A RESOLUTION APPROVING THE APPLICATION OF
VETERANS OF FOREIGN WARS POST 9323
FOR GAMBLING CONTROL BOARD PREMISES PERMIT FOR
OPERATION OF GAMBLING ACTIVITIES WITHIN THE
CITY OF OAK PARK HEIGHTS
WHEREAS, VFW Post #323 has applied with the State of Minnesota Gambling
Control Board for a premises permit to operate a gambling activity at the site of VFW
Post #323, 5880 Omaha Avenue North, within the City of Oak Park Heights; and,
WHEREAS, the application would be effective through 3/31/01; and,
WHEREAS, the City of Oak Park Heights has reviewed the application of VFW
Post #323 and finds that its purposes meet the necessary community standards, proceeds
being dedicated to the support of charitable activities within the St. Croix Valley; and,
WHEREAS, the City of Oak Park Heights has solicited the input of the public
and there have been no objections to the granting of the renewal application for the
premises permit as applied for by VFW Post #323 with the State of Minnesota Gambling
Control Board.
NOW, THEREFORE, BE IT RESOLVED, BY THE CITY COUNCIL FOR
THE CITY OF OAK PARK HEIGHTS AS FOLLOWS:
That the application of VFW Post #323 with the State of Minnesota Gambling
Control Board to operate gambling activities on the site of VFW Post #323 at 5880
Omaha Avenue North within the City of Oak Park Heights through 3/31/01 and the same
are hereby approved.

Dear City Clerk:
Attached are the premise permit renewal applications for the operation of charitable gambling at the
Millroad Inn and the Stillwater Bowl, both of which are located in the City of Oak Park Heights.
This renewal is effective 04/01/00 through 03/31/02.
The profits from charitable gambling are being directed to ice costs, in order to keep the cost of playing
hockey as reasonable as possible. In doing this, we are hoping to make playing youth hockey available to
as many children in our community as we can.
Since our last license renewal, our Lawful Purpose Contributions were as follows:
3- 17 -98: $ 1150.00
2- 16 -99: 4741.45
4- 12 -99: 1037.50
4- 21 -99: 33,088.06
11- 16 -99: 5513.06
For a total of $45,530.07, which helps pay for ice time costs for our hockey players. It also helps pay for
the Stillwater Area Hockey Association's contribution to the St. Croix Recreation Center, which benefits
many community activities.

A RESOLUTION DESIGNATING THE COURIER NEWS
AND THE STILLWATER GAZETTE AS THE CITY OF
OAK PARK HEIGHTS OFFICIAL NEWSPAPERS
WHEREAS, the City of Oak Park Heights has determined the need to designate
two newspapers as official newspapers for the City for 2000 due to time sensitive
publications.
NOW THEREFORE, BE IT RESOLVED, that the City Council for the City of
Oak Park Heights designates the Stillwater Gazette and the Courier News as the official
newspapers for 2000.

paper used by the City.
NOW THEREFORE, BE IT RESOLVED, that the City Council for the City of
Oak Park Heights designates the Stillwater Gazette as the official newspaper to handle
time sensitive publications for 2000.

THE YEARS OF SERVICE OF JOSEPH ANDERLIK TO
THE CITY OF OAK PARK HEIGHTS AS ITS
CONSULTING ENGINEER
WHEREAS, the City of Oak Park Heights has received the benefit of the services
of Joseph Anderlik as its consulting engineer over the past 40 years; and,
WHEREAS, Joseph Anderlik has had a direct and immediate impact on the growth
and development of the City of Oak Park Heights in projecting its utilities, storm water systems,
municipal water systems, growth, development and has well served the residents of the City of Oak
Park Heights; and,
WHEREAS, Joseph Anderlik has transitioned effective January 1, 2000 with his
consulting firm to a consultant status and will no longer be directly responsible to the City for the
providing of its consultant services; and,
WHEREAS, it is appropriate that the City take this opportunity to recognize Joseph
Anderlik's contribution to the City over these past 40 years and acknowledge the significant
contribution that he has made to the benefit of the residents of the City of Oak Park Heights.
NOW, THEREFORE, BE IT RESOLVED, by the City Council for the City of
Oak Park Heights that this City Council does hereby extend its gratitude and thanks to Joseph
Anderlik for his over 40 years of direct services to the citizens and residents of the City of Oak Park

CITY OF OAK PARK HEIGHTS
WASHINGTON COUNTY, MINNESOTA
RESOLUTION AUTHORIZING ACCEPTANCE
OF A TRAFFIC SAFETY AWARD
WHEREAS, the City of Oak Park Heights desires to guard the safety of the citizens
by improving traffic safety and participating in the Safe and Sober Challenge; and
WHEREAS, under the provisions of the Highway Safety Act (P.L.89 -563), the
Minnesota Department of Public Safety has federal funding to promote traffic safety; and
WHEREAS, the Minnesota Department of Public Safety has judged that the City of
Oak Park Heights' efforts to decrease impaired driving and increase seat belt use to be exceptional,
and wants to reward those efforts by providing additional funding for the Oak Park Heights Police
Department.
NOW, THEREFORE, BE IT RESOLVED that the City of Oak Park Heights
enter into an agreement with the Minnesota Department of Public Safety, Office of Traffic Safety,
for the Safe and Sober Challenge during the period of December 1, 1999 to June 30, 2000.
BE IT FURTHER RESOLVED that the Chief of Police for the City of Oak Park
Heights is hereby authorized to execute such agreements as are necessary to implement the project
on behalf of the City of Oak Park Heights.
BE IT FURTHER RESOLVED that the Chief of Police for the City of Oak Park
Heights is hereby authorized to be the fiscal agent and administer the grant on behalf of the City of
Oak Park Heights.
BE IT FURTHER RESOLVED that the City of Oak Park Heights does hereby
acknowledge and accept the $2,000 grant provided it by the Minnesota Department of Safety as part
of the Safe and Sober Challenge.

WHEREAS, Ann Bodlovick served as an appointed member of the Cable
Advisory Board from 1979 to 1981 and the Cable Commission from 1982 to
2000; and
WHEREAS, Ann Bodlovick was instrumental in bring cable to the St.
Croix Valley; and
NOW, THEREFORE, BE IT RESOLVED, the City of Oak Park
Heights hereby recognizing and commends Ann Bodlovick on her distinguished
service to the Cable Commission and her overall service to the City of Oak Park
Heights and thanks her for her dedication during her appointment.

BUSINESS DISTRICT AND THE CREATION OF A CENTRAL BUSINESS
DISTRICT FUND AND AUTHORIZE EXPENDITURE FOR THE T.I.F.
ANALYSIS, CBD DESIGNS AND PLANNING.
WHEREAS, Council has requested that the establishment of a Central Business
District, creation of a Central Business District Fund and the expenditure of T.I.F. funds
be investigated to reaffirm that these actions occurred.
WHEREAS, Authorization was given to City staff to develop a town center
concept in May 1998.
WHEREAS, A zoning district "Central Business District" was established in
August 1998.
WHEREAS, A building inventory analysis was performed in the existing T.I.F.
District redevelopment area that included structures in the Central Business District.
WHEREAS, Legal research was conducted to examine opportunities within the
existing T.I.F. District.
WHEREAS, The City of Oak Park Heights entered into a Memorandum of
Understanding with other property owners in the Central Business District.
WHEREAS, The City worked cooperatively with the property owners and
entered into a contract with BRW to complete an urban design study and invited the
public to participate in a design charette.
WHEREAS, The existing T.I.F. District project area was amended.
WHEREAS, The Oak Park Heights City Council created a Central Business
District (CBD) Fund with the Economic Development Authority acting as administrators
of the fund.
WHEREAS, The Economic Development Authority accepted administrative
responsibility of the CBD Special fund.
WHEREAS, A transfer of $10,000 was made from the Community Development
budget to the Central Business Development Special Fund.
WHEREAS, The City Council accepted $2,500 from the Valley Senior Services
Alliance and $500 from Tim Nolde for the BRW planning fees.

A RESOLUTION AUTHORIZING THE BUDGET
TRANSFER OF TAX INCREMENT
FINANCING FUNDS TO THE GENERAL FUND
WHEREAS, the City of Oak Park Heights has previously
established a tax increment financing district; and,
WHEREAS, said tax increment financing district
generates funds for administration fees to be paid to the
City of Oak Park Heights; and,
WHEREAS, the City has incurred administrative fees
based upon work performed in relationship to said tax
increment financing matters for calendar year 1999 in the
amount of $7,253.00; and, \\
WHEREAS, the City of Oak Park Heights contemplates
additional administrative fees as they continue to review the
• established tax increment financing district and improvements
to be rendered to the St. Croix Mall area which will require
additional staff time and work; and,
WHEREAS, the City also anticipates additional audit and
accounting expenses as it affects the tax increment financing
district.
NOW, THEREFORE, BE IT RESOLVED, by the City Council for
the City of Oak Park Heights that there shall be transferred
from the St. Croix Mall tax increment financing fund to the
general fund the sum of $7,253.00.

