Call to Order/Pledge of Allegiance/Approval of Agenda: Mayor McComber called the meeting to order at 7:00 p.m. Present: Councilmembers Liljegren, Runk, and Swenson. Staff present: City Administrator Johnson and City Attorney Kranz. Absent: Councilmember Dougherty, City Planner Richards, and City Engineer Mann. Mayor McComber added Agenda Item II: "Swearing in of Police Officer Lee Schroeder"and New Business Item B.: "Cancel November 22 and December 27 City Council Meetings." Councilmember Swenson, seconded by Councilmember Liljegren, moved to approve the Agenda as amended. Carried 4-0. II. Swearing in of Police Officer Lee Schroeder: The Honorable Ed Cass swore in the City's newest Police Officer, Lee Schroeder. III. Council/Staff Reports: A. Mayor McComber: She reported the next Parks Commission meeting was set for November 21 at 7:00 p.m.; she attended the ribbon cutting for Special Products the previous week and Councilmember Dougherty attended the ribbon cutting for the Elks club; she and Administrator Johnson attended the Community Thread breakfast the previous Friday; she was attending the National League of Cities Conference the following week; and registration was open for the regional meeting for the joint LMC/Metro Cities policy adoption. B. Councilmember Dougherty: Absent C. Councilmember Liljegren: He reported that he received feedback that the polling location at City Hall ran smoothly on Election Day, and he thanked City Clerk Pinski. D. Councilmember Runk: He reported that he attended the CVB meeting, and they were interested in following the progress of the new bike trail in Oak Park Heights. E. Councilmember Swenson: He reported the five-year franchise agreement was ready to be signed. He requested a notice be put in the City newsletter about the cable representative position vacancy. F. Councilmember Runk, seconded by Councilmember Swenson, moved to go into a closed session. Carried 4-0. The City Engineer has calculated the City's utility area charges for 2017 and is recommending a 3.4% increase in the area charges for water, sanitary sewer, and storm sewer. This increase percentage is based on the Construction Cost Index. I recommend approval of the area charges for sanitary sewer,water main, storm sewer and TSMP area storm sewer as of January 1,2017 per the attached recommendation from the City Engineer. These charges should be adjusted from time to time to recover additional costs incurred as a result of inflation,capitalized interest,or revisions/updates to trunk facilities. The table on the following page is a tabulation of the current area charges and those proposed for development initiated after January 1,2017. Adjustments to the City's utility area charges are tied to the ENR national Construction Cost Index (CCI),which is a benchmark of the current cost of materials and labor in the construction industry. The City's utility area charges were last updated in November 2015. From the third quarter of 2015 to the third quarter of 2016,the CCI has increased 3.4%,which is the current increase we are recommending to the City's area charges. D ca ch 2 ■ E E k � � \ 0 CV @ Page 19y1a RESOLUTION NO. 16-12-54 CITY OF OAK PARK HEIGHTS WASHINGTON COUNTY,MINNESOTA A RESOLUTION ESTABLISHING AREA CHARGES THROUGHOUT THE CITY OF OAK PARK HEIGHTS FOR CONNECTIONS TO MUNICIPAL WATER SYSTEMS, SANITARY SEWER SYSTEMS AND STORM SEWER SYSTEMS WHEREAS,Minn. Stat. §444.075, Subd. 3 authorizes municipalities to establish a system of charges for the construction, reconstruction, repair, enlargement, improvement or other obtainment, maintenance operation and use of municipal facilities, including, but not limited to charges for connections to such municipal facilities for municipal water, sanitary sewer, and storm sewer; and, WHEREAS, City ordinances provide for the Council to establish from time to time area charges to be collected for properties developing in and connecting to the municipal water, sanitary sewer and storm sewer systems; and, WHEREAS,the City has historically established and collected area charges; and, WHEREAS, area charges established by the City of Oak Park Heights require modification and amendment from time to time; and, WHEREAS, the office of the City Engineer has provided recommendations to the City Council as it affects the establishment of area charges throughout the City of Oak Park Heights as it relates to connection to trunk sanitary sewer systems, trunk water systems and trunk storm sewer systems;and, WHEREAS,the City Council determines it to be in the best interest of the residents and City of Oak Park Heights that such fees be periodically reviewed and adjusted to take into account cost of construction and replacement and systems, cost of maintenance operation and other expenses that the City expects to incur with regard to the maintenance of such systems. NOW, THEREFORE, BE IT RESOLVED, by the City Council for the City of Oak Park Heights that effective January 1, 2017 city area charges to be applied throughout the City of Oak Park Heights for properties developing or connecting to municipal utilities shall be as follows: 1. Sanitary sewer area charge as follows: Commercial/Industrial&Retail Business Centers -$2,579.00 