Please review my letter dated March 4 h , 2005;1 have again attached copy. As a result of their failure to protect the City's property, the curb and sidewalk will need to be replaced and/or repaired to the extent determined by the City, .Additionally, the street was damaged by the vehicles, mostly tracked vehicles, and therefore the City's road must also be repaired. Enclosed you will find color photographs that clearly show the damages. The City will be preparing estimates for these repairs in the next 30 days. Once these estimates are complete we will provide you such information and how the City will proceed. Senior Housing Partners shall be responsible to cover all costs related to these repairs. This appears to have occurred when heavy machinery was unloaded at this location and trucks used the crossing site to work on clean -u p of the site west of Oakgreen and south of 5e street north. The attached pictures show damage and/or-removal of the new (2004) seal coat, damage to two sections of curbing and some damage to the asphalt trail. Restoration of the sod was not done. This work was performed by a contractor who did not take measures to protect the public property and restore it at completion of their project. The first 3 pictures are views to the north, south and west. The next Z are specific damage to the road. The next 3 are damage to the curbing. The last two are damage to the trail. On Tuesday, March 1" there were excavation activities (frost breaking) occun by Bolander without a soil scientist present at the site. This was a violation of item 4 as stated on A endix B of your Conditional Use Perrot. work was stopped until the appropriate person cane to the site - Eric Stommes GNE Consultants. Please remind your contractor that a soil scientist must be on site and monitoring the project AT ALL TEES. The person from Bolander at the site was also reminded that curb protection must be installed. On Thursday, March 3 substantiat soils removal and bacMling activities commenced. No curb protection, as required in item 1 -Appendix B has been installed as well as no efforts have been made t0 protect the City's trail. The City will monitor the site for curb / trail damage once the project is complete and the spring thaw occurs. Should the City determine that these items are damaged, the City shall require these be repaired. and/or replaced. Lastly, contrary t Minnesota law, none of the loads leaving the site have been covereditarped.