RESOLUTION VACATING DRAINAGE AND UTILITY EASEINUNTS
ALONG THE COMMON OR SHARED INTERIOR LOT LINE
EXISTING BETWEEN LOTS I AND 2, BLOCK 2, KERN CENTER
SECOND ADDITION, WASHINGTON COUNTY, MINNESOTA
WHEREAS, City of Oak Park Heights has previously been petitioned by St. Croix
West Holdings LLC, the owners of Lots 1 and 2, Block 2, Kern Center Second Addition, seeking
the vacation of the drainage and utility easements existing between the shared or common lot line
between Lots 1 and 2, Block 2, Kern Center Second Addition; and
WHEREAS, applicant is also the owner of all of the property affected by the
proposed vacation; and
WHEREAS, it appears to the City Council that the drainage and utility lot lines
proposed for vacation have never been used by the public and it is improbable that there will ever be
• any public need for said drainage and utility easements inasmuch as the property is proposed to be
used by the United States Postal Authority with the construction of a structure on or about the
common lot line between the above two referenced lots; and
WHEREAS, it appears for the foregoing reasons to be in the public interest to
vacate the drainage and utility lot lines as it affects the shared boundary between Lots 1 and 2,
Block 2, Kern Center Second Addition.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR

ESTABLISHMENT OF A NO WAKE ZONE ON THE
ST. CROIX RIVER FROM THE NORTHERN PROPERTY
LINE OF SUNNYSIDE ON THE ST. CROIX
TO THE PROPOSED DNR LAUNCH RAMP
WHEREAS, the City Council for the City of Oak Park Heights has received a
request from the Port of Sunnyside Club, Inc. to support their proposal to establish a no wake zone
in an area north of their northern property line and extending to the south to the proposed DNR
launch ramp as it affects the St. Croix River; and
WHEREAS, the high volume of boat traffic on the St. Croix River with excessive
speeds and large wakes that are created thereby are creating issues of safety and property damage
for the traveling public and property owners along the St. Croix River; and
WHEREAS, ample precedent has already been established on various sections of
the St. Croix River to establish no wake zones where property and safety are in danger; and
WHEREAS, the City Council finds it to be in the best interests of its citizens,
property owners, the traveling public and boaters to establish a no wake zone in the area so
designated.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR
THE CITY OF OAK PARK HEIGHTS AS FOLLOWS: That the City of Oak Park Heights
hereby acknowledges and supports the establishment of a no wake zone on the St. Croix River from
an area to be established beginning at the northern property line of the Port of Sunnyside Club, Inc.
and extending to the south to the proposed DNR launch site.

RESOLUTION 00.02 -17
WHEREAS, the City of Oak Park Heights has been granted the legal authority to
negotiate, award and regulate cable television franchises under both federal statute Title 6
and Minnesota State statute Chapter 238; and
WHEREAS, the City of Oak Park Heights accepted the responsibility that comes with
the awarding of the cable television franchise, including ensuring that the cable company
meets the identified needs of the community such as community television and
institutional networks and by serving as a local resource to resolving customer service
issues and customer complaints; and
WHEREAS, state legislation has been proposed that would repeal Chapter 238 and
revoke the City's authority to award a cable television franchise, eliminate the City as a
local resource to its citizens for resolving customer service issues and customer
complaints, and remove the City's ability to receive direct support for community
television and other provisions that meet community needs; and
WHEREAS, it has not been demonstrated that local governments' role in cable
franchising impedes in any manner the ability of cable and telecommunications
companies to build infrastructure or to offer full and competitive services; and
• WHEREAS, while the City of Oak Park Heights acknowledges the regulatory challenge
of addressing the convergence of voice, video and data services, local governments are
essential to any legislative discourse in this area and must retain authority to ensure
continued local support for its community.
NOW, THEREFORE, BE IT RESOLVED:
1. That the City of Oak Park Heights must retain its authority to define and meet
local community telecommunications needs through the franchising of companies
that provide cable television services or otherwise and that it further asserts its
right to retain its local authority to enter into contracts to serve its community:
2. That any plan for telecommunications restructuring in Minnesota should continue
to provide the City of Oak Park Heights with stable and undiminished funding,
through franchise fees, in -kind services and grants for community television (PEG
access) and institutional networks, in order to meet local telecommunications
service needs and interests:
3. That any plan for telecommunications restructuring in Minnesota should be
consistent with federal law; and
4. That any plan for telecommunication restructuring in Minnesota should expressly
provide authority for local governments to build and operate their own
telecommunications networks to provide their citizens with advanced and
competitive telecommunications services.

CITY OF OAK PARK HEIGHTS
WASHINGTON COUNTY, MINNESOTA
RESOLUTION TO THE CITY OF OAK PARK HEIGHTS REGARDING GRANT
APPLICATION TO THE DEPARTMENT OF NATURAL RESOURCES FOR
LOCAL TRAIL CONNECTIONS AND IMPROVEMENTS
WHEREAS the Minnesota Department of Natural Resources has matching funds
available to accelerate development of trail linkages and /or trail plans through the 2000
Local Trail Connections Grant Program, and
WHEREAS the City of Oak Park Heights has conducted and completed a Comprehensive
Bicycle and Pedestrian Trail System Plan as of 1999,
WHEREAS a need has been identified in the Comprehensive Plan that will put final
connection to trail systems throughout the cities east -west linear park system to Valley
View Park,
WHEREAS emphasis is on building a connection between Swager Park to local
development of NSP park site, and wetland bridge connection to lower Oak Park Heights,
• BE IT RESOLVED that the City of Oak Park Heights is applying for the Local Trail
Connection Programs Grant and has the legal authority to apply for financial assistance,
and has the institutional, managerial, and financial capability to ensure that all aspects of
the proposed project will be completed;
BE IT FURTHER RESOLVED that the City of Oak Park Heights and its partner(s) will
share in the costs of the proposed project with the DNR by providing a cash or in -kind
match totaling at least 50% of the proposed project cost with a maximum grant
application of $50,000;
BE IT FURTHER RESOLVED that upon approval of its application, The City of Oak
Park Heights may enter into agreement with the Department of Natural Resources or the
above project and that the City of Oak Park Heights certifies that it will comply with all
aspects of the grant agreement.
NOW BE IT FURTHER RESOLVED the Department of Natural resources is hereby
authorized to execute the grant agreement as necessary to implement the project on
behalf of the eligible applicant.

RESOLUTION NO. 00-02-19
Resolution Authorizing Certain Tax Increment Activities and Expenditures
BE IT RESOLVED by the Board of Commissioners (the "Board ") of the Oak Park
Heights Economic Development Authority (the "Authority ") as follows:
1. Recitals.
(a) On June 29, 1999, the Board approved certain redevelopment project and
tax increment amendments (the "Amendments "), including the
amendment of the Redevelopment Plan for the Redevelopment Project
which was originally approved in March of 1989 and the Tax Increment
Plan originally approved in 1989 for the Tax Increment District known as
the Saint Croix Mall Tax Increment District (the "TIF District ").
(b) Included in the Amendments were various costs for street, public utility
and other public infrastructures within the Redevelopment Project.
(c) Area No. 3 of the Redevelopment Project includes the area of the City
known as Lowe Oak Park Heights, and it has been proposed that the
Authority plan and possibly undertake redevelopment of certain streets,
sidewalks and curb and gutter in portions of that area (the
"Improvements ").
2. Authorization. The study and development of proposals for the Improvements are
hereby authorized to be undertaken, including the letting of planning and
engineering contracts, and it is further authorized that the costs thereof may be
paid from existing tax increment revenue from the TIF District. These activities
and agreements may be undertaken in the name of the Authority and/or the City
of Oak Park Heights on behalf of the Authority.
Adopted this 8 day of February, 2000, by the Board of Commissioners of the Oak Park

WHEREAS, Kristopher Godden, on behalf of Whitetails Unlimited, Inc. has
applied with the State of Minnesota Gambling Control Board for a permit to conduct a
one -day raffle on March 18, 2000 at the site of VFW Post #323, 5880 Omaha Avenue
North; and,
WHEREAS, The City of Oak Park Heights has reviewed the application and
finds that its purposes meet the necessary community standards; and
WHEREAS, the City of Oak Park Heights has solicited the input of the public
and there have been no objections to the granting of the application for the raffle permit
as applied for by Whitetails Unlimited, Inc. with the State of Minnesota Gambling
Control Board.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR
THE CITY OF OAK PARK HEIGHTS AS FOLLOWS:
That the application of Whitetails Unlimited, Inc. with the State of Minnesota
Gambling Control Board to conduct a one -day raffle on March 18, 2000 at the site of the
VFW Post #323, 5880 Omaha Avenue North within the City of Oak Park Heights and the
same are hereby approved.

TRAINING FACILITY AND SUPPORTING
THE STATE OF MINNESOTA LEGISLATION TO
PROVIDE FINANCIAL ASSISTANCE FOR THE
CONSTRUCTION OF THE JOINT FACILITY
WHEREAS, Washington and Ramsey County Local Governments Public Safety
Personnel are required to participate in numerous training exercises to insure that they are
adequately prepared to address Public Safety situations associated with their jobs, and;
WHEREAS, Ramsey and Washington County Local Government Police and Fire
Personnel lack adequate facilities to conduct training associated with carrying out their Public
Safety duties, and;
WHEREAS, Washington and Ramsey County Local Government Officials proposed the
construction of a Joint Training Facility for Police and Fire Personnel for the local governments
of Washington and Ramsey County, and;
WHEREAS, The City Council of the City of Oak Park Heights supports the construction
of a Joint Ramsey /Washington County Public Safety Training Facility, and;
WHEREAS, Oak Park Heights City Council believes the State of Minnesota should
actively support the joint effort by Ramsey and Washington County Local Governments to
construct a Joint Public Safety Training Facility.
NOW, THEREFORE, BE IT RESOLVED, BY THE CITY COUNCIL FOR THE
CITY OF OAK PARK HEIGHTS AS FOLLOWS:
1. The City of Oak Park Heights supports the construction of a Ramsey/Washington
County Joint Public Safety Training Facility.
2. The City Council of the City of Oak Park Heights requests the State of Minnesota
participate in the cost of constructing a Ramsey /Washington County Joint
Training Facility by allocating monies during the 2000 Legislative Session to
assist with the construction of said facility.

