RE: Driveway, Lawn Parking & Inoperable Vehicle
Dear Jason& Kelly,
I wrote you this past November 13, 2016, notifying you of City Ordinance 401.15.F.4.h.13 that
requires all hard surfacing of areas to be used for parking spaces and driveways and of City
Ordinance 401.15.F.7 regarding off street accessory parking not being utilized for storage or
placement of inoperable vehicles. You were asked to relocate vehicles to the driveway or submit
a complete plan for an expansion of your current off street parking areas and to remove what
appeared to be an inoperable van parked upon the lawn.
As of today, I have not received a response from you and the van remains sitting upon the lawn
area. A closer inspection of the van shows that it has expired tabs and does appear to be in an
inoperable condition. Your existing driveway/parking area appears to be a gravel driveway and
is in need of upkeep. At minimum, additional class V material needs to be placed to maintain
minimum driveway standards.
This letter serves as the City's direction that you:
(1) Remove the van from the lawn area. In an inoperable condition, the vehicle may not be
stored upon your driveway.
(2) Submit a permit application and plan to the City for repair to the driveway, along with its
expansion should you opt to expand the footprint of the existing dirt/gravel drive/parking
area.
City Ordinance 401.15 F.4. h.13, requires all vehicles to be parked upon a hard surface (see
below).
401.15.F.4.h.13 — Surfacing. All areas intended to be utilized for parking space
and driveways shall be hard surfaced with materials suitable to control dust and
drainage. Plans for surfacing and drainage of driveways and stalls for five (5) or
more vehicles shall be submitted to the City Engineer for review and the final
drainage plan shall be subject to written approval.

Hard surface is considered to be that of asphalt, concrete, cobblestone, paving block or crushed
rock that meets minimum Class 5 materials and which has a 4-inch minimum base depth.
The van is to be removed and your permit application and plan received and work completed for
driveway repair and/or alteration no later than March 23, 2017.
I noted that you do not appear to have a vehicle parking garage at this property. If you would
like to pursue the possibility of placing a garage structure, I am happy to visit with to discuss the
situation and work with you to find a suitable solution.
Presently your yard is in violation of Ordinance 401.15F.4 & 7 as noted above and your prompt
attention is requested. Failure to respond or address the compliance shall result in the matter
being forwarded to the Oak Park Heights Police Department for citation consideration.
