HomeMy WebLinkAbout2002-07-11 PC Recommending ResolutionA RECOMMENDING RESOLUTION OF THE PLANNING COMMISSION CITY OF OAK PARK HEIGHTS WASHINGTON COUNTY, MINNESOTA A RESOLUTION ESTABLISHING FINDINGS OF FACT AND RECOMMENDING TO THE CITY COUNCIL THAT THE REQUEST BY WALGREENS FOR AN AMENDMENT TO THE CONDITIONAL USE PERMIT AND SITE PLAN FOR THE PROPERTY LOCATED AT 6061 OSGOOD AVENUE NORTH SHOULD BE APPROVED WITH CONDITIOlvS WHEREAS, the City of oak Park Heights has received a request from Semper Development representing walgreens for an Amended Conditional Use Permit to allow a change . g 9 in the site plan to expand the width of. the drive- through lane; and after having conducted a public hearing relative thereto, the Planning Commission of Oak Park Heights makes the following findings of fact: 1. The real property affected by said application is legally described as follows, to wit: and SEE ATTACHMENT A 2. The applicant has submitted an application and supporting documentation to the Community Development Department consisting of the followin g items: and SEE ATTACHMENT B 3. The subject property is zoned Bm2, General Business District in which retail sales operations are a permitted use; and 4. The request is to change the width of the drive - through lane, make changes to the landscape plan, and revise the sidewalks and parking layout of the approved site plan; and 5. The City staff prepared a memorandum dated June 27, 2002 reviewing the request; and 6. The memorandum dated June 27, 2002 recommended the request be approved with conditions; and 7. The Plannin Commission held a public hearin at their Jul 11, 2002 meetin took comments from the applicants and public, closed the public hearin and made the followin recommendation: NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION FOR THE CITY OF OAK PARK HEIGHTS THAT THE PLANNING COMMISSION RECOMMENDS THE FOLLOWING: A. The application submitted b Semper Development for a Wal at 6061 Os Avenue North for a CUP amendment to allow an expansion in width of the drive-throu lane from 12 feet to 16 feet and to revise the approved site plan to address chan in the sidewalks, parkin and landscapin and affectin real propert as follows: SEE ATTACHMENT A Be and the same as hereb recommended to the Cit Council of the Cit of Oak Park Hei for approval subject to the followin conditions: 1. The applicant shall redesi the site plan to illustrate a 24-foot wide drive lane and a 4-foot wide sidewalk alon the west side of the buildin 2. The applicant shall g rant the Cit a public access easement for the sidewalk adjacent to Os Avenue subject to review and approval b the Cit Attorne 3. This amended approval is subject to all the ori conditions of approval (except condition 16 relatin to project approval) outlined in the ori conditional use permit dated Ma 3 1, 2002. 4. Condition number 11 of the ori resolution shall be amended to read as follows, "This Conditional Use Permit re q uires that an chan in the use of the propert must compl with the Cit Ordinances and parkin standards in place at the time the use chan 5. The revised landscapin plan is subject to the review and approval of the Cit Arborist. 6. Project approval will become null and void after 18 months unless the propert owner or applicant has substantiall started construction.