per acre. Low Density Residential- $2,459.00 per acre. Medium Density Residential- $3,280.00 per acre. High Density Residential- $5,740.00 per acre. Page 20 of 156 2. Municipal water area charge as follows: Commercial/Industrial&Retail Business Centers-$13,402.00 per acre. Low Density Residential- $12,785.00 per acre. Medium Density Residential- $17,045.00 per acre. High Density Residential- $29,834.00 per acre. 3. Storm sewer area charges in the sections of the city located within the Valley Branch Watershed District and the Middle St. Croix Valley Water Management Organization as follows: Commercial/Industrial&Retail Business Centers-$2,090.00 per acre. Low Density Residential -$1,151.00 per acre. Medium Density Residential-$1,669.00 per acre. High Density Residential- $2,090.00 per acre. And additional TSMP storm sewer area charges in the areas of the city located in the Browns Creek Watershed District however excepting the areas located West of Trunk Highway 5, South of Trunk Highway 36 and north of 55th Street as follows: Commercial/Industrial&Retail Business Centers- $9,748.00 per acre. Low Density Residential- $8,809.00 per acre. Medium Density Residential -$9,326.00 per acre. High Density Residential-$9,748.00 per acre. BE IT FURTHER RESOLVED, that as to the determination of land use and computation of acreage as it affects each development or connection related to the collection of these fees, all such determinations/computations shall be made through the office of the City Engineer with all such fees being thereafter collected through the office of the City Administrator. No connection shall be made to any municipal utility system until such time as the area fees as calculated and determined by the office of the City Engineer have been collected. Due to scheduling of December council meetings,the list has been prepared as of December 8, 2016,however, in accordance with policy,the City will accept payments on the delinquent amounts through December 15,2016. Therefore,I request that Council adopt the list and give me authority to adjust the amounts for payments or corrections that may be received prior to certification to the County Auditor. 5 Page 23 of 156 1 CITY OF OAK PARK HEIGHTS COUNTY OF WASHINGTON AND STATE OF MINNESOTA RESOLUTION 16-12-55 A RESOLUTION APPROVING CERTIFICATION OF DELINQUENT UTILITY CHARGES TO THE COUNTY AUDITOR FOR COLLECTION WITH THE 2017 TAX BILLS WHEREAS,the following properties have delinquent utility bills as of December 13, 2016 and that require collection; SEE ATTACHED LIST 1 WHEREAS,the City Staff for the City of Oak Park Heights has complied with the collection procedures for the utility billing and the above accounts remain delinquent as of December 15, 2016; and, WHEREAS,the City is allowed by statute to use certification to the County for inclusion on the real estate tax collection system as the collection mechanism. NOW, THEREFORE,BE IT RESOLVED,by the City Council of the City of Oak Park Heights that delinquent utility charges included on the list supplied by the Finance Director and as reduced for payments between December 13,2016 and December 15,2016, be certified to the County Auditor for Collection with the 2017 Tax Bill. Although I do not have accounts set up at the other financial institutions listed, I may be using them in the future depending upon the rates offered and if they are willing to pledge securities for any deposits above FDIC limits. The State and City entered into an agreement identified as MnDOT Contract No.92834("Original Agreement").The Original Agreement defines the parties respective obligations to maintain the South Frontage Road along Truck Highway No.36 within and adjacent to the Oak Park Heights city limits;and 2. There are many uncontrollable factors the City must comply with that affect both the amount of revenues the City receives and the amount the City must expend in order to provide the current level of services. There are also numerous unfunded mandates the City must comply with, such as: Revenues • Tax exempt property—City must still maintain police/fire protection, streets, etc. • Limitations of local special assessments. • Local improvement feasibility reports requirements. • Limitation of maximum penalties and fines for ordinance violations. • Truth in taxation requirements. • Limitation on fees for licenses, i.e. off-sale and Sunday on-sale liquor, fireworks. Expenditures • Pay equity, implementation and reporting. • Worker's compensation. • Public pensions. • Continuation of health and life insurance coverage. • Prevailing wages paid on public contracts. • Veteran's preference. • Mandatory binding arbitration for employee classes such as police and firefighters. • Various public safety requirements i.e. Peace officer standards and training, confined space entry, suspense file reduction,tobacco compliance checks. • Building code administration and limits to permit fees for minor improvements. • Numerous environment requirements i.e.,wastewater treatment standards Wetland Conservation Act, recycling programs, waste collection practices, drinking water standards, surface water management plans, Federal Clean Water Act, Wellhead Protection, Wastewater permit requirements, and storing of hazardous substances reporting. • Planning requirements for land use, zoning,building codes. • Comprehensive plan updates. • Conducting elections including paying judges, absentee ballots and recounts. • Record keeping requirements for Data Practices Act and retention schedules. • Competitive bidding. • Open Meeting Law notices, agendas and minutes. • Various financial reporting requirements, i.e. budget, audit reports, TIF reports, building inspection fee reporting, business subsidy reports, outstanding debt reports, continuing disclosure reports. Page 4 Page 60 of 156 Budget Process The City Council and staff engage in a thorough budget process each year in order to present a fair and balanced budget for the citizens of Oak Park Heights. 