RESOLUTION AUTHORIZING AND DIRECTING
THE CITY ADMINISTRATOR AND DIRECTOR OF
PUBLIC WORKS TO BEGIN NEGOTIATIONS WITH THE
DEPARTMENT OF CORRECTIONS TO ACQUIRE AN
EASEMENT FOR MUNICIPAL WELL CONSTRUCTION
WHEREAS, the Department of Public Works has recommended to the City
Council of the City of Oak Park Heights that an additional municipal well be constructed to serve
the City's water distribution system; and
WHEREAS, favorable locations with regard to the potential siting of a municipal
well have been identified on property owned by the Minnesota Department of Corrections; and
WHEREAS, the Minnesota Department of Corrections is agreeable to negotiating
with the City of Oak Park Heights as it affects the location and siting of the municipal well on their
property.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR
THE CITY OF OAK PARK HEIGHTS AS FOLLOWS:
• 1. That the office of the City Administrator in conjunction with the Director of
Public Works is authorized and directed to begin negotiations with the Minnesota Department of
Corrections as it affects the potential siting of a location for the construction of a municipal well
with related distribution lines and services on property owned by the Minnesota Department of
Corrections.
2. That the office of the City Administrator and Director of Public Works in
conjunction with the City Attorney are also authorized and directed to negotiate easements as it
affects the siting and acquisition of a municipal well location site on property owned by the
Minnesota Department of Corrections.
3. That the Director of Public Works may authorize survey work as may be
required in the site selection process.

RESOLUTION OF THE CITY COUNCIL FOR THE
CITY OF OAK PARK HEIGHTS SUPPORTING THE
DELAY OF THE PROPOSED REORGANIZATION OF
THE NORTHERN WATERSHED UNITS BY
WASHINGTON COUNTY UNTIL SUCH TIME AS
CRITICAL ISSUES HAVE BEEN DEVELOPED
WHEREAS, the City of Oak Park Heights has been advised that Washington County is
considering the reorganization of watershed units of government particularly Brown's Creek, middle St.
Croix Valley and related watershed units for various portions of the middle to northern portions of
Washington County; and
WHEREAS, it appears that the County and related staff are proposing the organization of
• a major watershed unit without finalization or formation of the issues regarding representation on that
governmental unit, funding of projects or establishment and formation of rules; and
WHEREAS, the City Council for the City of Oak Park Heights regards the formation and
governance of a major watershed unit to be incomplete and premature pending the resolution of those
issues.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR THE
CITY OF OAK PARK HEIGHTS AS FOLLOWS: That the City of Oak Park Heights hereby
resolves and supports the position that no reformation of a governance unit for a watershed should be
established for any portion of the City of Oak Park Heights: (a) until such time as the new governance
unit would have clearly established and delineated provisions for representation on the governance board
of such a new unit; (b) until the establishment of policies with regard to funding of projects and how costs
would be borne by the various sub - watershed areas; and (c) until the establishment and formation of rules
of governance that would apply to that new watershed entity.

RESOLUTION ESTABLISHING A POLICY ON THE RETENTION
OF VIDEOTAPES RESULTING FROM COUNCIL, PLANNING
COMMISSION, PARK COMMISSION AND RELATED MEETINGS
WHEREAS, the St Croix Valley Joint Cable Communications Commission has
previously provided the service for videotaping City Council meetings for the City of Oak Park
Heights; and
WHEREAS, the Commission has advised the City that it intends to donate
equipment to the City from which the City will produce its own videotapes as may be related to the
cable casting of City Council, Planning Commission and Park Commission meetings; and
WHEREAS, such tapes will remain the property of the City of Oak Park Heights;
and
WHEREAS, the City Council maintains its official minutes as prepared by the
recording secretary from all such meetings; and
• WHEREAS, the City Council has determined that it is in the interest of the City to
retain tapes before re- recording over them for a period of sixty (60) days.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR
THE CITY OF OAK PARK HEIGHTS AS FOLLOWS:
That as it affects the establishment, use and re -use of videotapes used in the
recording of meetings of the City Council, Planning Commission, Park Commission
and related government bodies and advisory commissions of the City of Oak Park
Heights, that all such meeting tapes shall be retained by the City offices for a period
of no more than sixty (60) days and thereafter resubmitted for purposes of re-
recording and re -use by technical staff of the City of Oak Park Heights and others
who are cable casting and/or recording such meetings and/or conferences.

A RESOLUTION ESTABLISHING WATER AND SEWER USAGE RATES
WITHIN THE CITY OF OAK PARK HEIGHTS
EFFECTIVE APRIL 1, 2000
WHEREAS, the City of Oak Park Heights by resolution and
ordinance regulates water and sewer usage rates within the
City for all users; and,
WHEREAS, a rate study has been conducted and completed
by Springsted Incorporated recommending water and sewer rate
increases to accommodate the cost for administrating,
managing, and providing municipal water and sewer services
to the citizens of the City of Oak Park Heights and all
properties connected thereto; and,
WHEREAS, current demands upon the municipal water
systems of the city necessitate the future construction of
additional municipal wells and infrastructure that must be
paid for by users of the system; and,
WHEREAS, the City Council has reviewed said rate
increases and determined the same to be fair and equitable.
WHEREAS, the city ordinances provide for the
implementation of rate increases by resolution.
NOW, THEREFORE, BE IT RESOLVED, by the City Council for
the City of Oak Park Heights as follows:
1. That effective April 1, 2000, the City of Oak Park
Heights shall establish a municipal water rate for all
users as follows:
a. A monthly rate of $1.21 for administrative
fees, $.44 for state water connection, and $1.17
per 1,000 gallons used for the first 5,000
gallons, with a per month minimum charge of $7.50.
b. A rate of $1.17 per 1,000 gallons for water
use above 5,000 gallons up to 16,000 gallons.
C. A rate of $1.47 per 1,000 gallons for water
use above 16,000 gallons up to 33,000 gallons.
• d. A rate of $1.76 per 1,000 gallons for water
use above 33,000 gallons.
2. That effective April 1, 2000, the City of Oak Park
Heights shall establish a municipal sewer rate for
all users as follows:
a. A monthly rate of $.85 for administrative
fees, and $2.32 per 1,000 gallons of water used
for the first 5,000 gallons, with a per month
minimum charge of $12.45.
b. A rate of $2.32 per 1,000 gallons of water
used over 5,000 gallons.
C. Residential sewer rates are determined by the
amount of water used in the month of December of
each year. Commercial, industrial and
institutional sewer rates are based on actual
usage.

RESOLUTION CHANGING THE CITY'S
MILEAGE REIMBURSEMENT POLICY
WHEREAS, the City mileage reimbursement policy was decreased to $0.31 per
mile in March, 1999; and,
WHEREAS, Treasury regulations require that mileage reimbursement over
$0.32.5 per mile to be treated as taxable wages.
NOW, THEREFORE, BE IT RESOLVED, by the City Council for the City of Oak
Park Heights, Washington County, Minnesota as follows:
That the City's mileage reimbursement policy shall be increased to $0.32.5 per
mile in accordance with Federal Treasury requirements.

METROPOLITAN COUNCIL FOR THE CENTRAL BUSINESS DISTRICT,
AND AUTHORIZING THE ACTIVITIES AS IDENTIFIED WITHIN THE GRANT
APPLICATION.
WHEREAS, The City of Oak Park Heights completed a design study and has
endorsed a preferred plan of development for the Central Business District; and
WHEREAS, The City of Oak Park Heights issued a request for qualifications and
a request for proposals to the development community for the Central Business
District; and
WHEREAS, The City is committed toward the physical development of the
Central Business district and has identified a need to develop design guidelines,
conduct reviews of proposals, conduct a phase 1 environmental assessment and
a schematic site engineering study; and
• WHEREAS, The estimated cost of these activities is $15,000.00; and
WHEREAS, The Metropolitan Council has planning assistance grant funds
available to assist in the financing of these activities.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR THE
CITY OF OAK PARK HEIGHTS THAT AN APPLICATION BE MADE TO THE
METROPOLITAN COUNCIL FOR PLANNING ASSISTANCE GRANT FUNDS

RESOLUTION COMMITTING UP TO $30,000 TO LONG LAKE WATER
QUALITY IMPROVEMENT PROJECT
WHEREAS, At the July 27, 1999 City Council meeting the Oak Park Heights
City Council authorized staff to proceed and come back with recommendations and final
figures for the Long Lake Water Quality Improvement project.
WHEREAS, Stormwater from developed land within the City of Oak Park
Heights is contributing to Long Lake.
WHEREAS, The City of Oak Park Heights has identified this project as part of its
Capital Improvement Program.
WHEREAS, The City of Stillwater has completed an engineering analysis to
calculate the inputs from contributing areas, including the City of Oak Park Heights.
WHEREAS, Using the peak flow rate computation the Oak Park Heights share for
the Long Lake stormwater project is $27, 820.58.
NOW, THEREFORE, BE IT RESOLVED, by the City Council for the City of Oak
Park Heights, Washington County, Minnesota as follows:
That the City commits $30,000 to the Long Lake Water Quality Improvement
Project.

RESOLUTION ESTABLISHING THE TALL ROUND HAT BOX FIXTURE
WITH ROUND POLES IN HARTFORD GREEN AS THE STREET LIGHT
DESIGN FOR THE CITY OF OAK PARK HEIGHTS, TALL LIGHTS PLACED
AT INTERSECTIONS AND MEDIUM HEIGHT LIGHTS AT MID -BLOCK
WHEREAS, the City Council wishes to identify a standard light fixture design to
be used throughout the City.
WHEREAS, a test bed of two different style lights were installed at the Oak Park
Heights City Hall to demonstrate the round hat box and decorative street light designs.
WHEREAS, the Oak Park Heights City Council may upon application consider a
different type of light design in a private development in it discretion.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR
THE CITY OF OAK PARK HEIGHTS AS FOLLOWS:
That the tall round hat box light fixture with round poles in Hartford green will be
the street light design for the City of Oak Park Heights. Tall lights be placed at the
intersections and medium height lights be placed at mid - block.

