Page 21 of 120 CITY OF OAK PARK HEIGHTS TUESDAY, MARCH 14,2017 Present: Mayor McComber, Councilmembers Dougherty, Li1jegren, Runk, and Swenson; City Administrator Johnson; City Attorney Vierling; and City Clerk Pinski. Also present: Kent Skaar, Statewide Senior Project Manager for Public Water Access at MN DNR, and Brandon Heim, Acquisition Specialist at MN DNR. Absent: None. 1. Call to Order: Mayor McComber called the meeting to order at 5:30 p,rn. 2. Meeting with DNR Representatives — Boat Launch Discussion: Representatives from MN DNR provided a PowerPoint Presentation on Minnesota boating statistics, public water access, a summary on the process with MNDOT, and a proposed site plan concept. Kent Skaar frorn MN DNR reported that funding for public water access came from two sources: the state water recreation account and the state game and fish account. Mayor McComber asked if there would be trash receptacles at the boat launch. Skaar responded that the policy at public water access sites was pack it in/pack it out. He suggested that trash receptacles tend to attract residential trash dumping, but local government units were welcome to place trash receptacles if they so wished. City Attorney Vierling questioned if they boat launch site would be open year-round. Skaar responded that DNR public water access sites do not close, but the DNR did not maintain the sites during the winter months. Councilmember Swenson thought the location that was selected was the best spot for the launch due to minimal current in the water there. Skaar reported that the DNR would come back to the City Council when they had the final design, and they would give the City Council updates when construction was taking place. 3. MMM -194 Page 23 of 120 CITY OF OAK PARK HEIGHTS TUESDAY, MARCH 14, 2017 CITY COUNCIL MEETING MINUTES L Call to Order/Pledte of Allegiance/Approval of Agenda: Mayor McComber called the meeting to order at 6:11 p.m. Present: Councilmembers Dougherty, Liljegren, Runk, and Swenson. Staff present: City Administrator Johnson and City Attorney Vierling. Absent: City Engineer Mann and City Planner Richards. Councilmember Runk, seconded by Councilmember Liljegren, moved to approve the Agenda. Carried 5-0. IL Summary of Closed Worksession on February 28, 2017 City Attorney Vierling reported that the City Council held a closed session relative to offers to purchase City land identified as PID 06-029-20-12-0020. He stated the City Council received updated information from the City Administrator and gave direction on communications, and no motions were made. III. Council/Staff Reports: A. Mayor McComber: She reported she, Councilmember Dougherty, and City Administrator Johnson met with Representative Lohmer and Senator Housley the previous week; she attended the Boomsite to Bayport meeting with City Administrator Johnson; she met with a group to discuss planning of the St. Croix River Crossing opening ceremonies; she was asked to testify before the House Transportation Committee; she provided the City Administrator with an invitation to the Prayer Breakfast at The Grand; LMC Conference registration was open; and there was a Chamber mixer scheduled for Thursday, March 16. B. Councilmember Dougherty: He reported that the next Planning Commission meeting was set for March 16 at 7:00 p.m. and he was unable to attend. Councilmember Liljegren stated he could not attend either. Councilmember Runk reported he would attend. C. Councilmember Liljegren: No report. D. Councilmember Runk: He reported that he attended the CVB meeting the following week. E. Councilmember Swenson: He reported that the Cable Commission's next meeting was set for Monday. He stated that the Lower Valley did not renew its contract with Valley Access, so that meant those residents would not be able to watch the cable access channel. F. Staff: No report. Page 33 of 120 RESOLUTION #_ A RESOLUTION SUPPORTING LOCAL DECISION-MAKING AUTHORITY WHEREAS, local elected decision -makers are in the best position to determine what health, safety and welfare regulations best serve their constituents; and WHEREAS, just like state legislative leaders, local elected officials are held accountable through Minnesota's robust elections process; and WHEREAS, ordinances at the local level are enacted only after a comprehensive, legal and open process; and WHEREAS, local units of government are required to publish notices about meetings where, policies will be discussed and decisions will be made; and WHEREAS, under the state's Open Meeting Law, public policy discussions and decisions must occur in meetings that are accessible to members of the public; and WHEREAS, cities are often laboratories for determining public policy approaches to the challenges that face residents and businesses; and WHEREAS, preservation of local control in Minnesota has yielded statewide benefits such as the 2007 Freedom to Breathe Act, an amendment to the Minnesota Clean Indoor Air Act; and WHEREAS, more than two dozen bills that restrict local decision-making have been introduced in 2017 to date. AJOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF OAK PARK HEIGHTS that this Council supports local decision-making authority and opposes legislation that removes the ability for local elected officials to respond to the needs of their businesses and constituents. As representatives of cities across tile state, we are v n°y concerned about this trend and the effects of bills that could significanthy 1hinder local officials from effectively acting to serve their local communities, as they are expressly elected to do. Bills would directly and indirecthy .hinderlova decision making across abroad range of policy and funding areas. Examples in legislation that would constrain local law enforcement authority, restrict a city's ability to set local ordinances, allow certain businesses unfettered access -to publicrights of way and eliminate a city's ability to manage them, restrict a city"s ability to use certain fee structures,reduce local government aid (LGA) based onfactors with no relation to the statutory LGA formula, and restrict a city's ability to consider a light rail project, Some bills would move aspects of local decision making authority to the Legislature. Other bills would require metro local officials to run the regional goverrinient, subjecting them to significant risks for conflicts for interest that could interfere with their ability to effectively represe.nt the. community in -which they are elected. Others would usurp local representative democracy by requiringreverse referendums for local levies and funding mechanisms provided under state law, it city officials recognize that policies for local decisiori -making authority can change over time, we are -very concerned about the e strong trend in dais area, and the effects these bills would have in hampering local officials from perrov.Tninn g their responsibilities and being able -to appropriately act to address local needs., Such bills would seem to presurne,however -unintentionally, -that, there is a one -size -fits. -all law that fits every community, or in other cases 'that the Legislature itself is in a better position to decide issues that are clearly local in nature.