1. The annual budget process commences in June/July of each year with the Finance Director distributing budget worksheets to the department heads for completion. The City Council is requested to inform the Finance Director of any special requests they may have for the budget. 2. The department heads determine the anticipated expenditures and budget requests for the upcoming year. These requests are submitted to the Finance Director and Administrator for review by the end of July. 3. The Finance Director compiles a draft of the preliminary budget and submits it to the City Council. 4. The City Council schedules workshops for discussion and review of the preliminary budget. There are usually 2 to 3 workshops held during the month of August and the first week in September. All workshops are public meetings and the public is welcome to attend. 5. After all input and requests have been considered, the Finance Director makes revisions to the preliminary budget and submits it to Council for approval of the proposed budget and tax levy. Per Minnesota State Statute this must be completed and certified to the County no later than September 30. 6. The City Council sets the date for the Truth in Taxation meeting requirements. The City is required to hold a meeting in which the public is allowed to speak and the budget and levy is discussed. The hearing may be a part of a regularly scheduled meeting. The dates must be certified to the County no later than September 30. 7. Council conducts additional workshops to discuss any additional changes to the budget due to updated revenue and/or expenditure information,i.e.insurance rates,contract fees, etc. 8. The Truth in Taxation meeting is held. 9. The final budget and levy must be certified to the County by December 28, 2016 and to the Minnesota Department of Revenue after the levy is adopted. State and Federal government regulations limit the ability to raise additional revenues, such as charges for licensing and permits. The 2017 budget is supported by$5,193,661 tax levy or 92.09%of the total revenue budget. Some factors affecting revenues are: • Revenues from Licenses and Permits have increased but are limited due to availability of developable real estate; • Interest earnings have decreased. • Intergovernmental Revenue had an increase • Other Revenue, such as funding for the School Liaison Officer has minimally increased. The total amount for 2016 is not reflected in the above percentages as the total amount is unknown at this time. The abatement petitions are continuously being settled by the county. The petitions from the commericial properties have decreased and should not have such a large impact on the future tax revenues collected. For 2017, the debt levy of$603,000 was added to General Fund Levy with a corresponding transfer expenditure of$603,000 to the debt service funds. The total 2017 Revenue Budget is $5,639,646. This is an increase of.32% or$18,086 over the 2016 Revenue Budget. General Fund Expenditures The Proposed 2017 budget for General Fund Expenditures is $5,639,646. This includes expenditures for operations and transfers for capital projects and debt service. The 2017 operations budget is $3,941,821 as compared to the 2016 operating budget of$4,001,085, a 1.45%decrease. Transfers for Debt Service and Capital Projects for 2017 are$603,000 and $1,094,825 respectively, which compares to $620,000 and $1,000,475 for 2016. Beginning in 2012 the City included the total Special Debt Levy in the General Tax Levy as a planning strategy should levy limits be implemented by the state. This would allow the City to build its tax base from which levy limits are calculated on. Prior to 2012,the City would levy the debt for the G.O Bonds of 2008 as a Special Debt Levy. The G.O. Bonds of 2009 has always been included in the General Tax Levy. In place of the MVHC,the homeowners receive an exclusion of a portion of the market value of their house from the property taxes. The exclusion is computed in a manner similar to the market value homestead credit.