Planning Commission's recommendations.
Councilmember Beaudet, seconded by Byrne, introduced a substitute
motion to accept the Planning Commission recommendations with a
change to item 1, amending the CUP to provide site delineation and
screening on 40 feet of the east side from the northeast corner and 8 feet
west from the northeast corner to complete the screening of the outdoor
storage area from the public right away. With a change of tenants with
outside storage, the fencing issue shall come back for City Council review.
Carried 4 -1, Turnquist opposed.
C. Appointment of Blue Ribbon Committee for Fire Protection Plan.
Administrator Melena reported staff recommendation for analysis of fire
protection by a Blue Ribbon Committee to consist of 5 members from
Bayport and 6 from Oak Park Heights. Melena suggested
Councilmember Turnquist as a Chairperson for the Committee and
Councilmember Byrne as a member. City Council would appoint the
remaining members.
Councilmember Swenson, seconded by Schaaf, moved to appoint a Blue
Ribbon Committee for Fire Protection Plan and set a deadline of June 6
for committee member applications. Carried 5 -0.
D. Annual Financial Report and Financial Analvsis and Manaa_ ement
Consideration.
Dave Mol from the accounting firm of Tautges, Redpath & Co., Ltd.
presented the December 31, 1999 Annual Financial Report and Financial
Analysis and Management Consideration Report.
Councilmember Beaudet, seconded by Turnquist, moved to accept the
Financial Report. Carried 4 -0.

RESOLUTION 00 -04 -32
RESOLUTION TO THE CITY OF OAK PARK HEIGHTS REGARDING GRANT
APPLICATION TO THE DEPARTMENT OF NATURAL RESOURCES FOR
FOREST HEALTH
WHEREAS, THE Minnesota Department of Natural Resources has matching
funds available to assist with education an control work for forest health concerns such as
oak wilt disease, and
WHEREAS, the City of Oak Park heights has contracted with a forestry
consultant to provide public education an inspection services for forest health issues
facing the community, and
WHEREAS, a need has been identified in the community for tree maintenance
information as well as identification and control of oak wilt infection centers,
NOW, THEREFORE, BE IT RESOLVED, that the City of Oak Park Heights and its
partner(s) will share in the costs of the proposed project with the DNR by providing a
cash or in -kind match totaling at least 50% of the proposed project cost with a maximum
• grant application of $6,400;
BE IT FURTHER RESOLVED That upon approval of its application, the City of Oak
Park Heights may enter into agreement with the Department of Natural Resources for the
above project and that the City of Oak Park Heights certifies that it will comply with all
aspects of the grant agreement.
NOW BE IT FURTHER RESOLVED the Department of Natural Resources is hereby
authorized to execute the grant agreement as necessary to implement the project on behalf
of the eligible applicant.

WHEREAS, it is essential that the City begin the process of locating and siting
public utilities, specifically ponding and storm water retention areas, within the central business
district; and
WHEREAS, the city staff has projected the location of storm water ponding and
storm water retention areas within the central business district; and
• WHEREAS, the securing of land necessary to serve such storm water ponding and
retention is essential to the development and furtherance of the central business district.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR
THE CITY OF OAK PARK HEIGHTS AS FOLLOWS:
1. that the office of the City Administrator is herewith authorized and directed
to expend necessary funds to secure surveys and /or title work as may be necessary to begin the
process of identifying affected properties within the central business district to be acquired; and

PROCLAMATION
WHEREAS: Minnesota is home to many of our nation's natural resources, foremost
among them are our beautiful and abundant forests; and
WHEREAS: Trees are an increasingly vital resource in Minnesota today,
enriching our lives by purifying the air, conserving soil, water and
energy, creating jobs through a large forest products industry,
serving as recreational settings, providing habitat for wildlife of all
kinds, and creating beautiful landscapes to make our communities
more livable; and
WHEREAS: Human activities such as construction damage, pollution and neglect, as
well as climatic extremes, disease and insects threaten our trees, creating
the need for concerted action to Ensure the future of commwiity arid rural
forests in our state and throughout the country; and
• WHEREAS: Each individual can act locally to improve the environment by planting
trees and ensuring that these trees are protected and receive proper
maintenance in the years ahead; and
WHEREAS: Each year on the last Friday of the month of April and throughout the
month of May, the people of Minnesota pay special tribute to the vital
natural resource that our trees represent and dedicate themselves to the
continued vitality of our state's community and rural forests;

CITY OF OAK PARK HEIGHTS
WASHINGTON COUNTY, MINNESOTA
RESOLUTION APPROVING THE
RECOMMENDATIONS OF THE WASHINGTON COUNTY
ASSESSOR TO THE LOCAL BOARD OF REVIEW
WHEREAS, The City Council for the City of Oak Park Heights sits as the Board of
Review pursuant to statute; and
WHEREAS, the Local Board of Review has convened pursuant to public notice
provided and published in manner specified by law; and
WHEREAS, the City received comments from three property owners affecting the
valuations of their respective properties; and
WHEREAS, the City Council for the City of Oak Park Heights sitting as the Board
• of Review has reviewed all three properties through the Office of the Washington County Assessor
and specifically finds the following:
1. As it affects the property identified as Parcel No. 4- 29 -20 -11 -0062,
the property has been reviewed and current sales exhibited within the neighborhood
show any loss of value due to assisted living units as complained of by the property
owner. The recommendation from the County Assessor's Office is to make no
change in the current valuation of that property.
2. As to the property identified as Parcel No. 4- 29 -20 -24 -0029, after
review of the property it does show a reduced building value of an additional 57%
for water and drainage problems existent upon the property at the present time. The
recommendation of the Washington County Assessor is to reduce the property value
$5,100 to the building thereby reassigning the value of the building from $94,300 to
$89,200.
3. As to the property identified as Parcel No. 5- 29 -20 -23 -0085, the
review of the property indicates that it is appropriate to implement a reduction of
$18,000 to the land and assign value to reduce same from its present $108,000 as
proposed to $90,000. The recommendation as it affects same is reasonable and
should be implemented.

NOW, THEREFORE, BASED UPON THE FOREGOING FINDINGS OF
FACT, IT IS HEREBY RESOLVED BY THE LOCAL BOARD OF REVIEW AND CITY
COUNCIL FOR THE CITY OF OAK PARK HEIGHTS AS FOLLOWS:
1. That there shall be no reduction to the property identified as Parcel No. 4 -29-
20-11- 0062, and the original estimated market value of $161,300 as assigned and specified as being
$34,000 attributed to the land and $127,300 attributed to the building shall remain in place and is
affirmed.
2. That as it affects the property identified as Parcel No. 4- 29 -20 -24 -0029, the
total assessed market valuation of the property shall be reduced to $123,200 consistent of $34,000
assigned to the land and $89,200 assigned to the building.
3. As it affects the property identified as Parcel No. 5- 29 -20 -23 -0085, the total
estimated market value shall be reduced to $284,200 assigned and attributed to $90,000 in value to
the land and $194,200 attributed to the building.
4. Be it further resolved, with the exceptions of the above three properties as
noted specifically above, that the balance of all of the recommendations and estimated market
values as determined by the Washington County Assessor on behalf of the City of Oak Park Heights
be and the same are hereby affirmed.

RESOLUTION DETERMINING FINDINGS OF FACT AND DENYING
APPLICATION OF TWIN CITY FEDERAL NATIONAL BANK FOR A
VARIANCE AS IT AFFECTS UTILIZATION OF REAL PROPERTY
LOCATED ON OUTLOT A, BRACKEY WEST ADDITION
WHEREAS, the City of Oak Park Heights has received the application of Twin
City Federal National Bank seeking subdivision, rezoning and a variance to utilize a portion of real
property located within the City of Oak Park Heights consisting in part of the South 196.06 feet of
what is now Outlot A, Brackey West Addition; and
WHEREAS, the applicant has sought a variance as part of this permit seeking to
implement two access drives on Neal Avenue; and
WHEREAS, the applicant has also sought rezoning from open space to business;
and
• WHEREAS, the applicant has also sought subdivision; and
WHEREAS, the applicant has failed to demonstrate any hardship as otherwise
defined within the ordinance to justify varying from the ordinances of the City with regard to access
drives onto Neal Avenue from the subject property; and
WHEREAS, there does not appear to be any unique geological, topographical or
other physical circumstances on the property that would warrant or justify additional accesses to
Neal Avenue other than the single access which is already permitted under the terms of the City's
Zoning Code; and
WHEREAS, the City's Zoning Code maintains a valid public policy as it affects the
prohibiting of excess accesses onto traveled portions of City streets by developing property so as to
not unduly create confusion in traffic patterns or otherwise create traffic circumstances under which
the public safety could be negatively impacted; and
WHEREAS, the applicant's requests for rezoning and subdivision are jointly
submitted with the application as it affects the variance and are predicated upon the variance issue.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR
THE CITY OF OAK PARK HEIGHTS AS FOLLOWS:
• 1. That the applicant having failed to demonstrate hardship as defined within
the ordinance, the afore - mentioned application on behalf of Twin City Federal National
Bank be and the same hereby is denied.
2. That the applicant's applications for rezoning and subdivision are also
denied.

CENTRAL BUSINESS DISTRICT.
WHEREAS, the City Council for the City of Oak Park Heights has worked cooperatively
with the Central Business District Partnership Group and the community to develop a
master plan of development for the Central Business District; and
WHEREAS, the City of Oak Park Heights is committed to providing mixed -use,
development and life -cycle housing opportunities for all members of the community; and
WHEREAS, the proposed Central Business District is a mixed -use, high density,
pedestrian oriented development that will serve as a center of public activity, offer
affordable life -cycle housing choices, and provide for pedestrian access to parks, job
opportunities and retail services for all members of the community; and
WHEREAS, the future development of the Central Business District to the standards
master plan will depend on securin
• outlined in the ast p a pe g outside financial assistance to
provide for the acquisition, redevelopment, and possible environmental remediation of
lands.
WHEREAS, the Livable Communities Demonstration Account of the Metropolitan
Livable Communities Fund administered by the Metropolitan Council provides
assistance to Cities in building models for compact, life -cycle communities.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR THE CITY OF
OAK PARK HEIGHTS, that staff is authorized to submit a grant application to the
Metropolitan Council for the compact, mixed -use, transit - oriented development of the
Central Business District.

• RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
OAK PARK HEIGHTS REGARDING
CONDUCT OF COUNCILMEMBER DAVID BEAUDET
WHEREAS, David Beaudet has in private conversations and public comments
denigrated the competence of City staff to members of our City commissions; and
WHEREAS, David Beaudet has deliberately misrepresented the facts and position of
City staff and Council to residents regarding a proposed street reconstruction project in the
"Village Area" of Oak Park Heights; and
WHEREAS, David Beaudet has communicated to prospective businesses planning to
build in Oak Park Heights that our City staff is incompetent and overpaid; and
WHEREAS, David Beaudet has verbally criticized City staff in public meetings and
before City commissions and in general created a hostile work environment; and
WHEREAS, David Beaudet has communicated privately with City staff attempting to
have them change a recommendation to council while asking said staff not to reveal said
conversation; and
• WHEREAS, David Beaudet attempted to halt a construction project, threatening the
project supervisor before being ordered off the site; and
WHEREAS, David Beaudet misrepresented himself and the facts regarding the siting of
a new water well to state agencies and further caused to be distributed to residents literature
misrepresenting the facts of this issue and caused anxiety among our citizens.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of Oak Park Heights
does hereby censure the above mentioned behavior of David Beaudet in the strongest possible
terms and hereby expresses its complete and total lack of confidence in the ability of Mr.
Beaudet to fairly carry out the duties of Councilmember.

RESOLUTION AUTHORIZING A RATE INCREASE FOR SOLID WASTE AND
RECYCLING
WHEREAS, the City Council determines Solid Waste and Recycling fees, and City
policies as they relate to Solid Waste and Recycling within the City of Oak Park Heights; and
WHEREAS, On August 10, 1999 the City Council approved a two -step rate increase for
solid waste and recycling. The first step taking effect on October 1, 1999 and the second to take
effect July 1, 2000.
WHEREAS, On March 23, 2000 the City of Oak Park Heights accepted a Memorandum
of Agreement with Superior Services;
WHEREAS, part of the agreement included a 5.3% adjustment to the contract to reflect
the changes in the private transportation Consumer Price Index (CPI) and increased fuel costs.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR THE
CITY OF OAK PARK HEIGHTS AS FOLLOWS:
• 1. The Senior Rate will be increased to $5.75.
2. The 35- gallon rate will be increased to $6.05.
3. The 65- gallon rate will be increased to $7.10.
4. The 95- gallon rate will be increased to $8.70.

RESOLUTION OF THE CITY COUNCIL APPROVING
ADVISORY GUIDELINES FOR ESTABLISHMENT OF CIVIL
PENALTIES FOR THE VIOLATION OF STATE LAW
REGARDING THE SALE OR FURNISHING OF
ALCOHOL TO MINORS
WHEREAS, Minnesota Statute §340A.503 provides that it is a gross misdemeanor
to sell, barter, furnish or give alcoholic beverages to a person under 21 years of age; and
WHEREAS, the City conducts regular compliance checks to ensure that those
establishments holding municipal liquor licenses in the City of Oak Park Heights are in compliance
with the state statute. In the event that a liquor license establishment is proved to have violated state
law, then the Council is called upon to determine how to proceed properly; and
WHEREAS, Minnesota Statute §340A.415 authorizes the City Council, upon proof
of violation of state law, to revoke the license or permit, suspend the license or permit for up to 60
days, impose a civil penalty of up to $2,000 for each violation, or impose any combination of these
• sanctions.
NOW, THEREFORE, in order to guide the City Council and in order to create a
uniform system for dealing with these violations, the City Council for the City of Oak Park Heights
does hereby approve the following:
1. BE IT RESOLVED that the following designated civil penalties shall
constitute advisory guidelines for City Council action in cases of violation of City issued liquor
licenses. It is understood that the Council may deviate from these advisory guidelines based upon
compelling circumstances presented in individual cases.
SALE OF ALCOHOLIC BEVERAGES TO MINORS
(OR PERMIT A PERSON UNDER THE AGE OF 21 YEARS TO
DRINK ALCOHOLIC BEVERAGES ON THE LICENSED PREMISES):
First Offense: Five Hundred Dollars ($500) civil fine.
Second Offense: One Thousand Dollars ($1,000) civil fine and one five -day license
suspension (Monday through Friday) for "off sale" licensees; and three weekend days suspension
(Friday through Sunday) for "on sale" licensees.

Third Offense: One Thousand Five Hundred Dollars ($1,500) civil fine and a ten-
day license suspension [to include at least one weekend day (Friday or Saturday)] for "off sale"
licensees; and a seven -day suspension for "on sale" licensees.
Fourth or Subsequent Offense: At City Council discretion.
2. BE IT FURTHER RESOLVED that it is the policy of the City Council
that the above sanctions shall be issued and calculated as against all offenses occurring within a 24-
consecutive month period from the date of the most recent violation. Any violations having
occurred beyond 24 consecutive months prior to the most recent violation shall not be counted in
terms of imposing the sanctions noted above.
3. BE IT FURTHER RESOLVED that if the City Council imposes a civil
fine, the Council shall also allow the license holder a reasonable time to pay the fine. A reasonable
time to pay means that all fines shall be paid within 60 days unless the Council determines that a
longer period of time is justified under the circumstances of the case. Failure of a license holder to
pay a fine within the time prescribed by the City Council shall cause that license to be immediately
suspended until full payment is received by the City.
4. BE IT FURTHER RESOLVED that any license holder who has had their
license or permits suspended or revoked pursuant to City action shall not be allowed to operate the
activity which required the license until the license is reinstated. Any operation during a period of
suspension or revocation shall be deemed to be an additional violation of the City's Liquor License
• Ordinance and of state law.

A RESOLUTION OF THE CITY OF OAK PARK HEIGHTS NOTING IT'S
NONCONCURRANCE WITH THE CITY OF LAKE ELMO'S COMPREHENSIVE PLAN
AMENDMENT FOR THAT PROPERTY IN THE SOUTHWEST CORNER OF 55
STREET NORTH AND STATE HIGHWAY 5
WHEREAS, the City of Lake Elmo has submitted a Comprehensive Plan
Amendment, dated June 2, 2000, to the Metropolitan Council for a 90 acre parcel at the
southwest corner of 55 Street North and State Highway 5 to review a land use change
from Undeveloped to Suburban Residential and Limited Business; and
WHEREAS, the City of Oak Park Heights received a copy of the Comprehensive
Plan Amendment on June 9, 2000; and
WHEREAS, the Comprehensive Plan Amendment identifies 85 acres of the area
in question for single family residential development and a limited parcel of 5 acres for
limited business; and
• WHEREAS, the area is proposed to be served by private community septic
systems with no connection to the Regional Wastewater Systems; and
WHEREAS, the Metro 2040 Regional Growth Strategy Map included within the
Regional Blueprint of the Metropolitan Council identifies the area in question within the
Urban Reserve; and
WHEREAS, allowing the area to develop as Suburban Residential Development
and Limited Business as identified within the Lake Elmo Comprehensive Plan will result
in an under - utilization of the potential density of land use development planned for as
part of the Metropolitan Council's designated Urban Reserve Area; and
WHEREAS, a need for business warehouse and industrial land has been
identified within the St. Croix Valley near the Highway 36 and Highway 5 corridors; and
WHEREAS, the City of Oak Park Heights has identified the potential for urban
expansion of the business warehouse /industrial land use within the area in question;
and
WHEREAS, the land at the southwest corner of Highway 5 and 55 Street North
is provided with corridor access, provides stable soil conditions for business warehouse
•
and industrial use; and could be served with Regional Wastewater Systems and
municipal water supply systems.
NOW THEREFORE BE IT RESOLVED BY THE CITY OF OAK PARK HEIGHTS,
that the City Council does not concur with the City of Lake Elmo's Comprehensive Plan
Amendment for that property in the southwest corner of 55 Street North and State
Highway 5 in that it is inconsistent with the Metropolitan Council's Regional Blueprint
and that it under - utilizes the potential for business warehouse, industrial and residential
development at urban densities as identified on the Regional Blueprint Strategy Map.

POLICE DEPARTMENT TO MAKE APPLICATION IN CONJUCTION
WITH THE STILLWATER AND BAYPORT POLICE DEPARTMENTS
TO THE MINNESOTA DEPARTMENT OF PUBLIC SAFETY OFFICE
OF TRAFFIC SAFETY FOR ENROLLMENT WITHIN THE SAFE AND
SOBER COMMUNITY PROJECT FOR THE PERIOD OF TIME
OF OCTOBER 1, 2000 THROUGH SEPTEMBER 30, 2001
WHEREAS, Safe and Sober is a National Traffic Safety Campaign
designed by the National Highway Traffic Safety Administration seeking to unite
national, state and local efforts to reduce impaired driving crashes and increase
safety belt and child seat use with enhanced and enforcement efforts in public
information and educational activities; and,
WHEREAS, the Chief of Police for the City of Oak Park Heights has
• recommended to the City Council that the City of Oak Park Heights coordinate
and enter into a Grant application with the Stillwater Police Department and the
Bayport Police Department to be submitted to the Minnesota Department of
Public Safety, Office of Traffic Safety for Grant funds, which would enable the
City of Oak Park Heights to enter the Safe and Sober Community's Project for
the period of time of October 1, 2000 through September 30, 2001; and
WHEREAS, the implementation of the Safe and Sober Program within the
Oak Park Heights Community could have a significant effect on public safety by
increasing public awareness of the risks associated with highway travel and
educating the public as to what can be done to manage those risks by use of
seat belts and sober driving and to publicly communicate to the community a
special enforcement efforts that are about to be implemented within the
community effecting the safe and sober program and also providing a report back
to the community with regards to the result achieved through the program; and,
WHEREAS, the City Council for the City of Oak Park Heights feels that
the best interest and public safety of its citizens could be furthered by applying
for the Grant Application in conjunction with the Stillwater Police Department and
the Bayport Police Department.

• NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR
THE CITY OF OAK PARK HEIGHTS AS FOLLOWS:
That the Oak Park Heights Police Department enter into a Grant
Agreement with the Minnesota Department of Public Safety, Office of Traffic
Safety for the project entitled "Safe and Sober Communities" during the period of
time from October 1, 2000 through September 30, 2001.
BE IT FURTHER RESOLVED, that Chief of Police, Lindy Swanson of the
Oak Park Heights Police Department is hereby authorized and directed to
execute such agreements as may be necessary to implement the project on
behalf of the City of Oak Park Heights Police Department.
BE IT FURTHER RESOLVED, that the Chief of Police, Lindy Swanson of
the Oak Park Heights Police Department is hereby authorized to be the fiscal
agent and administer this grant on behalf of the City of Oak Park Heights Police
Department.

RESOLUTION OF THE CITY COUNCIL FOR THE
CITY OF OAK PARK HEIGHTS DETERMINING THE EXISTENCE OF
HAZARDOUS BUILDINGS AND ORDERING THEIR REMOVAL
AND ABATEMENT
WHEREAS, the City Council for the City of Oak Park Heights has received a
report of its Building Official with regard to the review of certain property existing at 13799 - 60
Street North in the City of Oak Park Heights; and
WHEREAS, the Building Official has, after conducting a personal inspection,
found the conditions of the dwelling site to be a threat to public health and safety in that the
following conditions exist at the residence:
A. The residence apparently has been used for the dumping of
miscellaneous household goods and trash.
B. The roof structure is beyond repair in that the framing structure is
• rotted and the shingles are deteriorated.
C. The fascia and soffits are rotted out, thereby permitting animals to
enter into the dwelling.
D. The siding and window conditions are also dilapidated, in disrepair
and not salvageable.
E. The dwelling has no electricity, water, sanitation facilities or heat;
and
WHEREAS, the Building Official has determined that the property is unsafe
beyond repair and has directed the property owner to clean up the site and remove the structure
within 30 days of the notice duly provided the property owner on June 20, 2000; and
WHEREAS, the property owner has failed to take any action to remedy the issues
or abate the nuisance and hazardous conditions upon the property within the time requested by the
Building Official.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR
THE CITY OF OAK PARK HEIGHTS AS FOLLOWS:

1. That the property listed on the building records of the City of Oak Park
• Heights as 13799 — 60`" Street North be and the same is hereby declared to be a hazardous building
and the abatement of the hazard is hereby ordered by the City Council.
2. That the office of the City Attorney is herewith authorized and directed to
commence proceedings under M.S. §463.15 et seq. with regard to the removal and demolition of
said property.
3. That the cost of said removal and demolition of the hazardous condition of
the property shall be assessed against the property in the manner and form provided for by statute.
4. That the annexed order of the City Council is hereby authorized and
approved for the Mayor and Clerk to execute and shall be delivered to the property owner.

SECTION 1. GROUNDS FOR ORDER. The City Council has been informed by the
Building Inspector, Mr. James Butler, that he has inspected the property at 13799 — 60 Street
North.
Specifically, the Building Inspector reports that he found existing conditions of the
dwelling to be a threat to the public safety and health in that the following conditions exist upon
the property:

The Building Inspector has related to the City Council that, in his opinion, the property is
unsafe beyond repair and is a hazardous structure and a threat to public safety and health.
Because of the physical damage of the property and its present condition constituting a hazard to
public health and safety, the Council herewith has determined same to be a hazardous structure
within the meaning assigned to M.S. §463.15, Subd. 3.
SECTION 2. CORRECTIVE ACTION REOUIRED,. Based upon the opinion of the
Building Inspector, it is the order of the City Council that the structure in question must be razed

and removed. This would include the removal of the structure itself and any personal property
still inside the structure. All items must be removed in an appropriate manner to a landfill
facility which can accept the remains of the property /structure and the numerous items which
apparently exist within the structure. All hazardous materials must be disposed of as required by
state, county and /or federal law.
SECTION 3. REASONABLE TIME FOR COMPLIANCE. Pursuant to M.S.
§463.17, Subd. 1, it is the intent of the City Council to provide the owner /occupier of the
property with a reasonable time to come into compliance with this Order. The Council believes
that the work referenced herein can be reasonably accommodated within twenty (20) days of the
date of this Order.
SECTION 4. NOTICE TO PROPERTY OWNER. THE OWNER OF THE
PROPERTY IS HEREBY NOTIFIED PURSUANT TO M.S. §463.17, Subd. 1, THAT A
MOTION FOR SUMMARY ENFORCEMENT OF THIS ORDER WILL BE MADE TO
THE DISTRICT COURT OF WASHINGTON COUNTY UNLESS CORRECTIVE
ACTION IS TAKEN OR AN ANSWER FILED WITHIN THE TIME SPECIFIED BY
M.S. §463.18.
SECTION 5. FILING WITH DISTRICT COURT,. The City Staff is hereby ordered
and directed to file a copy of this Order, with proof of service upon the owners of the property,
with the District Court Administrator for the Washington County District Court.
SECTION 6. FILING WITH COUNTY RECORDER. The City Staff is also hereby
ordered and directed to file of record with the Registrar of Titles for Washington County a notice
of the pendency of this proceeding, describing with reasonable certainty the lands affected
thereby and the nature of this Order.
SECTION 7. SERVICE UPON OWNER,. The City Staff is hereby authorized and
directed to cause a copy of this Order to be served upon the owner(s) of record, or the owner's
agent if an agent is in charge of the building, and also serve a copy upon any occupying tenant,
and upon any lienholders of record in the manner provided for service of a summons in a civil
action. If the owner(s) cannot be found, the Order shall be served upon the owner by posting it
at the main entrance of the building, or, if there is no building, in a conspicuous place on the
property, and by four (4) weeks' publication in the Stillwater Gazette.
SECTION 8. MOVEMENT FOR DEFAULT.. If no answer is served within the time
allowed by law, or if the building is not razed as required by this Order, then the City Staff is
hereby authorized and directed to request of the District Court by way of motion an Order for
enforcement of this Order.

RESOLUTION ELECTING TO CONTINUE PARTICIPATING IN THE LOCAL
HOUSING INCENTIVES ACCOUNT PROGRAM UNDER THE
METROPOLITAN LIVABLE COMMUNITIES ACT
CALENDAR YEAR 2001
WHEREAS, the Metropolitan Livable Communities Act (Minnesota Statues Section
473.25 to 473.254) establishes a Metropolitan Livable Communities Fund which is
intended to address housing and other development issues facing the metropolitan area
defined by Minnesota Statutes section 473.121; and
WHEREAS, the Metropolitan Livable Communities Fund, comprising the Tax Base
Revitalization Account, the Livable Communities Demonstration Account, the Local
Housing Incentive Account and the Inclusionary Housing Account is intended to provide
certain funding and other assistance to metropolitan area municipalities; and
WHEREAS, a metropolitan area municipality is not eligible to receive grants or loans
• under the Metropolitan Livable Communities Fund or eligible to receive certain polluted
sites cleanup funding from the Minnesota Department of Trade and Economic
Development unless the municipality is participating in the Local Housing Incentives
Account Program under the Minnesota Statutes section 473.254; and
WHEREAS, the Metropolitan Livable Communities Act requires the Metropolitan
Council to negotiate with each municipality to establish affordable and life -cycle housing
goals for that municipality that are consistent with and promote the policies of the
Metropolitan Council as provided in the adopted Metropolitan Development Guide; and
WHEREAS, each municipality must identify to the Metropolitan Council the actions the
municipality plans to take to meet the established housing goals through preparation of
the Housing Action Plan; and
WHEREAS, the Metropolitan Council adopted, by resolution after a public hearing,
negotiated affordable and life cycle housing goals for each participating municipality;
and
WHEREAS, a metropolitan area municipality which elects to participate in the Local
Housing Incentives Account Program must do so by November 15 of each year; and
•
WHEREAS, for calendar year 2001, a metropolitan area municipality that participated in
• the Local Housing Incentive Account Program during the calendar year 2000, can
continue to participate under Minnesota Statutes section 473.254 if. (a) the municipality
elects to participate in the Local Housing Incentives Program by November 15, 2000; and
(b) the Metropolitan Council and the municipality have successfully negotiated
affordable and life -cycle housing goals for the municipality:
NOW, THEREFORE, BE IT RESOLVED THAT the City of Oak Park Heights

WHEREAS, the ordinances of the City of Oak Park Heights reserve the authority to
establish license fees to the City Council from time to time; and
WHEREAS, the City has not experienced a license fee adjustment in the area of
alcohol or liquor sales since 1980; and
WHEREAS, the city police department and administration have experienced
increased code enforcement and administrative expense in the supervision of liquor licenses within
the city, and
WHEREAS, the City Staff has reviewed neighboring communities as it affects fees
for licenses charged therein; and
• NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR
THE CITY OF OAK PARK HEIGHTS AS FOLLOWS:
1. That on -sale liquor license fees shall be established as of January 1, 2001 in
the amount of $2,500 and Sunday on -sale license fees shall be established in the amount of $500.

presented by City Administration in the total General
Fund amount of $2,402,525.00.

Whereas, Minnesota State Statute 275.078 requires a
city council to adopt and file an authorizing resolution
with the county auditor if its city's tax rate will be
higher the following year than a theoretical tax rate for
the previous year:
Therefore, be it resolved by the City Council for the
City of Oak Park Heights, County of Washington, that the
County Auditor is authorized to fix a property tax rate for
taxes payable in the year 2001 that is higher than the tax
rate calculated for the City for taxes levied in 1999,
collectible in 2000.
Adoption of this resolution does not prohibit the City
from certifying a final levy that will result in no tax
rate increase or a tax rate decrease.
The City Administrator is hereby instructed to
transmit a certified copy of this resolution to the County
Auditor of Washington County, Minnesota.

