Eri oh Jrn, City Administrator I RELEASE Between the City of Oak Park Heights(the"City")and Ms.Bonnie Polichnia(the"Owner") 1 LEGAL DESRCIPTION/PIN#: See Exhibit A. Whereas the elevation of Oldfield Ave.has been established to ensure the proper conveyance of storm water from the City's right of way and adjoining private driveways into a public storm system;and, Whereas the elevation of the home at 5869 Oldfield Ave(further described in Exhibit A)as owned by Ms.Bonnie Polichna(the Owner)and its related driveway was not consistently designed to ensure positive drainage from the property onto the City right-of- 1 way and then conveyed to the City's systems;and, Whereas it is necessary that the elevation of such improvements need to be adjusted to create that positive drainage onto Oldfield Ave„prevent storm water from flowing eastwardly up the driveway from the City's street and that such improvements are necessary due to discrepancies in the elevations utilized at the time of construction. In consideration of the above: 1. I, Bonita Polichna, the Owner of 5869 Oldfield Ave shall, at her sole expense, reconstruct the entire driveway at an estimated cost of$6,200 including its connections to the City right of way and that it is the Owner's responsibility to 1 secure responsible contractors and develop plans that accomplish the above goals without impact to adjoining properties. It is further the Owner's sole responsibility to ensure the driveway is constructed,reconstructed and is maintained at an elevation to prevent any damages to the Owner's person or property from storm water flow derived from Oldfield Ave. 2. 1,Bonita Polichnia,in exchange for the sum of$900.00 as received from the City do hereby release and forever discharge the City of Oak Park Heights including all its agents, employees and related parties and any other person, firm or corporation charged or chargeable with related responsibility or liability, their heirs, representatives and assigns, from any and all claims and causes of action for property damage,loss of use and depreciation sustained or that(I)or the property has or may sustain as a result of storm water drainage derived from Oldfield Ave and its related connections and/or improvements included within this Release.