(40% of the first $76,000: $30,400-(EMV-$76,000)X .0009; Maximum EMV $413,800) The impact of this change varies in each community. This calculation reduces the total tax capacity of the city, reducing the total that is available to allocate taxes on,therefore generally increasing individual tax bills. The median market value for residential property is estimated to have increase by 2.8% for 2017 as compared to 2016. In addition Commercial Property and Public Utility values remained unchanged from 2016. The changes in market values over the last couple years has shifted the tax burden toward residential properties. The shift in values continue to raise taxes on residential properties. The graph reflects the shift of the tax burden from commercial properties to residential properties for 2013-2016. Residential properties paid 26.44%of the tax levy in 2013 as verses 31.24 %in 2016 (the valuation for property types is not available for payable 2017 tax capacity at this time.) This represents a decrease of 2.5% from 2016 rates of 57.725%. The Tax Rate is applied to the tax capacity value of the property to calculate the property taxes due. An increase in tax rate would mean an increase in taxes if the tax capacity value of the property remained the same from one year to the next, while a decrease in tax rate should decrease the taxes. With the proposed General Fund budget of$5,639,646 supported by a tax levy totaling $5,193,661 -residential properties in the City will see an average 1.0 %increase in their city taxes or an average of less than$10.00. This increase is a result of the increase in the market value (2.5%). See the following comparison of taxes for a Median Value Oak Park Heights Residence. Page 12 Page 68 of 156 This variation is also due to the unique total tax capacity of the city that is shared by residential, commercial and public utility on approximately 1/3 basis for each. The result of this shared capacity for residential property means that 69% of the tax burden is shared by the commercial property along with the public utility,Xcel Energy. As the values change for Commercial property along with the Fiscal Disparity Tax, and changes to the public utility values,residential taxes will vary as seen in the chart above. It is anticipated that rates will have a small increase to meet the needs of the Water Fund. The amount of gallons of water billed have decreased which has resulted in decreased revenues. SEWER UTILITY The Sewer Utility Fund expenditures are anticipated to increase$62,000, 6.8%for the year 2017. Charges from Metropolitan Council Environmental Services increased $40,551 or 8.8%. The increase in Met Council charges cannot be absorbed in the present rate structure and utility rates are anticipated to be increased in 2017 on the average of 5-6%. STORM WATER UTILITY The Storm Sewer Utility Fund revenues will remain the same for 2017, while expenditures are expected to increase by$8,200 or 10.9%. Added costs are for engineering and expenses regarding the MS4 implementation which is required by the DNR. There is no proposed change to rates for 2017. Capital Improvement Bonds of 2009 $ 449,525 G.O. CIP Refunding Bonds of 2012 $5,903,684 G.O. Capital Improvement Bonds of 2014 $3,593,450 The G.O. Capital Improvement Bonds of 2008 were issued in 2008 to provide financing for the construction of the City Hall. The city sold Advance Refunding Crossover Bonds to prepay the GO Capital Improvement Bonds of 2008. This reduced the future scheduled tax levies for debt by$495,000. The 2008 Bonds were called and paid in 2016. The bonds are scheduled to be retired in 2028. The G.O. Capital Improvement Bonds of 2009 were issued in 2009 to provide additional financing for the construction of the City Hall. This bond is scheduled to be repaid by a General Obligation Debt Levy. The bonds are scheduled to retire in 2019. During 2014 the City issued$3,775,000 General Obligation Bonds for the 2014/2015 Street Reconstruction projects. This bond is scheduled to be repaid by General Obligation Debt Levy, Special Assessments, and a transfer from the Water Utility Fund. The bonds will be paid until 2025. Budgeted Projects Fund The Budgeted Projects Fund was established to fund capital purchases for public works, police, administration, etc. The revenues received in this fund are transfers in from the General Fund and.the Utility Funds. Revenue received for tree replacement and occasionally revenue received as donations are also deposited in this fund. For the year 2017 the City has budgeted transfers from the General Fund Budget in the amount of$632,075 and transfers in from the Utility Fund in the amount of$159,475. The anticipated expenditures for 2017 are$350,000 for sealcoat/crack seal,park and trail improvements and maintenance,tree planting, computers and software and an estimated $390,000 for street maintenance-mill and overlay. The site is zoned B-3, Highway Business and Warehouse in which retail stores and commercial recreation such as the indoor firearms range is a permitted use. This facility will provide a community, family friendly, safe and inviting environment for all levels of shooting sports enthusiasts. Range 082 Indoor Shooting is a 45,000 square foot entertainment facility incorporating five shooting bays, educational space and retail area. The shooting range will consist of 38 lanes (10 rifle, 10 training, 18 pistol). Top quality, state-of-the art equipment from Action Target will make it a true Five Star Range. The free shooting bays allow for shooting competitions and competitive shooting tournaments, as well as individual practice. The 