This amendment would make allowances to the site plan to expand the width of the drive through lane from 12 feet to 10 feet. The original approvals for this site were granted in March of 2002. Attached for Reference: Exhibit A: Exhibit B: Exhibit C: Exhibit D: ISSUE ANALYSIS Original Site Plan Original Landscape Plan Revised site Plan Revised Landscape Plan The applicant made several minor changes to the site along with the widening of the drive through lane. These changes are outlined below. 1. Drive Through. The applicant has revised the site plan to illustrate a 15 -foot drive through lane along the east side of the property. 2. Sidewalks. The revised site plan contains two sidewalk changes. First, the sidewalk along Osgood Avenue North has been relocated onto the property. The applicant will grant an easement to the city for this sidewalk. Second, the sidewalk along the west side of the building has been narrowed from 5- feet to 3-feet. Staff recommends that the applicant revise the site plan to widen this sidewalk to 4 -feet and narrow the adjacent drive lane to 24 -feet. 3. Parking. The lengths of the parking stalls along the west side of the site were shortened from 26 -feet to 18-feet. The adjacent curb will allow for a two foot overhang. It is important to note that there were no changes to the number of overall parking stalls. 4. Landscaping. There were two notable changes to the landscape plan. First, the applicant added landscaping to the island in the southern parking lot. Second, landscaping was added to increase screening along the northeast corner and eastern perimeter of the site. These changes are subject to the review and approval of the city Arborist. 5. Transformer. The applicant relocated the transformer from the southeast corner of the building to the northern property boundary. 6. Trash Storage. The applicant has redesigned the trash and storage area along the north side of the building so that only the recycling enclosure remains on the exterior of the building. Trash will be stored inside the principal building. 7. The applicant has also requested a change to condition 11 of the original conditional permit approvals. The original condition reads, "A deed restriction must be put in place stating that a change in use of the property requires City review and approval and the use must comply with the City parking standards in place at the time the use changes." The applicant's proposed language, that is acceptable to the city Attorney, is as follows, "This conditional Use Permit requires that any change in the use of the property must comply with the city ordinances and parking standards in place at the time the use changes." CONCLUSSION AND RECOMMENDATION Overall, staff finds that the proposed changes improves the overall design of the site and recommends approval of an amendment to the site plan and conditional use permit. This recommendation is based on the findings made in this report and is subject to the conditions listed below. 1. The applicant shall redesign the site plan to illustrate a 24 -foot wide drive lane and a 4 -foot wide sidewalk along the west side of the building. 2. The applicant shall grant the city a public access easement for the sidewalk adjacent to Osgood Avenue subject to review and approval by the city Attorney. 3. This amended approval is subject to all the original conditions of approval outlined in the original conditional use permit dated May 31, 2002. 4. Condition number 11 of the original resolution shall be amended to read as follows, "This Conditional Use Permit requires. that any change in the use of the property must comply with the City ordinances and parking standards in place at the time the use changes." 5.