WHEREAS, the City Council for the City of Oak Park Heights recently
passed a resolution on February 22, 2000 opposing reorganization of watershed units until
such time as critical issues had been developed and determined as it affects the
reorganization of those watershed units proposed at that point in time; and,
WHEREAS, the Washington County staff has proposed another plan for
reorganization of watershed units affecting the Brown Street Watershed Organization,
• Carnelian Marine Watershed Organization, Middle St. Croix Valley Water Management
Organization and others; and,
WHEREAS, it appears that the County has yet to develop within any of
these plans formation of issues regarding representation from specific government units,
funding of projects or establishment or formation of rules, and/or has developed these plans
without significant planning as to the continuation of the remaining watershed units; and,
WHEREAS, the County plan ignores the fact that certain watershed units,
specifically the Middle St. Croix Valley Water Management Organization, is a functioning
and viable watershed unit of government whose functioning may be impaired as a result of
the County's proposal to remove part of its jurisdiction from the current Middle St. Croix
Valley Water Management Organization; and,
WHEREAS, the Middle St. Croix Valley Water Management Organization
has been established under Chapter 103 of the Minnesota Statutes and has been recognized
by the Board of Water and Soil Resources, completing the filing of first generation plans
with regard to operations; and,
WHEREAS, the Middle St. Croix Valley Water Management Organization
is in the process of implementing certain projects and plans in accordance with its rules and
the regulations previously approved by the Board of Water and Soil Resources; and,
•

WHEREAS, it would appear that the County of Washington is without
• statutory authority pursuant to Minnesota Statute § 103B.231, Subds. 3(a) and (b) to alter the
Middle St. Croix Water Management Organization.
NOW, THEREFORE, BE IT RESOL'V'ED, by the City Council for the
City of Oak Park Heights as follows:
1. That the City Council does hereby oppose any plans by Washington
Cotmty Board of Commissioners or its staff to reorganize or change boundaries as it affects
the Middle St. Croix Valley Water Management Organization.
2. That the City of Oak Park Heights opposes any further action by
Washington County to reorganize the watershed units government, unless and until
compliance with the statutory requisites have been provided for as required by law.
BE IT FURTHER RESOLVED, that the City Council for - the City of Oak
Park Heights does instruct its administrative staff to forward a copy of this Resolution to the
Board of Water and Soil Resources so that entity can be advised as to the opposition of the
City of Oak Park Heights to the organization plans as advocated by Washington County as
it affects these various governmental units of watershed. districts or organizations.

A RESOLUTION PROVIDING FOR THE ISSUANCE
AND SALE OF TAX EXEMPT LOAN PARTICIPATIONS,
(BOUTWELLS LANDING PROJECT), SERIES 2000A, B and C
BE IT RESOLVED by the City Council of the City of Oak Park Heights, Minnesota (the
"City "), as follows:
1. Authoritv. The City is, by the Constitution and laws of the State of Minnesota,
including Minnesota Statutes, Chapter 462C, as amended (the "Act "), authorized to issue and sell
its revenue bonds or other obligations for the purpose of financing or refinancing the cost of
housing developments for the elderly and to enter into agreements necessary or convenient in the
exercise of the powers granted by the Act.
2. Description of Project; Prior Bonds,. On December 30, 1998 the City issued its
$8,000,000 Elderly Housing Revenue Bonds (Boutwells Landing Project), Series 1998A (the
"1998A Bonds ") and its $30,000,000 Elderly Housing Revenue Bonds (Boutwells Landing
Project), Series 1998B (the "1998B Bonds ") and on June 30, 1999 it issued its $8,000,000
Elderly Housing Revenue Bonds (Boutwells Landing Project) Series 1999A (the "Series 1999A
Bonds) pursuant to the Act and loaned the proceeds thereof to Valley Senior Services Alliance, a
Minnesota nonprofit corporation (the WSW'), in order to provide financing or refinancing with
• respect to costs of the acquisition, construction and equipping of an elderly housing development
consisting of approximately 228 rental units located at South of 58 Street and Norell Avenue
including units for independent living, assisted living and cottage living and an approximately
45,000 square foot central building with dining, laundry, offices and common areas (the
"Project "). Title to the Project may be transferred by VSSA into a Minnesota limited liability
company of which VSSA is the sole member (the "Company ").
The Series 1998A Bonds, Series 1998B Bonds and Series 1999A Bonds (the "Prior
Bonds ") are currently outstanding in the principal amount of $28,000,000. The proceeds of the
Series 1998A Bonds were used for land acquisition and site improvements to the Project.
$10,000,000 of the Series 1998B Bonds were refunded and used to build a 92 -unit assisted living
facility and $8,000,000 of the Series 1998B Bonds were refunded by the Series 1999A Bonds
and used to begin construction of the cottage -style independent living facilities. The Company
has proposed that the City issue an additional $2,000,000 of revenue bonds to finance the "Town
Center" portion of the Project which consists of dining, laundry, offices and common areas.
3. Plan of Financing,. In order to refund the Prior Bonds (thereby providing
permanent, fixed -rate financing for the Project) and to finance the Town Center, the Company
has proposed to this Council that the City and the Cities of Bayport ( "Bayport") and Marine on
Saint Croix ( "Marine "), Minnesota, or another City to be named, enter into a joint powers
agreement in the form of the Allocation Agreement (as hereafter defined) under Minnesota
Statutes §471.59, to jointly issue "bank qualified" Tax Exempt Loan Participation Notes
(Boutwells Landing Project) Series 2000A, 2000B and 2000C, each in the principal amount of
• $10,000,000 for a total principal amount of $30,000,000 (the "Notes "). The Notes will be placed

for sale by U.S. Bancorp Piper Jaffray Inc. (the "Placement Agent ") with banking institutions
• (the Lenders ") pursuant to a Placement Agent Agreement among the City, the Placement Agent
and the Company (the "Placement Agent Agreement ") . The City, the Lenders and a banking
institution to be determined (the "Servicer ") will enter into a Servicing and Intercreditor
Agreement dated as of December 1, 2000 (the "Servicing Agreement "). The proceeds of the
Notes will be loaned to the Company pursuant to a Loan Agreement dated as of December 1,
2000 among the City, the Company and the Lenders (the "Loan Agreement "). Repayment of the
Notes will be secured by collateral provided by the Company including the Mortgage (as
hereafter defined). Escrowed proceeds of the 1998B Bonds will be transferred to the Project
Fund created under the Indenture (as hereafter defined) and will be available to be disbursed to
pay current Project costs.
4. Documents Presented. Forms of the following documents related to the Notes
have been submitted to the City:
(a) The Loan Agreement pursuant to which the Company agrees to provide
for the full and prompt payment of the principal of, premium, if any, and interest on the
Notes; and
(b) The Servicing Agreement, authorizing the issuance of the Notes and
pledging certain revenues, including those to be derived from the Loan Agreement, as
security for the Notes, and setting forth proposed recitals, covenants and agreements
relating thereto; and
• (c) The Combination Mortgage, Security Agreement and Fixture Financing
Statement and Assignment of Leases and Rents, dated as of December 1, 2000, from the
Company to the City (the "Mortgage "), by which the Company grants to the City a
mortgage lien on and security interest in certain mortgaged property including the
Project, as described therein, as security for the payment of the Notes and assigns to the
City its interests in all leases and rents with respect to the mortgaged property (not
executed by the City); and
(d) The Assignment of Mortgage dated as of the date of delivery of the Notes,
from the City to the Servicer (the "Assignment "), by which the City assigns its interest in
the Mortgage to the Servicer on behalf of the Lenders; and
(e) Three Guaranty Agreements each dated as of December 1, 2000, from
Presbyterian Homes & Services, Presbyterian Homes Housing and Assisted Living, Inc.
and VSSA to the Servicer on behalf of the Lenders to secure repayment of the Notes and
the Company's obligations under the Loan Agreement (not executed by the City); and
(f) The Disbursing Agreement dated as of December 1, 2000 among the
Company, the Servicer and First American Title Insurance Company, as disbursing agent,
setting forth the conditions to disbursement of amounts held in the Project Fund, as
defined in the Servicing Agreement, in payment of costs of the Project (not executed by
• the City); and

(g) The Placement Agent Agreement, providing for the placement of Notes
• from the City by the Placement Agent and setting forth the terms and conditions of
purchase; and
(h) The Joint Powers and Allocation Agreement dated as of December 1, 2000
among the City, Bayport and Marine (the "Allocation Agreement ") pursuant to which the
Notes shall be designated "qualified tax- exempt obligations" for purposes of Section
265(b) of the Internal Revenue Code of 1986, as amended.
5. Findings. It is hereby found, determined and declared that:
(a) Based on Company representations to City, the Project constitutes an
elderly residential rental project authorized by and described in the Act.
(b) There is no litigation pending or, to the City's actual knowledge,
threatened against the City relating to the Notes, the Loan Agreement, the Placement
Agent Agreement, the Servicing Agreement, the Allocation Agreement or the
Assignment (collectively, the "City Note Documents ") or questioning the due
organization of the City, or the powers or authority of the City to issue the Notes and
undertake the transactions contemplated hereby.
(c) The execution, delivery and performance of the City's obligations under
the City Note Documents do not and will not violate any order of any court or other
• agency of government of which the City is aware or in which the City is a party, or any
indenture, agreement or other instrument to which the City is a party or by which it or
any of its property is bound, or be in conflict with, result in a breach of, or constitute
(with due notice or lapse of time or both) a default under any such indenture, agreement
or other instrument.
(d) It is desirable that the Notes be issued by the City upon the terms set forth
in the Servicing Agreement under the provisions of which the City's interest in the Loan
Agreement will be pledged to the Lenders as security for the payment of principal and
purchase price of, premium, if any, and interest on the Notes.
(e) Under the provisions of the Act, and as provided in the City Note
Documents, the Notes are not to be payable from nor charged upon any funds other than
amounts payable pursuant to the Loan Agreement and moneys in the funds and accounts
held by the Servicer which are pledged to the payment thereof; the City is not subject to
any liability thereon; no owners of the Notes shall ever have the right to compel the
exercise of the taxing power of the City to pay any of the Notes or the interest thereon,
nor to enforce payment thereof against any property of the City; the Notes shall not
constitute a general or moral obligation of the City or a charge, lien or encumbrance,
legal or equitable, upon any property of the City (other than the interest of the City in the
loan repayments to be made by the Company under the Loan Agreement); and each Note
issued shall recite that such Note, including interest thereon, shall not constitute or give
rise to a charge against the general credit or taxing powers of the City.