8,500 square foot retail space will offer a wide variety of merchandise, including unique and high end items not generally offered at other sporting goods outlets. The retail space will also include a libraryAeechnical center and concession area. Patrons will experience a safe and welcoming environment when they step in the door. Highly skilled and knowledgeable staff will assist all patrons, whether they are seasoned shooters or beginners. Classes will be offered and taught by certifled professionals approved by the Minnesota BCA and NRA. Classes will range from beginner safety and personal defense to advanced marksmanship and tactical. Range 082 will be a year round destination which the City of Oak Park Heights can call a landmark for the community. ISSUES ANALYSIS Comprehensive Plan. The property is designated as Highway Business/Warshouse on the Proposed Land Use Map. The proposed use is consistent with this land use designation. 2 Page 95 of 156 Zoning. The property is zoned B-3 Highway Business and Warehouse District. The use of the site for retail and as commercial recreation is a permitted use in this district. Subdivision. The property has been split as part of a minor subdivision in compliance with Section 402.01 G. Minor Subdivisions of the Subdivision Ordinance.- Site rdinance:Site Plan. The front of the building is orientated to Highway 15 with the parking lot adjacent to the front entrance. A large front yard on the southeast side and large side yard on the southwest allows for green area, landscaping and storm water ponding. The loading area for the building is located on the Memorial Avenue North side of the building but is screened with a berm and landscaping. Setbacks. The building and parking areas are compliant with all setback requirements. Traffic Circulation/Curb Cuts. The site plan indicates that there will be two curb cuts off of Memorial Avenue North. The curb cut and driveway near the northwest property lines is set back 10.5 feet and is compliant with setback requirements. There are three landscape islands within the parking lot. The plan should be subject to review by the Fire Marshal for emergency vehicle access. Snow Storage. The plans do not indicate an area for snow storage. The applicant shall indicate where the snow is to be stored. Parking. The submitted landscape pian is subject to City Arborist review and approval. City Arborist comments are found as an exhibit to this report. Lighting. The lighting plan indicates the locations of the parking lot and site fixtures as well as the building wall fixtures. The lighting specifications indicate that the fixtures to be used in the parking lot and on the walls, will be full cut off and LED. The light poles 3 Page 96 of 156 are shown at 25 feet with a 3-foot base. The lighting regulations limit the height from ground level to the top of the fixture at 25 feet. All light fixtures shall be required to be full cut off, compliant with the height requirements, and be consistent with Section 401.15.B.7 of the Zoning Ordinance as it relates to lighting requirements. A photometric plan shall be provided subject to review of City Staff. Trash Storage. The floor plan indicates that the trash containers will be stored behind the fenced area on the northwest side of the building. The fence will be a solid concrete structure. Mechanical Screening. Any exterior mechanical equipment, either on the roof or ground mounted will need to be screened In accordance with Section 401.15.E.10.e. of the Zoning Ordinance. The plans indicate that the roof mounted and ground mounted mechanical equipment will all be screened. Noise. Sound levels generated from the site shall be in compliance with Section 401.15.6.11 of the City Zoning Ordinance. All of the gun range activity is to be conducted indoors. There will be no range activity outside of the building. Grading, Drainage, Erosion Control and Utilities. Grading, drainage, erosion control, and utility plans are subject to review and approval by the City Engineer. Storm water issues are also subject to review and approval by the Browns Creek Watershed District. Signage. Freestandina Sion. The applicant has proposed two freestanding signs, one adjacent to Highway 15 and the other adjacent to Memorial Avenue. The location of the Memorial Avenue sign is not shown on the site plan. The proposed plans indicate that the signs would be lit by sign floods mounted on the parking lot light poles. Additional detail is required to review how the signs will be illuminated. The signs will be required to comply with the Zoning Ordinance lighting requirements. Staff will approve the lighting specifications for the signs at the time of permitting. Design Guidelines Architectural Guidelines. Fagade Treatments The building will be required to have a definite base, middle and top at its front, side and rear facades. With the previous approval, City Staff has asked the project architect to provide another option to add more architectural interest on the northeast and southeast elevations. Revised diagrams indicate the revised plans that were approved. Ground Level Expression This is a one story building with a significant wood canopy at the front entrance facing