ordinance
lighting requirements. Staff will approve the lighting specifications for the signs at the
time of permitting.
Design Guidelines
Architectural Guidelines.
Façade Treatments
The building will be required to have a definite base, middle and top at its front,
side and rear facades. With the previous approval, City Staff has asked the
project architect to provide another option to add more architectural interest on
the northeast and southeast elevations. Revised diagrams indicate the revised
plans that were approved.
Ground Level Expression
This is a one story building with a significant wood canopy at the front entrance
facing Highway 15. The main entrance is well defined by the canopy and glass.
Transparency
The building uses glass on the front facade. The Design Guidelines requires at
least a 20 percent transparency on ground floor, street facing facades. The
building front, facing the Highway 15, is 36 percent transparent. The Planning
Commission should comment on the lack of transparency on the Memorial
Avenue building side.
Entries
The building features a prominent entry with a prominent canopy and glass.
Roof Design
The building has a flat roof. The rooftop mechanical equipment will be
completely screened.
Building Materials and Colors
The applicant has provided a color perspective for review. The building will be a
combination of textured concrete, wood and glass. Building material samples will
be required for the Planning Commission meeting.

Franchise Architecture
The building is not a franchise design.
Site Design Guidelines
Building Placement
The proposed building has a well-defined entrance and attractive front which is
visible from Highway 15.
Parking Areas
The parking area includes landscaped areas.
Storm water
Storm water will be addressed by the City Engineer.
Pedestrian and Common Space
Currently, there are no trails on Memorial Avenue. The plans show a trail along
Memorial Avenue that will be constructed at 8 feet in width to match the trail
adjacent to the Kwik Trip development.
Landscaping
Building entrance plantings are required and are provided on the plans. The
overall landscaping plan is a very positive feature of the site. The landscape plan
is subject to review and approval of the City Arborist.
Trees/Shrubs
The trees and shrubs used in the landscape plan shall be subject to the review
and approval of the City Arborist.
Utilites/Service/Loading/Storage Areas
Addressed elsewhere in the planning report.
Lighting
Addressed elsewhere in the planning report.
Signage

Pedestrian/ Bicycle Routes
A bike rack location has been provided on the plans.
CONCLUSION / RECOMMENDATION
Subject to the preceding review, City staff recommends approval of the following listed
request subject to the conditions that follow:

• Design Standards/Site Plan Review
1. The site plan shall be subject to review and approval of the Fire Marshal.
2. The Applicant shall provide a snow removal plan or indicate if the snow will be
hauled off site.
3. The landscape plan shall be subject to the review and approval of the City
Arborist.
4. All grading, drainage, erosion control, and utility plans are subject to review and
approval of the City Engineer. Storm water plans are also subject to review and
approval of the Browns Creek Watershed District.
5. All light fixtures shall be full cut off, compliant with the height requirements, and
be consistent with Section 401.15.6.7 of the Zoning Ordinance as it relates to
lighting requirements. Outdoor lighting for the parking areas shall be turned off
one hour after closing, except for approved security lighting.

fixture cut off and illumination.
10. The Planning Commission should comment on the lack of transparency on the
Memorial Avenue building elevation.
11. The Planning Commission shall comment on the building design and building
materials. The applicant shall provide building material samples for Planning
Commission review.
12. If additional parking is required for the gun range use, the City Council may
require the curb and pavement to complete the proof of parking stalls.

Re: Range 082 Landscape Plan Review
I have reviewed the landscape plans submitted by Lorene Clark for the Range 082 Indoor
Shooting plans dated 11/15/2016. The following includes my comments and/or
recommendations:
Landscape Plan (L2.1)
The overall design of the plan is attractive and will complement the building well. The plan
includes an acceptable species selection of deciduous trees, coniferous trees, ornamental
trees, shrubs and perennial plants to be installed ((660) total). All plants included in the plan
are hardy under local growing conditions, tolerant or resistant to major insect and disease
problems and fairly low maintenance. All plant sizes, root and container classes included in
the plans conform to the City of Oak Park Heights zoning ordinance requirements. The
locations chosen for most plants are appropriate. The only exception would be the placement
of thornless honeylocust in relatively small parking lot medians on the NE/SE side of the
development and in the narrow median along the N side of the development. These trees can
be very large at maturity and the parking lot medians and the north median will not allow
enough rooting space for these trees to grow to a healthy maturity. I recommend replacing
the honeylocust in the medians with six Japanese tree lilacs which are smaller ornamental
trees and also have some resistance to de-icing salts. (This has been changed by the
applicant, site review meeting 8/5/15.) Also at the meeting with the developer 8/5/15, it was
recommended that shrubs and/or possibly ornamental grasses be planted along a wall facing
the Memorial Avenue side of the property.

