RE: Oak Park Heights— Midstate Landscape and Excavating - Conditional Use
Permit Application— 5750 Memorial Avenue North
FILE NO: 236.02 — 17.02
Dear Mr. Anderson:
The City is in receipt of your application materials submitted on March 13, 2017 to allow
for a landscaping and excavation company in the B-3 Highway Business and
Warehouse District at 5750 Memorial Avenue North. The application consists of
requests for a Conditional Use Permit to allow for outside landscape materials and
equipment storage. With this letter, we are notifying you that the application is not
complete. The City will deem it complete with receipt of the following items by March
22, 2017:
1. Please identify how long the short-term stockpile areas will remain and when
the future landscape material storage bunkers will be completed.
2. An erosion control plan should be provided for the site, especially as it relates
to the short-term storage of materials.
3. If any changes to the lighting for the site are proposed, a lighting plan should
be provided.
4. What are your plans for signage?
5. What are your plans for trash and recycling storage?
We would invite you and your representatives to a staff meeting on March 22, 2017 at
10:30 AM at City Hall to discuss these issues and address any questions you may have.

If all of the application materials are submitted as requested, the Planning Commission
would consider the application at a meeting scheduled for April 13, 2017 at 7:00 PM in
the City Hall Council chambers.
Pursuant to Minnesota Statutes 15.99, Sub. 3(f), the City of Oak Park Heights is
herewith extending the period of time for agency/city review of the application for an
additional 60-day period (for a total of 120 days from the date of application) inasmuch
as the City has determined that additional research and study by the City staff relative to