Highway 15. The main entrance is well defined by the canopy and glass. Transr)arencv The building uses glass on the front facade. The Design Guidelines requires at least a 20 percent transparency on ground floor, street facing facades. The building front, facing the Highway 15, is 36 percent transparent. The Planning Commission should comment on the lack of transparency on the Memorial Avenue building side. Entries The building features a prominent entry with a prominent canopy and glass. Roof Design The building has a flat roof. The rooftop mechanical equipment will be completely screened. Buildina Materials and Colors The applicant has provided a color perspective for review. The building will be a combination of textured concrete, wood and glass. Building material samples will be required for the Planning Commission meeting. 5 Page 98 of 156 Franchise Architecture The building is not a franchise design. The plans show a trail along Memorial Avenue that will be constructed at 8 feet in width to match the trail adjacent to the Kwik Trip development. Landscaping Building entrance plantings are required and are provided on the plans. The overall landscaping plan is a very positive feature of the site. The landscape plan is subject to review and approval of the City Arborist. Trees/Shrubs The trees and shrubs used in the landscape plan shall be subject to the review and approval of the City Arborist. This facility will provide a community,family friendly, safe and inviting environment for all levels of shooting sports enthusiasts. Range 082 Indoor Shooting is a 45,000 square foot entertainment facility incorporating five shooting bays, educational space and retail area. The shooting range will consist of 38 lanes(10 rifle, 10 training, 18 pistol).Top quality, state-of-the-art equipment from Action Target will make it a true Five Star Range. The five shooting bays aliv,,01cr shooting competitions and competitive shooting tournaments, as well as individual practice. The 8500 square foot retail space will offer a wide variety of merchandise, including unique and high end items not generally offered at other sporting goods outlets. The retail space will also include a library/technical center and conosssion area. Patrons will experience a safe and welcoming environment when they step in the door. Highly skilled and knowledgeable staff will assist all patrons,whether they are seasoned shooters or beginners. Classes will be offered and taught by certified professionals approved by the Minnesota BCA and NRA. The following includes my comments and/or recommendations: Landscape Plan (1-2.1) The overall design of the plan is attractive and will complement the building well. The plan includes an acceptable species selection of deciduous trees, coniferous trees, ornamental trees, shrubs and perennial plants to be installed ((660) total). All plants included in the elan are hardy under local growing conditions, tolerant or resistant to major insect and disease problems and fairly low maintenance. All plant sizes, root and container classes included in the plans conform to the City of Oak Paris Heights zoning ordinance requirements. The locations chosen for most plants are appropriate. The only exception would be the placement of thornless honeylocust in relatively small parking lot medians on the NE/SE side of the development and in the narrow median along the N side of the development. These trees can be very large at maturity and the parking lot medians and the north median will not allow enough rooting space for these trees to grow to a healthy maturity. I recommend replacing the honeylocust in the medians with six Japanese tree lilacs which are smaller ornamental trees and also have some resistance to de-icing salts. (This has been changed by the applicant, site review meeting 8/5/15.) Also at the meeting with the developer 8/5/15, it was recommended that shrubs and/or possibly ornamental grasses be planted along a wall facing the Memorial Avenue side of the property. Trees are not required to be staked as long as they can stand upright on their own. The landscape contractor is required to plant trees and shrubs according to the approved planting detail diagrams and landscape notes submitted with the final approved landscape plan. This will be checked after planting and any deviations from the plans must be corrected before the landscaping will be approved by the City, this needs to be noted in the final plans. In June 2015, the Developers(Creative Home Construction Investments LLC)of this site requested an extension of the one year timeline and which was granted under City Council Resolution 15-06-30 which gave certain timelines for the execution of the Developer's Agreement and the supply of all securities and platting to be completed by June 2016. These conditions were not met. In January 2016, the City received a second extension request from Creative Home Construction Investments LLC representative Mick Lynskey to extend the approvals through June 2017.Their various rationale at that time included a "softening of the market". The City Council agreed to an extension but with the limitation that the Developers Agreement and required securities be posted by 