Planting Specifications (L2.2)
The landscape notes and planting detail submitted is acceptable. Trees are not required to be
staked as long as they can stand upright on their own. The landscape contractor is required to
plant trees and shrubs according to the approved planting detail diagrams and landscape
notes submitted with the final approved landscape plan. This will be checked after planting
and any deviations from the plans must be corrected before the landscaping will be approved
by the City, this needs to be noted in the final plans.

We have reviewed the hard copy plan resubmittal regarding the proposed Range 082 Indoor
Shooting Project,received 11/23/2016 from the City.Following are the remaining items to be
addressed:
Sheet C2.1—Site Plan
1. The width of the trail along Memorial Avenue North needs to be revised and shown as an
8-foot wide trail,with 5-foot separation from the roadway pavement.
Sheet C3.1, C3.2 -Grading and Erosion Control
1. The Trail Section detail shows a 10-foot wide trail,revise to show 8-foot wide trail with 5-
foot separation from the roadway pavement.
2. The grading along the northeast side of the property needs to tie in with the grading
completed by the Furniture Warehouse. The grading plan for the Furniture Warehouse is
available upon request,however,it should be noted that it is not a record plan of as-built
conditions,which would need to be verified.
Storm Sewer/Storm Water Management
1. The project is subject to review by the Brown's Creek Watershed District.The City shall be
provided a copy of the permit approval letter from the BCWD.
General Comments
1. The City reserves the right to inspect the construction of the project. The City or its
designee shall be present for water and sanitary sewer service connections at the right-of-
way.
2. The Owner will need to comply with all requirements of the NPDES Construction
Stormwater Permit and the Brown's Creek Watershed District. The City reserves the right
to require additional erosion control measures as determined/necessary during the
construction of the project.

Re: 2017 Meeting and Council Representation Schedule Amendment
The proposed 2017 Planning Commission meeting calendar and commission representation
schedule is attached.
The calendar has been created to meet the schedule established by the Planning
Commission Bylaws, scheduling its meeting the 2nd Thursday of the month.
The commission representation schedule continues the rotation that has been followed in
2016 with the month where the vacant position would typically have been placed left blank.
The schedule will be updated at such time that the vacant position is filled in early 2017.
The Commissioner noted on the schedule for a month is designated as the Commission
representative to the City Council meeting in that month. This meeting is typically the
Council meeting following the Planning Commission meeting.
The Commission should review the meeting dates and representation schedule and move
to approve it as presented or with amendment from the Commission.

The City of Oak Park Heights has recognized the need to update the Comprehensive
Plan 2008 to both satisfy Metropolitan Council requirements and provide ongoing
direction for development and land use, housing, community facilities, utilities, and
parks and trails. It is recognized that the Comprehensive Plan 2008 provided
positive direction and strategies for the upcoming decade.
The Comprehensive Plan 2040 process will update and reinforce those goals,
policies and plans from the 2008 plan. Additionally, it will focus on the new issues
and challenges this community will need to focus in the next ten years.
Lee Mann, the City Engineer and I are currently in the process of developing a Work
Program with timeline and budget. It is expected that the Comprehensive Plan
process will begin in early 2017 and take about a year to complete with approval by
the Metropolitan Council. We will have the Work Program available at your January
meeting for comment and a recommendation to the City Council.
Please find attached the Community Pages from the Local Planning Handbook for
Oak Park Heights. This provides population, household, and employment forecasts
as well as allocations for affordable housing and sewer. Links to other planning
