Oak Park Heights, MN 55082 Re: Special Event Signage—"Happy Hour" Sign Dear Mr. Graf: I visited with you on April 2, 2009 regarding the "Happy Hour" banner you have placed at your store entry. I advised you of City Ordinance 401.15.G.8 which requires that special event permits for such signage. I provided you with a copy of this ordinance and a special event permit application at the time of my visit. I have enclosed another copy with this letter for your convenience. We discussed the ordinance allowance of 50 calendar days of special event signage each year and that there was not a fee for the permit; however failing to get one was considered an ordinance violation. During our visit, you mentioned that your corporate entity would like to have the "Happy Hour" signage on a permanent basis. I advised you that they would need to address the sign as part of their development signage approvals and suggested that you contact them regarding this and have them contact me should they like to pursue this possibility. To date, I have not been contacted by anyone to this regard. The special event permit you applied for on April 3, 2009 requested a permit for the time period of April 3 through May 10, 2009. I gave you a call and we talked about the number of days per year and event periods again. We revised the permit to April 3 through April 14, 2009. A site visit made on April 15th found the sign still in place. I called the store and left a message for you regarding taking the sign down or applying for a new special event permit. I did not receive a response back. In light of your original application time period request, I extended your permit from the 15th of April to May 10th Ruby Tuesday May 21,2009 Page 2 A site visit made on May 15th found the sign still in place. At this time and with this letter, you are requested to remove the "Happy Hour" and any other temporary signage to the exterior of the store by the end of the day Monday, May 25, 2009. A site visit will be made after that date to confirm ordinance compliance. If the compliance is not found,violation notice will be forwarded to the Oak Park Heights Police Department with a request that you be issued a citation for the same. As of the 23`d of May, Ruby Tuesday will have utilized the full amount of special event days permitted each calendar year by City Ordinance. No additional special event permits shall be issued to Ruby Tuesday for the calendar year 2009. Placement of any additional special event signage/advertisement to the business exterior will result in citation. City Ordinance 401.15.G.6.c and d. set for the regulations for permanent and temporary window signage for the City. I have enclosed a handout with this information for your use as you may find it useful for event advertisement at your business. Please note that special event permits are not required for this type of signage; however window signage shall comply with the ordinance section requirements. If your corporate entity wishes to revisit the signage for the store, please have them contact me. Feel free to share my contact information with the appropriate party.