12/31/16 with construction to commence by that June 2017 timeline. To date the Developer's Agreement has not been initiated by the Developer nor is there a reasonable expectation that any work would commence in 2017 as plan designs should already be underway. The City has now received a third extension request—dated December 6th,2016 whereby the Developers are seeking timelines through September 2018.That letter is enclosed,again citing unknown market conditions,etc. Recommendation: Please recall the site itself has a planned use of"Low Density Residential"as outlined in the City's 10—year comprehensive plan and to date Staff is not aware of planned deviation or thought to reconsider this land-use. The City's previous water supply plan was updated and approved by the DNR in April of 2012; however the DNR required OPH to update and submit a plan in 2016 to sync plan submission with other City's rather than accepting plan submissions on a staggered schedule. The DNR cites the purpose of the water supply plan is to encourage communities to deal proactively with providing sustainable drinking water. There are four sub parts to the updated plan: A water supply system description and evaluation,emergency preparedness procedures, a water conservation plan and water demand projections. Recall,early in 2016 the Council approved an expenditure of$8,550 for Stantec to assist City staff in compiling the plan. City Staff and Stantec did work together to compile and evaluate data and the draft plan was submitted to the DNR and the Met Council for review on December 5,2016. A full draft of the 150 page plan is available upon request,but it's a dry read. The following are the high points: (gpcd)=gallons per capita per day • Residential per capita water demand averaged 67 gpcd in 2005 -2007 but is now about 55 gpcd in 2014-2015. • The total per capita water demand average was approximately 131 gpcd between 2010 and 2015;a decrease from approximately over 140 gpcd between 2005-2009. Page 140 of 156 • Population growth in Oak Park Heights was approximately 1.6%between 2005 -----2015 (4,633 to 4,706). Total per capita water demand is decreasing; from over 140 gpcd in 2005—2009 to 126 gpcd in 2014—2015. • Average day water demand has decreased slightly over the last 10 years and per capita water usage has dropped slightly as population has slowly increased.Additionally,the maximum day water demands have decreased from a high of 1.86 MGD in 2005 to an average of 1.3 MGD in 2012 -2015. The process of updating the plan will continue into 2017.As noted above,the draft plan assembled throughout 2016 was submitted to the DNR and Met Council for review. Draft plans must also be sent to neighboring communities for review and comment. After the review and revision process between the DNR and City staff,the OPH Council must formally adopt the final plan. Prior to construction it was a wider gravel shoulder. I would speculate these parking areas have been established for decades. This however now more clearly conflicts with the City's Winter parking rules-as there is a clear delineation of lands and which does not allow-24-hour on street parking. To address this,the City may seek to install signage in this area that would allow for parking from the SE comer of 65th and Paris Ave.to a point approximately 150' south so as to continue the"on-street"parking capability. These signs would be installed by the City at the City expense,but may require County permission as it is in their ROW. Requested Action: Authorize the Chief of Police to create a Parking Zone,including the placement of signage from the S.E. comer of 65th and Paris to a point 150' south+/-so as to allow the winter on-street parking generally in front of the two properties of 6461 and 6469 Paris Ave. See Attached Resolution. Page 149 of 156 RESOLUTION A RESOLUTION APPROVING THE CREATION OF LIMITED WINTER ON-STEET PARKING AREAS ALONG PARIS AVE (CSAH 23) Whereas,prior to 2016,two homes located at 6461 and 6469 Paris were allocated permission park along the adjacent Paris Ave.roadway as their general parking area for their homes; and, Whereas prior to 2016,the City could not materially enforce winter parking rules in this area as there was not a clear delineation of public right of way vis a vis the private property; and, Whereas in 2016, Washington County did reconstruct Paris Ave. in this area and which clearly located the right of way and created a clear curb-line with shoulder, but did also include unique parking areas; and, Whereas the City maintains Ordinance 1101.03 H. that prohibits on-street parking during winter months so that snow can be cleared curb-to-curb, this new construction would create a conflict with the City Ordinance and any continued accommodation made between the two properties and Washington County. NOW, THEREFORE, BE IT RESOLVED that the City permits the winter on-street parking of duly licensed and operable vehicles from the southeast corner of 651h Street and Paris Ave.to a point approximately 150' south and as accommodated by the now constructed"bump-out"area. BE IT FURTHER RESOLVED that the Chief of Police shall secure and install the necessary signage to implement the terms of this resolution.
