The City's Engineer, Karen Erickson, P.E. of Bonestroo and Associates, has reviewed the application and
has submitted the attached letter — indicating that the approach contemplated by the Applicant is in
compliance with appropriate environmental and engineering standards in yak Park Heights.
Accordingly, Ms, Erickson has no objection to allowing the project to proceed under a Conditional Use
Permit. However, the following are minimum. conditions should be placed on the approval
Minimum Conditions For Approval:
1. Applicant shall protect all City infrastructure; curb, gutter, bituminous trailways, etc from
damages.
2. All access shall be from 5 8 Street.
3. All mud, debris, dirt, etc tracked onto the City streets/trails shall be cleaned -up at the, end of
each construction day. There shall be no stockpiling of any fill or excavated materials on or
off site,
4. No excavations or backfilling of any type may proceed without a Minnesota licensed soil
scientist present at the site AT ALL TIMES. Applicant shall backfill any and all excavations
with materials as indicated in scope of work before leaving the site at the end of each
construction day. Site shall be reseeded with appropriate grasslprairie mixture.
5. Soil Erosion and Drainage Plans are subject to final verification by the City Engineer prior to
work commencing.
5. Applicant shall provide the City a final closure report that indicates and demonstrates that all
relevant State and Federal remediation standards and reporting requirements have been met.

We have reviewed the Soil Correction Flan for the vacant lot in the southwest quadrant of
Oak green Avenue and 58 Street North, as su bmitted by GME consultants, Inc., on
January 1 2005.

Dear Mr. Johnson:
In this letter, we provide the information you requested in your December
16, 2004 and January 5, 2005 letters regarding the Conditional Use Permit
(CUP) for Senior Housing Partners (SHP), the Property owner You
highlighted 12 items on the development application checklist which are
addressed below.

SHP hired GME Consultants.. I to provide environmental consulting
services, including Phase I and II Environmental Site Assessments
(ESA.$) . We found lour Level petroleum c ontamination in the soil and
buried debris in three locations on the Property labeled areas 1, 2 ■
3 on the attached diagram. SHP proposes to excavate and dispose of
the impacted material which is estimated to be about 800 cubic yards
These three areas are further described below.
Area 1 - It appears that f ill soil with debris had been deposited
in this former "low" area in the past. We estimate that this fill
soil with debris is about 4 to 5 feet below existing grade at its
deepest location, which thins out to its perimeter.

Area '2 - We previousl observed scattered surface petroleum
stainin in this area. We estimate that the upper 1 to 2 feet of
soil, is impacted.,

> Area 3 - This area was reportedl the former location of a basement
on the Propert It appears that fill soil with debris -had been
deposited in the former basement. We estimate that the basement
floor slab is about 8 feet below g rade.
Our Environmental Scientist will be present on the Propert durin
the removal process-, to conduct field testin and observe the
excavated materials, Followin excavation, we plan to collect
confirmation soil samples from the bottom and sidewalls of the
excavations for anal testin The confirmation samples will
determine whether residual contaminated soil remains. Followin
removal of the contaminated soil, SHP proposes to backfill the
excavations to ori g rade with a suitable soil. At this time,
the propose to backf ill. the excavations with a sand or sand with
silt, classified as SP or SP-SM accordin to the Unified Soil
Classification S This soil will be compacted to 95% of the
maximum modified proctor dr densit (ASTM D:1527) . Backfillin of
the excavations will occur shortl after excavation.
SHP has enrolled this site in the Minnesota Pollution Control A
(MPCA) Voluntar Investi and Cleanup (VIC) and the Voluntar
Petroleum Investi and Cleanup (VPIC) pro These pro
will provide technical assistance and review services and ma provide
le assurances throu closure letters upon project or objective
completion.

Development of the Propert is not planned at this time. SHP i
plannin to remove the 'impacted fill soil and debris from the
Propert and return the surface g rade to existin conditions.
11) TrafficlVehicular Mana Plan
SHP contracted Carl Bolander & Sons Compan (Bolander) to excavate
these materials and load it directl into trucks for disposal at the
SKB landfill in Rosemount, Minnesota. Prior to haulin the material,
Bolander told us that the intend to place landscape fabric overlain

landscaping, to minimize damage from the trucks and heavy machinery.
Bo.lander said they also will place "Truck Hauling" signs on 04kgreen
Avenue and 58 Street . during transport activities.
