Our client has confirmed that the substantive provisions are acceptable, and we onl have a few questions/comments: 1. We are doin an escrow closin with Mr. and Mrs. Bradshaw ( the current owners later this month, pursuant to which the will deposit in escrow the deed and related closin documents, to be released in Au The escrow acknowled that the CUP will be filed now ( in Ma Should we list Net Lease or the Bradshaws as the owner? We would prefer to list Net Lease, because Net Lease is the ultimate developer, but want to be able to record the document in Ma before the deed is filed. 2. There are two blanks below Net Lease's address; if those are intended to be completed with fax and phone numbers, those numbers are 612/313-2500 (phone and 6121313-0136 ( fax ) . 3. Item 11 calls for deed restrictions. Since the Bradshaws are not part to the development and the Cit is not conve title, but we will record the CUP, could we please replace the statement with the actual restrictions the Cit is lookin for? Perhaps state: "An use of the propert other than as a retail facilit and/or pharmac shall re approval of the cit and such use must compl with the Cit parkin standards in place at the time the use chan 4. 1 have attached the le description, Exhibit A, for y our use. It is the same le description as was appended to the deed y ou previousl approved with the exception that I corrected a t ("it intersection" in the third to last line of the first para was chan to "its intersection").