6. Annroval and Execution of Documents,. The form of Note and the City Note
Documents are approved. The City Note Documents are authorized to be executed in the name
and on behalf of the City by the Mayor and the City Clerk, at such time, if any, as they may
deem appropriate, or executed or attested by other officers of the City, in substantially the form
on file, but with all such changes therein, not inconsistent with the Act or other law, as may be
approved by the officers executing the same, which approval shall be conclusively evidenced by
the execution thereof; and then shall be delivered to the Servicer on behalf of the Lenders.
Modifications to the forms of Guaranty and Mortgage and other collateral security documents
may be made at the discretion of the parties thereto.
7. Annroval. Execution and Delivery of Notes. The City is authorized to issue the
Notes, in an aggregate principal amount of not to exceed $30,000,000, in the form and upon the
terms set forth in the Servicing Agreement, which terms are for this purpose incorporated in this
resolution and made a part hereof, provided, however, that the interest rates on the Notes shall be
as set forth in the final form of the Servicing Agreement, to be approved, executed and delivered
by the officers of the City authorized to do so by the provisions of this Resolution, which
approval shall be conclusively evidenced by such execution and delivery; and provided further
that, in no event, shall such rates of interest produce a net interest cost in excess of 8% per
annum. The Placement Agent has agreed pursuant to the provisions of the Placement Agent
Agreement and subject to the conditions therein set forth, to place the Notes for sale at par. The
Mayor, City Clerk and other City officers are authorized to execute the Notes as prescribed in the
Servicing Agreement at such time, if any, as they may deem appropriate, and to deliver them to
the Servicer, together with a certified copy of this Resolution and the other documents required
• by the Servicing Agreement, for authentication, registration and delivery to the Placement Agent.
8. Certificates. etc. The Mayor, City Clerk and other officers of the City are
authorized at such time, if any, as they may deem appropriate, to prepare and furnish to bond
counsel and the purchaser of the Notes, when issued, certified copies of all proceedings and
records of the City relating to the Notes, and such other affidavits and certificates as may be
required to show the facts appearing from the books and records in the officers custody and
control or as otherwise known to them; and all such certified copies, certificates and affidavits,
including any heretofore furnished, shall constitute representations of the City as to the truth of
all statements contained therein.

RESOLUTION ESTABLISHING CONNECTION FEES THROUGHOUT THE CITY
OF OAK PARK HEIGHTS FOR CONNECTIONS TO MUNICIPAL WATER
SYSTEMS, SANITARY SEWER SYSTEMS AND STORM SEWER SYSTEMS
WHEREAS, Minn. Stat. §444.075, Subd. 3 authorizes municipalities to
establish a system of charges for the construction, reconstruction, repair, enlargement,
improvement or other obtainment, maintenance operation and use of municipal facilities,
including, but not limited to charges for connections to such municipal facilities for municipal
water, sanitary sewer, and storm sewer; and,
WHEREAS, City ordinances provide for the Council to establish from time
to time connection charges to be collected for properties developing in and connecting to the
municipal water, sanitary sewer and storm sewer systems; and,
• WHEREAS, the City has historically established and collected connection
charges; and,
WHEREAS, connection charges established by the City of Oak Park Heights
require modification and amendment from time to time; and,
WHEREAS, the office of the City Engineer has provided recommendations
to the City Council as it affects the establishment of connection charges throughout the City
of Oak Park heights as it relates to connection to trunk sanitary sewer systems, trunk water
systems and trunk storm sewer systems; and,
WHEREAS, the City Council determines it to be in the best interest of the
residents and City of Oak Park Heights that such fees be periodically renewed and adjusted to
take into account cost of construction and replacement and systems, cost of maintenance
operation and other expenses that the City expects to incur with regard to the maintenance of
such systems.
NOW, THEREFORE, BE IT RESOLVED, by the City Council for the City
of Oak Park Heights that effective January 1, 2001 city connection charges to be applied
throughout the City of Oak Park Heights for properties developing or connecting to municipal
utilities shall be as follows:
•
1. Sanitary sewer connection charge, $2,600.00 per acre.
2. Municipal water connection charge, $4,520.00 per acre.
3. Storm sewer connection charge, $5,730.00 per acre.
BE IT FURTHER RESOLVED, that as to the computation of acreage as it
affects each development or connection related to the collection of these fees, all such
computations shall be made through the office of the City Engineer with all such fees
being thereafter collected through the office of the City Administrator. No connection
shall be made to any municipal utility system until such time as the connection fees as
calculated and determined by the office of the City Engineer have been collected.

EASEMENT FOR A COMMUNICATIONS TOWER LOCATED ON OUTLOT B
THE BRACKEY ADDITION FROM MR. BRACKEY
WHEREAS, the City of Oak Park Heights selected a request for proposal
from Magnum Business Systems for further negotiation, subject to land acquisition would
be necessary for a communications tower.
WHEREAS, Mr. and Mrs. Robert Brackey have presented to the City a gift
of a permanent easement for a communications tower on land located in Outlot B the
Brackey Addition.
WHEREAS, State Statutes §465.03 (Gifts to Municipalities) requires that a
• City may accept a grant or devise of real or personal property, which would benefit the
citizens. Every such acceptance shall be by resolution of the governing body adopted by a
two- thirds majority of its members, expressing such terms in full.
NOW, THEREFORE, BE IT RESOLVED, by the City Council for the
City of Oak Park Heights recognizes the public need for a communications tower and does
hereby accept the gift of a permanent easement for a communications tower on land located
in Outlot B the Brackey Addition.

• 1. That the City Administrator is hereby authorized and
directed to certify to the Washington County Tax Accounting
Department the General Fund levy for the City of Oak Park
Heights for calendar year 2001 in the amount of $1,529,035.00.
2. That the City Administrator is also authorized and
directed to certify to the County Tax Accounting Department
the Bonded Indebtedness levy for 1995 General Obligation Bonds
in the amount of $59,400.00 to be collected in calendar year
2001.

A RESOLUTION ESTABLISHING SEWER USAGE RATES
WITHIN THE CITY OF OAK PARK HEIGHTS
EFFECTIVE JANUARY 1, 2001
WHEREAS, the City of Oak Park Heights by resolution and
ordinance regulates sewer usage rates within the City for
all users; and,
WHEREAS, a rate study has been conducted and completed
by Springsted Incorporated recommending sewer rate increases
to accommodate the cost for administrating, managing, and
providing municipal sewer services to the citizens of the
City of Oak Park Heights and all properties connected
thereto; and,
WHEREAS, the City Council has reviewed said rate
increases and determined the same to be fair and equitable.
• WHEREAS, the city ordinances provide for the
implementation of rate increases by resolution.
NOW, THEREFORE, BE IT RESOLVED, by the City Council for
the City of Oak Park Heights as follows:
That effective January 1, 2001, the City of Oak
Park Heights shall establish a municipal sewer
rate for all users as follows:
a. A monthly rate of $.90 for administrative
fees, and $2.46 per 1,000 gallons of water used
for the first 5,000 gallons, with a per month
minimum charge of $13.20.
b. A rate of $2.46 per 1,000 gallons of water
used over 5,000 gallons.
C. Residential sewer rates are determined by the
amount of water used in the month of December of
each year. Commercial, industrial and
institutional sewer rates are based on actual
usage.

A RESOLUTION RECOGNIZING THE CONTRIBUTIONS
OF JERRY TURNQUIST AS CITY COUNCILMEMBER OF
THE CITY OF OAK PARK HEIGHTS FROM 1996 THROUGH 2000
WHEREAS, Jerry Turnquist has served as a Councilmember for the City
of Oak Park Heights from 1996 through 2000; and,
WHEREAS, he has been an active representative as Councilmember for
the City of Oak Park. Heights over the four years of elected service ; and,
WHEREAS, prior to being elected as Councilmember and concurrently
with his term, he served on the Cable Commission.
NOW THEREFORE, BE IT RESOLVED, that the City Council for
• the City of Oak Park Heights commends Jerry Turnquist for his four years of
public service as Councilmember and thanks him for his dedication and
commitment to the interests of the citizens of the City of Oak Park Heights.

A RESOLUTION AUTHORIZING THE BUDGET
TRANSFER OF TAX INCREMENT
FINANCING FUNDS TO THE GENERAL FUND
WHEREAS, the City of Oak Park Heights has previously
established a tax increment financing district; and,
WHEREAS, said tax increment financing district
generates funds for administration fees to be paid to the
City of Oak Park Heights; and,
WHEREAS, the City has incurred administrative fees
based upon work performed in relationship to said tax
increment financing matters for calendar year 2000 in the
amount of $; and,
WHEREAS, the City of Oak Park Heights contemplates
additional administrative fees as they continue to review the
• established tax increment financing district and improvements
to be rendered to the St. Croix Mall area which will require
additional staff time and work; and,
WHEREAS, the City also anticipates additional audit and
accounting expenses as it affects the tax increment financing
district.
NOW, THEREFORE, BE IT RESOLVED, by the City Council for
the City of Oak Park Heights that there shall be transferred
from the St. Croix Mall tax increment financing fund to the
general fund the sum of $3,450.00.

RESOLUTION CHANGING THE CITY'S
MILEAGE REIMBURSEMENT POLICY
WHEREAS, the City mileage reimbursement policy was to $0.32.5 per mile in
2000; and,
WHEREAS, Treasury regulations require that mileage reimbursement over
$0.34.5 per mile is to be treated as taxable wages.
NOW, THEREFORE, BE IT RESOLVED, by the City Council for the City of
Oak Park Heights, Washington County, Minnesota as follows:
That the City's mileage reimbursement policy shall be increased to $0.34.5 per
mile as of January 1, 2001 in accordance with Federal Treasury requirements.
