CITY OF OAK PARK HEIGHTS
WASHINGTON COUNTY,MINNESOTA
A RESOLUTION ESTABLISHING FINDINGS OF FACT AND
RECOMMENDING TO THE CITY COUNCIL THAT THE
REQUEST BY THE CITY OF OAK PARK HEIGHTS FOR
A CONDITIONAL USE PERMIT FOR SIDE YARD SETBACK AND
DESIGN GUIDELINE/SITE PLAN REVIEW FOR A PARK SHELTER AT
COVER PARK, SHOULD BE APPROVED WITH CONDITIONS
WHEREAS,the City of Oak Park Heights has received a request from the City
Administrator for a Conditional Use Permit for a side yard setback and Design Guideline/Site
Plan review for a new park shelter at Cover Park, located at 58th Street North and Peller Avenue
North, and after having conducted a public hearing relative thereto, the Planning Commission of
Oak Park Heights makes the following findings of fact:
1. The real property affected by said application is legally described as
follows,to wit:

2. The applicant has submitted an application and supporting documentation to the
Community Development Department consisting of the following items:

and
3. The property is zoned 0, Open Space Conservation District in which Cover Park
has been allowed as a permitted use; and
4. The site plan indicates a 17-foot side yard setback from the property line to the
building,requiring review and approval of a Conditional Use Permit in that a 30-foot setback is
required; and
5. Cover Park is a long and narrow lot limiting the location of the park shelter and
parking lot; and
6. The City of Oak Park Heights has determined that the front of the park structure
be orientated west for ease of access from the parking lot and the skating rink, and will allow for
the possible placement of solar panels on the roof of the structure; and
7. Design Guideline/Site Plan approval is required for the new building and site
improvements; and
8. City staff prepared a planning report dated March 8, 2017 reviewing the request;
and
9. Said report recommended approval of the Conditional Use Permit for a side yard
setback, and Design Guideline/Site Plan review, subject to the fulfillment of conditions; and
10. The Planning Commission held a public hearing at their March 16, 2017 meeting,
took comments from the applicants and public, closed the public hearing, and made the
following recommendation:
NOW,THEREFORE,BE IT RESOLVED BY THE PLANNING
COMMISSION FOR THE CITY OF OAK PARK HEIGHTS THAT THE PLANNING
COMMISSION RECOMMENDS THE FOLLOWING:
A. The application submitted from the City Administrator for a Conditional Use Permit for a
side yard setback and Design Guideline/Site Plan review for a new park shelter at Cover Park,
located at 58th Street North and Peller Avenue North, affecting the real property as follows:

Be and the same as hereby recommended by the Planning Commission of the City of Oak Park
Heights with the following conditions:
1. All tree removal and landscape plans shall be subject to review and approval of the
City Council.
2. All lighting proposed for the park building and parking areas shall be in compliance
with Section 401.15.B.7 of the Zoning Ordinance.
3. Any mechanical equipment installed outside of the building shall be screened in
accordance with Section 401.15.E.10.e of the Zoning Ordinance.
4. The grading and drainage plans shall be subject to review of the City Engineer and
the applicable watershed district.
5. The Planning Commission and City Council shall comment on the building addition
appearance, colors, and materials as part of the Design Guidelines review.
6. A bike rack shall be added to the site near the new park shelter.
7. The Planning Commission recommends that the City Council consider high durability
glass for the park shelter that will resist vandalism and sports play activities.
8. The City Engineer shall review the slope on the east side of the park shelter to assure
room for maintenance and to avoid erosion issues.
