the Plans satisfy the requirements of Sections II(6), II(7), 11(9), II (10), , II 13 and

3. A: free - standing pylon sign with an electronic readerboard may be installed on the
Property, provided the readerboard complies with the requirements of the CUP
that the readerboard does not have flashing or intermittent lights or animation, that
the text is in white light and that the message is not changed more than once every
six hours. The building . signage and logos, for the Walgreen building, , as shown on
the Plans, appear to comply with the sign ordinances of the City,' as built

1. CONDITIONAL USE PERMIT FOR:
All uses shall be subject to the following conditions and/or restrictions imposed by the City Council of the
City of Oak Park Heights.
Conditional Use Permits have been granted to allow the parking space reductions, curb cuts and
driveway widths as proposed by the applicant associated with the construction of a Walgreen's Pharmacy Store
at the site identified. Site plans are attached hereto as Exhibit B and are incorporated by reference herein.
II. ADDITIONAL RESTRICTIONS AND PROVISIONS.
The following additional restrictions and provisions being part of the Conditional Use Permit to be issued
herein affecting the following natters shall be:
1. A conditional use permit to allow the northerly access onto Osgood Avenue North at 36 feet in width is
approved.
? . Access permits from Washington County are required for Osgood Avenue.
3. Access onto 60 Street is subject to the conditions imposed by MNDOT including the applicant closing
60 Street west of the access to their property as shown on the submitted plans.
4. The applicant must convey to the City a trail easement along Osgood Avenue and install a concrete
sidewalk or bituminous trail. The applicant shall work with Washington County because part of the
sidewalk may need to be within the County right-of-way.
5. The project is subject to review and approval by the Middle St. Croix Watershed Management
Organization.
6. Grading, drainage, and utility plans are subject to the approval of the City Engineer.
7. The proposed retaining wall must be designed by an engineer and is subject to review and approval of
the City Engineer.
8. The landscaping at the base of the retaining wall must be maintained by Walgreens even though it is at a
lower elevation than the rest of the property.
9. The landscape plan must include the following revisions: a slight adjustment of landscaping along the
west property line if necessary to allow space for a sidewalk, planters at the building entrance, and
landscaping on the north property line. The applicant is responsible for all proposed landscaping. The
landscape plan is subject to City Arborist review and approval.
10. The submitted tree replacement plan is subject to City Arborist review and approval.
11. This Conditional Use Permit requires that any change in use of the property requires review and
approval of the use by The City of Oak Park Heights and the proposed use must comply with the City
Ordinances and parking standards in place at the time the use changes.
12. Snow must either be stored within the green space of the site or be removed from the property.
Pilasters must be added to the north and east sides of the building.
14. The lighting plan must be revised to comply with the City's foot - candle requirements. The maximum
height of the light fixtures is 25 feet. The style of the light fixtures must be bronze, shoebox, full -cut-
off, and 90 degree angle. The proposed fixtures are not acceptable.
15. The electronic reader board is not allowed to have flashing or intermittent lights or animation, the text
shall be in a white light, and the message must not change more often than every six hours.
16. Project approval will become null and void after 18 months unless the ro ert owner or applicant has

17. The building is not allowed neon lighting surrounding the corporate symbol in the atrium of the building.

We have reviewed the latest revised final development plans and drainage calculations for the
at the northeast corner of Osgood Avenue and 60 Street N. r
proposed Walgreens development �
Our office last reviewed p lans for this development on February 13, 2002. The following
comments andior recommendations pertain to the latest revised plans and drainage calculations
(previous comments still applicable, or meant to serve as a reminder, are shown in italics):
Site Layout/Access Locations:,
1. Washington County and MnfDOT have previously approved the right -in only access, as long
as the frontage road will be closed. Pursuant to this, MniDOT will require an Access Permit
and a p ernzit to allow work within Mn/DOT right-of-way for the proposed closing f and
drivewa y access into the frontage road. The developer should supply copies of all permit
applications and approvals to the City.
2. Mn/DOT has also previously indicated that since Osgood Avenue is Washington County
State Aid Highway 24, any work on Osgood Avenue must meet State Aid Standards and

Specifications. This will include the proposed driveway accesses, curb and gutter
installation for closing or closin off the frontage road, storn'r sewer structure modifications, and traffic
control.
3. Proposed landscaping in the green area adjacent to Osgood Avenue right-of-way falls within
p p g
existing utility and sanitary sewer easements. Verbiage should be included in the
developer's agreement so that the developer will he responsible for restoring surface
improvements should any repair /modifications be required to the existing utilities
encompasses by those easements.
4. It appears the proposed sidewalk location adjacent to Osgood Avenue (5' wide, 2' back of

existin g . curb) will result in the need to relocate several power poles, street signs and one.
hydrant. This should be shown or noted on the plans.

Grading:
5. A retainin g up wall u to 13' in height is proposed along the majority of the east side of the site.
A design for this wall, stamped by a registered engineer in the state of Minnesota, will need
to be submitted f or our review and approval prior to construction (Landform notes this in
their September 5, 2001 memorandum).
Sanitary Sewer:
6. The p lans do indicate to "Coordinate the abandonment of all existing utilities and services
with the Ci ty o f Oak Park Heights "; but we recommend the locations of any existing utilities
be shown on the plans so the City has a record of this data.
Water Main:,
7. Verify existing hydrant locations (needfor any new hydrants) and emergency vehicle access
locations /widths with the Fire Department.
Storm Sewer:
8. The revised drainage area map & calculations are acceptable as submitted. The tributary area
was revised/expanded to more accurately reflect the actual existing area tributary to the
existin g storm sewer structures on Osgood Avenue. Proposed storm sewer through the
Walgreens parking area has been upsized from 18" to 21" pipe to account for this increase in

tributary storm water runoff.

THIS INDENTURE, made this day of , 2002, by and
between NET LEASE DEVELOPMENT LLC, a Limited Liability Company under the laws of
the State of Delaware, party of the first part; and the CITY OF OAK PARK HEIGHTS,
Washington County, Minnesota, party of the second part.
WITNESSETH:
WHEREAS, the above - named party of the first part is the owner in fee simple of
the real estate hereinafter described, a description for which is annexed to this document as
Exhibit A.
That for and in consideration of the sum of One and 00/100 Dollars ($1.00) and
other good and valuable consideration, the receipt of which is hereby acknowledged, the party of
the first part has this day bargained and sold, and by these presents does bargain, sell and transfer
unto the City of Oak Park Heights, its successors and assigns the following:
A perpetual easement for public walkway, bike path, and pedestrian crossing
